Does Bank of America Sponsor H-1B Visas? What OPT and STEM OPT Candidates Should Check First

Bank of America files H-1B petitions, but that does not mean your role will be one of them. Here is what to verify before you apply on OPT.

You have a Bank of America posting open in one tab and your OPT end date in another. Before you spend a weekend tailoring a resume for a credit risk analyst or software engineer role in Charlotte, you want one answer: does Bank of America sponsor H-1B visas?

Yes, in the general sense. Bank of America (BofA) has an H-1B filing history in public USCIS and Department of Labor (DOL) data, which you can search yourself. But "the company sponsors" and "this role will sponsor you" are different claims. Sponsorship at a large bank is decided by business line, job family and budget, and on STEM OPT it also depends on E-Verify and a training plan. This guide shows what to check first, in order, so you do not burn OPT unemployment days on roles that were never going to file for you.

Status line: what is true as of October 2026

Rule or actionStatus (as of October 2026)What it means for you

FY2028 H-1B registrationNot announcedNo registration dates exist yet; March 2027 is only an expectation
$100,000 H-1B entry restriction (Proclamation 11069)Extended to 2027-09-21 on paper; fee blocked by two courtsThe fee is not being collected
$103,265 cap-subject H-1B feeProposed (comments closed 2026-09-24)No final rule; it would cover F-1 change-of-status cases if finalized
EO 14431 (layoffs as an H-1B factor)In effect as a directive since 2026-09-18Agencies "take into account" employer layoffs; no automatic denial
DOL PERM suspension of 8 named employersIn effect (announced 2026-10-08)PERM only; Bank of America is not one of the eight
Duration-of-Status ruleBlocked by a federal court on 2026-09-14; DHS appealedYour 60-day F-1 grace period still applies
Ending the worker 60-day grace periodProposed (comments close 2026-11-10)Covers H-1B and other workers, not F-1; today's rule still applies
OPT fees ($70,000 / $30,000)Proposed (NPRM 2026-10-08; comments close 2026-11-09)Not law; current OPT filing costs are unchanged

None of these rules names Bank of America. They change the cost and odds of sponsorship at every cap-subject employer.

Does Bank of America sponsor H-1B? What the public data can and cannot tell you

There are two free, official places to research bank of america h1b history.

  1. The USCIS H-1B Employer Data Hub (uscis.gov) lists approvals and denials by employer, fiscal year, state and city. It covers FY2009 through FY2026 Q3 only, so any "FY2026 Q4" ranking you see online is not based on complete data. Our walkthrough of the USCIS H-1B Employer Data Hub explains each column.
  2. DOL Labor Condition Application (LCA) disclosure data from the Office of Foreign Labor Certification (dol.gov) shows job titles, worksite cities and offered wages on certified LCAs. An LCA is a required step before an H-1B petition, but a certified LCA does not mean a petition was filed or approved.

Two metric traps catch almost everyone:

Search every entity name

USCIS and DOL record the exact legal entity on the filing. A large bank holding company files through more than one subsidiary, and names change after mergers. When you search, try variations such as "Bank of America," "BofA" and the names of its securities and wealth-management subsidiaries, then check which entity is listed on the job posting or offer letter. The entity that hires you is the one that files your petition and, on STEM OPT, the one that must be enrolled in E-Verify.

Which BofA roles fit the H-1B rules

The H-1B is for specialty occupations: jobs that normally require at least a bachelor's degree in a specific field. That legal test, not the employer's brand, drives most of the answer to does bofa sponsor h1b for any given posting.

Role family at a large bankSpecialty-occupation fitNotes
Software engineering, data engineering, cybersecurityStrongDegree in CS, engineering or a related field is typical
Quantitative modeling, risk analytics, model validationStrongOften require a quantitative master's or PhD
Data science and analyticsUsually strongDepends on how specific the degree requirement is
Investment banking, sales and trading, researchVariesMany hire across majors; a "any bachelor's" requirement weakens the case
Branch, teller, client associate, call centerWeakRarely require a specific degree

If you are aiming at front-office finance, read our guide to H-1B sponsorship in investment banking. Many of those roles also involve FINRA qualification exams, listed at finra.org. Passing an exam does not change the H-1B test: the petition still has to show the job needs a degree in a specific field.

