I-765 Processing Time by Category: How Long OPT, STEM OPT, H-4 and C9 EADs Take

OPT, STEM OPT, H-4 and C9 work permits each run on their own clock, and since automatic extensions ended, a slow renewal can leave a gap in work authorization.

Status as of October 14, 2026: The end of automatic EAD extensions is in effect (final rule published 2026-10-14). The $70,000 / $30,000 OPT fee is proposed only. The Duration-of-Status rule is blocked, so the 60-day F-1 grace period still applies.

The short answer on i-765 processing time in October 2026: there is no single number. USCIS publishes a separate processing time for each EAD category, and the only authoritative figure is the one on the USCIS processing times page today. For OPT, community reports say the posted average rose to roughly 4-5 months by late September 2026. That is reported and not verified against USCIS, so confirm it on the USCIS page and with your DSO.

Your category code decides which line on that page applies to you, whether you can buy speed, and what happens if your current card runs out before the new one arrives.

I-765 processing time by category (as of October 2026)

Your category is printed on your receipt notice and on the application itself. Use that code, not a guess, when you look up your wait.

Fees: the premium figure comes from the G-1055 fee schedule, edition 10/07/26. On the same schedule, an I-765 filed while a post-April 1, 2024 I-485 is pending costs $260. Base fees for the other categories are on the G-1055 itself.

Use the right form edition. USCIS says it accepts the 08/21/25 edition of Form I-765 and does not accept the 09/15/26 edition, because the rule that edition was written for is blocked. Check the I-765 form page before filing, because a rejected filing restarts the wait.

How to read the USCIS processing times page

Most "my case is stuck" panic comes from reading this page wrong:

  1. Open egov.uscis.gov/processing-times.
  2. Select Form I-765.
  3. Select your category. Match the wording to your code: (c)(3)(B) for post-completion OPT, (c)(3)(C) for STEM OPT, (c)(26) for H-4, (c)(9) for a pending I-485.
  4. Select the office shown on your I-797C receipt notice. Times differ between offices, so the wrong office gives you the wrong wait.
  5. Read two numbers. One is the posted processing time. The other is the "receipt date for a case inquiry." If your receipt date is earlier than that inquiry date, your case is outside normal processing time and you can submit an online case inquiry.

The posted time looks backward: it describes cases USCIS has already finished, not a promise about yours. If a range online disagrees with the page, the page wins, and your own receipt notice governs over anything published here.

The OPT approval timeline, step by step

Pre-completion and post-completion OPT follow the same stages. This is the opt approval timeline you will actually see:

  1. DSO recommendation. Your DSO records the recommendation in SEVIS and issues an updated I-20. Your I-765 must match it.
  2. Filing. You file online or on paper, inside the window that USCIS's I-765 instructions and your DSO describe. Post-completion OPT has to be filed before your 60-day F-1 grace period ends. That grace period is still 60 days because the Duration-of-Status rule is blocked.
  3. Receipt notice (I-797C). This is your proof of filing and the source of your receipt number and office.
  4. Biometrics, if scheduled. Some OPT and STEM OPT filers receive an ASC appointment notice. Our guide to OPT biometrics appointments explains why and what to bring.
  5. Decision. The status changes to approved, or USCIS issues a request for evidence.
  6. Card production and mailing. The card is produced and mailed after approval. Delivery problems are their own category of delay.
  7. Start date. On post-completion OPT you may not work before the EAD is approved and its start date has arrived. Your unemployment clock (90 days on post-completion OPT) counts from that start date, not from your filing date.

Step 7 is why a slow OPT case is a job-search problem, not only a paperwork problem. An offer with a fixed start date may move, or vanish, if your card has not arrived, so tell recruiters plainly that your EAD is pending. If the wait is already long, our action plan for a delayed OPT EAD card covers how to talk to employers and USCIS.

I-765 processing time after biometrics

USCIS does not publish a separate "after biometrics" clock. The posted time covers the whole case. Biometrics is a step that must be finished before USCIS can decide, so it can slow a case down, but finishing it does not start a countdown.

After your appointment, three things can happen:

Your i 765 waiting time is still measured against the case inquiry date on the processing times page, starting from your receipt date. Do not measure it from your biometrics date.

STEM OPT: the 180-day SEVIS problem

STEM OPT applicants face a risk that has nothing to do with USCIS's own pace. According to the SEVIS Help Hub, SEVIS automatically cancels any STEM OPT request that stays in "Requested" status for more than 180 days. If USCIS is slow, your SEVIS record and your USCIS case can fall out of step.

That makes your DSO part of your processing-time plan. If your case is getting close to that point, tell your DSO so they can check your SEVIS record. USCIS cannot fix a SEVIS record, and an immigration attorney is not a substitute for your DSO on SEVIS questions.

STEM OPT also has its own rules for working while a timely-filed extension is pending, separate from the automatic-extension rule discussed below. How they apply to your dates is a question for your DSO. For month-by-month expectations, see our STEM OPT processing time guide.

