DHS Ends Automatic Extension of Employment Authorization: What the October 14 Final Rule Changes

The temporary 2025 cut is now permanent. If your EAD renewal was filed on or after October 30, 2025, your card no longer stretches past its printed date.

Status as of October 14, 2026: The final rule ending automatic EAD extensions is in effect. It publishes and takes effect today. Nothing about it is proposed or pending.

Yes, DHS ends automatic extension of employment authorization for good. The final rule (RIN 1615-AD05, docket USCIS-2025-0271) went on public inspection on October 13, 2026 and takes effect on publication, October 14, 2026. It adopts the October 30, 2025 interim final rule (90 FR 48799) "without change." So if you filed an EAD renewal on or after October 30, 2025, your work authorization under that card ends on the date printed on it. There is no I-765 automatic extension anymore: a pending renewal and its receipt notice do not carry you past that date.

If you are an H-4 spouse, a green-card applicant using a pending-I-485 EAD, or an F-1 student planning ahead, this is the one date you can't lose track of. Here is what changed, what didn't, and what you can check today.

How DHS ends automatic extension of employment authorization

The 2025 interim final rule ended automatic extensions for renewal EADs right away. An interim final rule takes effect before public comment closes, and the agency can later keep it, change it or drop it. In the final rule, titled "Removal of Automatic Extensions for Certain Employment Authorization Documents," DHS answers the comments and finalizes the interim rule without changes. Three things follow:

  1. The rule is no longer temporary. DHS did not undo or soften the interim rule after comments.
  2. The cutoff date stays October 30, 2025. The final rule does not move the line. Renewals filed on or after that date get no automatic extension, H-4 EADs included.
  3. Your card's printed expiration date is the end of work authorization under that card unless the renewal is approved first, or you are authorized to work on a separate basis. A pending renewal no longer bridges the gap.

The final rule walks through its own example. An adjustment applicant's EAD expires May 30, 2026, and the renewal is filed February 4, 2026, after the October 30, 2025 cutoff. If the renewal is still pending on May 31, the person cannot keep working for the employer from that day unless they are authorized to work on another basis. Once the renewal is approved, they may resume work during the validity period on the new card.

The rule changes the automatic extension. DHS says it does not change the underlying eligibility of H-4, L-2 or other employment-based dependents to apply for an EAD, or of adjustment applicants to seek one while an I-485 is pending.

Who this hits hardest

H-4 spouses of H-1B workers

H-4 spouses drew many of the public comments DHS answered in the final rule, and DHS acknowledges that dependents and adjustment applicants may face temporary lapses in work authorization when renewals run long. If you renewed on or after October 30, 2025, a slow approval can take you out of work even though you filed on time. Our guide to the end of H-4 EAD auto-extension covers the H-4 timeline in more detail. The main correction for this week: the final rule does not rescind the H-4 EAD. Searches for "H-4 EAD removal" have risen, but that is not evidence of a rescission rule, and our H-4 EAD removal rumor explainer separates the two. The H-4 EAD is still available to apply for and renew. What ended is the bridge.

Green-card applicants on a pending-I-485 EAD

If your adjustment of status is pending and you rely on the (c)(9) EAD, for example after leaving H-1B status or as a dependent, the same rule applies to renewals filed on or after October 30, 2025. Under the G-1055 fee schedule dated 10/07/26, an I-765 filed with a pending I-485 that was filed on or after April 1, 2024 costs $260. Our (c)(9) EAD category guide covers that category. Many H-1B workers with a pending I-485 still hold H-1B status, which is a separate basis for work that does not depend on the EAD. Whether to work on the EAD or on H-1B is a status decision with long-term consequences, so make it with an immigration attorney.

F-1 students on OPT and STEM OPT

Initial post-completion OPT was never auto-extended: work starts only once the EAD is approved and its start date arrives. This rule changes nothing there. The final rule's text does not address the STEM OPT bridge (working on an expired OPT EAD while a timely STEM OPT I-765 is pending) or the H-1B cap-gap extension. Both rest on separate F-1 provisions, not the renewal-EAD provision this rule changed. Even so, confirm with your DSO before you count on either one, because your SEVIS record and I-20 recommendation decide eligibility. Our STEM OPT EAD extension timing guide covers the mechanics.

