OPT to O-1: When to File, How to Avoid a Status Gap, and What Changes When You Switch
A filed O-1 petition does not keep you working after your OPT card expires, so the filing date decides whether you face a gap.

Part of our guide to the O-1 visa.
Yes, you can usually move from OPT to an O-1 visa without leaving the US: a US employer or US agent files Form I-129 asking USCIS to change your status from F-1 to O-1. The hard part is timing. As of 2026-11-01, an O-1 petition gets no cap-gap protection (our reading of USCIS's cap-gap rules), so your OPT work stops on your EAD end date if the approval has not arrived. The USCIS processing-times tool (read 2026-11-01) shows 80% of I-129 O cases completed within 14.5 months; premium processing ($2,965) gets a USCIS action within 15 business days.
This guide covers the status-gap math. Whether your record meets the evidence bar is covered in our O-1 criteria guide with new-grad examples.
Status as of 2026-11-01
- In effect: cap-gap for timely, cap-subject H-1B change-of-status petitions only; the STEM OPT 180-day automatic extension, unchanged by the 2026-10-14 EAD final rule; OPT unemployment limits of 90 days (150 in aggregate on STEM OPT); and the F-1 60-day grace period, because the Duration of Status rule has been blocked by a federal court since 2026-09-14 (see the USCIS I-539 page).
- In effect, challenged: PA-2026-05 (since 2026-08-05), which allows denial without an RFE when required initial evidence is missing and caps RFE response time at 12 weeks; AAUP v. Mullin has no ruling.
- Scheduled: from 2026-11-09, USCIS accepts only the 09/09/26 edition of Form I-129; old filing addresses work only if postmarked on or before that date.
- Proposed, not law: ending the 60-day worker grace period O-1 holders use (comments close 2026-11-10) and removing deference to prior approvals on extensions (comments close 2026-11-13). Check the Federal Register for the outcome after those dates.
- Under OIRA review, no text: "Amending the Premium Processing Timeframe" (RIN 1615-AD25), received 2026-10-13, direction unknown. Today's 15 business days apply.
Can you switch from OPT to an O-1 visa?
Yes. An F-1 student on OPT or STEM OPT can change status to O-1 inside the United States when a US employer or US agent files Form I-129 with a change-of-status request and USCIS approves it. You cannot self-petition, there is no lottery or annual cap, and your OPT work authorization still ends on the date printed on your EAD.
That petitioner can still be a company you own: USCIS's PA-2025-02 (January 2025), still the main O-1 evidence guidance, says "a separate legal entity owned by the beneficiary" may file. Our overview of change-of-status options for international students puts the O-1 next to the other routes out of F-1.
Does cap-gap cover an O-1 petition?
No. USCIS's cap-gap page says the provision "applies only to beneficiaries of cap-subject H-1B petitions, not to beneficiaries of cap-exempt H-1B petitions." An O-1 is not an H-1B petition at all, so our reading is that it gets no cap-gap either.
Cap-gap (our guide) carries F-1 status and OPT work to April 1 of the fiscal year requested, or the petition start date if earlier. None of that attaches to an O-1 filing.
What can keep you working past your EAD end date (as of 2026-11)
| Mechanism | What triggers it | Helps an OPT-to-O-1 move? | Status |
|---|---|---|---|
| Cap-gap | Timely, cap-subject H-1B change-of-status petition | No (our reading for O-1) | In effect since 2025-01-17 |
| STEM OPT 180-day extension | STEM OPT I-765 filed before your OPT EAD expires | Indirectly; it extends OPT, buying time for an O-1 decision | In effect; unchanged by the 2026-10-14 rule |
| A pending O-1 petition | Form I-129 with a change-of-status request | No; it authorizes no work | Not a work authorization |
| F-1 60-day grace period | End of OPT or STEM OPT | Lets you remain for a limited time; no work | In effect (D/S rule blocked) |
The USCIS STEM OPT page (updated 2026-01-30) still says USCIS "will automatically extend your employment authorization for 180 days" for a timely application, which you can file up to 90 days before your OPT EAD expires and within 60 days of your DSO's SEVIS recommendation. A STEM I-765 filed after expiry gets no 180 days. Whether your degree and employer qualify is a DSO question.
Can you keep working on OPT while the O-1 is pending?
Yes, up to your EAD end date, under the normal OPT rules. The pending O-1 adds nothing to your work authorization and takes nothing away.
- The petitioner can be your OPT employer meanwhile, if the job relates to your degree. On STEM OPT that employer must be enrolled in E-Verify and sign your Form I-983 training plan.
