Graduating in December 2026 on F-1: Your OPT Window, the Real Grace Period and the Proposed Fee

The 30-day grace period you keep reading about belongs to a blocked rule, the school-paid $70,000 OPT fee is only a proposal, and your OPT filing window is already open.

Part of our guide to the proposed OPT fee.

If you are graduating in December 2026 on F-1 and plan to use OPT, three facts set your calendar as of November 1, 2026. USCIS can receive your Form I-765 from 90 days before your I-20 program end date until 60 days after it (in effect). Your grace period is still 60 days, because the Duration of Status rule that would have cut it to 30 days has been blocked by a federal court since September 14, 2026. And the school-paid $70,000 OPT fee is only proposed. For a December 15 program end date, your window runs from September 16, 2026 to February 13, 2027.

Status line, as of November 1, 2026: OPT filing rules, the 60-day grace period and the 90-day OPT unemployment limit are in effect; the D/S rule (91 FR 44976) is blocked; the OPT fee (91 FR 64566) is proposed. D/S summary-judgment replies are due Monday, November 2; check the docket after that date.

Common misconception: "December graduates now get only a 30-day grace period." Correction: that number comes from the D/S final rule, which never took effect. The USCIS Form I-539 page, updated October 7, 2026, says DHS "is preliminarily enjoined from taking any further action to implement the final rule" and "USCIS will proceed under the previous regulatory provisions." Some official pages were never updated after the order (FederalRegister.gov's effective-date field, the eCFR text of 8 CFR 214.2(f), ICE's SEVIS "What's New" page, SEVP broadcast BCM 2607-02). They are stale, not proof the rule is live.

Graduating in December 2026 with OPT: the short answer

As of November 1, 2026, a December 2026 F-1 graduate's OPT application must reach USCIS between 90 days before the I-20 program end date and 60 days after it, and within 30 days of the DSO's SEVIS recommendation, whichever ends first. The F-1 grace period is still 60 days, and the OPT fee is only a proposal.

When should I apply for OPT if I graduate in December 2026?

Inside a window that is already open. The USCIS OPT for F-1 students page says you "May apply up to 90 days before you complete your degree, but no later than 60 days after you complete your degree," and "Must apply within 30 days after your DSO enters the recommendation for OPT into your SEVIS record." Exactly when you file inside that window is a decision to make with your DSO; here is how the clocks work.

Every deadline counts from the program end date on your I-20, not your ceremony. If a thesis defense, a last course or an incomplete grade could move that date, settle it with your DSO before requesting the recommendation.

Study in the States' Applying for Practical Training page (updated August 24, 2026) adds three limits. The 60th day after the program end date is "the latest possible start date for post-completion OPT" and the last date to be recommended or to file. You may start work only "Once you receive your EAD and the Employment Start Date on the EAD arrives." And all post-completion OPT must be finished within 14 months of the program end date, with up to 12 months authorized per degree level.

Processing time is the other half of the calendar. On November 1, 2026, the USCIS processing-times tool showed 80% of I-765 (c)(3) F-1 student cases completed within 5 months. That describes recently finished cases, not a promise for yours. Premium processing ($1,780) buys a USCIS action within 30 business days, not an approval.

Both clocks bind at once. Whichever ends first, the 30th day after your recommendation or the 60th day after your program end date, is your real deadline.

Do weekend deadlines roll over now?

Only on paper. Under PA-2026-15, in effect since October 23, 2026, the USCIS Policy Manual chapter on submitting requests counts weekends and holidays as days, and a paper filing is still timely "if received by the end of the next business day" when a period ends on a day USCIS does not accept paper. Electronic filings never roll. Our reading is that the 30-day and 60-day OPT windows roll on paper, and that the roll changes when a filing counts as timely, not how long you may stay. Confirm with your DSO and do not plan around it.

How to file for OPT between now and February, step by step

  1. Confirm the program end date on your I-20 with your school's international student office.
  2. Request the OPT recommendation from your DSO and note the date it is entered in SEVIS; that starts your 30-day clock.
  3. Choose how to file. Category (c)(3)(B) can be filed online through a USCIS account (see Forms Available to File Online). On paper, use only the 08/21/25 edition from the USCIS I-765 page; USCIS is not accepting the 09/15/26 edition. Our field-by-field I-765 walkthrough covers each part of the form.
  4. Pay the fee listed in Form G-1055 (edition 10/26/26): $470 online through Pay.gov, or $520 on paper by card (Form G-1450) or bank debit (Form G-1650).
  5. Mail a paper filing to the current address on the USCIS filing-locations update page; the I-765 location changed October 7, 2026, and an old address works only with a postmark on or before November 9, 2026.
  6. Check your initial evidence. Under PA-2026-05 (in effect since August 5, 2026, and challenged in court), USCIS can deny an OPT I-765 that lacks required initial evidence without first sending a request for evidence. Our initial-evidence checklist for avoiding a no-RFE denial lists what to include.
  7. Watch for your Form I-797C receipt and any biometrics notice, and keep your US mailing address current.
  8. Apply for a Social Security number at an SSA office on or after your EAD start date; the 08/21/25 I-765 has no SSN request.
  9. Report your employer the way your school instructs once you start work, so the SEVIS unemployment counter has employer information.

Is the F-1 grace period 30 or 60 days after graduation in 2026?

Sixty. The D/S final rule would have replaced duration of status with fixed admission periods and cut the F-1 grace period to 30 days. Judge Saylor's September 14, 2026 order in the District of Massachusetts postponed the rule and enjoined DHS nationwide, so D/S, the 60-day grace period and the no-I-539 status quo still apply.

