PERM Special Handling for University Faculty: The 18-Month Clock for H-1B Professors

Your university has 18 months from the day it selected you to file a special-handling PERM, and the prevailing wage queue alone can take months of that window.

Part of our guide to PERM labor certification.

PERM special handling is the Department of Labor's optional labor certification route for college and university teaching jobs, set out in 20 CFR 656.18. Your university skips the fresh round of ads that standard PERM requires, documents the competitive faculty search it already ran, shows you were more qualified than every US applicant, and files Form ETA-9089 within 18 months of selecting you. Miss that date and that search can no longer carry the case; 656.18(d) points the university to standard PERM, which means a fresh round of recruitment.

Status line, as of 2026-11-01: 20 CFR 656.18 is in effect and unchanged. DOL's PERM labor-market-test proposal (RIN 1205-AC29) cleared White House review on 2026-10-23 but is unpublished, with no public text or comment period (OIRA list), so no PERM rule has changed. DOL's prevailing-wage rule (RIN 1205-AC30) is only proposed. The clock is tight because of the queue: on 2026-09-30, DOL's FLAG processing times showed PERM prevailing wage determinations being issued for requests received in June 2026.

What is PERM special handling?

PERM special handling is an optional labor certification procedure in 20 CFR 656.18 for college and university teaching positions. The employer relies on its completed competitive faculty search, documents why the selected foreign national was more qualified than each US applicant, and must file the PERM application within 18 months of that selection, with no new advertising round.

Faculty hiring does not fit the PERM calendar. Standard PERM under 20 CFR 656.17 requires mandatory recruitment "at least 30 days, but no more than 180 days, before the filing of the application," which would mean re-advertising a job you already hold. Section 656.17(e) exempts "college or university teachers selected pursuant to a competitive recruitment and selection process." A special-handling case rests on four conditions:

The ordinary PERM pieces still apply: a prevailing wage determination, a posted notice of filing, and an offered wage at or above the prevailing wage.

What goes in the special-handling file

Under 656.18(b), the university must be able to produce:

The regulation's wording is that the employer "must be able to document" these items, so they make up the audit file: the university keeps supporting documentation for five years from filing (20 CFR 656.10(f)) and produces it if the Certifying Officer asks. Note the word "each": the reasons must cover every US applicant, not only the finalists.

Special handling vs standard PERM: what actually differs

For a teaching job, the comparison standard is the same under either route. 20 CFR 656.24(b)(2)(ii) says: "If the job involves a job opportunity as a college or university teacher, the U.S. worker must be at least as qualified as the alien." Section 656.18(d) adds that a university filing for a teacher under either route must be able to show, if the Certifying Officer asks, that you were "more qualified than each U.S. worker who applied for the job opportunity." What special handling buys is time and reuse: the search you already won counts.

The last column is why research-only roles are harder: under 656.24(b)(2)(i), a minimally qualified US applicant can block certification. Our explainer on PERM recruitment and the recruitment report covers that standard.

When does the 18-month deadline start?

It starts when "a selection is made," not on your start date, your H-1B approval or your arrival. The regulation does not say which document fixes that date; universities commonly document the written offer or the committee's final report (common practice, not a DOL definition), and counsel decides which date the file will show.

Common misconception: "The university has 18 months from my start date," or "DOL has 18 months to approve it." Correction: 656.18(c) runs from the selection and governs only when the application is filed. DOL's review time after filing does not count.

A worked timeline: offer in February, deadline in August

Say your tenure-track offer is dated 2026-02-16, the university treats that as the selection date, and you start teaching on a cap-exempt H-1B on 2026-08-17.

That leaves about four months of slack. A slow determination, a missing committee report or a funding lapse can eat it. The current stopgap funds the government through 2026-12-11 (P.L. 119-103, sec. 106). Unless Congress passes funding by then, DOL's foreign labor processing, including prevailing wage and PERM work, could pause; that is how practitioners read earlier lapses, not something DOL has announced. The text of 656.18(c) has no extension or exception. Once the date passes, the fallback 656.18(d) names is the basic process, with new recruitment. A department that waits for your first-year review in summer 2027 is nearly out of time.

After filing, other clocks take over. As of 2026-10-21, FLAG showed analyst review at January 2026 priority dates and audits at December 2025; analyst determinations issued in August 2026 took 303 calendar days on average. A certified PERM must support an I-140 within 180 calendar days (20 CFR 656.30(b)). H-1B time is capped at six years, and an AC21 section 106(a) extension past that needs a PERM or I-140 filed at least 365 days earlier (8 CFR 214.2(h)(13)(iii)(D)). Our guide to H-1B extensions past six years covers the rest.

Does special handling apply to research-only positions?

Generally no. Section 656.18 covers "college and university teachers," so a research scientist, a research professor with no teaching load or a postdoc normally goes through the basic process or a category without PERM. The regulation sets no minimum share of teaching time, so a mixed appointment is a judgment for the university's immigration counsel.

Two more limits apply. A postdoc is usually fixed-term, and PERM needs permanent, full-time work; a one-year visiting position generally fails the same test, while a renewable lecturer line may still qualify (our reading; counsel decides). A part-time adjunct role is not full-time.

For research-only roles, the routes are basic PERM, the EB-1B outstanding researcher petition, which needs a permanent research position but no PERM, or the EB-2 national interest waiver. If H-1B years are the pressure point, see H-1B vs O-1 for researchers and academics.

Does a university still need a prevailing wage determination?

Yes. Every PERM case, special handling included, needs a determination from DOL's National Processing Center under 20 CFR 656.40, and the offered wage must equal or exceed it (656.10(c)(1)).

