Applying for US Jobs From Abroad After OPT Ends: The H-1B Lottery, Consular Processing and Interviews
Going home when OPT ends does not take you out of the H-1B lottery, but it changes how your employer files, what the $100,000 fee question means for you and how you interview.

Part of our guide to H-1B visa stamping.
Yes, you can apply for an H-1B from outside the US. A US employer, not you, submits the lottery registration, and it needs your passport details, not a US address or status. If you are selected, the employer files Form I-129 requesting consular notification, and you interview at a US consulate. Going home after OPT ends changes three things: there is no cap-gap bridge, your start date waits for a visa, and you sit squarely in the group the $100,000 payment would reach if collection ever resumed.
Status as of November 1, 2026:
- FY2028 H-1B registration: not announced. USCIS must give at least 30 days' notice; March 2027 is an expectation, not a date.
- Wage-weighted selection: in effect since 2026-02-27.
- $100,000 payment under Proclamation 11069: in effect on paper, blocked in practice. It is not being collected, and appeals are pending.
- In-person visa interviews for H-1B applicants: in effect since 2025-10-01.
- F-1 60-day grace period after OPT: still applies, because the Duration of Status rule has been blocked by a federal court since 2026-09-14 (summary judgment briefed; DHS's appeal pending).
Can you apply for an H-1B from outside the US?
Yes. The H-1B is employer-sponsored, so a US employer can register you for the cap lottery while you live abroad, using your passport details. If you are selected, it files Form I-129 for consular notification. You then attend an in-person visa interview in your country of nationality or residence, and enter once the visa is issued.
The USCIS registration page (updated 09/21/2026) says each registration "must provide the beneficiary's valid passport or travel document information." Nothing in that step asks where you live. So the H-1B lottery from India or anywhere else works the same as from Boston: the employer registers, USCIS selects, the employer petitions.
If you are still in the US and weighing the two filing routes, see our comparison of H-1B consular processing and change of status; this guide is the plan once you have left.
Inside the US vs abroad: what changes (as of 2026-11)
| Step | Still in the US on OPT or STEM OPT | Back home after OPT ends |
|---|---|---|
| Lottery registration | Employer registers you | Same; your passport details are what matter |
| Petition request | Usually change of status (I-797A approval) | Consular notification (I-797B approval) |
| Bridge from OPT end to H-1B start | Cap-gap, for a timely cap-subject change-of-status petition (at most to April 1 of the fiscal year requested) | None; you wait abroad |
| $100,000 payment if collection resumed | Not reached when the change of status is granted | Reached (consular-notification petition) |
| Visa interview | Not needed to start work | Required, in person, before you can enter |
| When H-1B status starts | On the petition start date | When CBP admits you |
Sources: USCIS cap-gap page; USCIS H-1B page. If you may qualify for STEM OPT, staying could keep cap-gap open; ask your DSO before your OPT end date, because a STEM OPT I-765 filed after the OPT EAD expires gets no 180-day extension.
The 12-month plan: a worked timeline from OPT end to H-1B start
Here is one example calendar. Assume your post-completion OPT ends on 2026-11-30, you have no STEM OPT, you fly home in January, and USCIS runs FY2028 like FY2027 (the weak link: nothing is announced).
