Job Hunting While Employed on STEM OPT: How to Find an H-1B Sponsor Without Breaking Your I-983
Your STEM OPT employer won't sponsor, but a new one can register you for the H-1B lottery while you keep your current job, your I-983 and your 150-day clock intact.

Part of our guide to Form I-983.
Yes, you can run a job search while on STEM OPT, and a new employer can register you for the H-1B lottery while you keep working for your current one. Nothing in the STEM OPT rules stops you from interviewing. The rules apply only when you actually change jobs: the new employer must be enrolled in E-Verify, you give your DSO a new Form I-983 within 10 days of starting, and every day without employer information counts toward your 150-day aggregate unemployment limit.
Status line, as of November 1, 2026: FY2028 H-1B registration is not announced. Wage-weighted selection is in effect. The OPT unemployment limits and the STEM OPT 180-day automatic extension are in effect and unchanged. Cap-gap is in effect for timely cap-subject changes of status only.
Job search while on STEM OPT: the short answer
You may interview and accept an offer while employed on STEM OPT. Any prospective employer, not only your current one, can submit your H-1B registration if it has a bona fide job offer for you. Changing jobs requires an E-Verify-enrolled employer, a new Form I-983 to your DSO within 10 days, and attention to your 150-day unemployment limit.
This guide covers the search: who to target, how to stay discreet and when to interview. For the compliance paperwork alone, our STEM OPT employer-change checklist goes step by step.
What is true right now (as of 2026-11)
| Item | Status (2026-11-01) | What it means for your search |
|---|---|---|
| FY2028 H-1B registration | Not announced | USCIS must give 30 days' notice; FY2027 ran March 4-19, 2026, at $215 |
| Wage-weighted selection | In effect since 2026-02-27 | The offered wage level changes the odds |
| OPT unemployment limits | In effect, unchanged | 90 days on OPT; 150 in aggregate with STEM OPT |
| STEM OPT 180-day automatic extension | In effect, unchanged by the 2026-10-14 EAD rule | Still applies to timely STEM OPT filers |
| Cap-gap | In effect (current rule since 2025-01-17) | To April 1 for a timely cap-subject change of status; none for cap-exempt |
| $100,000 H-1B payment (Proclamation 11069) | Proclamation in effect on paper to 2027-09-21; the fee is blocked by courts | Not collected; a change of status USCIS grants inside the US was never covered |
| E-Verify | Extended by the continuing resolution to 2026-12-11 | What happens after 12-11 depends on whether Congress passes funding |

Can I look for another job while on STEM OPT?
Yes. Interviewing is not employment, and no rule requires you to tell your employer, your DSO or SEVP that you are looking. Your obligations are triggered by events: a last day, a new employer, or a material change to the training plan on your current I-983.
That leaves room to search quietly:
- Keep the search off company systems. Use a personal laptop, email and phone.
- Use recruiter-only visibility on job sites instead of a public "open to work" banner.
- Keep doing the job on your I-983. A former employer must sign your final evaluation, so you want that signature to be easy to get.
How do I find employers that will sponsor?
Start from filings, not job ads. In one vendor's sample of 2,718 engineering roles at 136 companies (read 2026-10-13), Match.dev reported that 88.1% said nothing about it, 0.4% explicitly offered it and 1.1% refused it, according to its published data. It is one vendor's count, but silence is not a no.
Two government datasets do the real work:
- DOL's LCA disclosure files. Every H-1B petition needs a certified Labor Condition Application, and DOL's OFLC performance page posts the filings by employer, job title, occupation, worksite and wage. The latest file covers FY2026 through Q3 (to 2026-06-30); DOL's Q3 selected statistics count 426,659 LCA applications received, down 8.8%.
- The USCIS H-1B Employer Data Hub. The Data Hub says it now covers FY2009 through FY2026 Q4, counting USCIS's first decisions on petitions for initial and continuing employment. Its definitions page puts a new employer's petition for someone moving from a different nonimmigrant classification, which is the F-1 to H-1B case, under new employment. So new-employment approvals are a closer signal than continuations or changes of employer.
Our walkthrough on building a sponsor target list from LCA data and the Data Hub shows the filters: your occupation, your metro, then the wage levels those employers actually offered. Filing volume alone does not show whether a company takes outside candidates; our guide to H-1B sponsorship jobs that welcome transfers sets out the signals that separate a working immigration process from an occasional filer.
Before you accept anything, check the company in the E-Verify Employer Search, which warns that a multi-site listing "does not necessarily mean that all of the hiring sites are enrolled." Ask HR for the company ID too.
Use referrals to get straight answers
A referral is the fastest way to learn how a company actually handles registration. Ask the employee who refers you, then the recruiter at the first screen:
- Did you register anyone last cap season, and will you register new hires for FY2028?
- What is your internal cutoff for an offer to make the registration? Each employer sets its own, and you want to know it in December, not March.
