Self-Petition Green Card Online: Filing I-140 and I-485 Together for EB-1A and NIW in 2026
Self-petitioners can now file the EB-1A or NIW petition and the green card application in one online session, but only if the priority date chart lets you.

Part of our guide to Form I-140.
If you are an F-1 student, OPT worker or H-1B professional building your own EB-1A or EB-2 NIW case, here is the short answer to the self petition green card question everyone is asking this fall: yes, you can now file Form I-140 and Form I-485 together online. Since 2026-07-24, unrepresented EB-1A and NIW self-petitioners can submit both forms in one USCIS online account, and attorneys can file the same pair concurrently online by PDF upload (USCIS).
The catch: online filing changed how you file, not whether you may file the I-485. That is still decided by your priority date and the visa bulletin chart USCIS designates each month, and for many readers in October 2026 the answer is "I-140 now, I-485 later."
Status as of 2026-10-14. In effect: online concurrent I-140 + I-485 filing for self-petitioners (since 2026-07-24); the 10/07/26 fee schedule; only the 09/18/26 edition of Form I-485 is accepted; the October 2026 Dates for Filing chart for employment-based I-485s; the final rule ending automatic EAD extensions (2026-10-14). Not yet published: the November 2026 Visa Bulletin. Unchanged since 2026-08-05: no new USCIS EB-1A or NIW policy after Policy Alert PA-2026-05.
What changed for self petition green card filers on 2026-07-24
Before July, pairing an online I-140 with an I-485 generally meant falling back to paper. The new option closes that gap.
| Old rule (before 2026-07-24) | New rule (in effect since 2026-07-24) | What to do differently | |
|---|---|---|---|
| Self-petitioner, no attorney | Concurrent I-140 + I-485 generally filed on paper | I-140 and I-485 filed together online in your own USCIS account | Build the full evidence set as clean PDFs before you start the session |
| Attorney or accredited representative | Concurrent package generally on paper | Concurrent filing online by PDF upload | Ask your representative which channel they use and why |
| Fees | Paper fees applied to the package | Lower online fees for I-140 and I-485 (G-1055, 10/07/26) | Budget with the online column, not the paper one |
| I-485 form edition | 01/20/25 and 09/04/26 editions in use | Only the 09/18/26 edition is accepted (since 2026-09-18, no grace period) | Download the form fresh from uscis.gov/i-485 the week you file |
Online filing is still optional: USCIS's mandatory e-filing rule (effective 2026-08-11) had designated no form as of 2026-10-13. If you file on paper, note that the I-485 filing location changed on 2026-10-07; packages sent to the prior location are accepted if postmarked by 2026-11-09.

The gate: your priority date must be current
For an EB-1A or NIW self-petition, your priority date is the date USCIS receives your I-140. To file an I-485 at the same time, that priority date must be earlier than the cutoff on the chart USCIS tells you to use that month, or the chart must show your category as current ("C").
For October 2026, USCIS requires the Dates for Filing chart for employment-based I-485s (USCIS filing charts).
October 2026 cutoffs (as of October 2026)
| Category | Country of chargeability | Dates for Filing (lets you file) | Final Action Date (lets USCIS approve) |
|---|---|---|---|
| EB-1 (includes EB-1A) | India | 2024-07-01 | 2023-02-01 |
| EB-1 (includes EB-1A) | China | 2024-07-01 | 2023-07-01 |
| EB-2 (includes NIW) | Rest of world | 2026-03-15 | 2025-01-01 |
| EB-2 (includes NIW) | China | 2023-01-01 | 2021-10-01 |
| EB-2 (includes NIW) | India | 2015-01-15 | 2013-11-01 |

Why a brand-new filing usually cannot be concurrent in a backlogged row
Run the arithmetic. A rest-of-world NIW self-petitioner who files the I-140 in October 2026 gets an October 2026 priority date, later than the 2026-03-15 cutoff, so the I-485 cannot be filed that month, online or on paper. The same logic applies to an EB-1A filer chargeable to India or China against a 2024-07-01 cutoff, and even more so in EB-2 India.
That does not make the I-140 pointless. Filing it locks in your priority date, and you can file the I-485 later in any month when the designated chart reaches you. Two situations change the math and both belong with a licensed immigration attorney: priority date retention from an earlier approved I-140 (for example, an old PERM-based EB-2 case), and cross-chargeability to a spouse's country of birth.
