Can You Work on an I-797 Receipt Notice? H-1B Transfer, STEM OPT, Cap-Gap and H-4 EAD Rules Compared
A receipt keeps you working in some statuses and not in others, and for H-4 EAD renewals filed since October 30, 2025 it no longer bridges the gap.

Part of our guide to the H-4 EAD.
Can you work on an I-797 receipt notice? Only when a specific rule says so. As of November 1, 2026, a receipt keeps or starts your work for an H-1B transfer (portability), a same-employer H-1B extension (the 240-day rule), a timely STEM OPT filing (up to 180 days), cap-gap for a cap-subject change of status (to April 1), and an eligible EAD renewal filed before October 30, 2025 (up to 540 days). It does not for an H-4 EAD renewal filed on or after October 30, 2025, initial OPT, or an F-1 to H-1B petition filed without valid OPT.
Status line, as of 2026-11-01. In effect: the final rule ending automatic EAD extensions (91 FR 65306), effective 2026-10-14, for renewals filed on or after 2025-10-30. It amends only 8 CFR 274a.13; in our reading, the portability, 240-day, STEM OPT and cap-gap rules are unchanged. Challenged: Jane Doe 1 v. DHS, whose 2026-09-10 injunction covers seven H-4 plaintiffs only. Proposed: ending the worker 60-day grace period (comments close 2026-11-10). Scheduled: from 2026-11-09, USCIS accepts only the 09/09/26 edition of Form I-129.
Can I work with an I-797 receipt notice? The short answer
An I-797C receipt notice proves USCIS received your filing; it does not authorize work by itself. You can work on a receipt only where a regulation says so: H-1B portability, the 240-day extension rule, the STEM OPT 180-day extension, cap-gap, and eligible EAD renewals filed before October 30, 2025. As of November 1, 2026, later H-4 EAD renewals get no extension.
If you are unsure which notice you hold, our guide to every I-797 notice type shows how to tell a receipt from an approval.

H-1B transfer: can you start the new job on the receipt notice?
Yes, if you qualify. The trigger is the filing, not approval; the I-797C is your proof of filing. Under 8 CFR 214.2(h)(2)(i)(H), an eligible worker "is authorized to start concurrent or new employment under section 214(n) of the Act upon the filing ... of a nonfrivolous H-1B petition on behalf of such alien, or as of the requested start date, whichever is later." Eligible means:
- you were lawfully admitted in, or otherwise granted, H-1B status (so an F-1 student with a pending change of status cannot port);
- the new petition was filed before your authorized stay on the I-94 expired; and
- you have not worked without authorization since your last admission.
Portability work "automatically ceases upon the adjudication" of the petition. A denial ends it; call an immigration attorney that day.
For Form I-9, USCIS's Handbook for Employers, section 7.5 has the new employer complete a new I-9, accept your foreign passport with your unexpired I-94 as a List A document, and write "AC-21" with the I-129 submission date. Our H-1B transfer process step by step covers what comes before that.
Edge cases to check before you resign
- Filed means properly filed. From 2026-11-09, USCIS accepts only the 09/09/26 I-129, and old mailing addresses work only if postmarked on or before 2026-11-09 (USCIS I-129 page). A rejected petition was never filed.
- Laid off, inside the worker 60-day grace period. This H-1B grace period (8 CFR 214.1(l)(2), not the F-1 one) is in effect; DHS has proposed eliminating it (comments close 2026-11-10; check the Federal Register for the outcome after that date). Whether a petition filed in that window supports a portability start is for the new employer's attorney.
- Cap-exempt history only. If you were never counted against the cap, moving from cap-exempt work to a cap-subject employer is a cap question, not a simple transfer.
What is the 240-day rule for H-1B extensions?
The 240-day rule lets you keep working for the same employer after your I-94 expires, if the extension was filed on time. 8 CFR 274a.12(b)(20) says such workers are "authorized to continue employment with the same employer for a period not to exceed 240 days beginning on the date of the expiration of the authorized period of stay."
