USCIS Online Filing in 2026: Can You E-File Form I-765, I-539 or I-129, and Is It Becoming Mandatory?
You can e-file an OPT I-765 today and USCIS now has the power to make e-filing mandatory, but it has not done so for any form yet. Here is what that means for you.

Part of our guide to the OPT I-765 application.
Yes, I-765 online filing is available for OPT and STEM OPT: you file through your own USCIS online account, upload your I-20 and evidence, and pay electronically. As of October 14, 2026, you can also file I-539 online for most student and dependent classifications if you file only for yourself. I-129 online filing is done by your employer, not by you. And USCIS e-filing is not mandatory for any form yet: a rule in effect since August lets USCIS require it, but no form has been designated.
The method matters most for deadlines, because a scheduled USCIS policy changes how weekend deadlines work for online filers.
Status line, as of October 14, 2026. In effect: the mandatory e-filing interim final rule (since 2026-08-11), with no form designated. In effect: online concurrent filing of I-140 and I-485 (since 2026-07-24). Scheduled: USCIS policy alert PA-2026-15 on how filing-deadline days are counted (effective 2026-10-23). Blocked: the Duration-of-Status rule (since 2026-09-14; DHS has appealed), which is why USCIS takes only the older I-765 and I-539 editions. In effect: the final rule ending automatic EAD extensions (published 2026-10-14).
I-765 online filing and the other forms, at a glance
This reflects the USCIS form pages as of October 2026. USCIS's Forms Available to File Online page is the source of truth and can change without warning.
| Form (as of October 2026) | Who files it | Online option | Edition USCIS accepts on paper | Mandatory e-filing? |
|---|---|---|---|---|
| I-765, OPT and STEM OPT | You | Yes, categories (c)(3)(A), (B) and (C), in your own USCIS online account | 08/21/25 only; the 09/15/26 edition is not accepted | No |
| I-539 | You | Yes for listed classifications (including F-1, F-2, H-4, J-1, J-2, B-1 and B-2), only if you file for yourself with no co-applicants | 08/28/24 only; the 09/15/26 edition is not accepted. Filing location changed 2026-10-07; prior locations accepted if postmarked by 2026-11-09 | No |
| I-129 | Your employer | Employer's account: H-1B petitions online, many other classifications by PDF upload | 09/09/26; the 02/27/26 edition only if postmarked or e-submitted before 2026-11-09 | No |
| I-140 + I-485 together | Attorney or accredited representative, or an unrepresented EB-1A or NIW self-petitioner | Yes, since 2026-07-24 | I-485: only the 09/18/26 edition | No |
Editions are mostly a paper problem: online, you answer USCIS's own questions. The I-765 and I-539 edition rule exists because a federal court blocked the Duration-of-Status rule on 2026-09-14; USCIS says it will implement that rule if the order is lifted. For paper filers, our I-765 edition and filing address guide walks through that trap in detail.
Is USCIS e-filing mandatory? What the new rule actually allows
The rule is an interim final rule, Federal Register document 2026-16313, in effect since 2026-08-11 and announced in a USCIS newsroom alert. It does three things:
- It lets USCIS require e-filing for any form that has been available to file online for at least 180 days.
- USCIS must give at least 60 days' notice before a requirement takes effect for a form.
- It allows hardship waivers, but they are discretionary, not automatic.
The comment period closed on 2026-10-13. As of October 14, 2026, USCIS has not designated any form, so paper filing of the I-765, I-539 and I-129 is still accepted with the right edition and address.
Forms with long-standing online options, such as the I-765 and I-539, may already meet the 180-day threshold, but eligible is not designated. A designation must name the form and give at least 60 days' notice. Until then, anyone saying a paper OPT application "will be rejected because e-filing is mandatory" is ahead of the facts.
