I-129 Filing Address: Where to File by Classification, and the Edition You Must Use
There is no single I-129 filing address. USCIS moved the I-129 filing locations on 2026-10-07 and the form edition changed too. Here is how routing works and what to check.

Your employer's immigration team says your petition goes out this week: a cap-gap case from F-1 OPT into H-1B, a transfer, or an extension. You want to know one thing: where is the I-129 actually filed, and is it on the right form?
The short answer: there is no single I-129 filing address. USCIS publishes the addresses on its Direct Filing Addresses for Form I-129 page, and it changed the I-129 filing locations on 2026-10-07. For many categories, the address depends on the classification, on whether premium processing is requested, and on the state where the petitioner's primary office is located. Packages sent to a prior location are accepted if postmarked on or before 2026-11-09. The form must be the 09/09/26 edition, or the 02/27/26 edition if postmarked or e-submitted before 2026-11-09.
I-129 filing address status as of October 2026
| Item (as of October 14, 2026) | Status | Date | What it means for an I-129 |
|---|---|---|---|
| New I-129 filing locations | In effect | Changed 2026-10-07 | Copy the address from the live USCIS page, not a template |
| Grace period for prior filing locations | In effect (30 days) | Postmarked on or before 2026-11-09 | After that, an old address risks rejection |
| Form I-129 edition 09/09/26 | In effect | Current edition | The edition to use going forward |
| Prior edition 02/27/26 | In effect (accepted for now) | Postmarked or e-submitted before 2026-11-09 | From 2026-11-09, only 09/09/26 is accepted |
| 9-11 Response and Biometric fee | In effect | Since 2026-09-09 | $4,000 (H-1B) or $4,500 (L-1), only on extension-of-status petitions by covered employers |
| Mandatory e-filing interim final rule | In effect | Since 2026-08-11; comment period ran to 2026-10-13 | USCIS may require e-filing later, with 60 days' notice. No form designated yet |
| PA-2026-15 "Definition of Day" | Scheduled | Effective 2026-10-23 | Changes how weekend and holiday deadlines work for paper filings |
| Deference-removal rule (RIN 1615-AD26) | Proposed | Published 2026-10-14; comments close 2026-11-13 | Would affect I-129 extensions. Today's deference rule still applies |
| $100,000 H-1B fee (Proclamation 11069) | Blocked by two courts | Proclamation extended to 2027-09-21 | Not being collected while the court orders stand |

Where to file Form I-129: the variables that decide the address
Your employer files the I-129; you are the beneficiary. Knowing the routing still helps you spot a mistake early. As of its 2026-10-07 update, the USCIS address page sorts paper filings along these lines:
- Classification. Each category has its own section: E, H-1B and its variants (H-1B1, H-1B2, H-1B3), H-2A, H-2B, H-3, L, O, P, Q-1, R-1 and TN.
- Which kind of H-1B. Cap-subject petitions, cap-exempt petitioners, and "all other" H-1B petitions have separate entries. Read the entry that matches the case instead of assuming they are the same.
- Premium processing. A petition filed together with Form I-907 has its own address, separate from the non-premium one. A standalone I-907 to upgrade a pending I-129 has its own instructions too, including a copy of the transfer notice if USCIS moved the petition. Our H-1B premium processing guide covers the rest of premium processing.
- The petitioner's primary office. For many categories, the state or territory where the employer's primary office is located decides which USCIS lockbox receives the package. That is the employer's office, which is not necessarily your worksite. A few categories use a single address nationwide.
- Carrier. The USPS address and the FedEx, UPS or DHL address are often different.
- Paper or online. An online filing has no mailing address. It goes in through the employer's USCIS online account.
USCIS warns that a petition filed at the wrong location may be rejected. Routing by form, category and carrier is common across USCIS forms; our I-485 filing address guide shows how it works for green card applications.
I-129 filing location by classification: what to confirm
This table lists what decides the address as of October 2026, not the address itself. Copy the specific address only from the live page.
| Classification | Typical I-129 scenario | What changes the address | Confirm on |
|---|---|---|---|
| H-1B cap-subject | First H-1B after registration selection, including F-1 OPT cap-gap cases | Cap-subject entry; premium vs. non-premium; primary office state; online option | Direct Filing Addresses page plus the selection notice |
| H-1B cap-exempt and other H-1B | Extension, transfer, amendment, cap-exempt employer | Which H-1B entry applies; premium vs. non-premium; primary office state | Direct Filing Addresses page |
| L-1A / L-1B | Intracompany transferee petition | L section; premium vs. non-premium; location rules where listed | Direct Filing Addresses page |
| O, P | Extraordinary ability, athletes, entertainers | Classification section; premium vs. non-premium | Direct Filing Addresses page |
| E, TN, R-1 | Treaty, USMCA professional, religious worker | Classification section; premium vs. non-premium | Direct Filing Addresses page |
| H-2A | Seasonal agricultural workers | Online only, on Form I-129H2A; USCIS says it rejects paper | Forms Available to File Online page |
| H-2B, H-3, Q-1 | Seasonal non-agricultural, trainee, cultural exchange | Classification-specific rows; some use one national address | Direct Filing Addresses page |
The same idea applies to green card petitions. Our I-140 filing address explainer walks through how USCIS assigns an immigrant petition.