The limits: the extension must be filed before your I-94 end date; it covers the same employer only; and if USCIS denies the case inside the 240 days, the authorization ends "upon notification of the denial decision." On Form I-9, HR writes "240-Day Ext." with the I-129 submission date and reverifies in Supplement B by the earlier of the decision or day 240.
The math that catches people
As of 2026-11-01, USCIS's processing-times tool shows 80% of H-1B extension cases completed within 11.5 months. Two hundred forty days is just under eight months, so a regular-processing extension can outlast the window.
Worked example. Your I-94 ends 2026-12-15 and your employer files on 2026-11-20, on the 09/09/26 edition. The window runs to about 2027-08-12 (counsel confirms the exact day); no decision by then means you stop working. Premium processing (Form I-907, $2,965 for most I-129 classes, 15 business days) is the employer's lever. See also working while an H-1B extension is pending.
STEM OPT: can you keep working after your EAD expires with a receipt?
Yes, if you filed on time. The 180-day extension is in effect and untouched by the 2026-10-14 rule, per USCIS's STEM OPT page. A STEM I-765 filed after the OPT EAD expires gets no 180 days.
Under 8 CFR 214.2(f)(11)(i)(C), you may file up to 90 days before the OPT EAD expires and must file within 60 days of your DSO's SEVIS recommendation. Work then continues from the card's expiration until USCIS decides, "but not to exceed 180 days" (8 CFR 274a.12(b)(6)(iv)).
Worked example. Your OPT EAD expires 2026-12-31; your DSO recommends on 2026-11-05 and you file on 2026-11-20. You can work up to 180 days past expiry, to 2027-06-29, or until a decision. The USCIS tool shows 80% of (c)(3) student I-765s completed within 5 months (as of 2026-11-01), so the cushion is thin. Premium processing costs $1,780 for 30 business days.
Since 2026-10-23, PA-2026-15 rolls a day-counted paper deadline ending on a weekend or holiday to the next business day; online filings never roll. Our reading: the 60-day window can roll on paper, but "before the EAD expires" is a date and does not. Confirm with your DSO.
On Form I-9, the M-274's F-1 section accepts your expired EAD with the I-20 your DSO endorsed for STEM OPT; HR writes "EAD EXT" with the date 180 days after expiry. Our guide to OPT and STEM OPT documents for I-9 reverification walks through each box.
Cap-gap: working on the receipt until April 1
Yes, for a cap-subject change of status filed while your OPT was valid. Under 8 CFR 214.2(f)(5)(vii), your status and OPT work "will be automatically extended until April 1 of the fiscal year for which such H-1B status is being requested or until the validity start date of the approved petition, whichever is earlier."
USCIS's cap-gap page sets three conditions:
- Cap-subject only. A cap-exempt employer means no cap-gap: work stops when your OPT EAD ends.
- OPT valid at filing. Students in the F-1 60-day grace period (a different period from the worker one above) "are not authorized to work"; a petition filed then extends status, not work.
- No bad outcome. Rejection, denial, revocation or withdrawal ends cap-gap automatically.
Why it matters now. A FY2027 petition still pending after 2026-10-01 keeps cap-gap running to April 1, 2027, and the USCIS tool shows 80% of H-1B change-of-status cases completed within 10 months (as of 2026-11-01). HR treats your expired EAD plus the I-797C as an unexpired EAD, writes "CAP-GAP" with the March 31 date, and reverifies by then if no approval arrives. The same USCIS page warns that leaving the US while the change-of-status request is pending means "the request for change of status will be considered abandoned," so talk to your DSO and an immigration attorney before any trip. Our cap-gap explainer has the full timeline.
Does an H-4 EAD renewal receipt let you keep working?
No, for any renewal filed on or after October 30, 2025, whatever older memos and forum threads say.