Old rule, new rule, what changes for you
| Topic | Old rule | New rule (status, date) | What to do differently |
|---|---|---|---|
| Paper vs online | Paper was always an option for every form | USCIS may require e-filing for a form with 60+ days' notice (in effect 2026-08-11; no form designated) | Knowing how your USCIS online account works means a future designation will not catch you mid-window |
| Deadline days | PA-2023-10 (2023) also rolled some non-day deadlines, such as a 21st birthday, to the next business day | PA-2026-15 (scheduled 2026-10-23): the roll applies only to day-counted deadlines on paper filings; e-filings never roll | For an e-filing, the calendar last day is the real last day |
| Concurrent green card filing | I-140 + I-485 together meant a paper package | Online concurrent filing (in effect since 2026-07-24) for representatives and EB-1A/NIW self-petitioners | An attorney can say whether the online route fits |
PA-2026-15: why e-filing changes your deadline math
USCIS issued policy alert PA-2026-15, "Definition of Day for Purposes of Filing Deadlines", on 2026-09-23. It is scheduled to take effect 2026-10-23 for paper filings received on or after that date, and it reverses the earlier PA-2023-10 guidance.
The mechanics:
- An e-filing is received when you submit it and never rolls to the next business day.
- The weekend or holiday roll survives only for deadlines counted in days, and only for paper filings.
- Status or eligibility deadlines do not roll at all. USCIS's example is a deadline tied to a 21st birthday.
OPT filing windows (after your DSO's recommendation, and after your program end date) are counted in days. If the last day falls on a Saturday and you file online, Saturday is the last day. The law firm Reddy Neumann Brown reports that the online system runs on UTC, which could put a late-evening US submission on the next calendar day; that is the firm's point, not the policy alert's, so confirm your timing with your DSO.
How I-765 online filing works for OPT and STEM OPT
This is the usual online sequence. For a line-by-line guide to the form questions, see our I-765 OPT EAD application walkthrough.
- Get the DSO recommendation first. Your DSO enters the OPT or STEM OPT recommendation in SEVIS and issues an updated I-20, and USCIS checks your filing against it.
- Create an individual USCIS online account at my.uscis.gov, separate from any employer or attorney account.
- Start Form I-765 and choose your category. Pre-completion OPT is (c)(3)(A), post-completion OPT is (c)(3)(B), and the STEM OPT extension is (c)(3)(C).
- Upload your evidence, typically the I-20 showing the recommendation, I-94, passport page, any prior EADs and a photo. STEM OPT filers also give degree and employer E-Verify details.
- Pay electronically. The fee is set in USCIS's fee schedule, Form G-1055. Premium processing for an OPT or STEM OPT I-765 is $1,780 under the 10/07/26 edition of G-1055.
- Submit and save the receipt. The receipt notice usually appears in your account soon after; the moment you submit is the moment USCIS receives it.
- Track the case and answer any RFE in the same account. Check the USCIS processing times page.
Do not travel outside the US while your OPT or STEM OPT I-765 is pending, however you filed.
Separately, the final rule ending automatic EAD extensions is in effect as of 2026-10-14 for renewal EADs filed on or after 2025-10-30, including H-4 EAD renewals. The H-4 EAD itself is not being rescinded.
File I-539 online: who can, and the F-1 wrinkle
USCIS's online I-539 covers a listed set of extensions and changes of status, including F-1, F-2, H-4, J-1, J-2, L-2, B-1 and B-2. The catch is co-applicants: the online form is only for someone filing for themselves. A family filing together uses one paper I-539 with one fee, or files separate online applications with separate fees. Check the I-539 page for your classification first.
Online filing skips two paper-only traps: the edition (USCIS accepts only the 08/28/24 edition on paper, not the 09/15/26 one) and the filing location, which changed on 2026-10-07. Paper forms sent to the prior locations are accepted if postmarked on or before 2026-11-09.
The F-1 wrinkle matters more than the method. The Duration-of-Status rule, which would have put F-1 extensions of stay on the I-539, is blocked: a federal court postponed it and enjoined its implementation on 2026-09-14 (Presidents' Alliance v. DHS, D. Mass.), and DHS's appeal does not revive it. D/S admission continues, the 60-day F-1 grace period still applies, and an F-1 student admitted for D/S does not need an I-539 extension of stay. Some school pages written before September 14 still describe the rule as in effect, so check with your DSO before acting on one.
If your H-4 I-539 would accompany a principal's I-129, ask the employer's attorney how the filings will be packaged.
