Laid Off on an H-4 EAD: Your Status, Unemployment Benefits and the Renewal Gap to Watch

Your H-4 status survives your own layoff. The end date on your EAD card is what limits your unemployment claim and your window to start the next job.

Part of our guide to the H-4 EAD.

As of November 1, 2026, being laid off on an H-4 EAD does not change your immigration status. Your H-4 status rests on your spouse's H-1B and your own I-94, not on your job, and the H-4 EAD has no unemployment-day limit like OPT's. You can usually file a state unemployment claim; the state decides, and a valid card is what shows you can accept work. The real deadline is the end date on your card. Under a final rule in effect since 2026-10-14, renewals filed on or after 2025-10-30 get no automatic extension, so if your card ends before such a renewal is approved, you cannot start or continue any job, salaried or freelance.

Status line, as of 2026-11-01:

Does losing your job on an H-4 EAD affect your H-4 status?

No. H-4 is a dependent status: it lasts while your spouse keeps H-1B status and your own I-94 is unexpired. Losing your own job ends a paycheck, not your status, and no grace period or unemployment clock starts. Your H-4 EAD, category (c)(26), stays valid until the end date printed on the card.

The card is evidence of permission to work. It is not your status. USCIS's page on employment authorization for certain H-4 dependent spouses says the EAD's expiration "should be the same date as the expiration date on your most recent Form I-94," and the USCIS Policy Manual gives (c)(26) cards a validity "up to end date of H-4 status, not to exceed principal's H-1B status." Because the card does not depend on your employer, a layoff leaves the employer nothing to withdraw and no SEVIS record to update. One thing to check: if that employer had started your own H-1B petition or green card case, ask an immigration attorney what the layoff means for that case.

What you lose is income, possibly health coverage, and time on a card that keeps running. What would change your status is something happening to your spouse's H-1B; for that case, read what happens to your H-4 status when your H-1B spouse is laid off.

Is there an unemployment limit on an H-4 EAD?

No. The 90-day and 150-day counts are F-1 OPT rules (see SEVP's BCM 2101-01) and apply only to students on OPT and STEM OPT. Nothing in the (c)(26) category counts unemployed days.

That freedom is built into the category. The 2015 DHS rule that created the H-4 EAD said that because these cards "may be used to work for any employer, workers are free to find new employment at any point during the EAD's validity" (80 FR 10284). The limit is the card's validity, not a day count.

A long gap does affect how employers read your resume. Our H-4 spouse job search strategy covers how to explain a gap and which employers to target first.

Can H-4 EAD holders collect unemployment benefits?

You can usually file a claim, and the state decides whether you qualify. The Department of Labor's guide, How Do I File for Unemployment Insurance?, says "Each state sets its own unemployment insurance benefits eligibility guidelines" and that the program serves workers who become unemployed "through no fault of their own." You file in the state where you worked, which you can find through CareerOneStop's state directory, the finder DOL links to.

Federal law adds an immigration screen. Under 26 U.S.C. 3304(a)(14)(A), benefits are not payable on work done by a noncitizen unless the person was, among other options, "lawfully present for purposes of performing such services." In our reading, wages you earned while your EAD was valid fit that description, but the state agency makes the call on your claim.

The test where visa status usually matters is "able and available." An H-1B worker's permission to work is tied to one employer, which complicates that test. Yours is not: while your card is valid, you can accept any job offer the day it arrives. Once the card ends without an approved renewal, you are no longer legally able to accept work, and your weekly certification has to say so.

For scale, Challenger, Gray & Christmas counted 165,925 job cuts announced by technology companies in 2026 through September, up 54% on the same period of 2025 (September 2026 report, released 2026-10-01).

