C09 EAD Category: The Green-Card-Pending Work Permit for H-1B and F-1 Workers
Your I-485 is in. The C09 card in your mailbox is a work permit with real power and real limits, and renewals no longer stretch past the printed date.

The c09 EAD category is the work permit USCIS issues to people whose green card application (Form I-485, adjustment of status) is pending. If your card says C09 in the Category field, you can work for any US employer, in any role, until the card expires or your I-485 is decided. It costs $260 if your I-485 was filed on or after April 1, 2024. And since October 30, 2025, a c09 renewal gets no automatic extension past the printed date.
Whether you are an H-1B engineer years into a green card case or an F-1 graduate whose employer filed your I-140 and I-485 together, the card comes with conditions. Here is what the code means, how it pairs with advance parole, and what changed in October 2026.
Status line: c09 category facts as of October 14, 2026
| Item | Status | Date | What it means for a c09 holder |

Your own I-797 notices and the dates printed on your card govern over anything in this post.
What the c09 category on your EAD actually is
An Employment Authorization Document is Form I-766, the plastic card. The Category line carries a code that tells employers and USCIS why you are allowed to work. C09 points to 8 CFR 274a.12(c)(9): an applicant who has filed for adjustment of status under section 245 of the Immigration and Nationality Act.
Three things follow:
- It is open-market work authorization. A c09 card is not tied to an employer, a job title or a wage level. Contrast that with H-1B, which authorizes work only for the petitioning employer under its Labor Condition Application, or with STEM OPT, which needs an E-Verify employer and a Form I-983 training plan.
- It depends entirely on the I-485. If USCIS denies the I-485, or you withdraw it, or it is treated as abandoned, the basis for the card is gone.
- It is temporary by design. Once the green card is approved, the permanent resident card proves work authorization.
If you need the basics of the underlying form, start with our guide on what Form I-485 is and how USCIS processes it.
Who files for a c09 EAD, and why the answer differs by status
Most readers of this site reach the I-485 stage by one of two roads: an employment-based case (PERM, then I-140, then I-485 when the priority date is current under the chart USCIS designates) or a self-petition such as EB-1A or EB-2 NIW. In both, the c9 card means different things depending on the status you hold today.
H-1B workers
H-1B is a dual-intent status. You can keep working for your sponsoring employer on H-1B while the I-485 is pending, and the c09 card does not change that. Many H-1B workers file the I-765 anyway, as insurance:
- If you are laid off, the card can let you keep working for a new employer without a new H-1B petition.
- If you want to move jobs, the card can sit alongside AC21 portability for the green card, which lets an I-485 pending 180 days or more follow you to a same-or-similar job through Supplement J.
The trade-off: once you start working on the EAD rather than under the H-1B petition, you may no longer be maintaining H-1B status. You remain in a period of authorized stay because the I-485 is pending, but you now depend on that application. If it is denied, you have no H-1B to fall back on. Whether and when to make that switch is a question for an immigration attorney, not a blog post.
F-1 students and OPT or STEM OPT workers
F-1 is not a dual-intent status, which makes the pending-I-485 period more delicate. Some F-1 graduates reach the I-485 stage while still on OPT or STEM OPT, for example when an employer files I-140 and I-485 together for a candidate whose priority date is current.
Key points for this group:
- Your OPT EAD (category c3B or c3C) and a c09 EAD are separate authorizations with separate rules. STEM OPT reporting duties continue while you are on STEM OPT.
- Leaving the US without advance parole is generally treated as abandoning a pending I-485, and F-1 has no exception to that.
- Do not travel while an OPT or STEM OPT I-765 is pending. Advance parole re-entry generally ends prior nonimmigrant status, F-1 included, so any trip is a question for your DSO and attorney first.
Anything touching SEVIS or your OPT record goes to your DSO. Anything about the I-485 or which authorization to rely on goes to a licensed immigration attorney. They are not interchangeable.
Self-petitioners
EB-1A and NIW self-petitioners who file their own I-485 can file the I-765 and I-131 alongside it. Our guide to EAD and advance parole for self-petitioners with a pending I-485 covers that sequence in detail.
The EAD/AP combo card
When you file Form I-131 (advance parole) along with the I-765, USCIS may issue a single EAD/AP combo card. It looks like a regular EAD but carries the annotation "Serves as I-512 Advance Parole". One card then does two jobs: it proves work authorization, and it is the travel document that lets you seek re-entry without abandoning the I-485.
What to know about the combo card:
- It is still an EAD. The C09 category and the expiry date work exactly as on a standalone card.
- Advance parole lets you request re-entry; it does not guarantee admission. CBP still inspects you at the port of entry, and the Proclamation 10998 travel ban (39 countries) remains in effect, unchanged since 2026-01-01.
- Traveling on parole can change your status. A traveler who returns on advance parole generally comes back as a parolee, not in their prior nonimmigrant status. H-1B and L-1 holders have separate, narrow travel rules that other statuses do not. Ask your attorney which applies to you before you book a flight.
- The I-131 fee is separate. Check the current figure on the I-131 page and the G-1055 rather than relying on an older post.
H-1B holders who travel on a visa instead need a valid stamp. Interview waivers ("dropbox") are gone, third-country stamping ended 2025-09-06, and domestic H-1B renewal is not back, so a stamping trip means applying in your country of nationality or residence.
How to file for a c09 EAD: step by step
This is how the process works. It is not a recommendation to file.
- Confirm the I-485 can be filed. For October 2026, USCIS requires the Dates for Filing chart for all employment-based and family-based I-485s. Check the USCIS adjustment of status filing charts page each month; the November chart and bulletin were not out at the time of writing.
- Use the right editions. USCIS accepts only the 09/18/26 edition of Form I-485. For Form I-765, USCIS's page (updated around 2026-10-07) says it accepts the 08/21/25 edition, not the 09/15/26 edition. Re-check both pages the day you file.
- File the I-765 with the I-485 or while it is pending. You can file it in the same package or later, as long as the I-485 is still pending. Mark eligibility category (c)(9).
- Pay $260 if your I-485 was filed on or after April 1, 2024, per the G-1055 fee schedule.
- Send it to the current address. The I-485 filing location changed 2026-10-07. Forms sent to the prior location are accepted if postmarked by 2026-11-09.
- Track the receipt. Your I-797C receipt notice starts the clock.
- Attend biometrics if scheduled. USCIS may reuse prior biometrics or schedule an appointment.
- Watch the expiry date from day one (see the next section).

