L-1 Visa to Green Card: EB-1C for L-1A Managers, PERM for L-1B Specialists
L-1A managers and L-1B specialists reach a green card by very different roads, and the L-1B clock is the one that catches people out.

Part of our guide to PERM labor certification.
The short answer to the L-1 visa to green card question: L-1A managers and executives usually go through EB-1C, a multinational-manager I-140 that skips PERM labor certification entirely. L-1B specialized-knowledge workers usually go through PERM, then an EB-2 or EB-3 I-140, because their job is judged on expertise, not on managing people or a function. Both end at an I-485 or consular interview once your priority date is current, but they differ sharply in time and in what happens if your L-1 clock runs out first.
Status as of 2026-10-14. In effect: a $4,500 9-11 Response fee on L-1 extension petitions filed by covered employers (since 2026-09-09); the end of automatic EAD extensions for renewals (final rule published and effective 2026-10-14); a DOL PERM suspension for 8 named employers (announced 2026-10-08). Proposed: elimination of the 60-day worker grace period, which covers L-1 (comments close 2026-11-10); removal of USCIS deference to prior approvals (published 2026-10-14, comments close 2026-11-13). Not published: the November 2026 Visa Bulletin.

As of October 2026:
| L-1A manager or executive | L-1B specialized knowledge | |
|---|---|---|
| Typical green card category | EB-1C (multinational manager or executive) | EB-2 or EB-3 through PERM |
| Labor certification (PERM) | Not required | Required |
| Who files the I-140 | Your US employer | Your US employer, after DOL certifies the PERM |
| Priority date set by | I-140 filing date | PERM filing date with DOL |
| I-140 regular processing, 80th percentile (~Sept 2026) [reported] | About 27.5 months | About 3 months (EB-2) or 4 months (EB-3 skilled) |
| Pre-I-140 DOL stages | None | Prevailing wage, recruitment, DOL analyst review |
| Visa Bulletin chart | EB-1 | EB-2 or EB-3 |
Those processing figures are reported by an aggregator, not published by USCIS. Confirm them against the live USCIS processing-times tool.
Path 1: EB-1C for L-1A managers and executives
USCIS describes the EB-1C requirements on its EB-1 page. In plain terms:
- You worked abroad, full time, in a managerial or executive role for a parent, branch, subsidiary or affiliate of your US employer, for at least one year in the three years before your L-1 entry (or before the petition, if you are filing from abroad).
- Your US job is also managerial or executive.
- The US employer has been doing business for at least one year and still has the qualifying relationship with the foreign entity.
No PERM and no labor-market test is why EB-1C is attractive, and why it is examined closely.
An L-1A approval does not guarantee EB-1C
The "manager" and "executive" definitions match L-1A, but the I-140 is a fresh review of your org chart, your reports, any essential function you manage, and whether you direct work rather than do it. Functional managers (who manage a function rather than a team) can qualify, and they draw the most requests for evidence. Our breakdown of why L-1A functional-manager petitions get denied covers the same weak points an EB-1C adjudicator probes.
For the full EB-1C evidence picture, see the EB-1C multinational manager green card guide.
L-1A to green card processing time
There is no single number, because three separate clocks run in sequence:
- I-140 adjudication. Regular EB-1C processing was reported by an aggregator at about 27.5 months at the 80th percentile around September 2026. Premium processing is available for I-140 petitions, with a $2,965 fee per the USCIS fee schedule (Form G-1055, edition 10/07/26). Check the I-140 page for the current premium timeframe.
- Priority date wait. Your priority date is the date the I-140 was filed. In the October 2026 bulletin, EB-1 Final Action Dates were 2023-02-01 for India and 2023-07-01 for China. For other chargeability areas, read the current Visa Bulletin directly.
- I-485 adjudication (or consular processing), once your date is current.
If the priority date is current when the I-140 is filed, the I-140 and I-485 can be filed together (see I-140 vs I-485 and concurrent filing). For October 2026, USCIS said all employment-based I-485 filings must use the Dates for Filing chart, under which EB-1 India and China were 2024-07-01. USCIS picks the chart month by month on its adjustment filing charts page.
Path 2: PERM for L-1B specialized-knowledge workers
The L-1B test is specialized knowledge of the company's products, processes or procedures, as described on the USCIS L-1B page. That is not a managerial test, so the L-1B role itself rarely supports EB-1C. The standard route is the same one most H-1B workers take.
The PERM sequence, step by step
- Prevailing wage determination (PWD). Your employer asks DOL for the wage for the role. As of 2026-09-30, DOL was processing PERM PWD requests filed in June 2026 (more in our prevailing wage processing time explainer).