| Window | What happens | Who acts | Status as of 2026-11-01 |
|---|---|---|---|
| By 2026-11-30 | OPT ends; last day you may work on it | You, with your DSO | In effect |
| 2026-12-01 to 2027-01-29 | F-1 60-day grace period; no work; prepare to depart | You | In effect (D/S rule blocked) |
| Dec 2026 to Feb 2027 | Keep interviewing; get an offer or a written commitment to register | You and the employer | Your search |
| About Feb 2027 | Attorney sets the occupation code, worksite and wage level; collects passport details | Employer | Weighted selection in effect |
| March 2027 (expected) | Registration window; FY2027's fee was $215 per registration | Employer | Not announced; 30 days' notice required |
| From April 1, 2027 (if the pattern holds) | Certified LCA from DOL, then I-129 with consular notification | Employer | FY2027's earliest filing date was April 1 |
| Spring to autumn 2027 | I-797B approval, DS-160, visa appointment, interview | You | In-person interviews in effect |
| From 2027-09-21 | Earliest admission for an October 1 start | You, at the port of entry | 8 CFR 214.1(l)(1) |
| 2027-10-01 | FY2028 H-1B employment can begin | You and the employer | First day of FY2028 |
The gap most people miss (our arithmetic). On USCIS's processing-times tool, read 2026-11-01, 80% of H-1B consular-notification petitions were completed within 11 months. On that snapshot, a regular-processing petition filed in early April 2027 might not be decided until early 2028, months past October 1. Premium processing on Form I-907 costs $2,965 (fee schedule G-1055, edition 10/26/26), and USCIS commits to "take adjudicative action" within 15 business days (premium processing page). That action can be a request for evidence, which restarts the clock. A draft rule titled "Amending the Premium Processing Timeframe" (RIN 1615-AD25) has been under OIRA review since 2026-10-13 with no public text, so check the live pages when your employer files.
Step by step, once you have an offer
- Confirm the occupation code, worksite and OEWS wage level with the employer's immigration attorney.
- Send your exact passport details for the registration; if your passport is close to expiring, ask the attorney whether to renew it first.
- Ask the employer to register you through its USCIS online organizational account in the announced window.
- Check that the attorney gets the Labor Condition Application (Form ETA-9035) certified by DOL through FLAG before the I-129 goes in.
- Discuss with the employer whether to add Form I-907 premium processing to the consular-notification I-129.
- Complete the DS-160 and book your appointment through the State Department's scheduling system, in your country of nationality or residence.
- Attend the in-person interview with your I-797B, passport, degree records and employment documents.
- Enter through a US port of entry no earlier than 10 days before the start date, then check your I-94 on CBP's site.
Under the weighted-selection final rule (in effect since 2026-02-27), a Level IV registration enters the pool four times, Level III three, Level II two and Level I once. The level is the highest OEWS level your offered wage meets for the occupation and area of intended employment, so the same salary can score differently by worksite; our FY2028 registration explainer has the details.
How do you land US jobs from abroad with visa sponsorship?
You need an employer willing to make three bets: on a lottery, on a start date many months away, and on a consular stage it does not control. Your job is to make those bets look small.
Will US employers interview candidates who are abroad?
Many will, because early rounds usually run over video wherever you sit. The friction from abroad is time-zone overlap, the work-authorization screening question, and the start date.
Fix the overlap with set US-hours windows; our guide to networking across time zones from home-country evenings has a weekly system for it. A US trip for interviews needs its own visitor visa or travel authorization, so ask an attorney before you book.
How to answer "Will you require sponsorship?" from abroad
Answer accurately: you are not currently authorized to work in the US and would need H-1B sponsorship. Then turn it into a plan: "I'd need you to register me in the FY2028 lottery, expected in March 2027. If I'm selected, the earliest start is October 1, 2027." Expect the question even when a posting is silent: according to one vendor's read of 2,718 US engineering roles at 136 companies (Match.dev, 2026-10-13), 88.1% said nothing about sponsorship, yet 90.7% of the application forms asked about it. That is a single-vendor snapshot, not a census.
Where offers from abroad usually come from
- Your OPT employer or former managers. They already know your work. Ask before you leave.
- Referrals and alumni. Warm introductions get past the authorization filter that screens out cold applications.
- Employers that have filed consular petitions before. Ask who their immigration counsel is.
- Routes outside the lottery. Cap-exempt employers, such as universities and qualifying affiliated nonprofits, petition year-round. An L-1 needs one continuous year of work abroad for a related company within the prior three years, so a job at a US employer's office in your home country can lead there. Proclamation 11069 covers only the H-1B, not L-1, O-1, E-3, H-1B1 or TN. Which fits you is a question for an immigration attorney.