Processing times matter more now. Community reports say posted OPT I-765 averages had risen to roughly 4-5 months by late September 2026 [reported]. USCIS has not confirmed that figure. Check the USCIS processing-times tool for your form and category, and ask your DSO how it lines up with your program end date. Our I-765 processing time by category post explains how to read the tool.

Two other items for the same window. The FY2027 inflation fee adjustments, scheduled to take effect on October 16, 2026, do not include OPT, H-4, I-485 or premium-processing fees. And the proposed OPT fees ($70,000 initial and $30,000 subsequent) are only proposed (comments close November 9, 2026). The school would be the legal payer, and the current I-765 fee has not changed. Our I-765 OPT application walkthrough explains how to read the form edition and fee lines. The USCIS I-765 page is the source of truth for the current edition and filing instructions.

How an EAD card renewal timeline now works

The USCIS I-765 page explains how early a renewal may be filed before the current card expires. You can no longer lean on an extension, so the gap between when your renewal is received and when it is approved decides whether you keep working on that card. A typical employment authorization card renewal now runs like this:

  1. Read your card. Note the "Card Expires" date and your category code. For renewals covered by the rule, that date is now a hard stop.
  2. Check your filing window on the USCIS I-765 page for your category, and check which form edition USCIS accepts. A filing on an edition USCIS no longer accepts can be rejected; our I-765 edition date and filing address guide covers the current one.
  3. Pull the live processing time for your category from the USCIS tool, and compare it with the time left before your card expires.
  4. Collect your supporting documents. H-4 filers need evidence of the H-4 status (I-94) and of the H-1B spouse's qualifying basis. A pending-I-485 filer needs the I-485 receipt.
  5. File and save the I-797C receipt. It no longer extends your work authorization, but you need it for case status, any service request, and any expedite request.
  6. Tell HR early. If approval may land after your card expires, your employer needs to plan for reverification and a possible unpaid leave period. Your employer decides how to handle that, not USCIS.
  7. Track the case in your USCIS online account. If processing goes outside normal times, an attorney can advise whether an expedite request or other step fits your facts.

When to file, and whether you qualify for a category, are questions for an immigration attorney, or your DSO for anything OPT or SEVIS.

What your employer sees on Form I-9

Under the old regime, HR could often accept an expired EAD plus a qualifying receipt notice as continued proof. For renewals filed on or after October 30, 2025, that combination no longer extends authorization, so the employer has to reverify when the card expires. The USCIS I-9 Central pages give employers the current reverification guidance. A short email pointing them to the final rule and its October 14, 2026 effective date can prevent a payroll mistake in either direction.

Frequently asked questions

Did DHS end automatic EAD extensions on October 14, 2026?

DHS made the end permanent on that date. The final rule (RIN 1615-AD05) publishes and takes effect on October 14, 2026, and it adopts without change the interim final rule that already ended automatic extensions on October 30, 2025. Renewal EADs filed on or after October 30, 2025 get no automatic extension.

Is the H-4 EAD being cancelled?

No. The H-4 EAD program itself is not being rescinded. The rule removes only the automatic extension for H-4 EAD renewals filed on or after October 30, 2025, so a pending renewal no longer keeps you working past the date printed on your card.

I filed my H-4 EAD renewal before October 30, 2025. Am I still covered?

H-4 renewals timely filed before October 30, 2025 kept the automatic extension as long as the H-4 I-94 was unexpired. Your own receipt notice, card dates and I-94 govern, so have an immigration attorney or your employer's counsel confirm how they apply to you.

Does this rule affect initial OPT or STEM OPT?

Initial post-completion OPT never had an automatic extension, so nothing changes there. The final rule's text does not address the STEM OPT bridge or the H-1B cap-gap, which rest on separate F-1 provisions, so confirm with your DSO before relying on either one.

What does an employment authorization card renewal cost in October 2026?

The G-1055 fee schedule dated 10/07/26 lists $260 for an I-765 filed with a pending I-485 filed on or after April 1, 2024, and $1,780 for premium processing of an OPT or STEM OPT I-765. Other categories have their own fees, so check the live USCIS fee schedule before filing.
