EB-2 NIW for Data Scientists Without Publications: Turning Industry Impact Into Dhanasar Evidence
No papers, no citations, no PhD. An NIW can still work for a data scientist, but only if outside evidence shows your work matters beyond your employer's numbers.

Part of our guide to EB-1A and EB-2 NIW.
Short answer: yes. An EB-2 NIW for data scientists can be approved without publications or citations, but it is a harder record to build, not an easier test. The USCIS Policy Manual chapter on national interest waivers (current as of 2026-10-27) lists "a strong citation history" as one example of evidence and says its list "is not meant to be a checklist or to indicate that any one type of evidence is either required or sufficient." What replaces papers is proof from outside your employer that people use, rely on or invite your work.
Status as of 2026-11-01:
- In effect: the Matter of Dhanasar test, applied through the USCIS Policy Manual, Vol. 6, Part F, Ch. 5.
- In effect, challenged: PA-2026-05 (since 2026-08-05) lets USCIS deny without an RFE or NOID when required initial evidence is missing. AAUP v. Mullin (D. Mass., filed 2026-10-05) challenges it; no ruling as of 2026-11-01.
- Latest data: NIW approval rate 42.5% (FY2026 Q1), 48.1% (Q2) and 55.3% (Q3, April to June 2026), all before PA-2026-05.
- Processing (USCIS tool, read 2026-11-01): NIW I-140, 30 months; EB-2 PERM I-140, 3 months.
- PERM: current rules apply. DOL's labor-market-test NPRM (RIN 1205-AC29) cleared OIRA review on 2026-10-23 and has not been published.
EB-2 NIW for data scientists: can you qualify without publications?
Yes. USCIS requires no papers and no set citation count for a national interest waiver. You still need EB-2 eligibility and all three Dhanasar prongs: an endeavor of substantial merit and national importance, proof you are well positioned to advance it, and a net US benefit from waiving the job offer. Without papers, independent evidence that others use your work carries prong two.
Industry work is in scope: the Policy Manual says STEM endeavors can qualify "whether in academic or industry settings." Our walkthrough of the Dhanasar three-prong test covers the standard itself; this post covers rebuilding the evidence papers would supply.
Why the profile is harder without papers
A peer-reviewed paper does three jobs at once: strangers vetted it, citations show others built on it, and it sits in a dated public record. Most industry data science has none of that. It is proprietary, team-credited and measured in your employer's metrics, which USCIS sets aside: "Benefits to a specific employer alone, even an employer with a national footprint, are not sufficiently relevant" to national importance.
So the petition rebuilds each job: outside vetting (independent letters, invitations), outside use (adoption, contracts) and a dated public record (reports, talks, patents). If you have a few papers, our guide to the citation evidence USCIS discounts explains why self-citations and weak venues add little. USCIS reports approval rates by category, not by field or publication count, so 55.3% is not your odds.
Can a data analyst qualify for an NIW?
Yes, if two things are true: EB-2 eligibility and an endeavor larger than reporting for one employer. The USCIS EB-2 page (updated 2025-01-15) accepts a US advanced degree or foreign equivalent, or a bachelor's plus five years of progressive experience in the specialty; exceptional ability needs at least three of the listed criteria. It also confirms NIW applicants "may self-petition."
The endeavor is the harder test. Weekly dashboards for a retailer are an occupation plus an employer. Anomaly-detection methods a state Medicaid program uses to flag billing errors, with the agency describing how it relies on them, start to look like an endeavor with reach.
What evidence replaces papers for prong 2?
The Policy Manual's prong-two factors include education and a record of success, a plan, progress, interest from "potential customers, users, investors," and "Evidence demonstrating how the person's work is being used by others," such as contracts, technology others use, and patents or licenses with proof of significance.
