Does Rivian Sponsor H-1B Visas? EV Engineering, Software and the Rivian-VW Joint Venture
USCIS approved 541 of 547 H-1B decisions for Rivian in FY2024, yet most of its internship postings rule out sponsorship. Here is how Rivian and its VW joint venture differ.

Part of our guide to companies that sponsor H-1B visas.
Does Rivian sponsor H-1B? Yes, at scale, but not for every role. In FY2024 the USCIS H-1B Employer Data Hub recorded 151 initial-employment approvals and 390 continuing approvals for Rivian Automotive, LLC, with 6 denials: 541 of 547 decisions approved, or 98.9%. The postings tell a narrower story. Of the 907 US postings on Rivian's careers site in early November 2026, 54 said sponsorship is not offered, most of them internships and early-career roles, and none promised it. Rivian and VW Group Technology, the joint venture with Volkswagen, is a separate employer with its own record.
Where the rules stand (as of 2026-11-01):
- Wage-weighted H-1B selection is in effect since 2026-02-27 under the weighted selection final rule. FY2028 registration is not announced; USCIS must announce it at least 30 days ahead (8 CFR 214.2(h)(8)(iii)(A)(3)), so watch its registration page, which still shows FY2027.
- The STEM OPT 180-day automatic extension is in effect for timely filers, per USCIS's STEM OPT page. The 2026-10-14 final rule ending automatic EAD extensions did not change it.
- The $100,000 H-1B payment (Proclamation 11069) is in effect on paper but blocked and not collected: a court vacated the agency guidance, per the USCIS I-129 page. Even if collection resumed, it does not apply to a change of status USCIS grants inside the US, the usual OPT-to-H-1B route; a denied change of status or a consular-notification petition would be covered (USCIS H-1B page).
Does Rivian sponsor H-1B? The short answer
Rivian Automotive, LLC is a steady H-1B filer: USCIS approved 98.9% of its FY2024 first decisions, and about 28% of approvals were for new employment, the category an OPT graduate's change of status falls into (our arithmetic). Sponsorship is still decided per requisition. Many internship and early-career postings say "No Visa Sponsorship", and the VW joint venture petitions under its own name and tax ID.
Rivian's H-1B record, entity by entity
USCIS H-1B Employer Data Hub, FY2024 first decisions, from the extract behind our employer pages (read 2026-11-01)
| Legal employer (as the Hub names it) | Initial approvals | Initial denials | Continuing approvals | Continuing denials | Total |
|---|---|---|---|---|---|
| RIVIAN AUTOMOTIVE LLC | 151 | 0 | 390 | 6 | 547 |
| RIVIAN AND VW GROUP TECHNOLOGY LLC | No FY2024 row | n/a | n/a | n/a | n/a |
The Hub's glossary counts petitions with "New employment" selected on Part 2, Question 2 of Form I-129 as initial, which is where an F-1 graduate's cap case lands. Extensions, amendments and changes of employer sit on the continuing side (our reading of the Hub's categories). So 151 of Rivian's 541 approvals (27.9%, our arithmetic) were the kind an OPT worker needs; the rest mostly involved people already in H-1B status.
Two caveats from the same glossary. "The most common spelling of employer name per unique tax ID is used," so each Rivian legal entity gets its own row. And the Hub's city is a mailing address, "not necessarily the beneficiary(ies) work location": Rivian's row says Irvine, California, while much of its engineering work is in Normal, Illinois.
The joint venture has no FY2024 row because it did not exist yet. Rivian's November 2024 Form 8-K planned closing for November 13, 2024, inside FY2025 (our arithmetic). Our Rivian Automotive employer page and Rivian and VW Group Technology employer page show later years; treat FY2026 as a partial year.
What is Rivian and VW Group Technology?
It is a 50/50 joint venture between a Rivian subsidiary and Volkswagen. The 8-K says it "will be established as an electrical architecture technology company with a focus on software, electronic control units and related network architecture design and development." Rivian consolidates its results, but its Q3 2026 Form 10-Q, filed 2026-10-29, is explicit: "the Joint Venture is a separate legal entity with its own management and board of directors."
For your visa, "separate legal entity" is the phrase that counts:
- H-1B is employer-specific. Moving from Rivian Automotive to the venture, or back, needs a new Form I-129 from the new employer.
- STEM OPT follows the employer. A move means a new Form I-983 with an employer enrolled in E-Verify, reported through your DSO.
- PERM is tied to one employer's job. If a green-card case is pending when you move, ask counsel what carries over.