- Are you enrolled in E-Verify, and will you sign a STEM OPT training plan (Form I-983) if I join before an H-1B starts?
- Who prepares your filings, in-house staff or outside immigration counsel?
When should I interview to make the FY2028 lottery?
Work backward from the registration window. USCIS must announce it at least 30 calendar days ahead (8 CFR 214.2(h)(8)(iii)(A)(3)), and as of 2026-11-01 it has not. Recent cycles point to March 2027, but that is an expectation only. An employer cannot register you without a bona fide offer, and its internal cutoff comes earlier. Our reading: treat November through February as your interview season.
Compare offers on wage level as well as salary. Under the weighted selection rule, in effect since 2026-02-27, a Level IV registration gets four entries and a Level I registration gets one, per the Federal Register final rule. The level depends on how the offered salary compares with the prevailing wage for that occupation and area, so the same salary can land at different levels in different metros. Our explainer on how the weighted lottery works covers the mechanics. For scale, the FY2026 cycle, the last on USCIS's chart and before weighting, had 343,981 eligible registrations and 120,141 selections.
Can a new employer register me for the H-1B lottery while I work elsewhere?
Yes. The registrant is the prospective petitioner: the company that wants to employ you in H-1B status. It need not be your current employer, and you need not have started there. According to the USCIS registration page, it attests that "The registration reflects a bona fide job offer," that the salary it offers is at or above the wage level it selected, and that it has not worked with another registrant to unfairly increase your chances of selection.
USCIS adds that a prospective petitioner "may only have one registration submitted per beneficiary per fiscal year," and that selection is "a weighted selection among properly submitted registrations for unique beneficiaries." Whether and how an employer registers you is its decision, made with its immigration counsel.
If you are selected, the new employer files Form I-129 asking USCIS to change your status, and you can keep working for your current STEM OPT employer meanwhile. If your EAD would end before the H-1B start date, cap-gap can extend your F-1 status and work authorization to April 1 of the fiscal year (or the petition start date, if earlier) for a timely cap-subject change of status. It ends automatically if the petition is denied, withdrawn, revoked or rejected. Cap-exempt petitions get no cap-gap, so a university petition has to be filed well before your EAD ends; the employer's attorney sets that timing.
Move now or move at the H-1B start date?
Once a sponsoring employer says yes, you have two clean paths.
| Question | Path A: join the new employer now, on STEM OPT | Path B: stay, start the new job when H-1B begins |
|---|---|---|
| Paperwork now | New I-983, E-Verify check, old employer's departure report | None until your last day; then the departure report and your final evaluation |
| Unemployment risk | Any gap between jobs counts toward the 150 days | Low while you stay employed |
| If you are not selected | You already work there; a later cap season may fit your STEM OPT | You stay put and keep searching |
| If the offer falls through | Hurts only if it happens after you resign | No effect on your current job |
| Who to ask | DSO for the I-983 and SEVIS steps | Employer's immigration attorney for petition timing; DSO for cap-gap |
A worked timeline with real dates (Path A)
Say your STEM OPT EAD runs from 2026-07-01 to 2028-06-30, your current employer will not sponsor, and an E-Verify-enrolled employer offers you a role in January and agrees to register you.
- Friday 2027-01-29: last day at the old job.
- By Friday 2027-02-05: the old employer reports your departure to your DSO (five business days).
- Monday 2027-02-08: first day at the new job. The nine days from January 30 to February 7 count toward your 150. The gap is under 10 days, so the loss-of-employment-first rule below does not apply.
- By 2027-02-08: submit the old job's final self-evaluation (10 days after leaving).
- By Thursday 2027-02-18: submit the new I-983 and report the new employer's name and address (10 days after starting).
- March 2027 (expected, not announced): the new employer registers you.
- Friday 2027-10-01: if selected and approved with a change of status, your H-1B can start. Your EAD runs past that date, so cap-gap is not needed.
If you are not selected, the FY2029 cycle (not announced) still falls inside your STEM OPT. Your EAD would end before an October 1, 2028 start, so cap-gap would matter then.
What do I file when I change STEM OPT employers?
Not a new I-765. As a question in SEVP's Form I-983 FAQ puts it, the DSO receives a new I-983, "but not the Form I-765." Your 24-month period stays the same; you carry it to the new employer.
- Verify the new employer in the E-Verify Employer Search and get its company ID. SEVP puts this on you: "It is the student's responsibility to ensure that they are working in accordance to all STEM OPT requirements, including E-Verify."
- Submit the final Form I-983 self-evaluation for the old job, signed by you and the old employer, to your DSO within 10 days of your last day.
- Confirm the old employer reports your departure to your DSO within five business days (an email is enough), under the employer reporting rules.
- Complete a new Form I-983 with the new employer and submit it to your DSO within 10 days of your start date.
- Report the new employer's name and address to your DSO within 10 days.
