I-765 Edition Date and Filing Address in October 2026: Why the 09/15/26 Form Gets Rejected
USCIS does not accept the 09/15/26 edition of Form I-765, and it moved the I-765 filing location on 2026-10-07. Here is how to check both before you mail anything.

Part of our guide to the OPT I-765 application.
If you are about to mail Form I-765 this month, two details decide whether USCIS even opens your case: the edition date printed at the bottom of every page, and the I-765 filing address for your eligibility category. As of October 2026, USCIS accepts only the 08/21/25 edition and does not accept the 09/15/26 edition. There is no single I-765 mailing address, and USCIS changed the I-765 filing location on 2026-10-07. Where you send it depends on your category and your delivery service, and you get it from the official USCIS list on the day you file.
Status line, as of October 2026. In effect: USCIS accepts the 08/21/25 I-765 edition only, and a new I-765 filing location applies since 2026-10-07, with packages postmarked on or before 2026-11-09 still accepted at the prior location (USCIS I-765 page, updated 2026-10-07). Blocked: the Duration-of-Status rule, since 2026-09-14. In effect: the mandatory e-filing interim final rule (since 2026-08-11), with no form designated yet. Scheduled: USCIS policy alert PA-2026-15 on filing-deadline days, effective 2026-10-23. Always check the live page at uscis.gov/i-765 before you file.
The short answer in one table (as of October 2026)
| Item | Status as of October 2026 | What it means for your I-765 |
|---|---|---|
| 08/21/25 edition of Form I-765 | Accepted | This is the edition to look for in the page footer |
| 09/15/26 edition of Form I-765 | Not accepted | A package on this edition can be rejected and returned |
| Duration-of-Status rule (91 FR 44976) | Blocked 2026-09-14; DHS appealed 2026-09-30 | USCIS says it is proceeding under the previous regulatory provisions |
| I-765 filing location | Changed 2026-10-07; prior location accepted for postmarks on or before 2026-11-09 | Look it up on the official addresses page on filing day; do not copy one from a forum |
| Mandatory e-filing IFR | In effect since 2026-08-11, no form designated | Paper filing of I-765 is still allowed; USCIS must give at least 60 days' notice before requiring e-filing for a form |
| PA-2026-15, definition of day | Scheduled, effective 2026-10-23 | Weekend and holiday roll-over applies only to day-counted deadlines on paper filings |
| OPT / STEM OPT premium processing | Unchanged at $1,780 (Form G-1055, edition 10/07/26) | Check the USCIS fee schedule for your base filing fee |
Why the 09/15/26 edition exists, and why it gets rejected
The 09/15/26 edition was not a routine refresh. DHS published its Duration-of-Status final rule on 2026-07-17, due to take effect on 2026-09-15, replacing "D/S" admission for F-1 students with fixed admission dates. USCIS revised Form I-765 (and Form I-539) to match.
Then, on 2026-09-14, Judge F. Dennis Saylor IV of the District of Massachusetts, in Presidents' Alliance v. DHS (No. 1:26-cv-13799), postponed the rule's effective date and enjoined DHS from implementing it. DHS appealed on 2026-09-30 (First Circuit No. 26-2112). The appeal does not revive the rule. We cover the case in depth in our explainer on the Duration-of-Status lawsuit before Judge Saylor.
So USCIS holds a form written for rules that are not in effect. Its I-765 page says it will proceed under the previous regulatory provisions, and that DHS disagrees with the order and will implement the rule if the order is lifted. The accepted edition is tied to the court order, not the calendar, and a PDF downloaded in September may be the version USCIS now refuses.
The rules that apply today are the ones you knew before September: D/S admission, the 60-day F-1 grace period, and no I-539 extension of stay for F-1 students. A school page written before 2026-09-14 may say otherwise; confirm with your DSO.
How to check the edition date on your I-765
- Look at the footer of page 1 of the form you plan to send. It reads something like "Form I-765 Edition 08/21/25".
- Check every page, not just the first. Every page should show the same edition; mixing pages from two editions invites a rejection.
- Download a fresh copy from uscis.gov/i-765 instead of reusing a saved file or a friend's template.
- Read the edition note on the form page itself. That note governs, not this article.
- Re-check on the day you mail it. Given the active appeal, a two-week-old check is not a current check.
If you want a field-by-field guide to completing the form itself, use our OPT EAD I-765 application walkthrough alongside the current USCIS instructions.
I-765 filing address: how USCIS decides where you file
There is no one "uscis address for i 765". USCIS routes I-765 filings to different lockbox facilities, set by a few variables.
- Your eligibility category. This is the code you enter on the form, such as (c)(3)(B) for post-completion OPT. Different categories go to different places.
- Sometimes another case. For some categories the page points to a separate lockbox chart, or keys the location to the receipt number of a related petition.
- Whether you file the I-765 alone or with another form. USCIS says that if your eligibility depends on another application filed with it, you file both where that other form goes. A premium processing request (Form I-907) also has its own address.
- How you send it. USCIS lists a PO box for US Postal Service delivery and a separate street address for FedEx, UPS and DHL. Couriers cannot deliver to a PO box, so use the line for your carrier.
USCIS publishes the current list on its Form I-765 filing addresses page, linked from the "Where to File" section of the I-765 page. On 2026-10-07 USCIS changed the filing location for mailed I-765s and gave a 30-day grace period: packages sent to a prior location are accepted if postmarked on or before 2026-11-09. Pull the address from that page on filing day, not from a blog post (this one included), a group chat, or last year's handout.