Summary-judgment cross-motions were filed October 30 and replies are due November 2, so a ruling can come any time after that; DHS asks for "a remand to the agency without vacatur" or relief limited to the plaintiffs. DHS's First Circuit opening brief (No. 26-2112) is due November 9, and an appeal does not revive the rule. Follow the district court docket or our Duration of Status court tracker.

The 60 days give you time to prepare to leave, transfer, change status, or file for OPT. If you file, ask your DSO how a pending application affects your stay past day 60, and what a denial would mean.

Are there two different 60-day grace periods?

Yes. A separate DHS proposal would eliminate the discretionary 60-day grace period for workers (H-1B, H-1B1, L-1, O-1, E-1, E-2, E-3, TN and dependents), not F-1 or OPT. It is proposed, comments close November 10, 2026, and the current 60 days still applies. It matters to you later, on H-1B.

Does the OPT fee apply to December 2026 graduates?

Not as things stand. As of November 1, 2026, the fee is a proposed rule, and as written it would reach only DSO recommendations dated on or after an effective date set 60 days after a final rule. No final rule exists.

The proposal (91 FR 64566, docket ICEB-2026-0100, published October 8, 2026) would have your SEVP-certified school pay $70,000 before the initial OPT recommendation and $30,000 before each later one, STEM OPT included. Schools could pass the cost to students or employers. Students already on OPT, already approved, or holding a recommendation dated before the effective date would not be covered. The $100,000 in headlines is the proposal's own OPT-plus-STEM-OPT example, not a separate fee. Our explainer on who would actually pay the proposed OPT fee goes deeper.

For a December 15 graduate, the latest a DSO recommendation could be entered is February 13, 2027. On the proposal's own terms, the fee could reach that date only if a final rule were published by about December 15, 2026 (our arithmetic, not a forecast; a final rule can change the terms). As of November 1, comments are open until 11:59 p.m. ET on November 9, more than 4,700 have been filed, and no final OPT-fee rule is at the White House's regulatory office (OIRA). UT Dallas's October 12 FAQ answers "Does this publication affect my current plans for OPT?" with "No"; Duke encourages students within the filing window "to apply as soon as possible."

The open question is later recommendations. A STEM OPT recommendation in 2027 or 2028 could be covered if a final rule is in effect by then, and the text does not settle whether a student whose first OPT was fee-free would owe $70,000 or $30,000 (our reading).

Can I travel while OPT is pending over winter break?

The schools that publish guidance say wait. Cornell, Johns Hopkins and USC advise against international travel while an initial OPT application is pending. Cornell's travel on OPT page says "We recommend against traveling until you receive your OPT/STEM OPT EAD," warns that if you miss a biometrics appointment while abroad "your case could be delayed or denied," and says that if OPT is denied while you are outside the US, "you cannot reenter the United States in F-1 status to reapply for OPT."

If a family emergency makes travel feel unavoidable, talk to your DSO before booking, and to a licensed immigration attorney if your history complicates re-entry: a past status gap, a visa problem, or a nationality covered by Proclamation 10998's 39-country restriction (in effect since January 1, 2026). D/S still applies when you re-enter. F-1 visa applicants, renewals included, interview in person in their country of nationality or residence; check the State Department's Global Visa Wait Times page, not a number quoted online.

Once your EAD arrives, our guide to re-entry documents and the pending-I-765 trap lists what to carry back. If family is flying in for the ceremony instead, see inviting parents to a December 2026 graduation.

How many days can I be unemployed on OPT?

Ninety on post-completion OPT. The SEVIS Help Hub's unemployment counter page (updated July 27, 2026) says "Post-completion OPT: 90 days" and "STEM OPT: 150 days, which includes any days accrued while on post-completion OPT." SEVIS counts each day without employer information, looking back to the "Actual OPT Start Date."

So the days between graduation and your EAD start date are not unemployment days. You can job hunt and interview while the application is pending; you cannot work until the EAD's start date arrives.

Frequently asked questions

When should I apply for OPT if I graduate in December 2026?

USCIS must receive your Form I-765 no earlier than 90 days before your I-20 program end date, no later than 60 days after it, and within 30 days of your DSO's SEVIS recommendation, whichever ends first. For a December 15, 2026 program end date, the outer window opened September 16, 2026 and closes February 13, 2027, by our count.

Is the F-1 grace period 30 days or 60 days now?

It is still 60 days. The Duration of Status rule that would have cut it to 30 days has been blocked by a federal court since September 14, 2026, and USCIS says it will proceed under the previous regulations. Summary-judgment replies are due November 2, 2026, so check the docket for any ruling after that date.

Will the proposed $70,000 OPT fee apply to me?

As of November 1, 2026 the fee is only proposed (91 FR 64566, comments close November 9, 2026). As written, it would reach only DSO recommendations dated on or after an effective date set 60 days after a final rule, and no final rule exists. The school, not the student, would be the legal payer, although it could pass the cost on.

Can I travel home in December while my OPT is pending?

Cornell, Johns Hopkins and USC advise against international travel while an initial OPT application is pending. Cornell warns that a biometrics appointment missed while abroad could delay or deny your case, and that if OPT is denied while you are outside the US you cannot reenter in F-1 status to reapply. Talk to your DSO first.

How many days can I be unemployed on OPT?

Up to 90 days on post-completion OPT, and 150 days in total if you later get the STEM OPT extension. The SEVIS counter starts from the actual OPT start date on your EAD, not from graduation. A 60-day OPT unemployment limit does not exist as of November 1, 2026.

Who to ask about what

Your DSO handles your I-20, SEVIS record, OPT recommendation and travel signature. A licensed immigration attorney handles status strategy, a denied OPT application or complicated travel. A tax professional who prepares nonresident returns handles your first tax year on OPT wages.
