ASU H-1B Sponsorship and Tempe's Job Market: Campus Roles, GoDaddy and the East Valley Chip Employers
ASU can sponsor you without the lottery, while GoDaddy and the Chandler chip employers cannot, and that one difference decides how you spend your OPT clock.

Part of our guide to H-1B jobs by state and city.
Yes, ASU sponsors H-1B visas, and it does so outside the lottery. As of November 1, 2026, ASU H-1B sponsorship works like this: the International Students and Scholars Center (ISSC) files petitions for teaching and research positions that ASU departments request, and coordinates staff cases that outside legal counsel then handles. As a university, ASU is cap-exempt, so it can file any time of year with no registration and no lottery. The catch for ASU graduates on OPT is that a cap-exempt petition gets no cap-gap protection. Private Tempe sponsors such as GoDaddy and Align Technology, and the Chandler chip employers, are cap-subject and go through the lottery.
Status as of 2026-11-01
- ASU's cap exemption: in effect under 8 CFR 214.2(h)(8)(iii)(F). "Reforming the H-1B Nonimmigrant Visa Classification Program" (RIN 1615-AD00), an unpublished draft, has been under OIRA review since 2026-08-24; its agenda abstract mentions "revising eligibility for cap exemptions," but no text is public and nothing has changed.
- Cap-gap for cap-exempt petitions: not available. It covers only cap-subject petitions.
- FY2028 H-1B registration: not announced. USCIS must give at least 30 days' notice; March 2027 is an expectation only.
- E-Verify: in effect. Its federal authority runs with the stopgap funding law through 2026-12-11; Arizona separately requires every employer to use it.
- OPT unemployment limits: in effect, unchanged at 90 days, or 150 in total with STEM OPT. The F-1 60-day grace period still applies: the duration-of-status rule has been blocked by a federal court since 2026-09-14, summary judgment is briefed, and DHS's appeal is pending.
ASU H-1B sponsorship: the short answer
ASU H-1B sponsorship starts with the hiring department, which submits an H-1B request; ISSC files teaching and research petitions, and outside counsel handles staff cases. ASU is cap-exempt, so it can file year-round with no lottery, but the petition gets no cap-gap protection, so its timing has to fit your OPT end date.
So a campus job and a GoDaddy or fab job can use the same degree yet run on different visa clocks. This guide takes the campus-to-job view; for the wider metro, see our Phoenix H-1B jobs guide.
Does ASU sponsor H-1B for staff positions?
Yes, on a separate track. ASU's ISSC H-1B page says ISSC "files H-1B petitions for teaching and research positions" and "coordinates the H-1B process for university staff positions," which outside legal counsel then handles. In practice:
- The department decides, not you and not ISSC. "The H-1B process begins once the ASU sponsoring department submits a complete and accurate H-1B request." Ask the hiring manager whether the position is approved for sponsorship before you accept.
- The department pays the filing fees. ISSC says departments pay the I-129 fees, and optional premium processing may be paid by the department or the beneficiary. The premium fee for an H-1B petition has been $2,965 since 2026-03-01 (USCIS fee schedule), for action within 15 business days (USCIS premium processing page).
- The start date sets the filing window. ISSC "can file an H-1B petition with the USCIS up to six months prior to the requested start date," and says it "cannot guarantee an exact employment start date."
- Staff roles still need a specialty-occupation fit, a job that normally requires a degree in a specific field. Outside counsel assesses that; USCIS decides it.
Separately, on 2026-10-09 DOL's Inspector General said it had subpoenaed nine universities, ASU among them, over "alleged misuse and misclassification within J-1 visa programs" (DOL OIG release). That concerns J-1 programs, not H-1B filing, and no findings had been published as of 2026-10-28.
Is Arizona State University cap-exempt?
Yes. ISSC puts it plainly: "As an institute of higher education and research, ASU is exempt from this cap." The governing regulation, 8 CFR 214.2(h)(8)(iii)(F), covers institutions of higher education, qualifying affiliated nonprofits and nonprofit or government research organizations. That changes three things for you:
- No registration or lottery. ASU can file whenever a department has a position and a start date.
