H-4 Spouse Getting Your Own H-1B: Lottery, Change of Status and Keeping Your H-4 EAD Job Until Day One

Your own H-1B frees your career from your spouse's job, but every day until October 1 still runs on their status and your EAD card.

Part of our guide to the H-4 EAD.

Yes, an H-4 spouse can get their own H-1B, and the usual route is an H4 to H1B change of status without leaving the US. A US employer registers you in the H-1B cap lottery. If you are selected, it files Form I-129 asking USCIS to switch you from H-4 to H-1B, effective no earlier than October 1. Until that day you are still an H-4 dependent: your status rides on your spouse's H-1B, there is no cap-gap for H-4, and you can work only on a valid H-4 EAD.

Status as of November 1, 2026: wage-weighted selection is in effect (since 2026-02-27). The FY2028 registration is not announced, and USCIS must give at least 30 calendar days' notice. No proposed or final rule ends the H-4 EAD; DHS lists a long-term agenda item (RIN 1615-AD14) with no proposal date. Automatic EAD extensions ended for renewals filed on or after 2025-10-30 (final rule in effect since 2026-10-14). The worker 60-day grace period still applies; ending it is only proposed.

H4 to H1B change of status: the short answer

An H-4 to H-1B change of status follows the normal cap process: an employer registers you in the lottery, files Form I-129 with a change-of-status request if you are selected, and your H-1B starts on the approved date, no earlier than October 1. Until then you stay in H-4, and only a valid H-4 EAD lets you work.

Three documents carry the process: the employer's registration, the I-129 petition filed after selection (it requests the change of status, so you file no separate I-539), and the I-797A approval, whose I-94 shows H-1B from the start date. For the longer career plan around this filing, see our guide to moving from H-4 EAD work to your own sponsorship.

What is in effect, proposed or only on an agenda

ItemStatus (as of 2026-11)What it means for you
Wage-weighted H-1B selectionIn effect since 2026-02-27The offered wage level sets your lottery entries
FY2028 registrationNot announced (30 days' notice required)March 2027 is an expectation only

Automatic EAD extensionEnded for renewals filed on/after 2025-10-30 (final rule in effect 2026-10-14; challenged, with court relief for seven plaintiffs only)A card that expires stops your work
$100,000 H-1B paymentProclamation in effect on paper; the fee is blocked by courts and not collectedA change of status granted inside the US was never covered
Worker 60-day grace periodIn effect; elimination proposed, comments close 2026-11-10A discretionary period of up to 60 days if your spouse's job ends (check the Federal Register for the outcome after 2026-11-10)
DOL prevailing-wage rule (RIN 1205-AC30)Proposed 2026-03-27; no final ruleToday's OEWS wage levels still apply

On the H-4 EAD, the DHS agenda entry for RIN 1615-AD14 lists the NPRM date as "To Be Determined", and nothing is under White House review. The real case for your own H-1B is independence: your work and status stop depending on your spouse's job.

Can an H-4 spouse enter the H-1B lottery?

Yes. Can H-4 apply for H-1B? Yes, but not on your own: the registrant is the prospective employer, and USCIS's registration page describes the account as one "a prospective petitioner must create." Your H-4 status plays no part in selection.

What does matter is the wage level of the job. Under the weighted-selection final rule, registrations "assigned wage level IV will be entered into the selection pool four times," Level III three times, Level II twice and Level I once. Two details catch H-4 spouses coming back from a career gap:

For scale, USCIS's registration chart ends at FY2026, the last cycle before weighting: 343,981 eligible registrations and 120,141 selected. The FY2027 fee was $215 per registration, and the FY2027 cap was reached on 2026-07-17 with no second selection.

Does a US master's give an H-4 spouse better lottery odds?

It gives you a second draw. USCIS's cap season page describes a 65,000 regular cap plus "an additional 20,000 petitions" for people with a US master's or higher. USCIS fills the regular cap first from the whole pool, then selects from the remaining master's-eligible registrations, and 8 CFR 214.2(h)(8)(iii)(A)(6) applies the same wage weighting in that second round. The degree must come from a US institution of higher education, and H-4 status changes nothing.

Two routes that skip the lottery

This table assumes a FY2028 cycle that follows the FY2027 pattern. Every 2027 date is an expectation, not an announcement.

On 2026-11-01, USCIS's tool showed 80% of H-1B change-of-status petitions completed within 10 months, so an April filing can still be pending in October. If USCIS decides after the start date, your H-1B generally begins on approval and you stay in H-4 until then. Premium processing on Form I-907 costs $2,965 and promises "adjudicative action" within 15 business days for an I-129. An unpublished draft titled "Amending the Premium Processing Timeframe" (RIN 1615-AD25) has been under White House review since 2026-10-13; its text and direction are not public. Check the live USCIS processing times, and see whether you can work on an I-797 receipt notice if the receipt confuses you.

Current amounts are on the USCIS fee schedule. From 2026-11-09, USCIS accepts only the 09/09/26 edition of Form I-129, so a spring 2027 filing will use whatever edition the I-129 page lists then.

Can I keep working on my H-4 EAD until my H-1B starts?

Usually yes. Until the change takes effect you are still in H-4, and your (c)(26) EAD is not tied to one employer, so you can keep your current job (with the sponsor or someone else) until your H-1B begins. What can break that plan is the card or your spouse's status, not the petition.

Where attorneys disagree. On its face, the (c)(26) EAD is not limited to one employer, and you stay in H-4 until the change takes effect. Practitioners still differ on how to treat work for a second, non-sponsoring employer while the H-1B change of status is pending, and the published rules do not address that sequence directly. Before you keep or take a job other than your sponsor's after filing, ask the attorney handling your I-129 to confirm the plan in writing.