Renewals: the automatic extension is gone
| Old rule | New rule | What to do differently | |
|---|---|---|---|
| Automatic extension on renewal | A timely filed c9 renewal could extend work authorization past the printed date while USCIS decided it | Renewals filed on or after 2025-10-30 get no automatic extension (IFR); adopted without change by the final rule effective 2026-10-14 | Treat the printed expiry date as a hard stop |
| Form I-9 at expiry | Employers could accept the expired card plus the renewal receipt | The receipt no longer extends the card | Expect reverification at expiry; give HR the timeline early |
| Gap risk | Small for timely filers | Real if USCIS has not approved the renewal before expiry | Know your fallback (H-1B, OPT, or none) before the date arrives |
Who feels this most:
- H-1B workers who kept H-1B status usually have a fallback: they can keep working for the H-1B employer on the petition even if the c09 card lapses.
- People who work on the c09 EAD alone, including former F-1 workers whose OPT has ended, may have to stop working on the expiry date until the renewal is approved.
The rule ends automatic extension, not the c09 category itself. Our explainer on the DHS final rule ending automatic EAD extensions covers who else it reaches.
Green card EAD card processing time
There is no single correct number, and a hard-coded one goes stale within weeks. To find yours:
- Open the USCIS processing times tool.
- Select Form I-765 and the category for a pending adjustment applicant.
- Choose the office shown on your I-797C.
- Compare the posted range with your receipt date. USCIS generally accepts a case inquiry only once your case falls outside the posted time.
Without an automatic extension, processing time now decides whether you have a work gap. The I-765 page explains how early a renewal can be filed; ask your attorney how that fits your expiry date.
Common mistakes
- Treating the renewal receipt as proof you can keep working. For renewals filed on or after 2025-10-30, it is not.
- Switching from H-1B to the EAD without understanding the trade. Working on the c09 card can mean you are no longer maintaining H-1B status, and your stay then depends on the I-485 alone.
- Leaving the US without advance parole. For most people, that abandons the pending I-485. The H and L exception is narrow and fact-specific.
- Filing an old form edition. Only the 09/18/26 I-485 edition is accepted, with no grace period.
- Planning around a November Visa Bulletin cutoff. It was not published when this post was written. Forecasts are not cutoffs.
- Telling a new employer you "have a green card". You have a pending application and an EAD. Say exactly that on I-9 and in interviews.
Frequently asked questions
What does c09 mean on an EAD card?
It is the code for a pending I-485 adjustment applicant, from 8 CFR 274a.12(c)(9). The card authorizes work for any US employer while the I-485 is pending and loses its basis if the I-485 is denied or withdrawn.
How much does a c09 EAD cost in 2026?
$260 under the G-1055 edition dated 10/07/26, if your I-485 was filed on or after April 1, 2024. Earlier filers were under the older bundled fee, so check the G-1055 before you pay.
Do H-1B workers need a c09 EAD while the I-485 is pending?
Not to keep working for the H-1B employer, because H-1B is dual intent. Many file anyway as a backup. Working on the EAD outside the H-1B petition can change your status, so talk to an immigration attorney before you switch.
Does a c09 EAD renewal get an automatic extension?
Not if the renewal was filed on or after October 30, 2025. The interim final rule of that date ended it, and the final rule effective October 14, 2026 kept it. The printed date is the end date.
What is the green card EAD card processing time?
It moves. Check Form I-765 for your office on the USCIS processing-times tool and compare it with your I-797C receipt date.

Frequently asked questions
What does c09 mean on an EAD card
C09 is the USCIS category code for an applicant whose Form I-485 adjustment of status application is pending. It comes from 8 CFR 274a.12(c)(9). The card lets you work for any US employer while the I-485 stays pending, and it ends if the I-485 is denied or withdrawn.
How much does a c09 EAD cost in 2026
Under the G-1055 fee schedule edition dated 10/07/26, an I-765 filed by someone whose I-485 was filed on or after April 1, 2024 costs $260. If your I-485 was filed before that date under the older bundled fee, the treatment differs, so read the G-1055 and the USCIS I-765 page before you pay.
Do H-1B workers need a c09 EAD while the I-485 is pending
Not to keep working for the H-1B employer, because H-1B is a dual-intent status and you can stay in it while the green card is pending. Many H-1B workers still file for the card as a backup in case the H-1B job ends. Using the EAD to work outside the H-1B petition can change which status you are in, so talk to an immigration attorney before you switch.
Does a c09 EAD renewal get an automatic extension
No, if the renewal was filed on or after October 30, 2025. The interim final rule that took effect that day ended automatic extensions for renewal EADs, and DHS adopted it without change in a final rule effective October 14, 2026. Your card is valid only through the date printed on it.
What is the green card EAD card processing time
USCIS does not publish one fixed number, and it moves. Look up Form I-765, the c9 category and your service center or field office on the official USCIS processing-times tool, and compare it with the receipt date on your I-797C notice.