The I-129 edition date you must use
The current edition is 09/09/26. Per the Form I-129 page, USCIS accepts the prior 02/27/26 edition only if it is postmarked or electronically submitted before 2026-11-09. Starting 2026-11-09, USCIS says it will accept only the 09/09/26 edition and reject the older one. A rejection happens at intake, before anyone looks at the merits.
Where to find the I-129 edition date: the footer of every page, which reads like "Form I-129 Edition 09/09/26". That includes every supplement the petition uses, such as the H Classification Supplement, the H-1B Data Collection and Filing Fee Exemption Supplement, the L Supplement and the O and P Supplement. A packet built from an old template can mix two editions; every page should match.
If your employer's counsel started your packet before the new edition was posted, it is reasonable to ask whether they rebuilt it on 09/09/26 and whether the address came from the page as updated on 2026-10-07.
What changed: old rule, new rule, what to do differently
| Topic | Old rule | New rule (status, date) | What to do differently |
|---|---|---|---|
| Filing location | Pre-2026-10-07 addresses | New locations in effect 2026-10-07; old ones accepted if postmarked on or before 2026-11-09 | Take the address from the live page on the filing date |
| Form edition | 02/27/26 edition | 09/09/26 edition in effect; 02/27/26 accepted if postmarked or e-submitted before 2026-11-09 | Check the footer on every page, supplements included |
| Weekend/holiday deadlines | 2023 guidance (PA-2023-10) | PA-2026-15, scheduled 2026-10-23: next-business-day rule only for day-counted deadlines on paper filings | Don't assume an e-filing or a status deadline rolls forward |
| Deference on extensions | Prior approvals with the same parties and facts get deference | Removal proposed in a 2026-10-14 proposed rule (RIN 1615-AD26), comments close 2026-11-13 | Nothing changes yet. Today's deference rule still applies |
The 9-11 fee, precisely
The 9-11 Response and Biometric Entry-Exit Fee rule has been in effect since 2026-09-09. It applies only to extension-of-status petitions filed by covered employers: those with 50 or more US employees, more than half of them in H-1B or L-1 status. The amounts are $4,000 for H-1B and $4,500 for L-1, and the fee applies even to same-employer extensions. Amended petitions that do not seek an extension are exempt. Whether a particular petition owes the fee is a question for the employer's counsel. Our H-1B extension 9-11 fee guide has the details.
This post does not list base I-129 or premium processing fees. Get those from the USCIS fee schedule linked from the I-129 page.
Online I-129 filing and the e-filing rule
USCIS's Forms Available to File Online page, updated 2026-10-07, lists two routes for Form I-129:
- Fill out the form online: non-cap H-1B petitions, and H-1B cap petitions whose registrations were selected.
- Upload a completed PDF: H-1B (including H-1B1, H-1B2 and H-1B3), E, H-3, L-1A, L-1B, blanket L, O, P, Q, R-1, TN, and cap-exempt H-2B. USCIS says cap-subject H-2B petitions should not be filed online.
H-2A petitions use Form I-129H2A, which can only be filed online. Our guide to USCIS online filing compares the online routes across forms.
The mandatory e-filing interim final rule took effect on 2026-08-11. It lets USCIS require e-filing for any form that has been e-fileable for at least 180 days, with at least 60 days' notice, and hardship waivers are discretionary. The comment period ran to 2026-10-13. No form has been designated yet.
Deadlines and the "Definition of Day" policy
PA-2026-15, issued 2026-09-23 and scheduled to take effect 2026-10-23 for paper filings received on or after that date, narrows the weekend and holiday rule. A deadline counted in days that lands on a weekend or federal holiday moves to the next business day only for paper filings. E-filings count as received the moment they are submitted, and they never roll. Status and eligibility deadlines do not roll at all.
For an I-129, that matters most for day-counted deadlines like an RFE response. If your status depends on a filing date, that math belongs to your employer's counsel.
Step-by-step: how to check an I-129 before and after it ships
You can't file the petition, but you can ask good questions. A reasonable sequence:
- Ask which classification and processing type (regular or premium) the petition uses, and whether it is paper or online.
- Ask whether the address came from the live Direct Filing Addresses page on the filing date, based on the employer's primary office state and the carrier used.