- The name changes by document. The 8-K says "Rivian and VW Group Technology, LLC"; the 10-K and 10-Q say "Rivian and Volkswagen Group Technologies, LLC"; DOL's files use both. Search both.
- It hires on its own board, jobs.ashbyhq.com/rivianvw.tech. Every posting we read on careers.rivian.com was tagged Rivian Automotive.
Rivian Automotive vs the joint venture (as of 2026-11)
| Rivian Automotive, LLC | Rivian and VW Group Technology, LLC | |
|---|---|---|
| Where it posts jobs | careers.rivian.com | jobs.ashbyhq.com/rivianvw.tech |
| Sponsorship language (postings we read, early November 2026) | 54 of 907 US postings say no sponsorship; none offer it | None of its 161 postings mention sponsorship either way |
| Most common LCA occupations (DOL FY2026 Q3 file) | Mechanical and industrial engineers, then software, electrical and mechatronics engineers | Software developers, then electrical engineers |
| Most common LCA worksites | Normal, IL, then Irvine and Palo Alto, CA, and Plymouth, MI | Palo Alto, then Irvine and Tustin, CA |
| Prevailing-wage levels on its LCAs | All four levels, mostly II and III | Mostly Level I and II |
| PERM cases in DOL FY2026 Q3 file | Yes, mostly certified, mostly senior titles | Yes, a few |
A third entity, Rivian, LLC, files a smaller number of LCAs under its own tax ID, mostly for industrial engineers, logistics analysts and software and data roles. Check which name is on your offer letter, because that is the employer that would file your petition.
Which Rivian jobs get H-1B sponsorship?
Engineering roles in manufacturing, vehicle hardware and software. In DOL's FY2026 Q3 LCA disclosure file (decisions from 2025-10-01 to 2026-06-30), downloadable from the OFLC performance data page, Rivian Automotive's filings centered on mechanical and industrial engineers at the Normal factory; the joint venture's on software developers and electrical engineers in Palo Alto and Irvine.
An LCA is not an H-1B petition. Employers need a certified LCA before filing a petition, often again for an extension, and the files include a few E-3 (Australian) and H-1B1 (Singaporean) cases, so they show which jobs Rivian sponsors, not your odds. Beyond Rivian, see our guide to hardware engineering jobs at EV startups that sponsor visas and the wider automotive and EV industry H-1B landscape.
Why the wage level on your offer matters in the lottery
Under wage-weighted selection, a registration at wage Level IV gets four entries and one at Level I gets one. DOL sets the levels by occupation and area, so the same salary can sit at a different level in Palo Alto than in Normal. The venture's LCAs skew to Levels I and II; Rivian Automotive's spread across all four. Ask which level your role would be registered at. For comparison with the largest EV sponsor, see how Tesla handles H-1B sponsorship for international candidates.
Does Rivian hire OPT students?
For some roles, but read each posting. Rivian's students page answers "Does your company sponsor international students?" with: "We encourage you to know your requirements in advance. We will review your eligibility on a case-by-case basis." It adds, "Valid work authorization is required for employment."
The postings are blunter. In early November 2026, 42 of 55 US postings in Rivian's Internships & Early Career category carried a "No Visa Sponsorship" line, including 8 of the 11 full-time "Early Career" roles. A handful of Palo Alto co-ops in AI, machine learning and chip design did not. The joint venture's 20 internship postings (13 in California and Illinois, 7 in Vancouver) say nothing about sponsorship, which is not the same as a yes.
What "No Visa Sponsorship" probably means. CPT and OPT are authorizations from your school and USCIS, not employer sponsorship, so the line most likely means no H-1B for that requisition later (our reading). For a summer internship that may not matter; for an early-career job it decides whether you have a path beyond STEM OPT. Ask the recruiter in writing.
CPT for co-ops. Rivian's spring 2027 co-ops run January to August 2027, onsite and full time, and the postings make school requirements "your responsibility to fulfill." SEVP's BCM 2608-01 allows CPT only "if its absence would make the attainment of a degree an impossibility." That guidance is in effect and challenged: the preliminary-injunction hearing in AAU v. DHS is set for 2026-11-06 at 3:00 p.m. (check the docket after that date). Several schools have paused some CPT approvals; Rochester, for example, has paused new CPT approvals except degree-required training since its 2026-08-28 notice. Confirm CPT with your DSO before you accept.
