When Should a PhD Student Apply for OPT? Defense Date, Submission Date or Graduation
For a PhD student the program end date is a choice, and the one you pick decides when your stipend stops, when OPT can start and whether STEM OPT stays open.

PhD OPT timing comes down to one decision: which date your DSO enters as your I-20 program end date. Once your coursework is done, a doctoral student can use OPT, and schools set that date at one of four points, under their own rules: coursework completion, the defense, final dissertation submission (often called deposit) or the normal end of the final term. Not every school offers all four. You can file for post-completion OPT from 90 days before that date to 60 days after it, and at many schools the same date ends your assistantship and on-campus work. An earlier date means an earlier job start. A later one protects your stipend and your STEM OPT options.
Status line, as of 2026-11-01. The OPT filing windows on the USCIS OPT page are in effect and unchanged. The DHS OPT fee rule ($70,000 for an initial recommendation, $30,000 for each later one, paid by the school) is only proposed; comments close 2026-11-09. SEVP's August CPT broadcasts are in effect as guidance and challenged, with a hearing on 2026-11-06 (check the docket for the outcome after 2026-11-06). The D/S fixed-admission rule has been blocked by a federal court since 2026-09-14; USCIS says it "will proceed under the previous regulatory provisions," so D/S and the 60-day F-1 grace period still apply.
What program end date should a PhD student use for OPT?
There is no single correct program end date for a PhD student. After coursework, depending on your school's rules, it can be set at coursework completion, the defense, final dissertation submission or the end of your last term. Each choice moves your OPT filing window, ends on-campus work on a different day and changes whether you can later request STEM OPT.
The regulation makes the early options possible: under 8 CFR 214.2(f)(10)(ii)(A)(3), a student "in a bachelor's, master's, or doctoral degree program" may have OPT "after completion of all course requirements for the degree (excluding thesis or equivalent)." An all-but-dissertation candidate need not wait for graduation.
Your DSO enters the date in SEVIS, and your department usually weighs in first. Indiana University asks your academic advisor to complete an Academic Advisor Verification e-form; UT Dallas has your department fill out an OPT Recommendation form for its early-start options. Our guide to the I-20 program end date versus your graduation date covers the general rules; this page covers the choice only doctoral students get.
PhD OPT timing: the four end-date options compared
Each option trades job-start speed against stipend, enrollment and STEM OPT. The example dates assume a candidate whose current I-20 ends with the spring 2027 term.
| End date set at | Example date | OPT filing window (90 before to 60 after) | Stipend and on-campus work | STEM OPT later | Main risk |
|---|---|---|---|---|---|
| Coursework completion (all but dissertation) | 2026-12-18 | 2026-09-19 to 2027-02-16 | Usually ends on the new end date | Not until every requirement, including the dissertation, is done | Date cannot be extended once OPT is approved |
| Dissertation defense | 2027-03-05 | 2026-12-05 to 2027-05-04 | Runs to the defense if school and funder allow | Revisions or deposit may still be outstanding; ask your DSO | The defense slips |
| Final submission (deposit) | 2027-04-09 | 2027-01-09 to 2027-06-08 | Runs to deposit if school and funder allow | Requirements met, so available if otherwise eligible (our reading) | Later job start |
| End of final term or conferral | 2027-05-14 | 2027-02-13 to 2027-07-13 | Runs to term end; may require full enrollment | Full eligibility if your degree and employer qualify | Latest start; if you finish early the DSO shortens anyway |
As of 2026-11. Example dates are illustrative (our arithmetic). Windows follow the USCIS OPT page; your school's options, your I-20 and your DSO control.
Ending at coursework completion
This gets you working soonest, and it is the hardest to undo. SEVP's Shorten Program page is blunt: "The shorten program function cannot be cancelled." Once USCIS approves OPT on a shortened doctoral record, the end date cannot be extended for more dissertation time, and you may not request STEM OPT until every academic requirement, including the dissertation, is complete. Temple adds that if your degree is unfinished when OPT ends, you "would have to leave the US to complete your degree remotely," and that a STEM extension requires the degree to be completed and awarded before your first year of OPT runs out.