- Your unemployment clock keeps running. Leaving a job to "wait for the O-1" spends days: 90 on post-completion OPT, 150 in aggregate on STEM OPT, counted for each day without employer information (SEVIS Help Hub). Our guide to the OPT 90-day unemployment clock shows how days add up.
- Travel changes the case. Leaving the US while a change of status is pending generally abandons that request. USCIS may still approve the petition itself for consular processing, and you would then need an O-1 visa abroad. Ask your DSO and the petitioner's attorney before any trip.
When should you file an O-1 if your OPT ends soon?
Early enough that a decision, including one after a Request for Evidence (RFE), lands before your EAD end date. The filing date is the petitioner's and its attorney's call; these are the clocks they work with. "Your employer or agent cannot file the petition more than one year before they actually need your services," says the USCIS O-1 page, which also recommends filing "at least 45 days before the date of employment."
Regular processing rarely fits that window. At 80% of I-129 O cases within 14.5 months, a petition filed on the first day the one-year rule allows would reach the 80% mark about two and a half months after its requested start date (our arithmetic). The figure moves monthly; check it the week the petition is planned.
O-1 filing costs and clocks (as of 2026-11)
| Item | Figure | Source |
|---|---|---|
| Form I-129, O classification | $1,055 paper; $1,005 online; $530 small employer or nonprofit | G-1055, edition 10/26/26 |
| Form I-907 premium processing | $2,965; USCIS action within 15 business days | G-1055; USCIS premium page |
| Regular processing | 80% of I-129 O cases within 14.5 months | USCIS tool, read 2026-11-01 |
| Filing window | No earlier than one year before the need for services; USCIS suggests at least 45 days ahead | USCIS O-1 page |
| Form edition | Only 09/09/26 from 2026-11-09 | USCIS I-129 page |
| Online filing | PDF upload for O-1A, O-1B and O-2 (added 2026-10-07) | USCIS online filing page |
Vendor pages still print older fees, so take the figure from the USCIS fee schedule, Form G-1055, on filing day, and the edition from the USCIS I-129 page. The O categories are on the I-129 PDF-upload page.
Premium processing is not a promise of approval. The USCIS premium processing page commits only to "issue an approval notice, denial notice, notice of intent to deny, or a request for evidence; or open an investigation for fraud or misrepresentation." An RFE makes the clock "stop and reset," and a new 15 business days starts when USCIS receives your response.
Worked timeline: STEM OPT ending 2027-06-30
A hypothetical: your STEM OPT EAD ends Wednesday 2027-06-30, and the petitioner requests an O-1 start of Thursday 2027-07-01. The premium page does not define "business days," so we skip weekends and federal holidays and assume any RFE arrives on the premium deadline. The arithmetic is ours.
| Date | What happens | Your work status |
|---|---|---|
| 2026-07-01 | Earliest filing date under the one-year rule | Working on STEM OPT |
| 2026-11 to 2027-02 | Evidence, expert letters, advisory opinion | Working on STEM OPT |
| Mon 2027-03-01 | USCIS receives Form I-129 (09/09/26 edition) with Form I-907 | Working on STEM OPT |
| Mon 2027-03-22 | Premium deadline for a USCIS action | Working on STEM OPT |
| Path A, 2027-03-22 | Approval (I-797A), validity from 2027-07-01 | STEM OPT to 06-30, O-1 from 07-01, no gap |
| Path B, Mon 2027-05-03 | RFE answered after six weeks; new clock to Mon 2027-05-24 | Decision due before 06-30 |
| Path C, Mon 2027-06-14 | RFE answered at the 12-week maximum; new clock to Wed 2027-07-07 | Work stops Thu 2027-07-01 until approval |
| Path D, before 2027-08-29 | Denial | No O-1; the F-1 grace period runs 60 days from the EAD end date (to about 2027-08-29) |
Path C is the status gap in miniature: one late RFE answer pushes the decision past the EAD date, and you cannot work in between. Under PA-2026-05 (in effect since 2026-08-05, challenged), 12 weeks is the maximum RFE response period, not the standard one; the deadline on your own notice governs. RFEs are common: in USCIS's I-129 RFE data, 24.2% of O petitions completed in FY2026 Q1-Q3 (October 2025 to June 2026, initial and extensions combined) had one, all before PA-2026-05.
Compare filing at USCIS's 45-day suggestion. Received Monday 2027-05-17, the petition's premium deadline is Tuesday 2027-06-08. An RFE that day, answered the same day, restarts a clock that runs to 2027-06-30, your last EAD day (our arithmetic). Forty-five days is a floor, not a margin.