How a state looks at an H-4 EAD claim (as of 2026-11-01)

TestWhat the state asksThe H-4 EAD angle
Base-period wagesDid you earn enough in the state's base period?Wages earned with a valid EAD are reported like any W-2 wages
Reason you leftDid you lose the job through no fault of your own?A layoff is different from a voluntary buyout or a firing; ask the state how it treats a buyout before you sign one
Able and availableCan you legally accept work now, and are you looking?Yes while the card is valid; no from the day after its end date unless a renewal is approved
Weekly certificationWhat did you work and earn this week?Report freelance income, severance and any change in your EAD

Two side points. The IRS says "Unemployment compensation is taxable income." Expect a Form 1099-G, and you can ask the state to withhold federal tax with Form W-4V. And if a green card case is ahead, ask your immigration attorney how any benefit is treated, since DHS's public charge final rule is in effect and challenged in State of New York v. DHS (as of 2026-11-01).

What if your H-4 EAD expires while you are job hunting?

For a renewal filed on or after 2025-10-30, a pending receipt notice does not extend your authorization: you cannot start or continue any job from the day after the card's end date until USCIS approves the renewal. Renewals timely filed before that date were automatically extended, for up to 540 days, but the final rule says only for H-4 spouses who "had an unexpired Form I-94" showing H-4 status. It adds that even under the old rules, a (c)(26) renewal that depended on a pending H-4 extension got no automatic extension.

The final rule is explicit about timing. It says "USCIS does not postdate the renewal EAD in relation to an applicant's current EAD's validity period" (final rule text). The same passage notes that USCIS "generally recommends" not filing more than 180 days before expiration, but that "there is no prohibition" on filing earlier. Our explainer on the end of the H-4 EAD auto extension walks through the change in detail.

Three facts shape the gap. The (c)(26) I-765 is paper-only (USCIS online filing list). It has no premium processing (USCIS I-907 page); the final rule says only that USCIS "will continue to explore" expanding it. And the card cannot outlast your H-4 I-94, so the renewal usually travels with your H-4 extension and your spouse's H-1B extension. The rule also notes that USCIS weighs expedite requests "on a case-by-case basis" at its "sole discretion"; whether one fits your facts is a question for your attorney.

These change monthly. Check the live USCIS processing times tool before you plan around any of them, and remember that 1 case in 5 takes longer.

The renewal-gap worksheet

Work through it on paper:

  1. Write your card's end date from the front of the EAD.
  2. Add one day. That is the first day you cannot work if no renewal has been approved.
  3. Look up today's figure for your filing path on the USCIS processing-times tool.
  4. Add that figure to the date the renewal was filed, or the date your attorney expects to file it. If the result falls on or after the date from step 2, you have a projected gap.
  5. Share the projected gap with the attorney handling your spouse's H-1B extension, since your I-539 usually rides with it.

Worked example (our arithmetic, using the 2026-11-01 figures). Your card ends 2027-06-30, so 2027-07-01 is your first day without authorization. Suppose the renewal is filed on 2027-01-01, 180 days earlier.

Filing pathProjected decision (80% figure)Projected gap
I-765 filed with the H-4 I-539 (6.5 months)about 2027-07-16about 16 days, 2027-07-01 to mid-July
Standalone I-765 (17.5 months)about 2028-06-16about 11.5 months

The same card and filing date produce a two-week gap on one path and nearly a year on the other. One common route onto the standalone path: the H-4 extension was approved earlier, but the EAD was not filed with it. A decision date is also not the card in your hand, so allow for mail time and ask your employer what it needs for Form I-9.

Timing a new job against an expiring card

Before you accept an offer, check four things:

Our guide to jobs you can take on an H-4 EAD covers what kinds of roles and contracts the card allows.

Can you be self-employed on an H-4 EAD?

Generally yes. The card is not tied to any employer, and freelancing, consulting and running your own business are generally treated as allowed while it is valid. Contract work can bridge the months between salaried jobs.

Three cautions apply. Self-employment ends at the card's end date like any job, so you cannot keep invoicing clients after it lapses without an approved renewal. States generally ask you to report work and earnings, self-employment included, on each weekly certification, and that work can reduce or stop benefits; check your state's rules before you take a contract. And the business structure you pick has tax and immigration consequences; see starting a business on an H-4 EAD, and have an immigration attorney review the plan before you register anything.