Substitute evidence without publications, as of 2026-11. "Per the Policy Manual" marks its text; the rest is our reading.
| Evidence | Mainly supports | What makes it count | What carries little weight |
|---|---|---|---|
| Deployed model with documented outside impact | Prong 2; prong 1 if the impact is field-wide | A hospital, agency or partner describing in writing what changed after adopting it | Internal dashboards and revenue lift (employer benefit alone, per the Policy Manual) |
| Public-sector or civic data project | Prongs 1 and 2 | A data-sharing agreement, an agency report citing the work, or an agency letter | Hackathon entries nobody adopted |
| Open dataset, package or tool | Prong 2 | Named organizations that depend on it; reports that cite it; your maintainer role | Stars, forks or download counts on their own |
| Invited talks and technical reports | Prong 2 | Invitation letters, program listings, later adoption by other teams | Self-published posts nobody references |
| Independent expert letters | Prongs 2 and 3 | Writers who know the work through its use, name specifics and point to exhibits | Manager and teammate letters alone; generic praise |
| Patents or published applications | Prong 2 | The patent record plus licensing or later use | A patent number with no account of its significance |
| User, customer or investor interest | Prong 2 | Correspondence, pilot agreements, contracts | Marketing material |
| Degrees and certificates | Prong 2 (background) | A clear tie to the endeavor | A degree alone ("not a sufficient basis," per the Policy Manual) |
Letters "may be persuasive when they are from experts in the person's field" and should be "supported by other independent evidence"; letters from interested government agencies, "while not required," can help, which matters for public-sector data work. Our comparison of independent expert letters versus collaborator letters explains how the two kinds work together.
Common misconception: "An NIW needs a stack of papers and a high citation count." Correction: the Policy Manual sets no publication or citation threshold; citations are one example on a non-exhaustive list, and the whole record is weighed.
Proving impact that sits behind an NDA
Get written clearance from your employer before any internal document, metric or client name goes into a federal filing. A number gains weight from outside corroboration: your statement that a model cut readmissions is a claim, while the partner hospital's letter describing what changed is evidence. Keep every figure accurate; under 8 CFR 204.5(e), an approval revoked for willful misrepresentation loses its priority date. For model infrastructure or production ML profiles, see our post on the EB-2 NIW for AI and machine learning engineers.
Prong 1: turning a data science job into an endeavor
Your endeavor is narrower than your occupation and broader than your employer. These are illustrations, not templates:
- Weak: "I will continue as a senior data scientist building churn models." Stronger: "I will develop and validate sepsis early-warning models that community hospitals can run on their own records," backed by hospital letters and public-health sources on the problem.
- Weak: "I analyze pricing data at a fintech." Stronger: "I will build detection methods for synthetic-identity fraud in instant payments," with evidence that institutions beyond your employer adopt or license the approach.
- Weak: "Data science is a national priority." That describes a field, not your endeavor.
Our list of national importance examples by field shows how other industries frame endeavors against the same standard.
Prong 3: why "there aren't enough data scientists" fails
The Policy Manual says "evidence of a national labor shortage in the person's occupation would not, by itself, satisfy this third prong." It weighs instead whether labor certification would be impractical, the benefit of your work even if other US workers are available, urgency, and whether you hold "unique knowledge or skills exceeding the minimum requirements standard for that occupation." A PERM test asks whether US workers meet one job's minimum requirements; an endeavor that spans partners, agencies or employers is something that test does not measure.
Is an NIW worth filing alongside an employer PERM?
Whether it is worth it for you is a call for a licensed immigration attorney, but the mechanics explain why some people file both: different petitioners, speeds and risks, and a priority date that can carry forward.
Under 8 CFR 204.5, an NIW's priority date is the date the "completed, signed petition (including all initial evidence and the correct fee) is properly filed with USCIS"; a PERM case's is the date DOL accepted the labor certification. An approved EB-1, EB-2 or EB-3 petition gives you its date for later petitions in those categories, unless the approval is revoked for fraud, willful misrepresentation or material error, or the labor certification is revoked or invalidated. A denied petition sets no date.