Common misconception: "File your H-4 EAD renewal on time and the receipt keeps you working for up to 540 days."
Correction, as of 2026-11-01: only timely renewals filed before 2025-10-30 keep up to 540 days. For later ones, (c)-category authorization "will terminate the day after the end validity date stated on the face of the EAD" (final rule, effective 2026-10-14).
Old rule, new rule, as of 2026-11-01 (91 FR 65306):
| Pending renewal | Filed before 2025-10-30 | Filed on or after 2025-10-30 | What changes at work |
|---|---|---|---|
| (c)(26) H-4 or (c)(9) EAD | Up to 540 days past the card's end date (H-4 also needed an unexpired H-4 I-94) | No extension | HR reverifies by the card's end date; work resumes only on approval |
| STEM OPT (c)(3)(C), timely | Up to 180 days | Unchanged | HR still enters "EAD EXT" |
Worked example. Your (c)(26) card ends 2027-01-31 and the renewal you filed in September 2026 is pending. HR must reverify by 2027-01-31, and you stop working on 2027-02-01 until the renewal is approved.
Also true as of 2026-11-01:
- The court order is narrow. The Jane Doe 1 v. DHS injunction (C.D. Cal., 2026-09-10) covers seven H-4 plaintiffs only.
- The H-4 EAD category still exists. No proposed or final rule ends it; DHS lists a long-term agenda item (RIN 1615-AD14) with no proposal date.
- Processing time decides the gap. 80% of standalone (c)(26) cases finish within 17.5 months, against 6.5 months when filed with an H-4 I-539 (USCIS tool, 2026-11-01). Filing is paper only, with no premium processing; ask the employer's attorney how to file.
Our explainer on the final rule ending automatic EAD extensions covers every affected category.
Initial OPT and a first F-1 to H-1B petition: no work on the receipt
The M-274 says F-1 students "must obtain an EAD from USCIS before they are authorized to work pursuant to OPT" and "may not begin employment until the date indicated on the EAD." Do not travel abroad while initial OPT is pending without first talking to your DSO. Likewise, an F-1 to H-1B receipt authorizes no work if you had no valid OPT at filing or, for a cap-exempt petition, once your OPT ends; H-1B work begins on the date your I-797A shows.
What your employer needs for Form I-9, step by step
- Download your latest I-94 from the CBP I-94 website and note its end date.
- Read the I-797C: the form (I-129 or I-765), the received date and any category code, such as (c)(3)(C) or (c)(26).
- Match your case to one table row, then confirm it with your DSO (OPT, STEM OPT, cap-gap) or the employer's immigration attorney (portability, 240-day rule, H-4).
- Present your chosen Form I-9 documents and ask HR to enter "AC-21", "240-Day Ext.", "EAD EXT" or "CAP-GAP" with the date in Section 2's Additional Information field.
- Calendar the Supplement B reverification date, track the case in USCIS's online case-status tool, and send HR the approval the day it arrives.
- Stop working and call your attorney or DSO the day a denial, rejection or withdrawal notice arrives.
Common mistakes
- Treating every I-797C as a work permit. Initial OPT receipts and H-4 renewals filed on or after 2025-10-30 authorize nothing.
- Filing STEM OPT after the OPT EAD expires.
- Starting the new H-1B job before the petition is filed, or on one USCIS rejected for an old edition or late postmark.
- Assuming 240 days covers a new employer or outlasts current processing.
- Counting on cap-gap for a cap-exempt employer or for OPT that expired before filing.
- Travelling on a pending case without your DSO or attorney.
Frequently asked questions
Can I start a new H-1B job on the receipt notice?
Yes, if you qualify for H-1B portability (8 CFR 214.2(h)(2)(i)(H), in effect as of November 1, 2026): you held H-1B status, the new employer filed a nonfrivolous I-129 before your I-94 expired, and you have not worked without authorization since your last admission. Work can begin on filing or the requested start date, whichever is later, and portability ends when USCIS decides, so a denial ends it.