I-129 online filing: your employer's account, not yours
Form I-129 belongs to the petitioner; you are the beneficiary. I-129 online filing happens in your employer's USCIS account. As of October 2026, USCIS takes cap and non-cap H-1B petitions as a fill-in online form, and accepts PDF uploads for many other classifications, including L-1, O, TN and E. Employers can still file on paper, and neither method is required.
- Ask which method was used. An online petition has no mailing address. The 02/27/26 edition is accepted only if postmarked or submitted electronically before 2026-11-09; from that date only the 09/09/26 edition is accepted.
- Get a copy of the receipt notice (I-797C). Portability and cap-gap questions start from that document.
- Do not expect the case in your own account. For a paper-filed case, see how to link a paper-filed case to your USCIS online account with the Online Access Code.
Online concurrent I-140 and I-485 filing since July 2026
Since 2026-07-24, attorneys and accredited representatives can file an I-140 and I-485 concurrently online by PDF upload, and unrepresented EB-1A and NIW self-petitioners can file both together online, as described on USCIS's additional PDF filing options page.
Under the 10/07/26 edition of G-1055, the I-140 is $715 on paper or $665 online (plus the Asylum Program Fee), and the I-485 is $1,440 on paper or $1,390 online. See our guide to filing I-140 and I-485 together online. If the package is mailed, only the 09/18/26 I-485 edition is accepted, and the filing location changed on 2026-10-07, so read how the I-485 direct filing address differs from the lockbox first.
Whether you qualify for EB-1A or NIW, and whether to file concurrently, is a question for a licensed immigration attorney.
Common mistakes
- Believing e-filing is already mandatory. No form is designated as of October 14, 2026.
- Paper filing on the 09/15/26 I-765 or I-539 edition. USCIS does not accept those editions while the Duration-of-Status rule is blocked.
- Counting on a Monday roll for an e-filing. E-filings never roll, and neither do status or eligibility deadlines.
- Filing an F-1 extension of stay because an old web page said so. The D/S rule is blocked.
- Assuming you can e-file your own I-129. Only the petitioning employer files it.
- Mailing to an outdated address. The I-539 and I-485 locations changed on 2026-10-07.
- Traveling while an OPT or STEM OPT I-765 is pending.
Frequently asked questions
Can I file Form I-765 online for OPT or STEM OPT?
Yes. Pre-completion OPT, post-completion OPT and the STEM OPT extension can all be filed through your own USCIS online account, where you answer the questions, upload your I-20 and evidence, and pay electronically. Paper filing is still allowed, but only on the 08/21/25 edition, because USCIS does not accept the 09/15/26 edition.
Is USCIS e-filing mandatory in 2026?
Not for any form yet. An interim final rule in effect since 2026-08-11 lets USCIS require e-filing for a form that has been available online for at least 180 days, with at least 60 days of public notice. As of October 2026, USCIS has not designated any form, so paper filing of the I-765, I-539 and I-129 remains available.
Can I file my own H-1B Form I-129 online?
No. Form I-129 is filed by the petitioning employer, not by you as the worker. Employers can file H-1B and many other I-129 petitions online through their own USCIS account, or they can still file on paper. Ask your employer or its attorney which method they used and for a copy of the receipt notice.
Can I file Form I-539 online?
Yes, for listed classifications such as F-1, F-2, H-4 and J-1, but only if you file for yourself with no co-applicants. Check the USCIS I-539 page for your classification before you start. Paper filers must use the 08/28/24 edition and the filing location that changed on 2026-10-07. F-1 students admitted for duration of status still do not need an I-539 extension of stay, because the Duration-of-Status rule is blocked.
Does a weekend deadline roll to Monday if I e-file?
No. Under USCIS policy alert PA-2026-15, scheduled to take effect 2026-10-23, an e-filing is received the moment you submit it and never rolls to the next business day. The weekend and holiday roll applies only to deadlines counted in days, and only to paper filings. Confirm how your own OPT window is counted with your DSO.
This guide explains how filing works; it is not legal advice, and your own I-20, I-94 and notices govern. Take OPT and SEVIS questions to your DSO, and H-1B or green card questions to a licensed immigration attorney.
Filing is one step; landing a job before your OPT unemployment days run out is the bigger one. If you want help with a job search built around your visa timeline, F1Jobs can talk it through with you.
