Chinese F-1 Students: OPT, H-1B Odds and the China Green Card Queue for Bachelor's and Master's Grads
The H-1B lottery does not weigh your nationality, but China shapes everything around it, from visa stamping at home to an EB-2 cutoff of October 2021 and a $5,000 student tax break.

Part of our guide to the Visa Bulletin and priority dates.
If you are a Chinese bachelor's or master's student, your path from OPT to H-1B is the one every F-1 student follows: 12 months of OPT, 24 more with a STEM degree, and an employer's H-1B registration in a lottery weighted by the offered wage, not by nationality. As of November 1, 2026, being Chinese changes three things around it: where you get visa stamps, how long your green card waits (the EB-2 China Final Action Date is 2021-10-01), and a tax treaty that can exempt up to $5,000 a year of student wages from federal income tax.
This guide is for non-PhD graduates; doctoral readers should use our guide for Chinese STEM PhD students.
Status as of 2026-11-01
- In effect: wage-weighted H-1B selection (since 2026-02-27); OPT unemployment limits of 90 days (150 in total with STEM OPT); duration of status (D/S) and the F-1 60-day grace period, because the new D/S rule has been blocked by a federal court since 2026-09-14 (summary judgment briefed; DHS's appeal pending).
- Proposed only: OPT fees charged to schools. Comments close 2026-11-09; after that the rule remains a proposal unless and until DHS publishes a final rule.
- Blocked: collection of the $100,000 H-1B payment, though Proclamation 11069 stays in effect on paper to 2027-09-21.
- Not announced: FY2028 H-1B registration. The December 2026 Visa Bulletin is not out.
Chinese students on OPT and H-1B: the short answer
Chinese F-1 graduates use the same OPT, STEM OPT and H-1B rules as every other student. USCIS weights H-1B selection by offered wage level and publishes no odds by nationality. China changes three things: visa stamping at a US post in China, a per-country green card backlog, and an Article 20 tax exemption of up to $5,000 a year.
How many Chinese students are in the US in 2026?
DHS's October 2026 SEVIS tables show 220,157 active F and M records for Chinese nationals, down 10.2% from October 2025 and second only to India's 316,893 (our sums of the DHS SEVIS data). Chinese master's records fell 17.0%. These are active records, not enrollment or new students. Open Doors 2026, which covers the 2025/26 academic year, is not published yet.

The "China -28%" figure attributed to ICEF counts F, M and J visas together, so it is not an F-1 number.
Is it harder for Chinese students to get an H-1B?
Not in the lottery. USCIS's registration page says it runs "a weighted selection among properly submitted registrations for unique beneficiaries based generally on the highest OEWS wage level that the beneficiary's proffered wage will equal or exceed." The registration does ask for your "valid passport or travel document information," which lets USCIS select by unique beneficiary, but nationality is not one of the weights.
Common misconception: "Chinese applicants have a lower H-1B selection rate."
Correction: USCIS publishes registration totals, not selection rates by nationality, so any "Chinese selection rate" online is a third-party estimate. Under the weighted selection rule, in effect since 2026-02-27, a Level IV registration gets four entries and a Level I registration one.
Two things do move your odds. Your degree: a US master's makes you eligible for the 20,000-slot advanced-degree exemption (the "master's cap") as well as the 65,000 regular cap, while a bachelor's graduate competes for the regular cap only. And your offer: the wage level for your occupation and work location sets your entries, as our explainer on how wage-based H-1B selection works shows. USCIS has not announced FY2028 registration and must give at least 30 days' notice; the FY2027 window ran March 4-19.
Where your nationality does matter
- Visa stamps. You apply in your country of nationality or residence (State Department rule since 2025-09-06), in person, with online-presence review.
- Export-controlled jobs. Under the Commerce Department's deemed-export rules, releasing controlled technology to a foreign national in the US can require a license, depending on the technology and the person's citizenship. Some employers screen for this early; see how to answer the "Are you a U.S. person?" question.
- No nationality shortcut. H-1B1, E-3 and TN are closed to Chinese citizens, and L-1 needs a year abroad with a related company, so it rarely follows OPT.
Finding employers that sponsor
The USCIS H-1B Employer Data Hub now covers fiscal years 2009 through 2026 (quarter 4), and DOL's OFLC disclosure data (latest files FY2026 Q3) show LCA filings by job title and wage. Cap-exempt employers (universities, their affiliated nonprofits, nonprofit and government research organizations) skip the lottery, but a cap-exempt petition gets no cap-gap, so plan the filing well before your OPT EAD ends. New H-1B hiring is frozen at some public employers: Texas state agencies and public universities until 2027-05-31 unless the Texas Workforce Commission permits, and 12 Florida public universities until at least 2027-01-05.
A worked OPT-to-H-1B timeline for a December 2026 graduate
Take a hypothetical student, Mei, a Chinese citizen who completes a STEM master's on Friday 2026-12-18 and has an offer from a cap-subject employer.
- Request the OPT recommendation from your DSO, who enters it in SEVIS. The USCIS OPT page lets you file up to 90 days before completing your degree, no later than 60 days after (2027-02-16 for Mei, our arithmetic), and within 30 days of the recommendation.