What happens to your health insurance?

Employer coverage usually ends with the job or soon after. Ask HR for your exact benefits end date, any COBRA continuation notice, and whether your job loss opens a special enrollment window on your spouse's plan.

Be careful with the Marketplace for 2027. By statute, the premium tax credit is scheduled to be zero from tax years after 2026-12-31 for lawfully present people who are not "eligible aliens," and state summaries include H-4 holders in that group. The implementing regulations are proposed, with comments due 2026-11-30 (Federal Register notice). Our guide to ACA subsidies ending for H-1B and H-4 households covers the options.

Laid off on an H-4 EAD: what to do in the first two weeks

  1. Check the end date on your EAD and your most recent I-94 on CBP's I-94 website, and write down the first day after the card's end date.
  2. Start a claim with the unemployment insurance agency in the state where you worked, using the DOL or CareerOneStop state directory; the state decides whether you qualify.
  3. Answer the claim's citizenship and work-authorization questions exactly as your EAD shows them, including category C26 and the card's end date.
  4. Request from HR, in writing, a separation letter that states the reason, your final pay and severance details, and your benefits end date.
  5. Ask your spouse's employer's immigration attorney when the H-1B extension and your H-4 I-539 are planned, and whether your I-765 can go in with them.
  6. Look up the current (c)(26) and I-539 figures on the USCIS processing-times tool, and run the worksheet above.
  7. Confirm the form edition on the USCIS forms updates page (I-765 08/21/25, I-539 08/28/24, as of 2026-10-30) and the current mailing address before anything goes in the mail. A package postmarked after 2026-11-09 must use the new address.
  8. Budget the fees from the USCIS fee schedule, G-1055 (edition 10/26/26): $520 for a paper I-765 and $470 for a paper I-539 ($420 online), paid by card (Form G-1450) or bank debit (Form G-1650).
  9. Set a weekly reminder for your unemployment certification, and tell the state the week your card ends if no renewal has been approved.

Common mistakes

Frequently asked questions

Does losing my job affect my H-4 status?

No. H-4 is a dependent status that lasts while your spouse keeps H-1B status and your own I-94 is unexpired, so losing your own job does not change it and starts no grace period. Your H-4 EAD, category (c)(26), stays valid until the end date printed on the card. That was true as of November 1, 2026.

Is there an unemployment limit on an H-4 EAD?

No. The 90-day limit (150 days with STEM OPT) is an F-1 OPT rule from SEVP and does not apply to the H-4 EAD. The limit is the card itself. For a renewal filed on or after October 30, 2025, you cannot work after the card's end date until the renewal is approved.

Can H-4 EAD holders collect unemployment benefits?

You can usually file a claim with the unemployment agency in the state where you worked, and the state decides. It looks at your past wages, why you lost the job, and whether you are able and available to work. While your EAD is valid you can accept any job. Once the card ends without an approved renewal, you are no longer legally able to work, and you have to report that to the state.

What if my H-4 EAD expires while I am job hunting?

For a renewal filed on or after October 30, 2025, you cannot start or continue any job from the day after the card's end date until the renewal is approved, under the final rule in effect since October 14, 2026. As of November 1, 2026, USCIS showed 17.5 months for a standalone H-4 EAD and 6.5 months when it is filed with the H-4 I-539 (80% of cases), so check the live tool before you plan around either figure.

Can I be self-employed on an H-4 EAD?

Generally yes. The H-4 EAD is not tied to any employer, and freelancing, contracting or running your own business is generally treated as allowed while the card is valid. Self-employment stops at the card's end date like any job, freelance income usually has to be reported on weekly unemployment certifications, and an immigration attorney should review any business structure first.

This is general information, not legal or tax advice. Your own EAD, I-94 and USCIS notices govern; ask your state unemployment agency about benefits, an immigration attorney about status and petitions, and a tax professional about taxes.

A layoff on an H-4 EAD is a deadline problem more than a status problem: the card's end date sets your runway. If you want help building a search that lands an offer inside that runway, talk to F1Jobs.