Bank of America visa sponsorship on OPT and STEM OPT

Most international candidates start at a bank on OPT, not H-1B. That changes what you need to verify.

Confirm E-Verify enrollment for the specific entity on your offer, and take any question about whether a role is "directly related" to your degree to your DSO. That is a school compliance question, not an immigration-attorney question.

The lottery math: why the wage level on your offer matters

Bank of America is a for-profit bank, so it is cap-subject. If you are on OPT or STEM OPT, a new H-1B normally means your employer registers you in the annual lottery. Since 2026-02-27, the wage-weighted selection rule gives each registration entries by DOL wage level: Level IV counts four times, Level III three times, Level II twice and Level I once. Our explainer on the wage-weighted H-1B lottery covers the mechanics.

After selection the employer files Form I-129; if you are in the US on OPT, it usually requests a change of status. Cap-gap rules can bridge the period between your OPT end date and an October 1 H-1B start for timely filed cases. Ask your DSO how cap-gap would apply to your SEVIS record.

How EO 14431 and the PERM suspension fit in

EO 14431, signed 2026-09-18 and in effect as a directive, tells DOL, DHS and State to "take into account" whether a sponsor engaged in layoffs within the previous year, or plans layoffs, that affect similarly situated US workers. It defines neither "layoffs" nor "similarly situated," creates no automatic denial, and had no implementing guidance as of 2026-10-13. Treat it as possible added scrutiny, not a bar. Our EO 14431 explainer covers the open questions. Read the order itself on federalregister.gov.

The DOL PERM suspension announced 2026-10-08 applies to eight named employers, and Bank of America is not among them. It affects PERM green-card labor certification only, not H-1B petitions. If long-term green-card sponsorship matters to you, ask about it separately: H-1B sponsorship and PERM sponsorship are separate decisions at most employers.

A step-by-step checklist before you apply

  1. Read the posting for sponsorship language. Some postings state whether visa sponsorship is available. If it says no, believe it.
  2. Identify the hiring entity. Note the legal entity name from the posting, the careers site or the offer letter.
  3. Search that entity in the Data Hub and the LCA data. Look for your job title, or a close variant, in your target city within the last two or three fiscal years.
  4. Check the specialty-occupation fit. Does the posting require a degree in a specific field? If it accepts any bachelor's, the H-1B case is harder.
  5. Confirm E-Verify if you will need STEM OPT. Check the exact hiring entity, not the parent brand.
  6. Ask the recruiter early and honestly. "This role would need H-1B sponsorship in the future. Is that supported for this position?" Answer application questions about future sponsorship truthfully.
  7. Map the wage level. Compare the offered salary to DOL prevailing wages for the title and metro.
  8. Track your clock. Count your OPT or STEM OPT unemployment days, and keep your DSO informed of employer changes within the required reporting window.

Frequently asked questions

Does Bank of America sponsor H-1B visas?

Yes, Bank of America has an H-1B filing history in public USCIS and DOL data, so it is an H-1B sponsor in the general sense. Sponsorship is still decided role by role and business line by business line, so confirm it for the specific posting before you rely on it.

Which Bank of America roles are most likely to be sponsored?

Roles that clearly require a specific bachelor's degree or higher, such as software engineering, data science, quantitative modeling and risk analytics, fit the H-1B specialty-occupation test most easily. Branch, teller and general client-service roles usually do not, regardless of the employer.

Can I work at Bank of America on STEM OPT?

Only if the role is directly related to your STEM degree, the hiring entity is enrolled in E-Verify, and you and the employer complete a Form I-983 training plan. Confirm E-Verify enrollment for the exact entity hiring you, and route eligibility questions to your DSO.

Does a Bank of America offer guarantee I get an H-1B?

No. Bank of America is a cap-subject employer, so a new H-1B for an OPT or STEM OPT worker normally goes through the lottery, which uses wage-weighted selection since 2026-02-27. No employer can promise you will be selected.

Does the $100,000 H-1B fee affect a Bank of America offer?

As of October 2026 the fee is not being collected. Proclamation 11069 extended the restriction to 2027-09-21, but two federal courts have blocked it. A separate $103,265 fee for cap-subject petitions is only proposed, with no final rule.
