Starting a PhD or Another Degree While on OPT: What Ends, What Transfers and How to Time It

Your EAD may run into next summer, but the day a new degree program takes over your SEVIS record, your OPT stops. Here is how to time the switch.

Yes, you can start a PhD while on OPT, or any other new degree, but the new program ends your OPT. As of November 1, 2026, the F-1 rule in effect says OPT is "automatically terminated" when you transfer to another school or begin study at another educational level, whatever end date your EAD card shows. In SEVIS, a move to a new school ends OPT on the transfer release date, and a move up a level at the same school ends it when the new program is registered. Finish the switch before your OPT and 60-day grace period run out. A higher-level degree earns a fresh 12 months of OPT when you complete it.

Status as of 2026-11-01. Blocked: the duration-of-status (D/S) final rule, by a federal court since 2026-09-14 (summary judgment briefed, DHS's appeal pending), so transfers and changes of level follow the previous regulations and the 60-day F-1 grace period applies. DHS's First Circuit opening brief (No. 26-2112) is due 2026-11-09 (check the docket for later filings and any ruling). Proposed: OPT fees paid by the school; comments close 2026-11-09. In effect: wage-weighted H-1B selection. Not announced: FY2028 H-1B registration.

Does my OPT end when I start a PhD?

Yes. Post-completion OPT, including STEM OPT, ends automatically when your SEVIS record transfers to a new school or you begin study at another educational level. At a new school it ends on the transfer release date; at the same school, when the new program is registered. A later EAD end date does not override this, and leftover OPT is forfeited.

The rule is one sentence in 8 CFR 214.2(f)(10)(ii)(B), quoted here from the version in force before the D/S rule's scheduled start (eCFR, 8 CFR 214.2 as of 2026-09-01):

"Authorization to engage in optional practical training employment is automatically terminated when the student transfers to another school or begins study at another educational level."

SEVP's job aid on OPT dates shows how that lands in your record: the OPT end date is "Shortened to the Transfer Release date" for a transfer and "Shortened to Registration date" for a change of educational level (SEVIS OPT Dates Job Aid). Ohio State's Office of International Affairs words the same-school case as "your OPT will automatically end on the new program start date" (Ohio State OIA). Either way, ask your DSO which date SEVIS will show and treat it as your last day of work.

Why the September version: eCFR's "current" page now displays the blocked D/S rule's text. USCIS says that while the court order stands, "USCIS will proceed under the previous regulatory provisions" (USCIS, Form I-539).

Common misconception, then correction. "My EAD runs to December 2027, so I can keep working until then even though my PhD starts in August 2027." The card's end date is the latest your OPT can last, not a promise. OPT work after the release or registration date is unauthorized employment, a status violation rather than a paperwork slip.

Starting a PhD while on OPT: transfer or change of level?

A degree at a different school is a SEVIS transfer. A higher degree at the school that recommended your OPT is a change of education level. Under 8 CFR 214.2(f)(5)(ii), a change of level keeps you in status when it follows the transfer procedures, so the deadlines are nearly identical.

The five-month limit and the 15-day reporting rule are in 8 CFR 214.2(f)(8). SEVP's May 2025 guidance tells DSOs the change-of-level process "must be completed before the end of the student's 60-day grace period" (Study in the States).

Can I take classes while on OPT?

Some, but not a new degree program. Recreational or avocational classes, such as a language course taken for interest, are generally treated as compatible with OPT. Schools differ on credit-bearing courses tied to your field, so ask your DSO before you register for anything for credit.

Temple's international office, quoting USCIS, says "Recreational and avocational classes are permissible" (Temple ISSS). MIT's answer is a flat "No" outside that exception: non-degree coursework related to your field does not qualify, and MIT applies the same answer to coursework in a new program at the same degree level (MIT ISO). Watch for the "test drive": a spring course inside the PhD you join in the fall can look like beginning study at another level.

How do I transfer my SEVIS record from OPT to a new program?

You request it through the school that holds your OPT record, pick a release date, then report to the new school when classes begin. The sequence must finish while you are in status, during OPT or the 60-day grace period after it.

  1. Confirm the new program's degree level and exact program start date with the admitting school's international office.
  2. Notify the DSO at the school that recommended your OPT, in writing, and send the admission letter. For a higher degree at the same school, request a change-of-level I-20 instead.
  3. Agree on a transfer release date in SEVIS. Treat it as your last day of OPT work.
  4. Report the end of your OPT job to your DSO. ICE's practical-training page says you "must report changes in name, address, employer and loss of employment to your DSO within 10 days of any change" (ICE, Practical Training).
  5. Collect the new school's transfer I-20 after the release date and keep it with your passport and old I-20s.
  6. Check in with the new school's DSO within 15 days of the program start date and enroll full time.

A worked timeline for a fall 2027 PhD start

Say your post-completion OPT EAD runs from 2026-07-15 to 2027-07-14, and a different university admits you to a PhD starting 2027-08-23.

The table assumes the rules that apply today. If a court lets the blocked D/S rule take effect before your switch, the grace period and transfer steps would change, so confirm every date with both DSOs in spring 2027.

The release date is a paycheck decision. If the new school asks for your record on 2027-06-01 to issue an I-20 early, you lose about six weeks of OPT pay. Ask whether it can wait until your last planned workday, and get the date from both DSOs in writing.

Staying at the same school means no release. Your DSO processes a change of level; Ohio State, for example, says you "must obtain the new I-20 within the 60-day grace period after your OPT end date."