For institutions of higher education and their affiliated nonprofits, "the prevailing wage level takes into account the wage levels of employees only at such institutions and organizations in the area of intended employment" (656.40(e)). A determination is valid for 90 days to one year (656.40(c)). Because a special-handling case runs no new recruitment, the ETA-9089 itself must be filed inside that window. FLAG's monthly counts on 2026-09-30 add up to about 49,034 PERM wage requests still pending from April to September receipts (our sum). Our walkthrough of Form ETA-9141 covers the request itself. DOL's prevailing-wage rule (RIN 1205-AC30, published 2026-03-27) is only proposed: it would raise the percentiles behind each wage level, it is not final, and today's levels apply (what the proposal would change).

How a special-handling case moves, step by step

Your university and its counsel run steps 2 to 7. Your job is to ask early and supply documents fast. The university's immigration counsel represents the university; for questions about your own options, such as filing an NIW yourself, you can consult your own immigration attorney.

  1. Ask your department chair or the international faculty office, in writing, whether your position is being processed under 20 CFR 656.18 and which date it treats as your selection date.
  2. Assemble the 656.18(b) file: the hiring official's statement, the committee report, the journal ad, other recruitment sources and the qualifications statement.
  3. Request the prevailing wage on Form ETA-9141 in DOL's FLAG system.
  4. Post the notice of filing at the worksite for 10 consecutive business days, and in in-house media, between 30 and 180 days before filing (20 CFR 656.10(d)).
  5. File Form ETA-9089 in FLAG before the 18-month date and inside the determination's validity period. The filing date becomes your priority date.
  6. Track the case on FLAG's processing-times page and keep the file ready for an audit.
  7. File Form I-140 with USCIS within 180 days of certification. Premium processing is 15 business days for EB-2 (non-NIW) and EB-1B petitions, and the fee for most I-140s is $2,965 (G-1055, edition 10/26/26).
  8. Check the Visa Bulletin and the USCIS filing-chart page before any I-485; for November 2026, USCIS requires the Dates for Filing chart.

The Florida and Texas pauses: what they cover

Public universities in Florida and Texas (status as of 2026-11-01)

  • Florida: the Board of Governors paused new H-1B hires at 12 public universities from 2026-03-02 until at least 2027-01-05, with renewals unaffected, according to Central Florida Public Media.
  • Texas: Gov. Abbott's 2026-01-27 letter bars state agencies with governor-appointed heads and public institutions of higher education from filing "any new petition to sponsor a nonimmigrant worker under the federal H-1B visa program" until 2027-05-31, without written permission from the Texas Workforce Commission. K-12 schools are not covered, according to the Texas Tribune, and private employers are outside the letter.
  • What the sources do not say: both pauses are described as covering new H-1B hiring and petitions. The Texas letter names only H-1B petitions, and nothing we rely on says either pause covers PERM or I-140s. Do not assume either way; ask your university's international office in writing.

Public and nonprofit universities are generally cap-exempt H-1B employers; our guide to cap-exempt universities and research hospitals explains how that works. Moving from OPT to a university H-1B? There is no cap-gap for cap-exempt petitions (8 CFR 214.2(f)(5)(vii)), so take the timing to your DSO before your EAD ends.

Should a professor file EB-1B or NIW instead?

Not necessarily instead. The routes are not exclusive: more than one petition can be filed for the same person. Special handling uses work the university already did; EB-1B and the NIW skip PERM but turn on your record.

Approval rates are approvals divided by approvals plus denials in FY2026 Q3 (April to June 2026), from the USCIS I-140 data. They predate PA-2026-05, in effect since 2026-08-05 and challenged in AAUP v. Mullin, which lets officers deny without a request for evidence when required initial evidence is missing. They are not your odds. A special-handling case typically lands in EB-2 when the job requires an advanced degree. Consular cases always use the Final Action Dates; the December 2026 bulletin was not out as of 2026-11-01, so any December cutoff you see is a forecast.

USCIS's EB-1 page says for EB-1B: "No labor certification is required." Its EB-2 page says NIW applicants "may self-petition." Points to weigh with an attorney:

Frequently asked questions

What is special handling PERM?

Special handling is an optional PERM procedure in 20 CFR 656.18 for college and university teaching jobs. The university relies on the competitive faculty search it already ran, including a national professional journal ad, instead of new ads, and shows you were more qualified than every US applicant. It is in effect and unchanged as of 2026-11-01.

When does the 18-month deadline start?

It runs from the date the university selected you in its competitive search, not from your start date or your H-1B approval. The regulation does not define which document fixes that date, so the university's counsel picks one, often the written offer. It is a deadline to file Form ETA-9089, not a deadline for DOL to decide.

Does special handling apply to research-only positions?

Generally no. Section 656.18 covers college and university teachers, so research-only jobs and postdocs normally use the basic PERM process under 20 CFR 656.17, EB-1B or the EB-2 national interest waiver. Whether a mixed teaching and research job qualifies is a question for the university's immigration counsel.

Does a university still need a prevailing wage determination?

Yes. Every PERM case needs a prevailing wage determination requested on Form ETA-9141, and for universities the wage reflects only similar institutions in the area under 20 CFR 656.40(e). As of 2026-09-30 DOL was issuing PERM determinations for requests received in June 2026, so the wage step usually comes first.

Should a professor file EB-1B instead?

Not necessarily instead. EB-1B skips PERM but needs international recognition, a tenure, tenure-track or permanent research offer, three years of teaching or research and 2 of 6 criteria, and the employer files it. USCIS approved 93.0% of decided EB-1B petitions in FY2026 Q3, before the 2026-08-05 evidence policy. An immigration attorney can weigh your record and birth country.