- No cap-gap. Cap-gap carries F-1 status and OPT work to April 1 of the fiscal year requested, or the petition start date if earlier, but only for a timely, cap-subject change-of-status petition (USCIS cap-gap page). ISSC's cap-gap page says: "The Cap-Gap is not available for F-1 students whose H-1B application has been filed as Consular Processing or is Cap Exempt." Our explainer on why cap-gap does not cover a university H-1B walks through the timing.
- No cap count. You can add a cap-subject concurrent job while ASU employment continues, but if the ASU job ends, USCIS "may revoke" the concurrent petition.
Common misconception, then correction. You will read that once a university sponsors you, you can move to any employer without the lottery. Under the current rule, a cap-exempt approval does not count you against the cap, so leaving ASU for GoDaddy or a fab is cap-subject unless you were already counted in your current six-year period.
An ASU-affiliated nonprofit can also be cap-exempt through a written affiliation agreement where "a fundamental activity" supports the university's mission; our guide to cap-exempt employer types, from universities to research nonprofits covers how to spot them.
H-1B jobs in Arizona near ASU: sponsors at a glance
H-1B petition decisions in the USCIS H-1B Employer Data Hub extract this site uses, FY2024 through FY2026 (FY2026 partial), as of November 2026. Counts are USCIS's first decisions (approvals plus denials) on new and continuing employment; city is the employer's mailing address.
| Employer | City in the Hub | Decisions, FY2024-FY2026 | First H-1B | What it means on OPT |
|---|---|---|---|---|
| Arizona State University | Tempe | 358 | Cap-exempt | Year-round filing, no cap-gap |
| GoDaddy | Tempe | 216 | Cap-subject | Lottery, then cap-gap if selected |
| Align Technology | Tempe | 120 | Cap-subject | Lottery, then cap-gap if selected |
| Intel | Chandler | 4,982 | Cap-subject | Lottery; STEM OPT buys more attempts |
| ASML (US LP and US LLC) | Chandler | 592 + 171 | Cap-subject | Lottery; check which entity hires you |
| Microchip Technology | Chandler | 242 | Cap-subject | Lottery |
| TSMC Arizona | Phoenix | 206 | Cap-subject | Lottery |
The Arizona sponsor hub lists 69 employers with 10,527 decisions over the same window, and the Phoenix page covers employers addressed in the city itself. Read the numbers with care:
- Decisions are not hires. Totals include continuing employment, such as extensions and amendments. Each company page splits out initial decisions (new employment, where a first H-1B after F-1 is counted), the closer signal for a new graduate.
- The city is not the job site. USCIS's guide to the Data Hub warns that the state "is not necessarily the beneficiary(ies) work location."
- Three years are not one. FY2026 is partial here; the live USCIS H-1B Employer Data Hub now says it covers through FY2026 quarter 4.
Which Tempe companies sponsor H-1B?
The three largest Tempe-addressed petitioners are ASU, GoDaddy and Align Technology. For a new ASU graduate, GoDaddy and Align are cap-subject: OPT, then an employer registration, then a change-of-status petition with cap-gap if you are selected. STEM OPT, if your degree qualifies, gives you more registration seasons.
Two facts shape your odds. Wage-weighted selection has been in effect since 2026-02-27: a Level IV registration gets four entries and a Level I registration one. And the FY2027 cap was reached on 2026-07-17 with no second selection.
When you search jobs in Tempe, AZ, read each posting's sponsorship language, then confirm with the recruiter. Most postings say nothing: one vendor's read of 2,718 engineering roles at 136 companies found 88.1% silent on sponsorship (Match.dev, read 2026-10-13; a single vendor's sample). Silence is not a no, so ask early and in writing.
Are Chandler semiconductor jobs open to OPT students?
Many are, but three filters decide whether a specific role works for you.
