Graduating in December 2026 on F-1? Your OPT Filing Window, Start Date and Winter Travel Plan

If your I-20 ends in December 2026, your OPT window is already open, and the start date you pick and the flight you book this winter can each cost you months.

If your I-20 program end date falls in December 2026, your December graduation OPT window is already open. USCIS accepts Form I-765 for post-completion OPT from 90 days before your program end date until 60 days after it, and within 30 days of the date your DSO enters the OPT recommendation in SEVIS. That is September 12, 2026 to February 9, 2027 for a December 11 end date, and September 20, 2026 to February 17, 2027 for December 19. Count from the date on your own I-20, not your commencement ceremony.

Status line, as of November 1, 2026. In effect: the OPT filing rules above, the 90-day OPT unemployment limit and the I-765 fee ($520 paper, $470 online). Blocked: the Duration of Status (D/S) final rule, postponed by a federal court since September 14, 2026, with summary judgment briefed (replies due November 2) and DHS's appeal pending, so D/S and the 60-day F-1 grace period still apply. A ruling can come at any time, so check the court docket. Proposed only: the OPT fee rule, comments closing November 9, 2026. Not announced: the FY2028 H-1B registration.

December graduation OPT in one paragraph

A December 2026 F-1 graduate can file Form I-765 from 90 days before the I-20 program end date until 60 days after it, and within 30 days of the DSO's SEVIS recommendation. The OPT start date can fall up to 60 days after the program end date. On November 1, 2026, USCIS showed 80% of F-1 student OPT cases finished within five months.

When should I apply for OPT if I graduate in December?

Two clocks must both be satisfied: one around your program end date, one from the day your DSO enters the recommendation. Miss either and USCIS can deny the application.

On its OPT page for F-1 students, USCIS says you "May apply up to 90 days before you complete your degree, but no later than 60 days after you complete your degree," and you "Must apply within 30 days after your DSO enters the recommendation for OPT into your SEVIS record." The underlying regulation is 8 CFR 214.2(f)(11). "Complete your degree" means the program end date in SEVIS, which our guide to the I-20 program end date versus your graduation date explains. If you finished early or a thesis is still open, that date may differ from an old I-20.

60-day date on a weekend?NoNo

The 30-day clock is the one that catches people

Say your DSO enters the recommendation on Friday, November 6, 2026. Day 30 is Sunday, December 6. Under PA-2026-15, in effect since October 23, 2026, a day-counted paper deadline ending on a weekend or federal holiday is met by the next business day, so in our reading a mailed I-765 arriving Monday, December 7 is on time. Online filings never roll, because USCIS treats them as received on submission (Policy Manual, Volume 1, Part B, Chapter 6); online, December 6 is the last day. Confirm with your DSO, and see our explainer on what counts as a day when a USCIS deadline falls on a weekend.

The second trap is overlap. For a December 19 graduate recommended on February 1, 2027, day 30 is March 3, but the 60-day limit ends February 17. The earlier date controls.

What start date should I choose for OPT?

SEVP's OPT guidance in the SEVIS Help Hub says the start date "must be on or after the Program End Date" and "cannot be more than 60 days after" it. OPT then runs up to 12 months, and USCIS says you "may not begin your pre- or post-completion OPT until after we approve your Form I-765." The right date depends on whether you have an offer, whether your degree is STEM, and when you file.

Filing late in the windowAt the November 1 pace (5 months for 80% of cases), the card may arrive well after the start dateNarrows the gap between start date and card

SEVP counts up to 90 unemployment days on post-completion OPT, from the actual OPT start date, for each day "without employer information," per its unemployment counter page. If USCIS approves the card after the date you asked for, the dates printed on the EAD govern; ask your DSO how that has played out at your school.

How the FY2028 H-1B lottery and cap-gap fit

As of November 1, 2026, USCIS has not announced the FY2028 H-1B registration. Its registration page still shows FY2027, USCIS must give at least 30 days' notice, and March 2027 is an expectation only.