Money moves too. Penn's doctoral OPT page says your new end date becomes "the last day you are eligible to work on-campus and/or receive a stipend from Penn." At UT Dallas, if OPT starts before the graduating semester ends, you cannot continue the assistantship, and "You will be asked to reimburse UTD for the tuition and student health insurance for that term."
Ending at the defense
This fits when the defense is scheduled and your committee is reliable. UT Dallas, for example, sets the program end date at "the date of your final oral examination, or the date of processing, whichever is later," requires that the exam date already be set, and wants the OPT start date within 60 days after the exam. Revisions and deposit then happen on OPT, which matters because SEVP bars a STEM request while any academic requirement is unmet. Ask your DSO whether your school treats deposit as outstanding.
Ending at final submission (deposit)
Deposit is usually the point at which every academic requirement is met, which makes it the cleanest date for STEM OPT purposes (our reading). The catch is timing: SEVP's OPT guidance for DSOs says DSOs "should verify and, if necessary, shorten the program end date on the Form I-20" before recommending post-completion OPT. Our reading: if you deposit well before the printed term end, expect your DSO to move the end date to match.
Ending at the end of the final term
The default path keeps funding simple longest and gives the latest job start. Buffalo runs fixed paths (June 1, August 31 or February 1 program ends, each with a 60-day OPT start window) and warns that "OPT does not waive Fall/Spring semester Graduate School enrollment requirements." Its August 31 path requires summer enrollment.
Can I apply for OPT before my dissertation defense?
Usually yes, once your coursework is complete. Indiana University tells doctoral students they are "eligible to apply for OPT at any time after completion of your coursework", with a chosen end date that "can be on or before (but no later than) the current Program End Date on your I-20."
There are two routes. Post-completion OPT on a shortened record starts your 12 months and your 90-day unemployment counter. Pre-completion OPT after coursework leaves your end date where it is but draws on the same 12 months; our comparison of pre-completion versus post-completion OPT has the deduction math.
Does my stipend end when my program end date passes?
For assistantships and on-campus jobs, usually yes, but schools differ on the edges. Buffalo says "Your on-campus employment/assistantship must end by your chosen program end date." Indiana University goes further: after the program end date you cannot work "(on- or off-campus, paid or unpaid)" until your OPT card's start date.
Temple is more flexible. If your end date falls during a fall or spring semester and you hold a TA or RA position, its office "can allow you to work in this position through the end of the current semester" if you tell it when you submit your OPT application. With a summer end date, you must stop on that date unless OPT is approved to start the next day.
Fellowships that are not pay for work can follow different rules, so ask your international office and the funder. The tax side is in our guide to PhD stipend taxes for F-1 students.
The income gap: a worked timeline
The filing window is 150 days long (90 before plus 60 after), about the same as 5 months (our arithmetic). On 2026-11-01 the USCIS processing-times tool showed 80% of F-1 student I-765 cases under category (c)(3) completed within 5 months. So even if you file on day one, a case that takes the full 5 months is decided around when your 60-day post-end window closes. Check the live tool before you plan around it.
Take the defense option from the table: end date 2027-03-05, window opening Saturday 2026-12-05. File on Monday 2026-12-07, once your DSO's recommendation is in SEVIS, and five months later is early May 2027. Under a rule like Penn's or Buffalo's, your stipend stops on 2027-03-05 and you cannot work until the EAD's start date, which leaves about two months without school pay (our arithmetic). The gap does not use up unemployment days, which SEVP counts from the actual OPT start date (90 on post-completion OPT, 150 in aggregate with STEM OPT).
Premium processing (Form I-907) for OPT costs $1,780 and targets 30 business days, per the USCIS fee schedule; whether it is worth it depends on that gap and your offer's start date.
How to set your end date and file
- Pull your most recent Form I-20 and confirm the current program end date with your international student office.
- Ask your graduate school which end-date paths it allows and which department form doctoral OPT needs.
- Check your assistantship or fellowship letter with your funding or HR office for the last paid day under each option.