Fees as of October 2026 (G-1055, edition 10/07/26)
| Form | Online fee | Notes |
|---|---|---|
| I-140 (self-petitioner) | $665 | Paper filing costs more |
| Asylum Program Fee (self-petitioner) | $300 | Charged with the I-140 |
| I-485 | $1,390 | Per applicant; paper filing costs more |
| I-765 with a pending I-485 filed after 2024-04-01 | $260 | Optional work permit (category c9) |
| Principal applicant, I-140 + I-485 online | $2,355 | Sum of the three rows above |
| With I-765 added | $2,615 | Before any advance parole or family members |
Source: Form G-1055 fee schedule. A spouse or child adjusting with you files a separate I-485 and pays a separate fee; check G-1055 for each person rather than multiplying the principal's number. Advance parole is a separate filing with its own fee. Our guide to EAD and advance parole while your I-485 is pending covers how those companion forms work for self-petitioners.
Step by step: filing I-140 and I-485 together online
- Check the chart first. Open the USCIS filing-charts page and confirm which chart applies this month and whether your priority date (the day you file) beats the cutoff for your category and country. If it does not, the I-485 cannot be filed that month.
- Read the USCIS online-filing page. It explains the paths open to unrepresented self-petitioners and to representatives, and lists the companion forms (such as I-765, I-131 and I-693) that can be uploaded with the I-485. Confirm the list the week you file.
- Confirm form editions. Only the 09/18/26 edition of the I-485 is accepted. Download every form the week you file.
- Assemble the I-140 evidence as PDFs. For EB-1A, that is evidence against the extraordinary-ability criteria plus final-merits support; for NIW, threshold EB-2 eligibility plus the three Dhanasar prongs. Label each exhibit clearly, because an officer reads it in a digital file.
- Assemble the I-485 civil documents. Birth certificate, passport, I-94, every immigration document you have held, photos, and the medical exam on Form I-693. Work from our I-485 document checklist so nothing is missing.
- Pay the online fees shown on G-1055 for each form in the session.
- Save your receipt notices. Each form gets its own receipt number. Your I-140 receipt date is your priority date.
- Attend biometrics when the appointment notice arrives, and keep your USCIS account address current.
- Watch for RFEs. After PA-2026-05 (2026-08-05), RFEs commonly give 30 days to respond, and 12 weeks is the maximum, not the standard. The deadline printed on your notice controls.
I-140 and I-485 concurrent filing processing time
There is no single number. Concurrent filing runs two separate adjudications:
- The I-140 decides whether you qualify as EB-1A or NIW. Premium processing ($2,965 on G-1055) speeds a decision on that form only, not the I-485.
- The I-485 decides whether you are admissible and whether a visa number is available. It cannot be approved until the I-140 is approved and your priority date is current on the Final Action Dates chart, which is usually more restrictive than the Dates for Filing chart that let you file.
So your real timeline is the later of three events: I-140 approval, I-485 background and interview processing, and Final Action date availability. For scale only: one law-firm aggregator reported regular (non-premium) I-140 processing at the 80th percentile of about 32.5 months for EB-1A and 30 months for NIW around September 2026. That is a reported, unofficial figure. Look up both forms on the USCIS processing times tool instead.
Two dated rules affect life while you wait. The c9 EAD is available at $260 with a pending I-485. And the final rule ending automatic EAD extensions is in effect on its publication, 2026-10-14: a renewal EAD application filed on or after 2025-10-30 no longer extends an expiring card while it is pending. See our breakdown of the automatic EAD extension rule.
What concurrent filing means for your F-1, OPT or H-1B status
A pending I-485 is an immigrant filing, and your nonimmigrant status still has its own rules.
| Your current status | Effect of filing an I-485 | Travel while I-485 is pending | Who to ask |
|---|---|---|---|
| F-1 student or OPT/STEM OPT | F-1 is not a dual-intent status, so the filing signals immigrant intent | Leaving without advance parole generally abandons the I-485, and the F-1 return route has no exception | DSO for SEVIS and OPT reporting; attorney for intent and travel |
| H-1B (and H-4 dependents) | H-1B is dual intent | A worker who keeps maintaining H-1B status can generally return on a valid H-1B visa without abandoning the I-485; the conditions are narrow | Attorney; employer's immigration counsel |
| Any status, I-140 denied | The I-485 generally falls with it, and so does a c9 EAD based on it | Plan for status independent of the green card case | Attorney |
If an H-1B holder needs a new visa stamp: third-country stamping ended 2025-09-06 (apply in your country of nationality or residence), and domestic H-1B renewal is not back. Check the live visa wait times page rather than assuming a slot exists.
Filing together vs. I-140 first: the factors, not the answer
Whether to file concurrently is a legal decision for you and a licensed immigration attorney. The factors people weigh:
- Chart position. If your priority date is not current on the designated chart, the choice is made for you that month.