Working for a US company's foreign affiliate or employer of record while you wait falls under your home country's employment and tax rules, so talk to a tax professional.
Does the $100,000 H-1B fee apply if you are outside the US?
Not right now, but you are the person it was written for. As of November 1, 2026, Proclamation 11069 is in effect on paper and the fee is blocked in practice: it is not being collected. Courts vacated the agency policies that implemented it; they did not strike down the proclamation, which runs to 2027-09-21.
The scope is why it matters most to you. USCIS's H-1B page (dated 2026-09-21) says the payment reaches petitions "on behalf of beneficiaries who are outside the United States and do not have a valid H-1B visa." Changes of status, amendments and extensions granted inside the US were never covered. The USCIS I-129 page (updated 10/30/2026) adds: "If this order is later lifted, DHS still plans to collect the payment."
| Case | Court | Status as of 2026-11-01 | Next date |
|---|---|---|---|
| California v. Mullin | 1st Cir. No. 26-1699 | Blocked (vacated); on appeal | States' brief due 2026-11-04 |
| Global Nurse Force v. Trump | 9th Cir. No. 26-6667 | Blocked (agency policies); on appeal | Government's opening brief due 2026-11-06, answering brief 2026-12-04 (check the docket after 11-06) |
| Chamber of Commerce v. DHS | D.C. Cir. No. 25-5473 | Challenged; fee upheld below | Argued 2026-03-09; no decision found as of late October |

While the fee was live, consular filings dropped: the Congressional Research Service reported on 2026-10-14 that initial H-1B petitions for consular processing from cap-exempt employers fell 91% year over year in the fee's first eight months. A separate $103,265 fee "for all H-1B cap-subject petitions, including those eligible for the advanced degree exemption", is proposed only: comments closed 2026-09-24, and no final rule was at the White House on 2026-11-01.
Raise the fee early, as a known unknown, and let the employer's attorney model it, since any payment would be tied to the employer's petition. Our guide to the $100K fee for consular and change-of-status cases has more background.
How long does H-1B stamping take after selection?
There is no single number, because three queues stack: USCIS's petition decision, the consulate's appointment calendar, and any post-interview hold.
- Petition. The 11-month snapshot above, or USCIS action within 15 business days with premium processing.
- Appointment. Waits differ by post. Use the State Department's Global Visa Wait Times page (marked "Last updated: 21-OCT-2026" in our November 1 research), never a forum screenshot. Mission India has allowed one free reschedule since 2025-01-01, according to a trade-press report.
- Interview. Under State's interview-waiver update, H-1B applicants, renewals included, interview in person from 2025-10-01. Since 2025-09-06 you apply in your country of nationality or residence. From 2026-08-01, routine visa services at 25 African posts moved to 20 regional hubs, per Brown's international office, so some applicants may have to travel to a third country. Our guide to preparing for an H-1B stamping interview covers the questions.
- Holds. H-1B applicants have been subject to State's online-presence review since 2025-12-15. On 221(g), the law firm Mintz wrote on 2026-10-30 that holds "can delay issuance for weeks or months" and that social-media vetting "is adding time."
Your approval notice will be an I-797B, which has no I-94 attached; our explainer on the I-797A vs I-797B approval notice shows what to check on it. If your nationality is on Proclamation 10998's list (39 countries, in effect since 2026-01-01), read State's announcement and talk to an attorney before you leave the US or plan a visa application.
Common mistakes
- Leaving without your paper trail. Take copies of your degree, transcripts, I-20s, EAD cards and employer letters; the petition and interview draw on them.
- Assuming cap-gap follows you home. It covers a change-of-status petition for someone still in the US. Once you have left, it does not apply.
- Overstating your status to clear a screen. Saying you are authorized to work when you are not can follow you into the petition and the interview. Answer accurately and pitch the plan.
- Reading the $100,000 fee as "gone for good" or "back." Both are wrong. It is blocked, not collected, and the government is appealing.
- Quitting a job at home or booking flights before the visa is issued. Petitions, appointments and 221(g) holds can each slip.