- Keep up the six-month validations and the 12-month and final evaluations listed on the Study in the States reporting page.
If more than 10 days pass between jobs, Study in the States says you "must first report the loss of employment to the DSO" and submit the new I-983 later. Our STEM OPT reporting checklist has every recurring deadline.
Do unemployment days reset if I switch?
No. The SEVIS Help Hub sets the STEM OPT limit at "150 days, which includes any days accrued while on post-completion OPT," counted from your actual OPT start date. Its instruction: "Count each day without employer information" (SEVIS Help Hub, updated 2026-07-27).
Our reading: the counter runs on what SEVIS shows, so a late I-983 can leave days without employer information after you start work. Ask your DSO for your total before you resign, and see how STEM OPT unemployment days count.
Can I have two STEM OPT employers?
Yes, with conditions. SEVP's FAQ says a student "may have multiple STEM OPT employers, as long as all conditions of the STEM OPT extension are met," including an I-983 for each opportunity, E-Verify for each employer, and "no less than 20 hours per week for each employer." A ten-hour-a-week side role cannot be a STEM OPT employer, and a future H-1B sponsor does not need to be one at all. Talk to your DSO before adding a second employer.
My STEM OPT employer won't sponsor. What now?
The reason changes your next move.
- Policy or cost. Another cap-subject employer can register you while you stay.
- The $100,000 payment. The USCIS I-129 page says a court "vacated agency guidance implementing the $100,000 payment requirement," and DHS still plans to collect if that order is lifted. Even then, USCIS said on 2026-09-21 that changes of status it grants inside the US were never covered; a denied change of status or a consular-notification petition would be. A separate $103,265 fee for certain cap-subject petitions (RIN 1615-AD20) is only proposed; comments closed 2026-09-24 and no final rule exists.
- Cap-exempt employers skip the lottery but offer no cap-gap. Florida has paused new H-1B hires at 12 public universities until at least 2027-01-05 (renewals unaffected), and Texas has frozen new H-1B petitions at state agencies and public universities until 2027-05-31 unless the Texas Workforce Commission permits one.
- Consultancies promising sponsorship. SEVP says a placement agency cannot sign your I-983 unless it is your E-Verify employer and provides and oversees the training.
One timing risk: the continuing resolution carries E-Verify only through 2026-12-11, according to CRS; what follows depends on whether Congress passes funding by then. During the 2025 shutdown, E-Verify went offline on 2025-10-01 for about a week. If a new job would start in December or January, ask HR how it would handle E-Verify if the system went down.
Common mistakes
- Reading a posting's silence as a refusal. Check the filings, then ask.
- Waiting for the March announcement to interview. Employer cutoffs come first.
- Resigning before confirming E-Verify. An unenrolled employer cannot carry your STEM OPT.
- Believing the clock resets. Misconception: "A new employer means my unemployment days start over." Correction: the 150 days are cumulative across OPT and STEM OPT.
- Skipping the old employer's final evaluation. SEVP says a missing one violates STEM OPT terms and may jeopardize your status.
- Filing a new I-765 for a job change. You need a new I-983, not a new EAD.
Frequently asked questions
Can I look for another job while on STEM OPT?
Yes. Nothing in the STEM OPT rules bars you from searching, interviewing or accepting an offer while you work for your current employer. Reporting duties start only when something changes, such as your last day or a new employer. Those rules are unchanged as of November 1, 2026.
Can a new employer register me for the H-1B lottery while I work elsewhere?
Yes. The registrant is the prospective employer, not your current one, and it must attest that the registration reflects a bona fide job offer. You can keep working for your current STEM OPT employer while the registration and any petition are pending. FY2028 registration is not announced as of November 1, 2026.
What do I file when I change STEM OPT employers?
Not a new I-765. The new employer must be enrolled in E-Verify, you submit a new Form I-983 to your DSO within 10 days of starting, and you submit the final self-evaluation for your old job within 10 days of leaving. The old employer reports your departure within five business days.
Do unemployment days reset if I switch?
No. The STEM OPT limit is 150 days in aggregate, including days used on post-completion OPT. SEVIS counts each day without employer information from your actual OPT start date, so a gap between jobs adds to the same total (SEVIS Help Hub, updated July 27, 2026).
Can I have two STEM OPT employers?
Yes, if each meets every STEM OPT condition. SEVP says each training opportunity needs its own Form I-983, each employer must use E-Verify, and you must work at least 20 hours a week for each employer, so a small side role cannot carry STEM OPT.

How we checked this: we read the official pages above, including the SEVP I-983 FAQ and the USCIS registration attestations, on November 1-2, 2026, and checked every date in the worked timeline against the 10-day and five-business-day rules. This is general information, not legal or tax advice; your own I-20, EAD and I-983 govern. Take SEVIS and I-983 questions to your DSO, and petition timing to a licensed immigration attorney.