Will I get new OPT after the PhD?

Yes, if the PhD is a higher educational level than the degree your current OPT came from. The regulation says a student "becomes eligible for another 12 months of practical training when they change to a higher educational level," and SEVP puts it plainly: "You can apply for 12 months of OPT at each education level" (ICE, Practical Training).

SEVP's 2010 guidance, answering a question about OPT split between two degrees, says the unemployment allowance starts over: "For each new period of post-completion OPT, the student will have the full 90-day period of unemployment" (SEVP Policy Guidance 1004-03). The limits today are 90 days on OPT and 150 in aggregate with STEM OPT (SEVIS Help Hub).

The proposed OPT fee is the open variable. Under the NPRM published 2026-10-08, the school would pay $70,000 before an initial OPT recommendation and $30,000 before each later one and could pass the cost on; recommendations dated before a final rule's effective date would be exempt (Federal Register). So the proposal would not touch the OPT you hold now; it would bear on the OPT request at the end of your PhD. The NPRM says the fee would apply to "a subsequent request for OPT" made after a final rule, but in our reading it does not settle whether a student whose first OPT was fee-free would trigger the $70,000 or the $30,000 charge. DHS also "considered ... having the one-time initial fee of $70,000 apply again to any initial period of OPT following the F-1 student's change to a higher educational level" and "especially encourages input" on it (91 FR 64576-77). That is an alternative inside a proposal, not a rule. Comments close 2026-11-09 at 11:59 p.m. ET, with more than 4,700 filed as of 2026-11-01; once they close, the rule stays a proposal unless DHS publishes a final rule. Our explainer on whether the proposed OPT fee could be charged twice works through the master's-then-PhD case. If you are finishing a degree now, Duke advised on 2026-10-12 that students within the filing window should "apply as soon as possible" (Duke Visa Services).

Should I register for the H-1B lottery before starting a PhD?

Your employer registers, not you, and as of 2026-11-01 USCIS has not announced FY2028 registration; its registration page still shows the FY2027 cycle (USCIS, H-1B registration). March 2027 is an expectation from past cycles, and 8 CFR 214.2(h)(8)(iii)(A)(3) requires at least 30 days' notice. Selection has been wage-weighted since 2026-02-27; our guide to what is expected for FY2028 H-1B registration covers the lottery itself. The real question is whether you would take an H-1B starting October 1, 2027, weeks into a fall PhD. In our reading of the rules, the collision works like this:

The realistic choices are to defer the PhD, let the H-1B go, or ask an immigration attorney and the program whether any arrangement allows both; your DSO speaks to the F-1 side only. Ask about deferral early, since each program sets its own deferral policy and admissions have tightened: according to the Association of American Universities, fall 2026 PhD admissions at its members fell 15% (AAU). Later, universities can file cap-exempt H-1Bs outside the lottery, though those get no cap-gap; our look at how a PhD compares with a master's for H-1B sponsorship odds covers that route. A draft rule titled "Reforming the H-1B Nonimmigrant Visa Classification Program" (RIN 1615-AD00) has been under OIRA review since 2026-08-24; its agenda abstract lists "revising eligibility for cap exemptions," and no text is public (Reginfo).

Frequently asked questions

Does my OPT end when I start a PhD?

Yes. Under 8 CFR 214.2(f)(10)(ii)(B), OPT is automatically terminated when you transfer to another school or begin study at another educational level, whatever end date your EAD shows. In SEVIS a transfer ends OPT on the transfer release date and a same-school change of level ends it on the registration date. As of 2026-11-01 these previous rules apply because the D/S rule is blocked.

Can I take classes while on OPT?

Schools generally allow recreational or avocational classes taken for interest. Starting a new degree program ends OPT, and schools differ on credit-bearing courses tied to your field, so ask your DSO before you register for anything for credit.

How do I transfer my SEVIS record from OPT to a new program?

Give the DSO at the school that recommended your OPT your admission letter and agree on a release date, which becomes your last day of OPT work. Then contact the new school's DSO within 15 days of the program start date. The release must happen before your OPT and 60-day grace period end, and classes must begin within five months.

Will I get new OPT after the PhD?

Yes, if the PhD is a higher educational level than the degree behind your current OPT; a second master's does not qualify. A STEM PhD can support a STEM OPT extension, even a second one, since the rule allows two in a lifetime. A proposed OPT fee rule, with comments closing 2026-11-09, asks whether to charge the $70,000 initial fee again after a move up a level; it is only a proposal.

Should I register for the H-1B lottery before starting a PhD?

Your employer registers, not you, and FY2028 registration has not been announced as of 2026-11-01; March 2027 is only an expectation. A selected FY2028 cap case could start no earlier than October 1, 2027, after a fall 2027 PhD begins, so map that collision with an immigration attorney before your employer registers.

How we checked this: we read 8 CFR 214.2(f) as in force on 2026-09-01 and compared it with the current eCFR text, SEVP's 2010 OPT guidance and OPT dates job aid, the USCIS and ICE pages above, the OPT fee NPRM, the D/S docket and the Ohio State, MIT, Temple, Duke and BU pages, as of November 1, 2026.

This is general information, not legal or tax advice. Your own I-20, EAD, I-94 and SEVIS record govern; confirm dates with your DSO for anything F-1 or OPT, and with a licensed immigration attorney before any H-1B or status decision.

Starting a PhD while still job hunting on OPT means running two clocks at once. If you want help focusing your remaining OPT months on employers that sponsor, F1Jobs works with international candidates on exactly that.
