TN Visa Renewal: Border vs USCIS Extension, How Many Times You Can Renew, and When to File

Your TN can be renewed again and again, up to three years at a time, but the route you pick decides whether you travel, wait months, or face a same-day answer at the booth.

Part of our guide to the TN visa.

TN visa renewal works one of two ways. Your employer files Form I-129 with USCIS while you stay in the United States, or you apply for a fresh TN admission at the border: Canadians at a port of entry or preclearance, Mexicans only with a valid TN visa. Each grant runs up to three years, and 8 CFR 214.6, in effect as of November 1, 2026, sets "no specific limit on the total period of time" in TN status. Your deadline is the "admit until" date on your I-94, not your visa stamp.

Status line (as of 2026-11-01). In effect: TN rules, unchanged after the July 2026 USMCA joint review left the agreement "not renewed" but in force. Scheduled: from 2026-11-09, USCIS takes only the 09/09/26 edition of Form I-129, and old mailing addresses work only if postmarked on or before that date. Proposed, not in effect: ending the worker 60-day grace period and removing USCIS deference to prior approvals (see the table below).

How TN visa renewal works in 2026

A TN renewal is a new grant of up to three years in TN status for the same professional job. Inside the United States, your employer files Form I-129 with USCIS before your I-94 expires. If you travel instead, a Canadian applies to CBP at a port of entry or preclearance, and a Mexican presents a valid TN visa.

USCIS decides an extension of stay under 214.6(h)(1); CBP decides readmission at the border under 214.6(h)(2). Eligibility and first applications are in our complete TN visa guide for Canadians and Mexicans. A new employer is a separate filing, covered in changing employers on a TN.

Your I-94 end date is the real deadline, not the visa stamp

Your stay ends on the "admit until" date of your most recent I-94, which you can pull from CBP's I-94 website after every entry (how to download your most recent I-94). Canadians are visa-exempt for TN, so the I-94 is their only clock. For a Mexican worker the visa is a travel document: it can expire while the I-94 runs, and a valid visa never extends an I-94 that has ended.

Is it better to renew TN at the border or with USCIS?

It depends on your citizenship, whether you plan to leave the US, and how close your I-94 date is.

How Canadians renew TN at the border

Under 214.6(d)(2) and (h)(2), a Canadian "who has not violated such status" may apply at a port of entry, an international airport or a preclearance station "prior to the expiration date of the previous period of admission, for a new three-year period of admission." CBP's TN and L-1 page for Canadians confirms that "Canadian citizens can continue to apply for TN and L classifications at U.S. ports of entry or U.S. preclearance facilities." Bring:

State's online-presence review of TN and TD visa applicants (since 2026-10-01) "does not apply to Canadian citizens who do not apply for U.S. entry visa stamps," per MIT's international office. The real risk is a refusal: you are in Canada and your US job stops until you are admitted. The I-129 instructions also let "citizens of Canada who are outside the United States" file for TN and then apply to CBP with the approval, but on USCIS time.

Can Mexican citizens renew TN at the border?

Only with a valid, unexpired TN visa. The USCIS TN page says "you must obtain a visa to enter the United States as a TN nonimmigrant," and 214.6(h)(2) requires Mexican citizens to present "a valid, unexpired TN nonimmigrant visa when applying for readmission." Without one, the choice is a new visa or a USCIS extension. For a new visa, as of 2026-11-01:

Because the visa matters only for travel, a Mexican TN worker with no trip planned can extend through USCIS and get a new visa before the next trip abroad.

How a USCIS TN extension works

Your employer files before your I-94 ends, and you must be "physically present in the United States at the time of the filing" (214.6(h)(1)(ii)). A typical filing:

  1. Check your I-94 "admit until" date; it sets every deadline.
  2. Confirm the job is the same USMCA profession and duties. If the employer, entity or role changed, ask the employer's immigration attorney whether this is still an extension.
  3. Prepare the 09/09/26 edition of Form I-129 (the only one USCIS accepts from 2026-11-09) with the Trade Agreement Supplement, marked TN1 (Canada) or TN2 (Mexico).
  4. Attach what the I-129 instructions ask for in a TN extension: evidence "such as a letter, describing the continuing employment," and of "continued valid licensing (if required by the profession and/or the state)."
  5. Pay the G-1055 fees: $1,015 on paper ($510 small employer or nonprofit) plus the Asylum Program Fee ($600, $300 or $0). G-1055 also lists $965 online, but TN is not on the I-129 PDF-upload list, so expect paper.
  6. Add Form I-907 and $2,965 for optional premium processing (USCIS action within 15 business days).
  7. Mail it to the current address on the I-129 page (changed 2026-10-07; old addresses accepted only if postmarked on or before 2026-11-09).
  8. File Form I-539 for a TD spouse or children in the US ($470 paper, $420 online); see TD status for TN dependents.

Working while it is pending. For a timely filing, 8 CFR 274a.12(b)(20) lets you "continue employment with the same employer for a period not to exceed 240 days" after your stay expires, ending automatically on notice of a denial. A new employer is different: "Employment with a different or with an additional employer is not authorized prior to Department approval of the request" (214.6(i)(1)).

Travelling while it is pending. If you must leave, 214.6(h)(1)(ii) says "the petitioner may request that USCIS notify the consular office" (or, for a visa-exempt Canadian, a designated port of entry) of the approval. In our reading, you then return on that approval instead of being extended inside the US. Ask the employer's attorney before you book. File complete, too: under PA-2026-05 (in effect since 2026-08-05, challenged in court), officers may deny without a request for evidence (RFE) when required initial evidence is missing.