- File Form I-765 online ($470) or on paper ($520, 08/21/25 edition), per the G-1055 fee schedule (edition 10/26/26). Since 2026-08-05 (PA-2026-05) USCIS can deny without a request for evidence when initial evidence is missing.
- Stay in the US while it is pending. USCIS's processing-time tool showed 80% of F-1 student (c)(3) cases completed within 5 months (read 2026-11-01).
- Report your employer as your DSO directs and watch the unemployment counter: 90 days on OPT.
- Confirm that your employer will register you for FY2028 once USCIS announces dates; March 2027 is an expectation, not an announcement.
- Check cap-gap with your DSO if selected. It covers only a timely, cap-subject change-of-status I-129 and extends F-1 status and OPT work to April 1 of the fiscal year requested, or the petition's start date if earlier (USCIS cap-gap page). Mei's FY2028 H-1B would start 2027-10-01, before her 12-month EAD runs out, so cap-gap would matter only if the EAD ended while the petition was still pending, and then no later than 2028-04-01 (our arithmetic).
- File a STEM OPT I-765 if not selected, up to 90 days before the OPT EAD expires and within 60 days of the DSO's recommendation. The employer must use E-Verify and sign a Form I-983 training plan; a timely filing brings the 180-day automatic extension, and the unemployment limit becomes 150 days in total.
On that schedule, OPT plus STEM OPT could span the 2027, 2028 and 2029 registration seasons, if USCIS keeps its spring calendar. Cap-gap ends automatically if the petition is denied, withdrawn, revoked or rejected.
Where the proposed OPT fee fits
The OPT fee proposal would make the school pay $70,000 before an initial OPT recommendation and $30,000 before each later one, STEM OPT included; schools could pass the cost on. As proposed, it would start 60 days after a final rule and skip recommendations dated earlier, so a recommendation Mei receives in late 2026 would fall outside it (our reading; a final rule could differ). Her STEM OPT recommendation might not, and the text leaves open whether a student whose first OPT was fee-free would owe $70,000 or $30,000. UT Dallas's 2026-10-12 FAQ put it plainly: "Does this publication affect my current plans for OPT? No."
How long is the EB-2 China green card wait?
No one can give you a reliable number, because the cutoff moves with demand. In the November 2026 Visa Bulletin, the EB-2 China Final Action Date is 2021-10-01, unchanged from October: a mainland-born applicant can reach final action only with a priority date earlier than that. The cutoff sits about five years behind today (our arithmetic), which describes the past, not your wait.
- Two charts. Final Action Dates decide approvals; Dates for Filing decide who may submit an I-485. USCIS says November employment-based I-485s "must use the Dates for Filing chart" (USCIS filing charts); consular cases always use Final Action Dates. Any December date you see now is a forecast.
- EB-3 is ahead this month. EB-3 China's Final Action Date (2022-01-22) is later than EB-2's. Employers sometimes file a new EB-3 I-140 and keep the earlier priority date; our EB-2 China priority date explainer covers the tradeoffs, and whether it fits you is an attorney question.
- Birthplace, not passport. The bulletin's China column is for people born in mainland China; chargeability follows country of birth, with narrow exceptions such as a spouse's country of birth.
- The queue. USCIS counted 23,168 China employment-based I-485s pending as of 2026-10-05 (published cells only) and 71,779 approved China petitions awaiting a visa as of June 2026 (primary beneficiaries, dependents excluded). The definitions differ, so do not add them.
- PERM first. DOL's FLAG processing times showed analyst review at January 2026 priority dates, averaging 303 days (as of 2026-10-21). DOL's PERM suspension of eight named employers (announced 2026-10-08) is not an H-1B suspension.
- Past six years on H-1B. AC21 allows one-year extensions when a PERM or I-140 was filed at least 365 days earlier, and three-year extensions with an approved I-140 when the per-country limit holds up the visa.
Do Chinese students get a tax treaty benefit on OPT?
In many cases, yes, for federal income tax; state tax and FICA follow their own rules. Article 20 of the US-China treaty exempts payments from abroad for your maintenance or study, qualifying grants, and up to $5,000 a year of personal-service income, for the period reasonably necessary to finish your education or training (IRS Publication 519). India's treaty has no such wage exemption (Publication 901), so Indian classmates' advice does not transfer.
- Claiming it at work. Pub 519's Appendix A gives the statement a Chinese student files with Form 8233 to claim exemption from withholding, including "I am present in the United States solely for the purpose of my education or training." OPT is practical training in F-1 status; confirm with a tax professional that your facts fit before you sign. Form 8833 is not needed for student treaty claims.
- It can outlast your nonresident years. In Pub 519's example, a Chinese student becomes a resident alien after five years, and "the provisions of Article 20 still apply because of the exception to the saving clause in paragraph 2 of the Protocol to the U.S.-People's Republic of China treaty dated April 30, 1984."