What if the approval comes late, or not at all?
- Late approval: no work from the day after your EAD ends until the O-1 takes effect. How long you may remain meanwhile depends on your grace period and the pending request; ask an attorney.
- Denial: nothing catches you automatically, and a denial after the grace period ends raises different questions. Talk to an attorney about next steps and to your DSO about your SEVIS record.
- Approval for consular notification (I-797B): you need an O-1 visa abroad first, applied for in your country of nationality or residence. State's interview-waiver update left waivers only for B-1/B-2 and H-2A renewals and diplomatic classes, so plan on an in-person interview, and check the live wait-times page.
How to plan your OPT to O-1 visa filing date
- Confirm your EAD end date on your Form I-766 and in SEVIS with your DSO, and ask whether a STEM OPT I-765 is still open to you.
- Check the I-129 O figure on the USCIS processing-times tool.
- Count back from the EAD end date, leaving room for one RFE: the response time on the notice plus another 15 business days.
- Agree the start date to request with the petitioner (a US employer or US agent) and its attorney.
- Assemble the evidence and the written advisory opinion USCIS generally requires (if no appropriate peer group exists, USCIS decides on the evidence submitted).
- The petitioner files Form I-129 with the O supplement and Form I-907, by mail or PDF upload.
- Track the receipt and calendar any RFE deadline.
- Keep your OPT reporting current in the SEVP Portal or through your DSO.
- Read the I-797A on approval, both the validity dates and the I-94, and tell your DSO.
Is your evidence ready? A short check for new grads
For the O-1A, the regulation asks for a major internationally recognized award or evidence meeting at least three of eight listed criteria, and USCIS then weighs the whole record. Speed works against a thin file, because PA-2026-05 lets officers deny without an RFE when required initial evidence is missing. Before anyone pays for premium processing, the questions are:
- Can you name three criteria and the document proving each one today, not "soon"?
- Will independent experts, not only co-authors and managers, write about your impact?
- Is the advisory opinion arranged, and has an attorney read the evidence itself?
The criteria guide walks through each one. For context, USCIS approved 91.0% of the O petitions it decided in FY2026 Q1-Q3 (approvals over approvals plus denials), a figure for every O petitioner, not new grads, and from before PA-2026-05.
What changes when you switch from F-1 OPT to O-1
| Topic | On F-1 OPT or STEM OPT | On O-1 |
|---|---|---|
| Who you can work for | Any employer in your field (STEM OPT: E-Verify employer, I-983) | Only the petitioner through whom you got the status (an agent's petition can cover several employers) |
| Changing jobs | Report it to your DSO or the SEVP Portal | New employer files its own Form I-129; no H-1B-style portability |
| Length of stay | 12 months, plus 24 on STEM OPT | Up to 3 years initially; extensions in increments of up to 1 year |
| Between jobs | 90 or 150 unemployment days | A discretionary grace period of up to 60 days (proposed for elimination); separately, up to 10 days after validity ends, no work |
| What governs your stay | SEVIS record and I-20 | Your I-94 |
| Green card intent | F-1 requires nonimmigrant intent | A labor certification or preference petition is not a basis to deny an O-1 |
| Spouse | F-2, no work | O-3, no work; study allowed |
| Social Security and Medicare | Student FICA exemption while a nonresident | Exemption ends with F-1 status (our reading) |
| $100,000 H-1B proclamation | Does not apply | Does not apply; it covers only H-1B |
Job changes. Under 8 CFR 274a.12(b)(13), an O-1 worker "may be employed only by the petitioner through whom the status was obtained" (traded professional athletes aside), and the O-1 page says "the new employer must file Form I-129." Unlike the H-1B, you cannot start a new job when that petition is filed; see changing jobs on an O-1 visa.
Green cards. Under 8 CFR 214.2(o)(13), an approved labor certification or a filed preference petition "shall not be a basis for denying an O-1 petition," an extension or a change of status. O-1 evidence often overlaps with an EB-1A self-petition, but the numbers differ: 80% of EB-1A I-140s completed within 32.5 months (USCIS tool, 2026-11-01), and the EB-1A approval rate was 32.2% in FY2026 Q3 (April to June 2026, before PA-2026-05). The memo PM-602-0199 (in effect, challenged) calls adjustment of status "extraordinary relief," so plan that step with an attorney.