When to file a TN renewal: a worked timeline

Ana, a Canadian TN engineer, has an I-94 ending 2027-03-31 and the same job continuing.

DateStepWhy it matters
2026-10-01About the earliest filing dateThe I-129 instructions: a petition generally "may not be filed more than 6 months prior to the date employment is scheduled to begin" (our reading, for a period starting 2027-04-01)
2026-11-09Edition and address cutoff09/09/26 edition only from this date; old addresses only if postmarked on or before it
2026-11-16Employer mails the I-129Timely, because the I-94 has not ended
about 2027-03-314.5 months after filing80% of TN I-129s finished within 4.5 months in the 2026-11-01 snapshot, so a decision may land right at her I-94 date
2027-03-31I-94 endsIf still pending, she keeps working for the same employer under the 240-day rule
late November 2027240 days run outOur arithmetic; ends sooner on a denial

Row four is the catch: at the 80% mark, a mid-November filing can still be pending on her I-94 date. Filing nearer the six-month point, or adding premium processing, makes that less likely; if the case is still open, the 240-day rule covers the same employer only. Check the live USCIS processing-times tool when you plan. Instead of a USCIS filing, Ana could present a new letter at preclearance when flying back from Canada in February 2027 and, if admitted, get a new I-94 that day.

Luis, a Mexican TN analyst, has a visa expiring 2026-12-20 and an I-94 running to 2027-06-30. His I-94 sets his stay, so his employer can file the extension before June with no travel, and he gets a new visa before his next trip abroad.

How many times can you renew a TN visa?

There is no cap. The rule in effect, 8 CFR 214.6(h)(1)(iv), says:

"There is no specific limit on the total period of time an alien may be in TN status provided the alien continues to be engaged in TN business activities for a U.S. employer or entity at a professional level, and otherwise continues to properly maintain TN nonimmigrant status."

The limit is a test, not a number. Each renewal re-asks whether your stay is temporary: under 214.6(b), "A temporary period has a reasonable, finite end that does not equate to permanent residence," and your work assignment must "end at a predictable time." In USCIS's I-129 data for FY2026 Q1-Q3 (October 2025 to June 2026), TN petitions, initial and extensions together, had a 94.9% approval rate (approvals divided by approvals plus denials) and an RFE in 13.0% of completions. That excludes border decisions and predates PA-2026-05.

Common misconception: "TN must be renewed every year."

Correction (as of 2026-11-01): each TN admission and each USCIS extension runs up to three years. The 2026-07-01 USMCA joint review left the agreement "not renewed" but in force, per the USTR statement, and TN rules did not change. See whether the TN visa will end after the USMCA review for the 2036 outer date.

Does a pending green card affect a TN renewal?

It can, on every route. TN is not a dual intent status (see TN dual intent and the 90-day rule), so the officer at the booth, the consulate or USCIS may weigh a pending PERM, I-140 or I-485 when deciding whether your stay is temporary.

Frequently asked questions

How do I renew my TN status?

Your US employer can file Form I-129 with USCIS while you are in the United States and before your I-94 expires, or you can apply for a new admission of up to three years at the border. Canadians can apply at a port of entry, airport or US preclearance station, and Mexicans need a valid TN visa. Both routes are open as of November 1, 2026, under 8 CFR 214.6.

How many times can a TN be renewed?

There is no fixed number. 8 CFR 214.6 allows each TN admission or USCIS extension for up to three years and says there is no specific limit on the total period, as long as you keep doing TN work at a professional level and maintain status. Each renewal is still a fresh decision on whether your stay is temporary.

Is it better to renew TN at the border or with USCIS?

It depends on your citizenship, travel plans and how close your I-94 date is. A Canadian at the border gets a same-day decision but is outside the US if refused. A USCIS extension needs no travel, and 80% of TN cases were finished within 4.5 months in the USCIS tool read November 1, 2026, while premium processing at $2,965 brings USCIS action within 15 business days.

Can Mexican citizens renew TN at the border?

Only with a valid, unexpired TN visa. Under 8 CFR 214.6, Mexican citizens must present a valid passport and TN visa to be readmitted. If the visa has expired, the options are a new visa from a US consulate, usually with an in-person interview under State Department rules in effect since 2025-10-01, or a Form I-129 extension with USCIS that needs no travel.

Does a pending green card affect a TN renewal?

It can. TN is not a dual intent status, so a pending PERM, I-140 or I-485 is a fact a CBP, consular or USCIS officer may weigh when deciding whether your stay is temporary. Leaving the US with an I-485 pending and no advance parole is generally treated as abandoning it under 8 CFR 245.2, so talk to a licensed immigration attorney before you travel or renew.

How we checked this: on 2026-11-01 we read 8 CFR 214.6, 274a.12 and 245.2 on eCFR, the 09/09/26 I-129 instructions, G-1055 edition 10/26/26, PA-2026-05, PM-602-0199, the TN sheet of the USCIS FY2026 Q1-Q3 I-129 data, and the USCIS and CBP pages above. State Department details come from the travel.state.gov pages listed above as published through that date, with the MIT, Mintz and BU notices cited where used.

This is general information, not legal or tax advice; your own I-94 and approval notices govern, and a licensed immigration attorney should review your specific renewal.

If your renewal is tied to a job change, or you are a Canadian or Mexican graduate lining up a role that fits a USMCA profession before your OPT or I-94 runs out, F1Jobs can help you plan that search.