- Request the OPT recommendation through your school's OPT portal, and write down the date your DSO enters it in SEVIS. USCIS must receive your Form I-765 within 30 days of that date.
- File Form I-765 under category (c)(3)(B), online through your USCIS account ($470) or on the 08/21/25 paper edition ($520). Old paper addresses work only if postmarked on or before 2026-11-09, per USCIS's filing-location update.
- Include every piece of required initial evidence. Since 2026-08-05 (in effect, and challenged in court), PA-2026-05 lets USCIS deny an OPT I-765 without an RFE when it is missing; our initial-evidence checklist for OPT walks through it.
- Decide whether to add Form I-907 premium processing, based on the gap between your end date and your job start.
- Tell your DSO when you defend and deposit. If you plan STEM OPT, note that only a STEM I-765 filed before your OPT EAD expires gets the 180-day automatic extension.
Pre-completion OPT as the fallback where CPT is paused
If your school has stopped approving CPT for an industry internship during the dissertation years, pre-completion OPT may still be open, at a price. SEVP's BCM 2608-01 (2026-08-12) allows CPT only "if its absence would make the attainment of a degree an impossibility"; BCM 2608-02 (2026-08-24) adds question-and-answer guidance for DSOs.
MIT paused pending CPT requests (The Tech, 2026-10-01), Rochester has paused new approvals except degree-required training since 2026-08-28, and UC Berkeley paused Course Credit CPT from late August. The broadcasts are challenged in Association of American Universities v. DHS; the preliminary-injunction hearing is 2026-11-06 at 3:00 p.m. (check the docket for the outcome after 2026-11-06), and our tracker of which schools paused CPT follows the case.
What pre-completion OPT costs a PhD student:
- Your 12 months. USCIS says a year of part-time pre-completion OPT reduces post-completion OPT by 6 months, "50% of the previously authorized year", and full-time use is deducted in full. A three-month full-time summer internship leaves nine months.
- Your STEM path from that period. Penn says you "May not apply for the STEM extension from a period of pre-completion OPT."
- Exposure to the proposed fee. The NPRM would charge the school "for any type of OPT," pre-completion included; it is proposed, not in effect.
What it keeps: your end date stays put, and UT Dallas notes pre-completion OPT has no unemployment limit and the I-20 may still be extended. Part-time use is capped at 20 hours a week while school is in session.
How the proposed OPT fee affects PhD timing
As of 2026-11-01 the OPT fee rule is a proposal. If finalized unchanged, it would take effect 60 days after the final rule is published and reach a DSO recommendation "for any type of OPT that is dated on or after the effective date of the final rule." The school is the legal payer and may pass the cost on.
Duke's visa office (2026-10-12) advises students already within the filing window to "apply as soon as possible." For PhD students who used OPT after a US master's, SEVP says "Twelve months of Regular OPT is available for each higher level of study." DHS also considered charging the $70,000 again at each higher degree level and "especially encourages input" on it. Whether someone whose earlier OPT was fee-free would owe $70,000 or $30,000 under the proposal is unresolved (our reading).
How long does OPT take for PhD students in 2026?
The same as for any F-1 student: on 2026-11-01 the USCIS tool showed 80% of (c)(3) cases completed within 5 months. USCIS reported 56,901 post-completion OPT receipts, 47,339 approvals and 70,225 cases pending in FY2026 Q3 (April to June 2026), in its I-765 data file.
Cornell, Johns Hopkins and USC advise against international travel while initial OPT is pending, and Cornell notes that if you are abroad and miss a biometrics appointment, "your case could be delayed or denied." That includes the trip home after your defense. If travel cannot wait, talk to your DSO before you book.
How your end date shapes the H-1B years that follow
An earlier end date starts your OPT clock sooner, but a dissertation still outstanding delays STEM OPT, and STEM OPT is what usually buys extra H-1B registration seasons (our reading). Cap-gap protects only timely cap-subject petitions; a university or other cap-exempt H-1B gets none. FY2028 registration has not been announced, and wage-weighted selection has been in effect since 2026-02-27. Our PhD-to-industry H-1B strategy guide covers where each path leads.