STEM OPT. USCIS requires the employer to "Be enrolled in E-Verify" and to sign Form I-983; our E-Verify employer lookup guide shows how to check the hiring entity. Unemployment limits are unchanged: 90 days on OPT and 150 in aggregate on STEM OPT, per the SEVIS Help Hub. The OPT fees are only proposed (comments close 2026-11-09): the school would be the legal payer, though it could pass the cost on, and the fee would reach only DSO recommendations dated 60 or more days after a final rule.
Does Rivian sponsor green cards?
Yes, mostly for experienced hires. DOL's FY2026 Q3 PERM disclosure file lists dozens of Rivian Automotive, LLC cases, most of them certified and most for senior titles (Sr., Staff, Lead, Manager) in Normal and Irvine, then Palo Alto. The joint venture and Rivian, LLC appear with a few cases each. That is a record of past filings, not a promise for your role. Our guide to checking whether a company sponsors green cards walks through the same file.
Rivian is not among the eight employers (Microsoft, Adobe, Cognizant, Infosys, TCS, Wipro, HCL and Capgemini) whose PERM cases DOL announced it had suspended on 2026-10-08. That action is in effect with no written notice or end date as of 2026-11-01, and, in Mayer Brown's words, it "does not suspend any employer from the H-1B program." As of 2026-10-21, DOL's FLAG processing page showed PERM analyst review at January 2026 priority dates, averaging 303 days; check the live page before you plan around it.
In the November 2026 Visa Bulletin, Final Action Dates are 2013-11-01 for EB-2 India, 2014-01-22 for EB-3 India and 2025-04-01 for EB-2 rest of world. USCIS requires the Dates for Filing chart for November I-485s (USCIS chart page): 2015-01-15 for EB-2 and EB-3 India, 2026-03-15 for EB-2 rest of world. Consular cases use Final Action Dates, and any December date is a forecast until that bulletin is out.
A Rivian PERM can matter even after a move. Under AC21, a PERM or I-140 filed 365 or more days earlier can support one-year H-1B extensions past six years, and under 8 CFR 214.2(h)(13)(iii)(D) the new employer need not be the PERM filer. DOL's PERM labor-market-test NPRM (RIN 1205-AC29) cleared White House review on 2026-10-23 but has not been published, so it has no text or comment period yet and current PERM rules apply.
Will Rivian layoffs affect sponsorship?
They can, though Rivian's filings give no headcount. Its Q3 2026 10-Q says: "we have implemented and continue to implement certain cost reduction efforts to reduce material spend, operating expenses, and capital expenditures, including several reductions in force."
We found no Rivian notice in the California EDD WARN reports covering 2024-07-01 through 2026-10-28. WARN covers only larger site-level layoffs, so that is not proof there were none; Illinois posts monthly summaries on DCEO's WARN page. Layoffs touch sponsorship in three ways:
- Your own status. The discretionary H-1B grace period of up to 60 days is in effect; DHS has only proposed eliminating it for H-1B and other worker categories, not F-1 students (NPRM, comments close 2026-11-10). On OPT or STEM OPT, a layoff runs the unemployment clock instead (90 days on OPT, 150 in aggregate with STEM OPT); the separate F-1 60-day grace period after OPT ends is intact because the D/S rule is blocked in court. See our guide to being laid off on STEM OPT.
- Green cards. Under 20 CFR 656.17(k), a layoff "in the area of intended employment within 6 months" in the same or a related occupation means the employer must notify and consider the laid-off US workers before filing PERM, which can slow green cards for that job family.
- Policy. EO 14431 (signed 2026-09-18) is in effect as a directive telling State, Labor and DHS to "take into account" a sponsor's layoffs in H-1B decisions, but as of 2026-11-01 no DOL, USCIS or State guidance implements it, and it creates no automatic denial.
How to check sponsorship for a specific Rivian role
- Open the USCIS H-1B Employer Data Hub and search "Rivian Automotive" and "Rivian and VW Group Technology"; compare initial and continuing approvals by year.
- Download the latest LCA disclosure file from DOL's OFLC performance page and filter the employer name for "Rivian"; check the SOC title, worksite and wage level for your job family.
- Read the full posting on careers.rivian.com or the venture's Ashby board, looking for a "No Visa Sponsorship" line near the role summary.
- Ask the recruiter which legal entity will issue your offer and whether the requisition supports H-1B registration and, later, PERM.
- Confirm in E-Verify's employer search that the hiring entity is enrolled before you plan a STEM OPT Form I-983.
- Take the offer to your DSO for CPT, OPT and STEM OPT questions, and to an immigration attorney for H-1B and PERM questions.
