Renewing a Driver's License on OPT: STEM OPT Pending, Cap-Gap and Expired EAD Situations by State
Your OPT card expired but STEM OPT or cap-gap still covers you. Whether the DMV renews your license depends on your state and one federal database check.

Renewing a driver's license on OPT usually goes wrong on the day your EAD expires: many DMVs end your card with the EAD and must confirm your status in the federal SAVE database before printing a new one. As of November 1, 2026, the federal rules that keep you authorized are unchanged and in effect: the STEM OPT 180-day automatic extension (the October 14, 2026 EAD rule did not touch it) and cap-gap to April 1 for a timely cap-subject petition. Whether a DMV renews on a pending case is a state, and often an office, decision. Texas DPS, per UT Dallas and TCU, waits for approval. The Bloomington, Illinois office, per Illinois State University, renews while STEM OPT is pending.
Status line, as of 2026-11-01. In effect: the STEM OPT 180-day automatic extension; cap-gap to April 1 (since 2025-01-17); and the final rule ending automatic extensions for certain EAD renewals filed on or after 2025-10-30 (91 FR 65306, effective 2026-10-14, challenged, with court relief for seven plaintiffs only). Blocked: the duration-of-status (D/S) rule, by a federal court since 2026-09-14, so F-1 admission is still for D/S and the F-1 60-day grace period still applies.
Misconception, then correction. "The October 2026 EAD rule ended the 180-day STEM OPT extension." It did not. That rule amends only 8 CFR 274a.13 and never mentions STEM OPT, OPT or cap-gap. USCIS's STEM OPT page still says that if you file on time, "we will automatically extend your employment authorization for 180 days." What the rule did end is the automatic extension for renewals filed on or after 2025-10-30 in categories such as (c)(9) and (c)(26) H-4; timely renewals filed earlier keep up to 540 days.
Renewing a driver's license on OPT: the short answer
Your state, and sometimes your local office, decides. Before issuing a REAL ID card, a DMV must verify your lawful status in the USCIS SAVE system, and federal rules cap a limited-term card at your authorized stay. Illinois State University says the Bloomington, Illinois office renews on a pending STEM OPT case; UT Dallas and TCU say Texas DPS waits for approval.
Three layers decide your outcome:
- Federal status rules (STEM OPT 180 days, cap-gap) decide whether you are still authorized, in every state.
- The SAVE check decides whether the DMV can see that authorization today.
- State policy decides whether a pending case is enough, and how long the card runs.
So you can be fully authorized to work on STEM OPT and still be refused a renewal in Texas.
Why your license ends when your EAD does
The federal REAL ID standard ties a non-citizen's card to their authorized stay. TSA's REAL ID FAQ says people in temporary lawful status get a limited-term card "with a validity period no longer than the period of authorized stay in the United States," or one year if the stay has no definite end. It adds that status documents "must be verified through Systematic Alien Verification for Entitlements (SAVE)" and that limited-term cards are renewed in person.
On OPT, the end date a DMV can see is usually your EAD's (our reading), so the card often ends with it. D/S has no definite end, which is why UT Dallas says Texas gives F-1 students admitted for D/S a license "with an expiration within one year," and why the University of Delaware quotes a one-year DMV policy for D/S records.
SAVE only reports; USCIS's SAVE page says "SAVE does not determine an applicant's eligibility for a specific benefit or license." And in the 2026-10-14 EAD final rule, DHS wrote: "This rule does not change State authority to determine which documents are acceptable for issuance of driver's licenses or other State identification." What keeps you authorized after the EAD expires
Federal rules, as of 2026-11. Your own I-20, I-797C receipt and EAD govern over this table.
| Your situation | Federal status | Can you work past the card date? | What a DMV would be checking for (our reading) |
|---|---|---|---|
| STEM OPT I-765 filed before the OPT EAD expired | 180-day extension in effect | Yes, up to 180 days or until USCIS decides | A pending STEM I-765 under your receipt number |
| STEM OPT I-765 filed after the OPT EAD expired | No 180-day extension | No | Nothing to renew on until approval |
| Cap-gap, OPT valid when the H-1B petition was filed | In effect since 2025-01-17 | Yes, to April 1 or the approved petition's start date, if earlier | F-1 status extended by a cap-subject change-of-status petition |
| Cap-gap, petition filed during your F-1 60-day grace period | In effect (status only) | No | F-1 status extended, no work |
| Cap-exempt H-1B pending (university, nonprofit research) | No cap-gap | No | Nothing new until approval |
| Initial OPT I-765 pending | F-1 status continues; no EAD yet | No, not before the EAD's start date | Your F-1 record; some offices wait for the EAD (see Illinois below) |
USCIS's cap-gap page says a student already in the grace period when the petition is filed keeps F-1 status but "will not be authorized to work." Our guide to exactly when the STEM OPT 180-day extension starts and ends covers the timing, and our comparison of what you can and cannot do on an I-797 receipt notice covers the other receipts.