- Recruitment. The employer runs the required recruitment to test the US labor market (the employer's process, not yours). See how long PERM labor certification really takes.
- PERM filing. The filing date becomes your priority date.
- DOL analyst review. As of 2026-10-05, DOL's FLAG portal showed analyst review on December 2025 priority dates, an average of 336 days. Audits were also at December 2025.
- I-140 in EB-2 or EB-3. EB-2 needs an advanced degree or its regulatory equivalent; EB-3 covers skilled workers and professionals. Regular processing was reported by an aggregator at about 3 months (EB-2 PERM) and 4 months (EB-3 skilled) at the 80th percentile around September 2026.
- I-485 or consular processing once the priority date is current.
As of early October 2026, the PWD and analyst queues together come to more than a year before the I-140 even starts. DOL's live numbers are on its Foreign Labor Certification pages.
October 2026 Visa Bulletin dates for the PERM categories
| Category (Final Action, Oct 2026) | India | China | Rest of World |
|---|---|---|---|
| EB-2 | 2013-11-01 | 2021-10-01 | 2025-01-01 |
| EB-3 | 2014-01-01 | 2022-01-08 | 2024-05-15 |
Rest of World EB-2 retrogressed in October from Current to 2025-01-01, and EB-3 Rest of World moved back to 2024-05-15. The November 2026 bulletin had not been published as of 2026-10-14, so any "November cutoff" you see is a forecast (our November 2026 predictions are labelled as such).
The L-1B clock problem
L-1 rules set a hard maximum stay, and L-1B's ceiling is shorter than L-1A's. The exact limits are on the USCIS L-1A and L-1B pages. H-1B workers can extend past their six-year limit on the strength of a long-pending PERM or an approved I-140, but those AC21 extension provisions apply to H-1B, not to L-1. A pending green card does not stretch an L-1 past its maximum.
So an L-1B worker facing more than a year of PERM plus a Visa Bulletin wait can hit the ceiling first. Options people commonly raise with counsel:
- Change to H-1B, which requires a cap-subject lottery selection unless you were counted before or the employer is cap-exempt. See switching from L-1B to H-1B while employed.
- Move into L-1A if the duties genuinely become managerial, not just the title.
- Recapture time spent outside the US during L-1 validity, which may extend the clock.
- Adjust status if the priority date becomes current before the clock runs out.
An immigration attorney can map these against your actual dates.
What changed in September and October 2026 (as of 2026-10-14)
| Item | Old rule | New rule (status, date) | What to do differently |
|---|---|---|---|
| L-1 extension cost | No 9-11 Response fee on extensions | $4,500 on L-1 extension-of-status petitions by a covered employer (in effect 2026-09-09) | Ask HR whether your employer is "covered" (50+ US employees, more than half in H-1B/L-1) |
| Form I-129 edition | 02/27/26 edition | 09/09/26 edition; old edition accepted until 2026-11-09 | Expect extensions to use the current I-129 edition |
| Worker 60-day grace period | Up to 60 days after employment ends | Elimination proposed (RIN 1615-AD22), comments close 2026-11-10 | Today's grace period still applies; follow the rulemaking |
| Deference to prior approvals | USCIS generally defers on same-facts extensions | Removal proposed (published 2026-10-14, comments close 2026-11-13) | Current deference rule still applies; see our deference proposal explainer |
| Automatic EAD extension | Renewal EADs were auto-extended | In effect: no auto-extension for renewals filed on or after 2025-10-30 (final rule 2026-10-14) | A pending-I-485 EAD renewal no longer carries an automatic extension, so L-1 status is a separate question |
| I-485 form | Older editions | Only the 09/18/26 edition accepted; filing location changed 2026-10-07 | Check the I-485 page before filing |
Sources: the 9-11 fee rule, the grace-period proposal, the deference proposal and the EAD extension rule. The worker grace-period proposal is a different rule from the F-1 grace period, which it does not cover.
If your L-1 employer is on the PERM suspension list
On 2026-10-08 DOL announced (in effect, no end date) that it would not accept or process PERM cases involving eight employers: Microsoft, Adobe, Cognizant, Infosys, TCS, Wipro, HCL and Capgemini. As announced, it covers PERM only and does not by itself end anyone's L-1 or H-1B status. EB-1C does not use PERM, so the announcement does not on its face reach it. No written DOL notice had been found, so confirm your case with counsel. More in our PERM suspension explainer.
Travel and stamping while your green card is pending
L-1 is a dual-intent classification (compared in our dual-intent visas guide). A pending green card case does not by itself bar an L-1 extension or stamp. Under USCIS rules, an L-1 holder who is maintaining status can generally travel on a valid L-1 visa and return to the same employer without abandoning a pending I-485. Confirm your own facts with an attorney before you book.