On day one the answer is simpler. Once you are in H-1B, you are no longer an H-4 dependent, so the EAD no longer covers you, and you may work only for the H-1B petitioner (or another employer that files its own H-1B petition for you). If you are not yet sure you qualify for an EAD at all, our H-4 EAD eligibility and application guide covers the approved I-140 and AC21 tests.

If you do not have an H-4 EAD

You cannot work for anyone, including the sponsor, until your H-1B status begins. A selection notice, I-797C receipt or I-797A approval does not change that. You can interview, negotiate and plan your start date.

Is there cap-gap for H-4 to H-1B?

No. USCIS's cap-gap page covers "cap-subject H-1B petitions that are properly and timely filed for an eligible F-1 student" and runs to April 1 of the fiscal year requested. It does not cover H-4 dependents, and it never covers cap-exempt petitions.

You do not need cap-gap in the same way, because H-4 status does not expire on a program end date. It lasts as long as your I-94 and your spouse's H-1B status do, and that is the weak point. If your H-4 I-94 ends before October 1, the pending H-1B petition does not stretch it. Bridging that gap normally takes an H-4 extension filed while you are still in status, usually alongside your spouse's extension, and your attorney should time it with the cap filing.

What happens if your spouse's H-1B ends before your H-1B starts?

Your H-4 status depends on theirs. If your spouse's employment ends, 8 CFR 214.1(l)(2) currently allows a discretionary grace period of up to 60 days for H-1B workers and their dependents. DHS has proposed eliminating it (RIN 1615-AD22); comments close 2026-11-10, and nothing changes unless a final rule is published. The proposal would leave only the 10 days after a petition's validity period in 8 CFR 214.1(l)(1), which runs from the petition's end date, not from a layoff. This is the worker grace period, separate from the F-1 60-day grace period.

If your spouse moves to a new H-1B employer in time, your H-4 can continue, though you may need your own filing. If your spouse leaves the US or loses status before your start date, your H-4 ends, your EAD ends with it, and USCIS can deny the change of status while approving the petition for consular notification (an I-797B). That means getting an H-1B visa abroad, in person, in your country of nationality or residence, with appointment waits on travel.state.gov.

The $100,000 payment is another reason to keep the change of status intact. USCIS's I-129 page says a court "vacated agency guidance implementing the $100,000 payment requirement," adding: "If this order is later lifted, DHS still plans to collect the payment." Its H-1B page (last updated 2026-09-21, before the latest court orders) says the payment does not apply to a change of status USCIS grants inside the US, but does apply if USCIS finds you ineligible for the change or the petition requests consular notification. With the fee blocked and not collected, that line matters only if collection resumes. For the household side, see what happens when a spouse is laid off on H-1B. Whether any status of your own could bridge the gap is a question for a licensed immigration attorney.

Before your employer files: a checklist

  1. Download your and your spouse's latest I-94s from the CBP I-94 website and confirm both run past 2027-10-01, or that extensions are planned.
  2. Compare the end date on your H-4 EAD (Form I-766) with 2027-10-01, and ask whether a renewal Form I-765 can be filed with your next H-4 extension on Form I-539.
  3. Ask HR which OEWS wage level the registration will claim for the offered wage, SOC code and work location.
  4. Confirm with the employer's attorney that the Form I-129 will request a change of status, not consular notification, and why.
  5. Decide with the attorney whether premium processing on Form I-907 is worth $2,965 for your dates.
  6. Avoid international travel while the change of status is pending unless your attorney has approved it, since leaving the US generally abandons the change request and leaves only consular notification.
  7. Tell the attorney about any job change your spouse is considering before your start date.

Common mistakes

Frequently asked questions

Can an H-4 spouse enter the H-1B lottery?

Yes, but you cannot register yourself. A prospective US employer submits the registration, and being on H-4 has no effect on your odds. Under the wage-weighted selection in effect since 2026-02-27, the wage level of the offered job sets your entries, from four at Level IV to one at Level I. As of 2026-11-01, USCIS has not announced the FY2028 registration dates.

Can I keep working on my H-4 EAD until my H-1B starts?

Usually yes, as long as your H-4 status and the EAD card both stay valid. Until the change of status takes effect, no earlier than October 1, you are still in H-4, and the (c)(26) EAD is not tied to one employer. Renewals filed on or after 2025-10-30 get no automatic extension, so if your card ends first you must stop work until the renewal is approved. Confirm any second-employer plan with the attorney handling your petition.

Is there cap-gap for H-4 to H-1B?

No. Cap-gap is an F-1 benefit for students whose employer timely files a cap-subject H-1B change-of-status petition, and it does not cover H-4 dependents. What carries you to October 1 is your own H-4 status, which depends on your spouse keeping H-1B status, plus a valid H-4 EAD if you want to work.

What happens if my spouse's H-1B ends before my H-1B starts?

Your H-4 status depends on your spouse's, so it can end with theirs, and your H-4 EAD ends with your H-4 status. As of 2026-11-01, a discretionary grace period of up to 60 days still applies to H-1B workers and their dependents, though DHS has proposed removing it (comments close 2026-11-10). If your status lapses before the change takes effect, USCIS can deny the change and approve the petition for consular notification, so call an immigration attorney right away.

Does a US master's give an H-4 spouse better lottery odds?

It gives you a second chance. USCIS first fills the 65,000 regular cap from all registrations, master's-eligible ones included, then selects for the 20,000 advanced-degree exemption from the master's-eligible registrations left over, with wage weighting in both rounds. The degree must be a master's or higher from a US institution, and being on H-4 makes no difference.