Common categories and where to look (as of October 2026)
| Category code | Who it covers | Where to find the filing location |
|---|---|---|
| (c)(3)(A) | F-1 pre-completion OPT | Foreign students section (separate address with Form I-907) |
| (c)(3)(B) | F-1 post-completion OPT | Foreign students section (separate address with Form I-907) |
| (c)(3)(C) | F-1 24-month STEM OPT extension | Foreign students section (separate address with Form I-907) |
| (c)(9) | Pending adjustment of status (I-485) | Depends on the type of pending I-485; the page points to the family-based or non-family lockbox charts |
| (c)(26) | Certain H-4 spouses (H-4 EAD) | Keyed to the receipt-number prefix on the H-1B spouse's latest I-129 approval notice |
The I-539 filing location changed on the same day, with the same 2026-11-09 postmark cut-off for prior locations. If you are an H-4 spouse filing an EAD alongside an I-539, read our note on the I-539 filing address change.
I 765 where to file: online versus paper
USCIS lets you file Form I-765 online through a USCIS account for certain categories, including F-1 OPT and STEM OPT. Online, there is no mailing address or PDF edition to pick.
The mandatory e-filing interim final rule (in effect since 2026-08-11) lets USCIS require e-filing for any form e-fileable for at least 180 days, after at least 60 days' notice. Comments closed 2026-10-13 and no form has been designated, so paper I-765 filing remains available. Watch the USCIS e-filing alert for a designation.
What changed, and what to do differently
| Topic | Old understanding | Rule as of October 2026 | What to do differently |
|---|---|---|---|
| I-765 filing location | The address you used before October | Changed 2026-10-07; prior location accepted for postmarks through 2026-11-09 | Pull the address from the live USCIS page |
| I-765 edition | The 09/15/26 edition would replace older versions on 2026-09-15 | USCIS accepts 08/21/25 and does not accept 09/15/26 | Check every page footer before mailing |
| F-1 admission | Fixed admission dates expected from 2026-09-15 | D/S rule blocked 2026-09-14; D/S and the 60-day grace period still apply | Treat pre-September school pages with caution; confirm with your DSO |
| Automatic EAD extensions | Many renewal filers got an automatic extension | Ended for renewals filed on or after 2025-10-30 (final rule effective 2026-10-14) | Plan around the possibility of a gap between cards; see our automatic EAD extension explainer |
What a rejection actually costs you
A rejection is not a denial. When USCIS rejects a filing for a wrong edition, a missing signature or an incorrect fee, it generally returns the package and treats the application as never filed, while your deadlines keep running.
Post-completion OPT applications generally must be received by USCIS no later than 60 days after your program end date and within 30 days of your DSO entering the OPT recommendation in SEVIS. A STEM OPT extension application has its own windows tied to your current OPT EAD and the DSO's recommendation date. A rejection that comes back three weeks later can push a refile close to or past those limits. Our guide to the OPT I-765 refile window after a rejection walks through how those dates interact.
Those are deadlines counted in days, so PA-2026-15 matters: from 2026-10-23, only paper filings get the next-business-day roll-over, and e-filings never roll. How that applies to your own I-20 and SEVIS dates is a question for your DSO, not a blog post. If your situation involves a pending green card or an H-4 EAD, a licensed immigration attorney is the right person to ask instead.
One more point that strands people abroad: do not travel while an OPT or STEM OPT I-765 is pending. Leaving the United States during that period can create serious problems with the application and your re-entry; raise any travel need with your DSO first.
Common mistakes
- Mailing the 09/15/26 edition because it is newer. Newer is not accepted. The 08/21/25 edition is the one USCIS lists.
- Reusing the address you mailed to before 2026-10-07. The location changed; pull it from the USCIS addresses page on filing day.
- Sending a courier package to a USPS-only address or a PO box. Use the line for your carrier.
- Entering the wrong eligibility category. The code drives where the form goes; confirm it against your I-20 and the instructions.
- Trusting a school page written before 2026-09-14. Some still describe the blocked rule's 30-day grace period as current. The F-1 grace period is still 60 days.
- Assuming an online filing gets a weekend roll-over. Under PA-2026-15, e-filings never roll.
- Paying the wrong fee. Check the current G-1055 fee schedule (edition 10/07/26) for your category.
Frequently asked questions
Which edition of Form I-765 does USCIS accept in October 2026?
USCIS says it accepts the 08/21/25 edition of Form I-765 and does not accept the 09/15/26 edition. The edition date is printed in the footer of every page of the form. Check the USCIS I-765 page on the day you file, because the accepted edition could change if the court order does.
Why does USCIS reject the 09/15/26 edition of I-765?
The 09/15/26 edition was built for the Duration-of-Status rule, which was meant to take effect on 2026-09-15. A federal court blocked that rule on 2026-09-14 in Presidents' Alliance v. DHS, and USCIS says it will proceed under the previous regulatory provisions. A form written for rules that are not in effect does not match the law USCIS is applying.
Where do I mail my I-765?
There is no single I-765 mailing address. The location depends on your eligibility category, whether you file it with another form, and whether you use the Postal Service or a courier. USCIS changed the I-765 filing location on 2026-10-07 and accepts packages postmarked on or before 2026-11-09 at the prior location. Use the USCIS I-765 filing addresses page on the day you mail.
What happens to my OPT filing window if USCIS rejects my I-765?
A rejected I-765 is treated as never filed, so it does not stop any filing window from running. For post-completion OPT, the application generally has to be received within 60 days after your program end date and within 30 days of your DSO entering the recommendation in SEVIS. If a rejection arrives near those limits, talk to your DSO right away about what your record allows.
Does the new USCIS weekend and holiday rule change my I-765 deadline?
USCIS policy alert PA-2026-15 is scheduled to take effect on 2026-10-23. Under it, the next-business-day roll-over applies only to deadlines counted in days and only to paper filings, and an e-filing is received when you submit it and never rolls. Ask your DSO how it applies to your own SEVIS dates.