Can I keep working on STEM OPT after my EAD expires if I have a receipt?
Yes, if the STEM I-765 was filed before your OPT EAD expired and within 60 days of your DSO's recommendation: up to 180 days past expiry, or until USCIS decides. The October 14, 2026 rule did not change this, but a filing after the OPT EAD expires gets no 180 days.
Does an H-4 EAD renewal receipt let me keep working?
Not if you filed on or after October 30, 2025. Under the final rule in effect since October 14, 2026, (c)(26) authorization ends the day after the card's end date, and work resumes only on approval. Earlier renewals keep up to 540 days; the September 10, 2026 order covers seven plaintiffs only.
What is the 240-day rule for H-1B extensions?
If your employer files an H-1B extension before your I-94 expires, 8 CFR 274a.12(b)(20) lets you keep working for the same employer for up to 240 days after the I-94 end date. It ends earlier on a decision, and on notice of a denial. A new employer is a portability question.
Can I work on the receipt for an F-1 to H-1B change of status?
Only through cap-gap: a cap-subject, timely petition filed while your OPT was valid extends status and work to April 1 of the fiscal year requested or the approved start date, whichever is earlier. Cap-exempt petitions get no cap-gap, and without valid OPT at filing you wait for H-1B status.

How we checked this: on 2026-11-01 we read 8 CFR 214.2 and 274a.12 (eCFR version of 2026-10-14), USCIS M-274 sections 5.0, 7.4.2 and 7.5, the 2026-10-14 final rule, the Jane Doe 1 order, the USCIS cap-gap, STEM OPT and I-129 pages, and the USCIS processing-times tool.
This is general information, not legal or tax advice; your own notice, I-94 and I-20 govern, and your employer's immigration counsel (or your DSO for F-1, OPT or SEVIS questions) decides how the rules apply to you.

Frequently asked questions
Can I start a new H-1B job on the receipt notice?
Yes, if you qualify for H-1B portability under 8 CFR 214.2(h)(2)(i)(H), in effect as of November 1, 2026. You must have been admitted in or granted H-1B status, the new employer must file a nonfrivolous I-129 before your I-94 expires, and you must not have worked without authorization since your last admission. Work can begin on filing or on the requested start date, whichever is later, and portability ends when USCIS decides the petition, so a denial ends it.
Can I keep working on STEM OPT after my EAD expires if I have a receipt?
Yes, if the STEM OPT I-765 was filed before your OPT EAD expired and within 60 days of your DSO's recommendation. You can then keep working for up to 180 days after the card's expiration date, or until USCIS decides, whichever comes first. The final rule of October 14, 2026 did not change this extension, but a STEM application filed after the OPT EAD expires gets no 180 days.
Does an H-4 EAD renewal receipt let me keep working?
Not if you filed the renewal on or after October 30, 2025. Under the final rule in effect since October 14, 2026, H-4 (c)(26) work authorization ends the day after the card's end date, and you cannot work again until the new card is approved. Renewals filed before October 30, 2025 can keep up to 540 days, and a September 10, 2026 court order covers only seven named plaintiffs.
What is the 240-day rule for H-1B extensions?
If your employer files an H-1B extension before your I-94 expires, 8 CFR 274a.12(b)(20) lets you keep working for the same employer for up to 240 days after the I-94 end date while the case is pending. The authorization ends earlier if USCIS decides the case, and it ends on notice of a denial. It does not cover a new employer, which is a portability question instead.
Can I work on the receipt for an F-1 to H-1B change of status?
Only through cap-gap, and only if the petition is cap-subject, timely, and filed while your OPT or STEM OPT was still valid. Cap-gap then extends your status and work to April 1 of the fiscal year requested or the approved start date, whichever is earlier. A cap-exempt petition gets no cap-gap, and a student with no valid OPT at filing cannot work until H-1B status begins.