State by state: what DMVs and university offices say
There is no national list. The table uses only university international-office pages (some quoting DMV policy), read November 1-2, 2026. Illinois State's caveat that its guidance "may be subject to change" applies to every row, so call ahead.
As of 2026-11. Pending-case renewal practice by state.
| State (agency) | STEM OPT pending | Cap-gap | How long the card lasts | Source |
|---|---|---|---|---|
| Texas (DPS) | Will not renew until approved; expect delays | Will not renew until approved; bring the cap-gap I-20 | D/S: within one year; renewed yearly | UT Dallas ISSO, TCU International Services, UT Austin Texas Global |
| Illinois (Bloomington office; elsewhere, ask your local office) | Can renew while pending; bring the OPT EAD and I-765 receipt | Not addressed | Six months from the OPT end date | Illinois State ISSS, STEM pending |
| Illinois, initial OPT pending (Bloomington office) | No renewal until the OPT EAD arrives; a 90-day driving-only temporary license instead | n/a | 90 days, no photo, not ID | Illinois State ISSS, OPT pending |
| Delaware (DMV) | Not addressed; no card without SAVE verification | Present the updated I-20 showing the extension; after approval, bring the I-797 | One year when records show D/S | University of Delaware ISSS |
| Any other state | Check your DMV's non-citizen page and your ISSS page | Same | Often the end date on your EAD or I-94 | Your DMV and your DSO |
Renew driver's license with STEM OPT pending in Texas
Texas is the strictest of the three. UT Dallas says F-1 students with an expired OPT EAD "who are pending approval of either a STEM OPT Extension or H-1B Cap-Gap Relief, will be unable to renew their license until the new status is approved." TCU's page says the same. UT Austin's Texas Global page says to expect delays with a pending OPT or STEM OPT case.
UT Austin also gives the escalation path: if the DPS officer cannot verify your status in SAVE, ask to speak with a supervisor, and if the supervisor cannot verify it, DPS should start a secondary verification. Separately, Newsweek reported that some H-1B workers said Texas DPS denied renewals over expired visa stamps (attorneys it quoted said the I-94, not the visa, controls the stay), and carried one account, which it could not verify, of a DPS record still showing STEM OPT after a change to H-1B. Treat these as reports, not policy.
A worked timeline: one STEM OPT case, two states
Suppose your OPT EAD and license both end on 2027-01-15 (Illinois State uses January 15 in its own example) and you file your STEM OPT I-765 on 2026-11-20, while the EAD is valid.
Worked example, as of 2026-11. Day counts are our arithmetic.
| Date | What happens | Bloomington, Illinois (per Illinois State) | Texas (per UT Dallas and TCU) |
|---|---|---|---|
| 2026-11-20 | STEM I-765 filed; I-797C receipt follows | Current license still valid | Current license still valid |
| 2027-01-15 | OPT EAD and license end | Renew with the OPT EAD and I-765 receipt; new card ends 2027-07-15 | No renewal while the STEM case is pending |
| 2027-01-16 | The 180-day work extension begins | You keep working | You keep working, without a valid Texas license |
| 2027-04-20 | Five months after filing (the snapshot below) | Return with the STEM EAD if approved | Renew with the STEM EAD once approved |
| 2027-07-14 | Last day of the extension if USCIS still has not decided | Work must stop after today; the card ends 2027-07-15 | Work must stop after today |
The five-month mark comes from the USCIS processing-times tool, which on 2026-11-01 showed 80% of I-765 (c)(3) F-1 student cases completed within 5 months. That is a snapshot, not a promise. Premium processing exists for OPT and STEM OPT I-765s ($1,780, 30 business days, per Form G-1055, edition 10/26/26); it can shorten the wait but does not change what a DMV accepts.
Drivers license during cap-gap
Cap-gap is automatic, with no new EAD. USCIS calls the DSO's updated I-20 "the only proof of continued employment authorization currently available." For an FY2027 cap petition still pending in November 2026, the extension runs to 2027-04-01 at the latest; if USCIS approves the petition sooner, cap-gap ends on the approved petition's validity start date. It ends automatically if the petition is denied, withdrawn, revoked or rejected. USCIS says the standard F-1 60-day grace period then runs from the notice, except after a denial or revocation for a status violation, misrepresentation or fraud. Any license basis tied to cap-gap ends with it; take that to your DSO and the employer's attorney, not the DMV.
Cap-gap is harder for a clerk to read: the evidence is an I-20 plus your employer's I-129 receipt, not a card. Texas, per UT Dallas and TCU, waits for the H-1B approval; UT Austin says to bring the cap-gap I-20 and the I-797C receipt and to expect delays. The University of Delaware says to present the updated I-20 showing the extension of stay, then return with the I-797 approval and ask the DMV to extend the license for one year. Our cap-gap explainer covers who qualifies and how the I-20 is issued.