Employer PERM vs self-petitioned NIW, as of 2026-11. Dated snapshots; check the live tools.
| Employer PERM (EB-2 or EB-3) | Self-petitioned NIW (EB-2) | |
|---|---|---|
| Who files | Your employer | You, or an employer |
| Labor certification | Required: prevailing wage, recruitment under 20 CFR 656.17, Form ETA-9089 | Waived; file ETA-9089 Appendix A and a signed Final Determination with the I-140 |
| DOL stage (FLAG) | PWDs at June 2026 receipts (as of 2026-09-30); analyst review at January 2026 priority dates, 303-day average (as of 2026-10-21) | None |
| I-140 processing (USCIS tool, 2026-11-01) | 3 months (EB-2 PERM); 4 months (EB-3 skilled) | 30 months |
| Premium processing (Form I-907) | 15 business days, $2,965 | 45 business days, $2,965 |
| I-140 approval rate, FY2026 Q3 | EB-2 PERM 97.4% | NIW 55.3% |
| Tied to the job offer | Yes | No |
Rates are from the USCIS FY2026 Q3 I-140 data (approvals over approvals plus denials); different tests and filers sit behind the gap, so neither figure predicts a case. The premium timeframes are current ones: an unpublished USCIS draft rule titled "Amending the Premium Processing Timeframe" (RIN 1615-AD25) has been under OIRA review since 2026-10-13, and its text is not public.
At one of eight named employers? DOL announced a PERM suspension of Microsoft, Adobe, Cognizant, Infosys, TCS, Wipro, HCL and Capgemini on 2026-10-08, with no public written notice or end date as of 2026-11-01. As Mayer Brown notes, it "does not suspend any employer from the H-1B program." A self-petitioned NIW needs no labor certification, so in our reading the suspension does not reach it.
What an NIW can do for an H-1B clock
Under 8 CFR 214.2(h)(13)(iii)(D)-(E), H-1B time beyond six years comes in up to one-year increments if a labor certification or I-140 was filed at least 365 days before the extension takes effect, and in up to three-year increments with an approved I-140 when the per-country limit keeps you from adjusting, judged as of the H-1B filing date. An NIW I-140 counts like a PERM-based one, and the new H-1B employer need not be the one that filed it.
A worked timeline: one India-born data scientist, two petitions
Take a hypothetical India-born data scientist with a US master's in statistics, on H-1B since 2022-10-01, so her six years end on 2028-09-30 (before any recapture). Her employer starts PERM; she and her attorney also prepare a self-petitioned NIW. This illustrates mechanics; it is not a recommendation.
- November 2026 to January 2027: she builds the NIW record; employer counsel files Form ETA-9141 for a prevailing wage determination.
- Monday, 2027-02-01: the NIW I-140 is properly filed, so under 8 CFR 204.5(d) her priority date is 2027-02-01.
- With Form I-907: 45 business days from receipt runs to about 2027-04-06, skipping the 2027-02-15 federal holiday (our arithmetic). Under PA-2026-05, a gap in initial evidence can mean a denial with no RFE.
- Without premium: the tool showed 30 months on 2026-11-01, and that figure moves.
- 2028-02-01: the NIW I-140 has been on file 365 days, so unless it is denied first it can support one-year 106(a) extensions once her six years run out.
- PERM track: the ETA-9089 is filed after the wage determination and recruitment, so its priority date likely falls after 2027-02-01. If the NIW is approved, a later EB-2 or EB-3 I-140 can keep the earlier date.
- 2028-09-30: an I-140 approved by then can support three-year 104(c) extensions while the per-country limit still blocks her. For scale, EB-2 India's Final Action Date in the November 2026 Visa Bulletin was 2013-11-01 (Dates for Filing 2015-01-15).
Born elsewhere, November 2026 EB-2 cutoffs were 2025-04-01 / 2026-03-15 for rest of world and 2021-10-01 / 2023-01-01 for China (Final Action / Dates for Filing). Consular cases always use Final Action Dates.
Step by step: building a no-publication NIW record
- Confirm EB-2 eligibility on the USCIS EB-2 page, with a credential evaluation for a foreign degree and experience letters for the bachelor's-plus-five route.