Worked example: an OPT engineer at the Normal plant
Say you finished an MS in electrical engineering in May 2026, your OPT EAD runs 2026-06-15 to 2027-06-14, and you joined Rivian Automotive in Normal in July 2026.
Illustrative timeline (as of 2026-11)
| When | What happens | Who acts |
|---|---|---|
| Now to early 2027 | Ask whether Rivian will register you for FY2028, and at what wage level | You and the recruiter |
| At least 30 days before registration | USCIS announces FY2028 registration (not announced as of 2026-11-01; March 2027 is an expectation only) | USCIS |
| Before 2027-06-14 | File Form I-765 for STEM OPT with Rivian's signed I-983; a timely filing gets the 180-day automatic extension | You, Rivian, your DSO |
| If selected | Rivian files Form I-129 requesting a change of status; if your OPT or STEM OPT would end first, cap-gap extends F-1 status and work authorization to the approved petition's start date, or to 2028-04-01 if that is earlier (our arithmetic for FY2028) | Rivian's counsel |
| If your team moves to the venture | New employer: new I-983, E-Verify check, DSO update and, for H-1B, a petition from the venture itself | You, the venture, counsel |
A STEM OPT filing made after the OPT EAD expires gets no 180-day extension, and a registration belongs to the employer that filed it, so raise any entity change during cap season with an attorney first. Cap-gap details are on the USCIS cap-gap page.
Common mistakes
- Treating Rivian and the venture as one employer. They have separate tax IDs, Data Hub rows, job boards and petitions.
- Taking silence for a yes. Most Rivian postings, and all of the venture's, say nothing about sponsorship.
- Assuming "No Visa Sponsorship" bars every F-1 student. Rivian reviews eligibility case by case; ask what the line covers.
- Accepting a spring co-op before your school confirms CPT. Some schools have paused approvals.
- Filing for STEM OPT after the OPT EAD expires. A late filing loses the 180-day extension.
- Reading a layoff headline as a sponsorship freeze. Check the latest 10-Q and state WARN reports, then ask about your team.
Frequently asked questions
Does Rivian sponsor H-1B?
Yes. The USCIS H-1B Employer Data Hub shows 151 initial-employment approvals and 390 continuing approvals for Rivian Automotive, LLC in FY2024, with 6 denials, so 541 of 547 decisions were approvals (98.9%). Sponsorship is still set per requisition, and 54 of the 907 US postings on Rivian's careers site in early November 2026 said sponsorship is not offered.
Does Rivian hire OPT students?
For some roles. Rivian's student FAQ says it will review eligibility "on a case-by-case basis" and that valid work authorization is required. In early November 2026, 42 of its 55 US internship and early-career postings carried a "No Visa Sponsorship" line, so ask the recruiter what that line covers before you rely on OPT or STEM OPT there.
Does Rivian sponsor green cards?
Yes, mostly for experienced hires. The Department of Labor's FY2026 Q3 PERM disclosure file (decisions from 2025-10-01 through 2026-06-30) lists dozens of Rivian Automotive, LLC cases, most of them certified and for senior engineering and operations titles. Rivian is not one of the eight employers in the PERM suspension DOL announced on 2026-10-08, and that suspension is not an H-1B suspension.
What is Rivian and VW Group Technology?
It is a 50/50 joint venture between Rivian and Volkswagen, formed in November 2024 to build vehicle electrical architecture, electronic control units and software. Rivian's Q3 2026 10-Q calls it a separate legal entity with its own management and board, so it files its own H-1B petitions, has its own Data Hub record and posts jobs on its own board.
Will Rivian layoffs affect sponsorship?
They can. Rivian's Q3 2026 10-Q (filed 2026-10-29) says it has carried out several reductions in force, without giving numbers. A layoff can end your job and start the discretionary H-1B grace period of up to 60 days (still in effect; its removal is only proposed) or the OPT unemployment clock. Under 20 CFR 656.17(k), a layoff in the same or a related occupation and area within six months before a PERM filing means the employer must notify and consider the laid-off US workers first.

How we checked this: Data Hub figures come from the USCIS extract behind our employer pages; LCA and PERM patterns come from our own filter of DOL's FY2026 Q3 disclosure files for employer names containing "Rivian", grouped by tax ID; posting counts come from every listing on careers.rivian.com and the venture's Ashby board, read in early November 2026 (postings change daily); company facts come from Rivian's SEC filings; rule status comes from USCIS, DOL and the Federal Register as of 2026-11-01.
This is general information, not legal or tax advice; your own I-20, EAD, I-797 and I-94, and your DSO or immigration attorney, govern your case.