- Ask which edition the packet uses. From 2026-11-09 it should be 09/09/26 on every page.
- If it is an extension, ask whether the 9-11 fee applies. That is a covered-employer question for HR and counsel.
- Ask for the courier tracking number for paper filings, so delivery can be confirmed.
- When the I-797C receipt notice arrives, keep it and note the receipt number. USCIS can later transfer a petition to another office and send a transfer notice. Track the case with the receipt number in USCIS's case status tools. Our explainer on Form I-797 notice types covers what each notice means.
- If you are on F-1 OPT in a cap-gap case, take the receipt notice to your DSO for any SEVIS or I-20 update. Questions about the petition itself go to the employer's immigration attorney. The two are not interchangeable.
Common mistakes
- Mailing to an old address after the grace period. Prior-location packages are accepted only if postmarked on or before 2026-11-09.
- Routing by your worksite instead of the employer's primary office. For many categories, USCIS uses the primary office state.
- Filing on the 02/27/26 edition on or after 2026-11-09. Intake rejection costs time, and in a cap or status-sensitive case, time is what you don't have.
- Using the non-premium address with a concurrent I-907. Premium filings have their own listing.
- Assuming the weekend rule rescues an e-filing. Under PA-2026-15, e-filings never roll.
- Believing the $100,000 fee is being collected. Proclamation 11069 extended the restriction to 2027-09-21, but two court orders block the fee.
- Treating proposed rules as law. Removing deference on extensions is only proposed. So is eliminating the worker 60-day grace period (comments close 2026-11-10). Today's rules still apply to both.
Frequently asked questions
Where do I file Form I-129
There is no single I-129 mailing address. The USCIS Direct Filing Addresses page, updated when the locations changed on 2026-10-07, assigns it by classification, premium or non-premium processing, and for many categories the state of the petitioner's primary office.
Which I-129 edition date does USCIS accept right now
The 09/09/26 edition is current. The 02/27/26 edition is accepted if postmarked or electronically submitted before 2026-11-09; from that date only 09/09/26 is accepted. Check the footer on every page, supplements included.
Can Form I-129 be filed online instead of mailed
Yes, for many classifications, and H-2A petitions on Form I-129H2A can only be filed online. The mandatory e-filing rule has been in effect since 2026-08-11, but no form had been designated as of October 2026, so paper filing remains available for the other categories.
Does a weekend or holiday deadline roll over for an I-129
Under PA-2026-15, scheduled for 2026-10-23, only day-counted deadlines on paper filings roll to the next business day. E-filings and status or eligibility deadlines never roll.
Does the new 9-11 fee apply to every I-129
No. It applies only to extension-of-status petitions by covered employers: $4,000 for H-1B and $4,500 for L-1, in effect since 2026-09-09. Amendments that don't seek an extension are exempt.
This article explains how I-129 filing logistics work. It is not legal advice. Your own receipt notice, I-94 and petition documents govern over anything published here, and decisions about your petition belong with the employer's immigration attorney.

Frequently asked questions
Where do I file Form I-129
There is no single I-129 mailing address. USCIS lists the addresses on its Direct Filing Addresses for Form I-129 page, which it updated when it changed the filing locations on 2026-10-07. For many categories the address depends on the classification, on whether premium processing is requested, and on the state of the petitioner's primary office. Your employer or its attorney files the petition, so the practical step for you is to ask them to confirm the address on that page on the day they file.
Which I-129 edition date does USCIS accept right now
The current edition is 09/09/26. USCIS also accepts the prior 02/27/26 edition if it is postmarked or electronically submitted before 2026-11-09. From 2026-11-09 USCIS says it will accept only the 09/09/26 edition. The edition date is printed at the bottom of every page, supplements included.
Can Form I-129 be filed online instead of mailed
Yes, for many classifications. USCIS lists them on its Forms Available to File Online page, and H-2A petitions on Form I-129H2A can only be filed online. A mandatory e-filing interim final rule has been in effect since 2026-08-11, but as of October 2026 USCIS has not designated any form for mandatory e-filing.
Does a weekend or holiday deadline roll over for an I-129
Under USCIS policy alert PA-2026-15, scheduled to take effect 2026-10-23, the next-business-day rule applies only to deadlines counted in days and only to paper filings received on or after that date. E-filings are received the moment they are submitted and never roll. Deadlines tied to status or eligibility do not roll either.
Does the new 9-11 fee apply to every I-129
No. The 9-11 Response and Biometric Entry-Exit Fee, in effect since 2026-09-09, applies only to extension-of-status petitions filed by covered employers, at $4,000 for H-1B and $4,500 for L-1. Amended petitions that do not seek an extension are exempt, and most H-1B employers do not meet the covered-employer test.