- Write an endeavor statement naming a field-level problem, how you will advance it in the US, and who outside your employer benefits.
- Collect outside-use exhibits (agency reports, partner letters, USPTO records, organizations that depend on your tool), each cleared in writing by your employer's legal or compliance team.
- Request letters from independent experts and outside users who know the work through its use.
- Assemble Form I-140 (edition 06/07/24 per the USCIS I-140 page) with ETA-9089 Appendix A and a signed Final Determination. G-1055 (edition 10/26/26) sets the fee at $715 paper or $665 online, plus an Asylum Program Fee of $600, $300 or $0; the I-140 page explains how self-petitioners answer the questions that set it.
- Decide with your attorney whether to add Form I-907; a faster answer can also be a faster denial.
- Ask an immigration attorney about immigrant intent if you are on F-1 STEM OPT, and your DSO about anything touching SEVIS or travel. Our guide to filing an I-140 while on OPT explains why F-1 is not dual intent.
- Track the Visa Bulletin and the USCIS adjustment filing chart before any I-485; for November 2026, USCIS requires the Dates for Filing chart.
Common mistakes
- Leading with company KPIs. "Reduced churn 12%" is employer benefit, which the Policy Manual calls not sufficiently relevant on its own.
- Counting attention as use. Stars, followers and leaderboard ranks show interest, not reliance.
- Filing thin and waiting for an RFE. Since 2026-08-05, missing required initial evidence can mean a denial with no RFE.
- Assuming NIW approvals collapsed after PA-2026-05. No USCIS data covers decisions under the policy yet; the latest quarter (April to June 2026) showed 55.3%.
Frequently asked questions
Can I get an NIW without publications or citations?
Yes. The USCIS Policy Manual NIW chapter (current as of 2026-10-27) lists a strong citation history as one example of evidence and says its list is not a checklist. Without papers, you need other proof that people outside your employer use or rely on your work, which is a harder record to build.
Can a data analyst qualify for an NIW?
Yes, with EB-2 eligibility (an advanced degree, a bachelor's plus five years of progressive experience, or exceptional ability) and an endeavor larger than reporting for one employer. Analytical work aimed at a field-level or public problem, with outside evidence that others use it, is what the Dhanasar test looks for.
What evidence replaces papers for prong 2?
The Policy Manual (current as of 2026-10-27) points to evidence of how others use your work (contracts, adopted technology, patents or licenses), progress, user or investor interest, and expert letters backed by independent evidence. For data scientists, that often means deployed models with documented outside impact, public-sector projects, open tools others rely on and invited talks.
Do I need a PhD for an NIW as a data scientist?
No. A US master's or foreign equivalent, or a bachelor's plus five years of progressive experience, meets the EB-2 baseline. The Policy Manual calls a STEM PhD tied to the endeavor "an especially positive factor" but says "a degree in and of itself" is not a sufficient basis for prong two, so evidence of impact matters more than the credential.
Is an NIW worth filing alongside an employer PERM?
That is a call for a licensed immigration attorney, but the mechanics explain why some people file both. Under 8 CFR 204.5(e), an approved EB-1, EB-2 or EB-3 petition generally gives you its priority date for later petitions in those categories. On 2026-11-01 the USCIS tool showed 30 months for an NIW I-140 and 3 months for an EB-2 PERM I-140.

How we checked this: we read the Policy Manual chapter, the USCIS EB-2 and I-140 pages, PA-2026-05, 8 CFR 204.5 and 8 CFR 214.2(h)(13)(iii) on 2026-11-01 and 2026-11-02; approval rates, processing times, fees and FLAG snapshots come from the USCIS and DOL pages listed above as of the dates shown, and November 2026 Visa Bulletin values were cross-checked against several law-firm summaries.
This is general information, not legal or tax advice. Your own notices govern, and a licensed immigration attorney (or your DSO for anything F-1, OPT or SEVIS) should review your specific facts.