Renew driver license with an expired EAD: when no extension applies
These gaps have no federal bridge, so a renewal usually waits for the new document:
- STEM OPT filed late. A STEM I-765 filed after the OPT EAD expires gets no 180 days. Talk to your DSO now.
- Day 181. The extension ends after 180 days. Illinois State puts it plainly: "you CANNOT WORK past the 180-day extension of your OPT EAD card."
- Initial OPT pending. No EAD exists yet; see the Bloomington, Illinois 90-day option above.
A lapsed license does not ground you: TSA's acceptable ID list includes a "Foreign government-issued passport." See our guide to flying with an EAD under REAL ID.
What documents should you bring to the DMV on STEM OPT or cap-gap?
Bring originals and one set of copies:
- Passport (identity), valid.
- Most recent I-94. Download it before you go; our guide to downloading your most recent I-94 explains why an older copy can fail.
- I-20. For STEM OPT, the I-20 showing your DSO's STEM OPT recommendation; for cap-gap, the updated I-20 showing the extension to April 1.
- I-797C receipt. Your STEM I-765 receipt, or your employer's I-129 receipt for cap-gap.
- Your OPT EAD, expiring or expired.
- State basics. Your current license, your Social Security card (TCU notes Texas offers an affidavit if you are not eligible for an SSN), and your state's proofs of residency.
What to do if the DMV refuses or cannot verify your status
A "cannot verify" result is a SAVE response, not a decision about your status. USCIS's SAVE CaseCheck page says "the majority of SAVE cases are verified for user agencies within seconds," but some take longer, and UT Austin warns that a case resolved in SAVE can take extra time to reach the DMV's database.
- Ask the clerk whether the refusal is state policy (no renewal while pending) or a SAVE result (unable to verify), and note the exact words.
- Request a supervisor and, if SAVE still cannot confirm your status, a secondary verification, as UT Austin advises for Texas DPS.
- Get the SAVE verification case number from the DMV, then check it in SAVE CaseCheck on uscis.gov with your ID type, date of birth and that number (or your receipt, A-number or passport number).
- Email your DSO at your school's international office with the clerk's wording, so they can check your SEVIS record and I-20.
- Check your receipt number in USCIS's online case status, and confirm it matches the number the DMV entered.
- Return to the DMV, after calling ahead, once SAVE resolves or your STEM EAD or H-1B I-797A arrives.
- Contact an immigration attorney (for cap-gap, through your employer) if the H-1B petition was denied, withdrawn, revoked or rejected, or if your DSO finds a problem with your record.
Common mistakes
- Driving on an expired card because you can still work. Work authorization is not a license. Plan for the gap.
- Filing STEM OPT after the EAD expires. That forfeits the 180-day work extension and leaves no timely pending case for even a lenient office to renew on.
- Bringing the receipt without the STEM I-20. The receipt shows a filing; the I-20 shows your DSO's recommendation. Bring both.
- Reading a DMV refusal as a status problem. It may be verification timing or state policy instead. Confirm with your DSO.
- Describing your status differently to get a card. Never. Present exactly what your documents show.
- Assuming another state's rule applies. One Illinois office's practice says nothing about Texas, or even about other Illinois offices.
Frequently asked questions
Can I renew my driver's license while my STEM OPT extension is pending?
It depends on your state and office. As of November 2026, Illinois State University says the Bloomington, Illinois DMV renews while STEM OPT is pending, with the card ending six months after the OPT end date. UT Dallas and TCU say Texas DPS will not renew until approval. Your 180-day work extension, in effect, is a separate question.
Can I get a driver's license during cap-gap?
Sometimes. Cap-gap extends F-1 status, and OPT work if your OPT was valid at filing, to April 1 (or the approved petition's start date, if earlier) for a timely cap-subject change-of-status petition, but each DMV decides what it accepts. University of Delaware says to present the updated I-20; UT Dallas and TCU say Texas DPS waits for the H-1B approval. Bring the cap-gap I-20 and the I-797C receipt.
Why does the DMV say it cannot verify my status?
DMVs check your status in the USCIS SAVE system. USCIS says most SAVE cases are verified within seconds but some take longer, and UT Austin says to expect delays while an OPT, STEM OPT or cap-gap case is pending. Ask for a supervisor or secondary verification, get the SAVE case number, track it with SAVE CaseCheck on uscis.gov, and tell your DSO what the clerk said.
How long does a limited-term license last on OPT?
Under the federal REAL ID standard, a limited-term card lasts no longer than your authorized stay, or one year when the stay has no definite end, as with duration of status. In practice an OPT license often ends on the EAD's end date. Illinois State University says a Bloomington, Illinois renewal issued while STEM OPT is pending ends six months after the OPT end date (checked November 2026).
What documents should I bring to the DMV on STEM OPT?
Bring your passport, most recent I-94, the I-20 showing your DSO's STEM OPT recommendation, your expiring or expired OPT EAD and the I-797C receipt for your STEM I-765. Add your current license, Social Security card and proofs of residency, and call ahead, because accepted documents differ by state and office.