On the dates you can request, OPT runs to roughly December 2027 through February 2028, past October 1, 2027, when FY2028 cap-subject H-1B employment would begin. In our reading, cap-gap would matter only if an H-1B change-of-status petition were still pending when your OPT ended. For a timely, cap-subject change-of-status petition, USCIS's cap-gap page extends status and OPT work to April 1 of the fiscal year requested (April 1, 2028 for FY2028), or to the petition's start date if earlier. Cap-exempt petitions, such as many university jobs, get no cap-gap. So the start date matters more for unemployment days and the STEM deadline than for the lottery.

If your degree is STEM-designated

Your OPT end date becomes your STEM OPT deadline. USCIS's STEM OPT page says that if you file on time and your OPT expires while the extension is pending, "we will automatically extend your employment authorization for 180 days." That extension is in effect and unchanged by the October 14, 2026 EAD rule, but a STEM I-765 filed after the OPT EAD expires gets no 180 days. Because that deadline is a date, not a count of days, in our reading PA-2026-15 does not roll it to a business day. On STEM OPT, the unemployment limit becomes 150 days in total, counting days used on OPT.

How long does OPT take in 2026?

On November 1, 2026, the USCIS processing-times tool showed 80% of I-765 (c)(3) F-1 student cases completed within 5 months. That is a dated snapshot, not a promise.

Misconception, then correction. Some aggregator sites list OPT processing at 4.5 months. The USCIS tool showed 5 months on November 1, 2026. Use the live tool, not a copied number.

USCIS's I-765 data for FY2026 Q3 (April to June 2026) shows 56,901 post-completion OPT receipts and 47,339 approvals in the quarter, with 70,225 cases pending at quarter end.

Against a mid-December start date, even a November filing can leave months between the start date and the card, though many cases finish sooner. Writing about the fee proposal on October 12, 2026, Duke's international office encouraged students already inside their filing window to "apply as soon as possible."

Three more facts shape the wait:

Can I travel home while my OPT is pending?

Cornell, Johns Hopkins and USC all advise December graduates with OPT pending not to travel abroad until the EAD arrives. Cornell's travel on OPT page puts it plainly: "We suggest you do not travel internationally before it is approved." These are school advisories, not a federal ban, but the reasons are concrete.

D/S still applies this winter, because the D/S rule is blocked; USCIS's I-539 page says it "will proceed under the previous regulatory provisions." Our winter break travel checklist for F-1 students covers the rest of the season. If a family emergency forces a trip, our guide to traveling on OPT with a pending I-765 lists the re-entry documents schools name; take that decision to your DSO first, and to an immigration attorney if a visa or travel-ban issue is involved.

If you stay in the US for the break

Boston University's international office reported on August 17, 2026 that ICE detentions had been "confirmed at 15 major U.S. airports," and it advises carrying immigration documents such as your passport, visa, I-94, I-20, EAD and I-797 on domestic trips. With OPT pending, the I-797 is your receipt notice. BU's current travel advisory also says "International travel risks remain high."

Does the proposed OPT fee affect December 2026 graduates?

Not as written. The OPT fee proposed rule, published October 8, 2026, is proposed only, and it would reach only DSO recommendations dated 60 or more days after a final rule. No final rule exists. The school would be the legal payer of $70,000 before an initial OPT recommendation and $30,000 before each later one, and it could pass the cost on. Comments close November 9, 2026 at 11:59 p.m. ET, with more than 4,700 filed as of November 1 (check the Federal Register docket for the outcome after November 9).

UT Dallas's FAQ on the proposed rule (2026-10-12) answers its own question, "Does this publication affect my current plans for OPT?", with "No." One question stays open for STEM graduates. STEM OPT counts as a later recommendation, and in our reading the proposal does not settle whether a student whose first OPT was fee-free would face the $70,000 or the $30,000 figure on a STEM request made after a final rule. Our explainer on who would pay the proposed OPT fee tracks it.