For a new stamp, interview waivers ("dropbox") are no longer available for L-1, and since 2025-09-06 you apply in your country of nationality or legal residence, not a third country. Proclamation 10998 (39 countries) remains in effect, unchanged since 2026-01-01. Check the live travel.state.gov wait-times page.
Common mistakes
- Assuming L-1A approval means EB-1C approval. It is a new adjudication with the same definitions, and thin org charts get questioned again.
- Measuring the L-1B timeline from the wrong date. The limit that matters is the L-1B statutory maximum, not the end date on your current I-797, and the DOL queues alone currently run more than a year.
- Counting on AC21 extensions. They are H-1B provisions. They do not extend L-1.
- Confusing the priority date sources. EB-1C's priority date is the I-140 filing date; a PERM case's is the PERM filing date. An approved I-140 can generally keep its priority date for a later petition.
- Reading a forecast as a cutoff. Only a published bulletin sets dates, and November 2026 is not out.
- Treating proposals as law. The grace-period and deference changes are proposed. The 9-11 fee is in effect.
- Assuming a pending-I-485 EAD renewal is auto-extended. That ended for renewals filed on or after 2025-10-30, so how L-1 status and a pending I-485 interact is a question for counsel.
Frequently asked questions
How long does it take to go from L-1A to a green card?
There is no single number. The EB-1C I-140 alone was reported at about 27.5 months (80th percentile, regular processing, ~September 2026). Then country of birth matters: in October 2026, EB-1 India's Final Action Date was 2023-02-01 and China's 2023-07-01.
Can an L-1B holder apply for EB-1C?
Usually not on the L-1B role alone. EB-1C asks whether your jobs abroad and in the US are managerial or executive, which is a different test. An immigration attorney should review the facts.
Does applying for a green card put my L-1 status at risk?
Not by itself. L-1 is dual intent, so a pending PERM, I-140 or I-485 does not make you ineligible for L-1 extensions or a stamp. You still have to maintain status.
What happens if my L-1B time runs out before my green card arrives?
Unlike H-1B, nothing extends L-1 past its statutory maximum because a PERM or I-140 is pending. People typically look at H-1B, a genuine move into L-1A, recapture, or adjustment if the date is current. Which fits is a question for an immigration attorney.
Does the new $4,500 L-1 fee apply to my green card case?
No. The 9-11 Response fee, in effect since 2026-09-09, applies to L-1 extension-of-status petitions by covered employers (50+ US employees, more than half in H-1B or L-1), not to the I-140 or I-485.
This article explains how the process works. It is not legal advice, and your own I-797, I-94 and attorney's guidance govern over anything published here.

Frequently asked questions
How long does it take to go from L-1A to a green card
There is no single number. The EB-1C I-140 stage alone was reported by an aggregator at about 27.5 months at the 80th percentile for regular processing around September 2026, and premium processing is available for an extra fee. After that, the wait depends on your country of birth, because EB-1 India had a Final Action Date of 2023-02-01 and EB-1 China 2023-07-01 in the October 2026 Visa Bulletin. Check the live USCIS processing-times tool and the current bulletin before you plan around any estimate.
Can an L-1B holder apply for EB-1C
Usually not on the strength of the L-1B role alone. EB-1C asks whether your qualifying job abroad was managerial or executive and whether your US job is too, and specialized-knowledge work is a different test. Some L-1B workers did manage people or a function abroad, so the answer turns on facts that an immigration attorney should review.
Does applying for a green card put my L-1 status at risk
No, not by itself. L-1 is a dual-intent classification, so a pending PERM, I-140 or I-485 does not by itself make you ineligible for L-1 extensions or for an L-1 visa stamp. You still have to maintain status and meet every L-1 requirement on each filing.
What happens if my L-1B time runs out before my green card arrives
The L-1 classifications have hard statutory maximums, and unlike H-1B there is no provision that extends L-1 past the limit because a PERM or I-140 is pending. People in that position typically look at a change to another status such as H-1B, an L-1A role if they genuinely move into management, time abroad that may be recaptured, or adjustment if the priority date is current. Which of these fits is a question for an immigration attorney.
Does the new $4,500 L-1 fee apply to my green card case
No. The 9-11 Response and Biometric Entry-Exit Fee, in effect since 2026-09-09, applies to L-1 extension-of-status petitions filed by covered employers, meaning employers with 50 or more US employees and more than half of them in H-1B or L-1 status. It is not a fee on the I-140 or I-485, but it does raise the cost for a covered employer of keeping you on L-1 while the green card is pending.