- FICA is separate. Nonresident F-1 students on OPT are exempt from Social Security and Medicare tax until they become resident aliens or change to H-1B (IRS FICA page). A student first present in 2022, such as a four-year bachelor's graduate finishing in 2026, is an exempt individual for 2022 through 2026; with 183 days in 2027 they become resident and owe FICA on OPT pay, while Article 20 continues. A master's student first present in 2025 stays exempt through 2029, which can cover OPT and most of STEM OPT (our reading of both examples).
- Forms, states and accounts. Article 20 covers students and trainees, so ask a tax professional how it applies in the year you change to H-1B. File Form 8843 for each year you exclude days as an exempt individual. California's FTB Publication 1031 says that unless a treaty "specifically excludes the income from taxation by California, the income is taxable." There is no US-China totalization agreement, and once you are a resident alien, FBAR applies if your foreign accounts exceed $10,000 in aggregate.
Should Chinese students avoid traveling home over winter break?
There is no blanket rule, and D/S still applies because the new rule is blocked. The risk sits in the return trip: an expired F-1 stamp means an in-person interview at a US post in China, since interview waivers for F-1 ended on 2025-10-01. China is not on either Proclamation 10998 list, per WashU's summary. Boston University's international office says "International travel risks remain high" and to allow "at least 30 days for visa processing" (BU ISSO advisory).
| Question (as of 2026-11) | If yes | Ask |
|---|---|---|
| Is your initial OPT I-765 pending? | Cornell, JHU and USC advise against travel until the EAD arrives; a missed biometrics appointment can delay or deny the case, and Cornell notes that after a denial abroad you cannot return in F-1 status to reapply | DSO |
| Does your F-1 stamp expire before you return? | Expect an in-person interview, online-presence review (since June 2025) and possible 221(g) holds that "can delay issuance for weeks or months" (Mintz, 2026-10-30) | DSO; attorney if refused |
| Is your I-20 travel signature older than 12 months (6 on OPT or STEM OPT)? | Get a new one before you leave | DSO |
| Is an H-1B change of status pending? | USCIS's cap-gap page says that if you travel abroad while it is pending, "the request for change of status will be considered abandoned" | Immigration attorney |
Check live estimates on the Global Visa Wait Times page (last updated 2026-10-21). State's figure of more than 300,000 visas revoked since January 2025 (2026-10-20) has no student breakdown, and a revoked visa is not a terminated SEVIS record. Our winter break travel checklist lists the documents to carry.
Later, an H-1B approved as a change of status lets you work without leaving, but your first trip abroad needs an H-1B stamp from a US post in your country of nationality or residence (for most readers, China), with online-presence review for H-1B since 2025-12-15; see our H-1B stamping guide for China and Guangzhou. The $100,000 payment never covered change-of-status approvals inside the US, and the USCIS I-129 page notes that "If this order is later lifted, DHS still plans to collect the payment."
Common mistakes
- Quoting a "Chinese H-1B selection rate." USCIS publishes none; wage level and degree drive your entries.
- Flying home with OPT pending. Schools advise waiting for the EAD; talk to your DSO first.
- Mixing up the charts. Dates for Filing lets you file an I-485 when USCIS designates it; only the Final Action Date lets USCIS approve it.
- Reading the cutoff as a wait time. The five-year gap describes past movement.
- Borrowing the wrong treaty rules. Article 20 has no fixed 3-5 year limit (three years is the teacher article), and India's treaty has no $5,000 wage exemption.
- Treating the OPT fee as law. It is a proposal, and the school would be the legal payer.
Frequently asked questions
How many Chinese students are in the US in 2026?
DHS's October 2026 SEVIS tables show 220,157 active F and M records for Chinese nationals, down 10.2% from October 2025 and second only to India (our sums). Chinese master's records fell 17.0%. These are active records, not enrollment, and Open Doors 2026 was not yet published as of 2026-11-01.
Is it harder for Chinese students to get an H-1B?
Not in the lottery. Since 2026-02-27 USCIS has weighted selection by the offered wage level, and it publishes no odds by nationality, so any Chinese selection rate is a third-party estimate. China matters elsewhere: visa stamping, export-controlled jobs and the green card backlog.
How long is the EB-2 China green card wait?
No one can promise a number. In the November 2026 Visa Bulletin, EB-2 China's Final Action Date is 2021-10-01, and USCIS requires the Dates for Filing chart (2023-01-01 for EB-2 China) for November I-485s. The Final Action Date trails today by about five years, but it moves with demand, so it is not a forecast.
Do Chinese students get a tax treaty benefit on OPT?
In many cases, yes, for federal income tax. Article 20 exempts up to $5,000 a year of personal-service income for a student or trainee, plus payments from abroad and qualifying grants, and Publication 519 says it can continue after you become a resident alien. Confirm your facts with a tax professional, since states such as California may still tax the income.
Should Chinese students avoid traveling home over winter break?
There is no blanket rule as of November 2026, and D/S still applies because the new rule is blocked. Schools such as Cornell advise against travel while an initial OPT application is pending. If your F-1 stamp has expired, plan for an in-person interview in China, online-presence review and possible administrative processing, and check your travel signature with your DSO.