- STEM OPT requirements. For the 24-month extension, the employer must "Remain a participant in good standing with E-Verify, as determined by USCIS" and sign Form I-983 (USCIS STEM OPT page). You can file the STEM I-765 "up to 90 days before your current OPT employment authorization expires," and a timely filing still gets the 180-day automatic extension, which the 2026-10-14 EAD rule left untouched.
- Export controls. Some fab, process and equipment roles involve controlled technology, and applications may ask whether you are a "US person." Answer honestly; our guide to the US-person export-control question explains why it differs from a sponsorship question.
- The lottery. Intel, ASML, Microchip and TSMC Arizona are cap-subject for a first H-1B. Under weighted selection the wage level on the registration matters, so ask where the role sits. Our overview of semiconductor H-1B hiring after the CHIPS Act covers role types and timelines.
Does Arizona require E-Verify for all employers?
Yes. Under A.R.S. 23-214(A), after December 31, 2007, "every employer, after hiring an employee, shall verify the employment eligibility of the employee through the e-verify program" (Arizona Revised Statutes 23-214).
- E-Verify is the norm in Tempe. Enrollment is a STEM OPT requirement, not a condition of 12-month OPT, but Arizona law means your employer should create an E-Verify case for you at hire anyway.
- State-law compliance is not proof for STEM OPT. The E-Verify Employer Search warns that a listing "does not necessarily mean that all of the hiring sites are enrolled in E-Verify." Ask HR for the company ID that goes on your I-765 and I-983.
- A federal outage is possible. E-Verify's authority runs with the stopgap law through 2026-12-11 (CRS report R49353), so it lapses unless Congress passes funding by then. In the 2025 shutdown it went down on 2025-10-01 and came back late on 2025-10-07, according to Miller Mayer. By precedent, a lapse could also pause DOL's processing of the labor condition applications every H-1B petition needs. See our guide to what an E-Verify outage would mean for STEM OPT hires.
Worked timeline: an ASU lab offer vs a Chandler fab offer
Say you hold an ASU master's in electrical engineering (a STEM degree), your OPT EAD runs from 2026-07-01 to 2027-06-30, and you have two offers: an ASU lab job whose department will request a cap-exempt H-1B for a 2027-07-01 start, and a process-engineer job at a Chandler chip employer that sponsors through the lottery.
Worked example, as of 2026-11-01. Dates other than the rule-based ones are illustrative.
| Date | ASU lab path (cap-exempt) | Chandler fab path (cap-subject) |
|---|---|---|
| Nov-Dec 2026 | Work on OPT; department sends the H-1B request to ISSC | Work on OPT; employer plans for FY2028 registration |
| 2026-12-11 | Stopgap funding ends unless Congress passes funding; E-Verify lapses with it, and LCA processing could pause | Same E-Verify and LCA risk |
| 2027-01-01 | Earliest filing date, six months before the start | No filing yet |
| March 2027 (expected, not announced) | Not relevant | FY2028 registration, if USCIS announces it with 30 days' notice |
| 2027-04-01 | Earliest STEM OPT I-765 filing (90 days before 2027-06-30), a fallback | Earliest STEM OPT I-765 filing; essential if not selected |
| 2027-06-30 | OPT EAD ends; no cap-gap, so a still-pending petition means a work gap unless a timely STEM OPT I-765 is pending | If selected and a change-of-status petition was filed, cap-gap carries status and work to the start date |
| 2027-07-01 and 2027-10-01 | ASU H-1B can start 07-01 if approved | FY2028 H-1B can start 10-01 |
The lab path is a processing-time problem, which a department can manage with an earlier start date or premium processing. The fab path is a lottery-odds problem, shaped by wage level and STEM OPT runway. Go over these dates with ISSC, whose DSOs handle OPT and STEM OPT, and with the employer's immigration attorney for the petition itself.
How to check whether a Tempe or East Valley employer will sponsor you
- Look up the exact petitioning entity in the USCIS H-1B Employer Data Hub, or on its company page here, and compare initial with continuing decisions.
- Search the entity and your hiring site in the E-Verify Employer Search, especially if you will need STEM OPT.