- Evidence strength. If the I-140 is denied, the I-485 fees go with it, and a 30-day RFE leaves little room to rebuild a thin record.
- Status. An F-1 student's intent and travel exposure differ sharply from an H-1B worker's.
- Family and cash flow. Each dependent adds an I-485 fee and documents; the principal pays $2,355 up front versus $965 for the I-140 and Asylum Program Fee alone.
Common mistakes
- Treating online filing as eligibility. The online option did not change the priority date rule. A brand-new EB-2 rest-of-world NIW filing, with no earlier retained priority date, cannot be concurrent in October 2026.
- Reading the wrong chart. USCIS chose Dates for Filing for October 2026; in some summer months of 2026 it required Final Action Dates. Check the filing-charts page every month.
- Uploading an old I-485 edition. Only 09/18/26 is accepted, with no grace period.
- Budgeting from paper fees or old blog posts. Use the 10/07/26 G-1055.
- Leaving the US on F-1 with a pending I-485. Without advance parole, that generally abandons the application.
- Assuming 12 weeks to answer an RFE. That is the maximum. Many notices give 30 days.
- Expecting a November cutoff. The November 2026 bulletin had not been published as of 2026-10-14. Anyone quoting one is forecasting.
Frequently asked questions
Can I file I-140 and I-485 together online for EB-1A or NIW?
Yes, since 2026-07-24; representatives file the pair online by PDF upload. The I-485 still needs a priority date current on that month's designated chart (Dates for Filing in October 2026).
How much does it cost to file I-140 and I-485 together online in 2026?
$665 (I-140 online) plus $300 (Asylum Program Fee) plus $1,390 (I-485 online), or $2,355 for the principal under G-1055 edition 10/07/26. An I-765 with a pending post-2024-04-01 I-485 adds $260. Each adjusting family member pays a separate I-485 fee.
What is the I-140 and I-485 concurrent filing processing time?
No single number exists. The I-485 waits for I-140 approval and a current Final Action date, so the slower event sets your timeline. Check the live USCIS tool.
Can I travel while my concurrent I-485 is pending on F-1 or H-1B?
Leaving without advance parole generally abandons a pending I-485. H-1B and L-1 workers maintaining status have a narrow exception; F-1 students and OPT workers do not. Ask an immigration attorney before any trip.
Can a new NIW filer from the rest of the world file concurrently in October 2026?
Generally not. A new October I-140 creates an October 2026 priority date, later than the 2026-03-15 cutoff. The I-485 can follow in a later month when a designated chart reaches that date.

Frequently asked questions
Can I file I-140 and I-485 together online for EB-1A or NIW
Yes. Since 2026-07-24, unrepresented EB-1A and EB-2 NIW self-petitioners can file Form I-140 and Form I-485 together through a USCIS online account, and attorneys or accredited representatives can file the pair concurrently online by PDF upload. You can only file the I-485 part if your priority date is current on the chart USCIS designates for that month, which for October 2026 is the Dates for Filing chart.
How much does it cost to file I-140 and I-485 together online in 2026
Under the 10/07/26 edition of the USCIS fee schedule (Form G-1055), the online I-140 fee is $665 plus a $300 Asylum Program Fee for self-petitioners, and the online I-485 fee is $1,390, which adds up to $2,355 for the principal applicant. An I-765 work permit filed with a pending I-485 submitted after 2024-04-01 is $260. Every family member who adjusts files a separate I-485 with its own fee, so check G-1055 for each person.
What is the I-140 and I-485 concurrent filing processing time
There is no single number, because USCIS adjudicates two separate forms on two separate clocks. The I-485 cannot be approved until the I-140 is approved and your priority date is current on the Final Action Dates chart, so the slower of those two events sets your timeline. Look up both forms on the live USCIS processing times tool rather than relying on a published estimate.
Can I travel while my concurrent I-485 is pending on F-1 or H-1B
Leaving the United States without advance parole is generally treated as abandoning a pending I-485. A narrow regulatory exception lets H-1B and L-1 workers who are maintaining that status return on a valid visa and resume it without abandoning the application, but F-1 students and OPT workers do not get that exception. Talk to an immigration attorney before booking any trip.
Can a new NIW filer from the rest of the world file concurrently in October 2026
Generally not in October. The October 2026 Dates for Filing cutoff for EB-2 rest of world is 2026-03-15, and a self-petitioner who files a new I-140 in October gets an October 2026 priority date, which is later than that cutoff. The I-140 can still be filed alone, with the I-485 filed in a later month when a designated chart reaches that priority date. The November 2026 Visa Bulletin had not been published as of 2026-10-14.