H-4 and C9: where slow processing now costs you a job

For H-4 (c)(26) and C9 renewals, the processing time itself is now a risk to your job, because of this rule change:

Old ruleNew rule (in effect)What to do differently
Renewal EADs in eligible categories, including H-4 and C9A timely-filed renewal could automatically extend the expiring card while it was pendingRenewals filed on or after 2025-10-30 get no automatic extension (interim final rule 2025-10-30; final rule adopting it unchanged, effective 2026-10-14)Compare your card's expiry date with the posted wait for your category. Raise the timing with HR and an immigration attorney before the card runs out
H-4 renewals filed before 2025-10-30Auto-extension availableKept auto-extension if the H-4 I-94 was unexpiredCheck your own filing date and I-94 with your attorney
The H-4 EAD itselfAvailable to eligible spousesStill available. Not rescindedIgnore "H-4 EAD removal" rumors

In practice, a renewal that takes longer than the time left on your card can now create a gap in work authorization. Under the old rule, the automatic extension usually covered that gap. Our explainer on the final rule ending automatic EAD extensions covers what changed. For H-4 specifically, see the current H-4 EAD processing time.

C9 applicants often hold another status as well, such as H-1B, that carries its own work authorization. Which authorization you rely on, and how travel affects a pending I-485, are decisions for a licensed immigration attorney. A DSO does not handle them.

Premium processing: who can buy speed

As of October 2026, premium processing for an OPT or STEM OPT I-765 costs $1,780 (G-1055 edition 10/07/26). Before you pay:

As of October 2026, that USCIS page lists only the three OPT categories, (c)(3)(A), (c)(3)(B) and (c)(3)(C), as premium-eligible I-765s. H-4 (c)(26) and C9 are not on it, so those applicants cannot buy speed this way.

Do not travel while your I-765 is pending

Do not travel while an OPT or STEM OPT I-765 is pending. Leaving mid-case can put the application and your re-entry at risk. Stamping has also tightened: interview waivers are gone for F-1, H-1B and H-4, and you must apply in your country of nationality or residence. For C9 holders, travel is tied to the pending I-485 and advance parole, so ask your attorney first.

Common mistakes

Frequently asked questions

How long does OPT I-765 processing take in 2026?

Community reports say the posted average rose to roughly 4-5 months by late September 2026, but that is not verified against USCIS. The number that counts is the one on the USCIS processing times page today for your category.

Is there a separate I-765 processing time after biometrics?

No. USCIS does not publish a clock that starts after biometrics. Its posted time covers the whole case, and biometrics is a step that must be finished before a decision. Compare your receipt date with the case inquiry date on the USCIS page.

Can I pay to speed up my OPT or STEM OPT application?

Yes. It costs $1,780 under the G-1055 edition dated 10/07/26 and guarantees a USCIS action within a set timeframe, not an approval. That action can be a request for evidence.

Does my H-4 or C9 EAD renewal still get an automatic extension?

Not if you filed it on or after October 30, 2025, under the interim final rule of that date, which the October 14, 2026 final rule adopted without change. A renewal still pending when your card expires can leave a gap, so talk to an immigration attorney early. The H-4 EAD itself has not been rescinded.

Can I travel abroad while my OPT I-765 is pending?

You should not plan international travel while an OPT or STEM OPT I-765 is pending. Leaving can put the application and your re-entry in jeopardy. Speak to your DSO before you book anything.

Frequently asked questions

How long does OPT I-765 processing take in 2026

Community reports say the posted USCIS average for OPT I-765s rose to roughly 4-5 months by late September 2026. That figure has not been verified against USCIS, so treat it as reported only. The number that counts is the one shown today on the USCIS processing times page for Form I-765 and your category, and your DSO can help you read it.

Is there a separate I-765 processing time after biometrics

No. USCIS does not publish a separate clock that starts after your biometrics appointment. Its posted time is measured across the whole case, and biometrics is one step that has to be finished before USCIS can decide. Some cases move quickly after biometrics and some sit for weeks, so compare your receipt date with the case inquiry date on the USCIS page.

Can I pay to speed up my OPT or STEM OPT application

Yes. Premium processing for an OPT or STEM OPT I-765 costs $1,780 under the G-1055 fee schedule edition dated 10/07/26. Premium processing buys a guaranteed USCIS action within a set timeframe, not a guaranteed approval, and the action can be a request for evidence. Whether it makes sense for you is a question for your DSO.

Does my H-4 or C9 EAD renewal still get an automatic extension

Not if you filed the renewal on or after October 30, 2025. The interim final rule of that date ended automatic extensions for renewal EADs, and the final rule published and effective on October 14, 2026 adopted it without change. If your renewal is still pending when your current card expires, you may have a gap in work authorization, so talk to an immigration attorney early. The H-4 EAD itself has not been rescinded.

Can I travel abroad while my OPT I-765 is pending

You should not plan international travel while an OPT or STEM OPT I-765 is pending. Leaving the United States during that period can put the application and your ability to re-enter in jeopardy. If something forces the question, speak to your DSO before you book anything.