Common mistakes
- Shortening before checking funding. At some schools your end date can end an assistantship mid-semester and trigger a tuition or insurance charge, and once OPT is approved the date cannot be extended for dissertation time.
- Missing the 30-day clock. USCIS must receive the I-765 within 30 days of the DSO's SEVIS entry, even when you are well inside the 90/60 window.
- Misreading weekend rules. Since 2026-10-23, PA-2026-15 rolls a day-counted paper deadline to the next business day; online filings never roll. Our reading: the 30-day and 60-day OPT windows roll on paper, but the STEM OPT "before the EAD expires" date does not. Confirm with your DSO.
- Believing the $70,000 fee is already charged. It is not. The fee is only proposed, and the school, not the student, would be the legal payer (it may pass the cost on).
Frequently asked questions
What program end date should a PhD student use for OPT?
There is no single correct date. Depending on your school, you may end at coursework completion, the defense, final submission or the end of the final term; each choice moves your OPT window (90 days before to 60 days after), your last on-campus workday and your STEM OPT options. Your DSO enters it, usually after your advisor signs off.
Can I apply for OPT before my dissertation defense?
Usually yes, once coursework is complete. A shortened record lets post-completion OPT start before the defense, but the date cannot then be extended and STEM OPT waits until every requirement is done. Pre-completion OPT keeps your end date but uses your 12 months.
Does my stipend end when my program end date passes?
For assistantships and on-campus jobs, usually yes. Penn and Buffalo end on-campus work at the end date; Temple can let a TA or RA role run to the end of a fall or spring semester if you tell its office when you apply for OPT.
Should I use pre-completion OPT while writing my dissertation?
It is a fallback where CPT is paused, but full-time use comes off your 12 months in full (part-time at half rate), and Penn says you cannot apply for STEM OPT from it. The 2026-10-08 fee proposal would cover any type of OPT; it is only proposed, and comments close 2026-11-09.
How long does OPT take for PhD students in 2026?
On 2026-11-01 the USCIS tool showed 80% of (c)(3) I-765 cases completed within 5 months. Premium processing costs $1,780 for a 30-business-day target. Check the live tool before planning a start date.

Frequently asked questions
What program end date should a PhD student use for OPT?
There is no single correct date. Once coursework is done, depending on the school, a doctoral candidate's I-20 program end date can be set at coursework completion, the defense, final dissertation submission or the end of the final term, and each choice moves the OPT filing window (90 days before to 60 days after the end date), the last day of on-campus work and your STEM OPT options. Your DSO enters the date in SEVIS and your advisor usually signs off, so settle it with both before anything is entered.
Can I apply for OPT before my dissertation defense?
Usually yes, if all coursework is complete. Your DSO can shorten your program end date so post-completion OPT starts before the defense, but SEVP says that date cannot then be extended for more dissertation time and you cannot request STEM OPT until every requirement, including the dissertation, is done. Pre-completion OPT after coursework is a second route that keeps your end date but uses part of your 12 months.
Does my stipend end when my program end date passes?
For assistantships and on-campus jobs, usually yes. Penn says the new program end date becomes the last day you can work on campus or receive a stipend, and Buffalo says an assistantship must end by the chosen end date, while Temple lets some TA and RA appointments run to the end of a fall or spring semester if you tell its office when you submit the OPT application. Confirm with your international office and your funding source, because each school sets its own practice.
Should I use pre-completion OPT while writing my dissertation?
It can be the fallback where your school has paused CPT, but it has a cost. Full-time pre-completion OPT comes off your 12 months month for month and part-time at half rate, and Penn says you cannot apply for the STEM extension from a period of pre-completion OPT. The DHS fee proposal of 2026-10-08 would also cover any type of OPT, though it is only proposed and comments close 2026-11-09.
How long does OPT take for PhD students in 2026?
PhD students file the same Form I-765 under category (c)(3) as other F-1 students. On 2026-11-01 the USCIS processing-times tool showed 80% of these cases completed within 5 months, and premium processing costs $1,780 for a 30-business-day target. Processing times change, so check the live tool before you build a start date around them.