- Check DOL's LCA disclosure files on the OFLC performance data page for the job title and wage level; the latest run through FY2026 Q3 (2026-06-30).
- Ask the hiring manager, or at ASU the hiring department, whether the position is approved for H-1B sponsorship and whether it would be filed cap-exempt or cap-subject.
- Confirm your OPT end date and unemployment days with ASU ISSC; the SEVIS Help Hub explains how days are counted.
- Schedule a call with the employer's immigration attorney about filing dates against your EAD end date before you sign.
ASU OPT in November 2026: three more facts
- Fewer F-1 records in Arizona. Arizona's active SEVIS records fell 11.0% from October 2025 to October 2026, against 7.1% nationally (our sums of DHS tables; active records, not enrollment), per the October 2026 SEVIS data.
- The OPT fee is still a proposal. DHS's OPT fee rule is proposed; comments close 2026-11-09 and no final rule exists. The school, not the student, would be the legal payer ($70,000 before an initial OPT recommendation, $30,000 before each later one, STEM OPT included), though schools could pass the cost on. It would reach only DSO recommendations dated 60 or more days after a final rule.
- The $100,000 H-1B payment: in effect on paper, blocked in practice. Proclamation 11069 runs to 2027-09-21, but courts vacated the agency policies that implement it (USCIS I-129 page), and both cases are on appeal. Even if collection resumed, a change of status USCIS grants inside the US was never covered (a denied one, or a consular-notification petition, would be). CRS reported on 2026-10-14 that initial H-1B petitions for consular processing from cap-exempt employers fell 91% in the fee's first eight months (CRS Insight IN12747).
Common mistakes
- Assuming every ASU job comes with sponsorship. The department must request it.
- Counting on cap-gap for an ASU H-1B. It does not exist for cap-exempt petitions; work the filing date backward from your EAD end date.
- Treating an ASU H-1B as a lifetime lottery pass. A later move to a private employer is cap-subject unless you were already counted.
- Skipping the E-Verify check because Arizona requires it. STEM OPT needs the right entity, hiring site and company ID.
- Believing the 60-day OPT unemployment figure online. The limits are 90 days on OPT and 150 in total with STEM OPT.
- Travelling before you get advice. Talk to ISSC and the employer's attorney before leaving the US while a STEM OPT I-765 or change-of-status petition is pending.
Frequently asked questions
Does ASU sponsor H-1B for staff positions?
Yes, if the hiring department requests it. As of November 1, 2026, ASU's International Students and Scholars Center (ISSC) files H-1B petitions for teaching and research positions and coordinates staff cases, which outside legal counsel handles. Ask the hiring manager whether your position is approved for sponsorship before you accept.
Is Arizona State University cap-exempt?
Yes. ISSC says ASU, as an institution of higher education and research, is exempt from the H-1B cap (8 CFR 214.2(h)(8)(iii)(F)), so it files year-round with no lottery. A cap-exempt petition gets no cap-gap extension of OPT. An unpublished rule under White House review since 2026-08-24 (RIN 1615-AD00) mentions cap exemptions in its abstract, but nothing has changed as of 2026-11-01.
Which Tempe companies sponsor H-1B?
In the USCIS H-1B Employer Data Hub extract this site uses (FY2024 to FY2026, FY2026 partial), the largest Tempe-addressed petitioners are Arizona State University (358 petition decisions), GoDaddy (216) and Align Technology (120). Are Chandler semiconductor jobs open to OPT students?
Many are, but Intel, ASML, Microchip and TSMC Arizona are cap-subject for a first H-1B, so you need a lottery selection. STEM OPT requires an employer in good standing with E-Verify and a signed Form I-983, and some fab roles ask a US-person export-control question. FY2028 registration had not been announced as of 2026-11-01.
Does Arizona require E-Verify for all employers?
Yes. A.R.S. 23-214(A) requires every employer to verify new hires through E-Verify, for hires after December 31, 2007. E-Verify's federal authority runs with the stopgap funding law through 2026-12-11. For STEM OPT, still confirm your employer and hiring site in the E-Verify Employer Search.