- Starting work the day you land early. Under 8 CFR 214.1(l)(1) you can be admitted up to 10 days before the validity period, but "the alien may not work except during the validity period."
Frequently asked questions
Can I be entered in the H-1B lottery while living outside the US?
Yes. The US employer submits the registration, which asks for your valid passport details, not a US address or status. As of November 1, 2026, FY2028 dates are not announced (USCIS must give 30 days' notice), and wage-weighted selection, in effect since February 27, 2026, gives higher-wage registrations more entries.
Will US employers interview candidates who are abroad?
Many will; early rounds usually run over video. The harder parts are time-zone overlap, answering the work-authorization question accurately, and the start date: FY2028 cap employment begins no earlier than October 1, 2027, and only after you get a visa.
What is consular processing for an H-1B?
It is the route from outside the US: the employer files Form I-129 requesting consular notification, USCIS issues an I-797B, and you apply with a DS-160 and an in-person interview in your country of nationality or residence. Status begins when CBP admits you, up to 10 days before the start date.
Does the $100,000 H-1B fee apply if I am outside the US?
Not right now. As of November 1, 2026, Proclamation 11069 is in effect on paper, but its $100,000 payment is blocked in practice and not being collected; courts vacated the agency policies implementing it, and the government is appealing. If collection resumed, it would reach consular-notification petitions for people outside the US, your route, not changes of status granted inside the US.
How long does H-1B stamping take after selection?
Three queues stack. USCIS's tool showed 80% of consular-notification H-1B petitions completed within 11 months (read November 1, 2026); $2,965 premium processing gets USCIS action, possibly a request for evidence, within 15 business days. Consulate waits vary and a 221(g) hold can add weeks or months; check State's live Global Visa Wait Times page.

This is general information, not legal or tax advice. Your own I-20, I-94 and approval notice govern over anything published here: ask your DSO about your F-1 grace period and departure, an immigration attorney about the petition and the fee, and a tax professional about working for a US company from abroad.
Going home after OPT is a change of address, not the end of the plan. If you want help running a focused search for employers that sponsor H-1B, F1Jobs works with international candidates on that search.
Frequently asked questions
Can I be entered in the H-1B lottery while living outside the US?
Yes. The registration is submitted by the US employer, not by you, and it asks for your valid passport details rather than a US address or status. As of November 1, 2026, USCIS has not announced FY2028 registration dates and must give at least 30 days' notice, and wage-weighted selection, in effect since February 27, 2026, gives higher-wage registrations more entries.
Will US employers interview candidates who are abroad?
Many will, because early rounds usually run over video wherever you sit. The harder parts are time-zone overlap, the work-authorization screening question, which you must answer accurately, and the start date, since FY2028 cap employment begins no earlier than October 1, 2027 and you need a visa first. A dated plan shows the employer exactly what sponsoring you involves.
What is consular processing for an H-1B?
It is the route for someone outside the US. The employer files Form I-129 asking USCIS to notify a consulate, USCIS issues an I-797B approval, and you then apply for the visa with a DS-160 and an in-person interview in your country of nationality or residence. H-1B status begins when CBP admits you, which can be up to 10 days before the petition start date.
Does the $100,000 H-1B fee apply if I am outside the US?
Not right now. As of November 1, 2026, Proclamation 11069 is in effect on paper but its $100,000 payment is blocked in practice and is not being collected, because courts vacated the agency policies that implemented it, and the government is appealing. If collection resumed, it would reach consular-notification petitions for people outside the US, which is your route, not changes of status granted inside the US.
How long does H-1B stamping take after selection?
It depends on three queues. USCIS's tool showed 80% of consular-notification H-1B petitions completed within 11 months when read on November 1, 2026; with $2,965 premium processing, USCIS acts within 15 business days, though the action can be a request for evidence. After that, appointment waits vary by consulate and a 221(g) hold can add weeks or months, so check the State Department's live Global Visa Wait Times page.