Your December-to-February OPT plan, step by step

  1. Confirm your program end date with your DSO, from your current I-20 or SEVIS record.
  2. Agree on a requested start date with your DSO before the recommendation is entered, using the trade-off table above.
  3. Request the OPT recommendation and updated I-20, note the date the DSO entered it in SEVIS, and calendar day 30.
  4. Assemble the initial evidence that the Form I-765 instructions list for category (c)(3)(B), starting with the I-20 your DSO endorsed, because PA-2026-05 lets USCIS deny a case that is missing it. Use the 08/21/25 edition; USCIS is not accepting the 09/15/26 edition.
  5. File online in your USCIS account ($470) or on paper ($520) at the address on the USCIS I-765 page. Addresses changed October 7, 2026, and old ones work only if postmarked on or before November 9, 2026 (filing locations update). Paper filers pay by card (Form G-1450) or bank debit (Form G-1650).
  6. Decide whether to add Form I-907 premium processing ($1,780).
  7. Attend your biometrics appointment at the Application Support Center named on your notice.
  8. Track your receipt number in your USCIS account.
  9. Apply for a Social Security number at the Social Security Administration on or after the EAD start date; SSA will not process one while the EAD start date is in the future (our guide to getting an SSN on OPT covers what to bring).
  10. Report each employer to your school as you start work, so SEVIS does not count employed days as unemployed.

Frequently asked questions

When should I apply for OPT if I graduate in December 2026?

USCIS accepts Form I-765 for post-completion OPT from 90 days before the program end date on your I-20 until 60 days after it, within 30 days of your DSO's SEVIS recommendation. For December 11, 2026 that is September 12, 2026 to February 9, 2027; for December 19, September 20, 2026 to February 17, 2027. Both windows were already open on November 1, 2026.

What start date should I choose for OPT as a December graduate?

SEVP allows a start date on or after your program end date and no more than 60 days after it, and OPT runs up to 12 months. If the card arrives in time, an earlier date lets you start work sooner; a later one delays your 90-day unemployment count and moves your OPT end date and any STEM OPT deadline later. If USCIS approves after your requested date, the EAD's dates govern. Settle it with your DSO, who enters it in SEVIS.

Can I travel home while my OPT is pending?

As of November 2026, Cornell, Johns Hopkins and USC advise December graduates with OPT pending not to travel abroad until the EAD arrives. A biometrics appointment missed abroad can delay or deny the case, and if OPT is denied while you are outside the US you cannot reenter in F-1 status. Talk to your DSO before booking.

How long does OPT take in 2026?

On November 1, 2026, the USCIS processing-times tool showed 80% of F-1 student I-765 (c)(3) cases completed within 5 months. Premium processing costs $1,780 with a 30-business-day timeframe. Check the live tool, because times change.

Does the proposed OPT fee affect December 2026 graduates?

As proposed on October 8, 2026, the $70,000 fee ($30,000 for each later recommendation) would be owed by the school and would reach only DSO recommendations dated 60 or more days after a final rule. No final rule exists, and comments close November 9, 2026. UT Dallas told students on October 12, 2026 that it does not affect current OPT plans.

How we checked this: we read the USCIS OPT page (updated November 25, 2024), SEVP's OPT guidance (updated May 19, 2025) and unemployment counter (updated July 27, 2026), Cornell's OPT travel page, the USCIS fee schedule (G-1055 edition 10/26/26), USCIS's FY2026 Q3 I-765 data, PA-2026-15 and the OPT fee proposed rule on November 1 and 2, 2026, and computed the calendar dates ourselves.

This is general information, not legal or tax advice; your own I-20, I-797 receipt and EAD govern, and your DSO (for OPT and SEVIS) or a licensed immigration attorney (for visa and H-1B strategy) should confirm any decision.