Pending proposals. The grace-period proposal (RIN 1615-AD22) would leave O-1 workers only the 10-day window after the petition's end date, which runs from that date, not from a layoff; the deference proposal (RIN 1615-AD26) covers all I-129 extensions, O-1 included.
Taxes. The IRS student FICA exemption covers nonresident F-1 students on practical training but not students who change "to another immigration status which is not exempt." Our reading is that O-1 is such a status; confirm withholding with a tax professional who handles nonresident returns.
Is O-1 better than waiting for the H-1B lottery?
Neither is better in the abstract. The H-1B needs a lottery selection but carries cap-gap protection from OPT; the O-1 has no lottery but a higher evidence bar and no cap-gap. Our O-1 vs H-1B comparison covers which profile fits which.
As of 2026-11-01, wage-weighted H-1B selection is in effect (since 2026-02-27) and the FY2028 registration is not announced. USCIS must announce it at least 30 calendar days ahead (8 CFR 214.2(h)(8)(iii)(A)(3)), so watch its registration page; March 2027 is only an expectation. Proclamation 11069 stands on paper, but court orders have blocked the agency policies that collect its $100,000 payment, and it covers only H-1B. Whether to run an H-1B registration alongside an O-1 petition, and how two change-of-status requests would interact, is a sequencing question for your attorney.
Common mistakes
- Treating a filed O-1 like cap-gap. A pending O-1 authorizes no work; your EAD end date is the line.
- Planning on regular processing. At 14.5 months for 80% of cases (2026-11-01), it outlasts the one-year early-filing window.
- Reading "15 business days" as "approved." Premium processing guarantees an action, and an RFE resets the clock.
- Quitting your OPT job to wait. Unemployment days keep counting.
- Missing the STEM OPT deadline. The 180 days apply only if the STEM I-765 is filed before your OPT EAD expires.
- Using the 02/27/26 I-129 edition from 2026-11-09, an old address after that date, or a vendor's fee table. Use Form G-1055, edition 10/26/26.
Frequently asked questions
Can I switch from OPT to O-1?
Yes, if a US employer or US agent files Form I-129 asking USCIS to change your status from F-1 to O-1 and USCIS approves it. You cannot file the petition yourself, and there is no lottery or annual cap. As of 2026-11-01, your OPT work authorization still ends on your EAD end date, whatever the O-1 case status.
When should I file an O-1 if my OPT ends soon?
Early enough that a decision, including one after a Request for Evidence, arrives before your EAD end date. On 2026-11-01 the USCIS processing-times tool showed 80% of I-129 O cases done within 14.5 months, longer than the one-year filing window, so a petition filed close to an EAD end date generally depends on premium processing. That costs $2,965 and gets a USCIS action, not necessarily an approval, within 15 business days. The filing date itself is a decision for the petitioner and its attorney.
Does cap-gap cover an O-1 petition?
No. USCIS says cap-gap applies only to beneficiaries of cap-subject H-1B petitions, not to beneficiaries of cap-exempt H-1B petitions. An O-1 is not an H-1B petition at all, so our reading is that it gets no cap-gap either, as of 2026-11-01.
Can I keep working on OPT while the O-1 is pending?
Yes, until the end date on your EAD, as long as you follow OPT rules such as working in your field and staying within 90 unemployment days (150 in aggregate on STEM OPT). The pending O-1 does not extend that date. If your EAD expires before approval, you must stop working until the O-1 takes effect.
Is O-1 better than waiting for the H-1B lottery?
They solve different problems. The H-1B needs a lottery selection but carries cap-gap protection from OPT, while the O-1 has no lottery or cap but needs evidence of extraordinary ability and gets no cap-gap. As of 2026-11-01 the FY2028 H-1B registration has not been announced. Whether to pursue one or both, and in what order, is a question for a licensed immigration attorney.

How we checked this: on 2026-11-01 we read the USCIS O-1, cap-gap, STEM OPT, premium processing, I-129, I-539 and online-filing pages, Form G-1055 (edition 10/26/26), the USCIS processing-times tool and the FY2026 I-129 RFE workbook, the eCFR text of 8 CFR 214.2(o) and 274a.12(b)(13), and the IRS student FICA page; the timeline dates are our own arithmetic.
This is general information, not legal or tax advice. Your own EAD, I-20, I-94 and USCIS notices govern; ask your DSO about anything F-1, OPT or SEVIS, a licensed immigration attorney about the petition and your status strategy, and a tax professional who handles nonresident returns about withholding.
If you are on OPT or STEM OPT and want a job search built around your EAD date and employers open to sponsorship, F1Jobs can help you plan it.
Frequently asked questions
