Research Associate Jobs in Biotech on OPT: Who Sponsors H-1B and When Cap-Exempt Labs Make Sense

Industry RA jobs mean the H-1B lottery. Cap-exempt university labs skip it but give no cap-gap. How to choose, check the wage and time the filing.

Part of our guide to cap-exempt H-1B employers.

Yes, research associate jobs with H-1B sponsorship exist across biotech, but an industry research associate (RA) role is cap-subject: your employer has to register you in the H-1B lottery, and since 2026-02-27 selection is weighted by the wage level of your offer, which favors higher-paid offers over entry-level lab pay. Universities, their affiliated nonprofits, and nonprofit or government research organizations can file a cap-exempt H-1B at any time of year, with no lottery. The catch: cap-exempt petitions get no cap-gap, and public universities in Florida and Texas have paused new petitions.

Research associate jobs with H-1B sponsorship: the short answer

A research associate job leads to H-1B sponsorship through one of two doors. At a for-profit biotech or pharma company, your registration must be selected in the H-1B lottery, and lower wage levels get fewer entries. At a university, an affiliated nonprofit, or a nonprofit or government research institute, the employer can file a cap-exempt H-1B any time, with no lottery but no cap-gap protection.

RA I, RA II or associate scientist: which title is it?

Many industry labs run a ladder from research associate I and II to senior research associate, then associate scientist and scientist. Bachelor's graduates are often hired at RA I and master's graduates at RA II or associate scientist, though each company sets its own bands. For a visa, the duties, required degree and occupation code matter more than the title.

At universities, "research associate" can mean a lab staff position or, at some schools, a post-PhD appointment, so ask which one is on offer. USCIS defines a specialty occupation as requiring "Attainment of a bachelor's or higher degree in a directly related specific specialty," on its H-1B specialty occupations page. The employer's attorney builds that case from the real duties.

The SOC code shapes both the wage and the case

The employer's Labor Condition Application (LCA) to DOL names a Standard Occupational Classification (SOC) code. RA jobs commonly fall under one of these:

SOC codeTitleWhat the BLS definition describes
19-4021Biological Technicians"Assist biological and medical scientists"; set up instruments, monitor experiments, collect samples
19-1021Biochemists and BiophysicistsThe chemistry and physics of living cells and organisms
19-1022MicrobiologistsMicroscopic organisms such as bacteria, algae and fungi
19-1029Biological Scientists, All OtherBiological scientists not listed separately
19-1042Medical Scientists, Except EpidemiologistsHuman disease and ways to improve health

Source: BLS 2018 SOC definitions. The employer's attorney picks the code from the actual duties, and those same duties have to support the degree requirement above. Because the prevailing wage is set per code and area, the same salary can land at a different wage level under a different code, and in industry the level sets your lottery entries.

Do biotech companies sponsor H-1B for research associates?

Many do, but sponsorship is decided company by company and often level by level: a company that sponsors scientists may not sponsor an RA I. Check the record before you invest weeks in interviews.

For the wider sector map, see our biotech and life sciences H-1B sponsorship guide.

Why the weighted lottery matters for RA pay

USCIS's registration page says selection is based "generally on the highest OEWS wage level" the offered wage equals or exceeds for the SOC code and worksite area. Under the weighted-selection rule, in effect since 2026-02-27, a Level IV registration is entered four times and a Level I registration once. Levels are measured against local wages, so the same RA salary can reach Level II in one county and only Level I in a higher-wage metro, where it gets the fewest entries. That is the core argument of our cap-exempt bridge strategy explainer.

Is a research associate role cap-exempt at a university?

Usually, if the employer is the university, a nonprofit related to or affiliated with it, a nonprofit research organization or a government research organization. The exemption follows the employer, not the title. An RA at a for-profit startup in a university research park is generally cap-subject; being next to a campus is not enough.

USCIS says H-1B workers "petitioned for or employed at an institution of higher education or its affiliated or related nonprofit entities, a nonprofit research organization, or a government research organization, are not subject to this numerical cap." Under 8 CFR 214.2(h)(8)(iii)(F), in its current form since 2025-01-17, a nonprofit can qualify through a written affiliation agreement where "a fundamental activity" supports the university's mission. A company employee placed at a qualifying entity can sometimes be exempt too, but only if they spend at least half their work time there (telework can count) and the employer's attorney confirms the other conditions.

Check the state. Florida's Board of Governors paused new H-1B hires at all 12 public universities from 2026-03-02 until at least 2027-01-05, with renewals unaffected, according to Central Florida Public Media. In Texas, Gov. Greg Abbott's 2026-01-27 letter bars public universities, and state agencies with governor-appointed heads, from filing any new H-1B petition without the Texas Workforce Commission's written permission until 2027-05-31. Private employers are outside it, and the order did not cover K-12 schools, per the Texas Tribune. Ask the international office before you accept, and see where cap-exempt jobs remain in Texas and Florida.

The $100,000 payment. CRS Insight IN12747 (2026-10-14) reports that initial H-1B petitions for consular processing from cap-exempt employers fell 91% in the fee's first eight months, compared with the same period a year earlier. Those are petitions for people abroad. A change of status USCIS grants to you on OPT was never covered, and as of 2026-11-01 collection is blocked by court orders on appeal. If collection resumed, a petition for consular processing, or a change of status USCIS denies, would be covered.

What is pending. RIN 1615-AD00, "Reforming the H-1B Nonimmigrant Visa Classification Program," has been under OIRA review since 2026-08-24. Its agenda abstract mentions "revising eligibility for cap exemptions, providing greater scrutiny for employers that have violated program requirements, and increasing oversight over third party placements." No text is public and no comment period is open; current cap-exempt rules apply. For the employer categories in depth, read our guide to cap-exempt universities and research hospitals.

Can I work as a research associate on STEM OPT?

Yes, if your degree is STEM-designated and the employer meets the STEM OPT rules; universities and biotechs both can. Per USCIS's STEM OPT page, the employer must be enrolled in E-Verify, sign a Form I-983 training plan that connects the RA role to your STEM degree, and offer an opportunity "commensurate with those of similarly situated U.S. workers in duties, hours, and compensation." It must keep a bona fide employer-employee relationship: you may not "work for the employer on a 'volunteer' basis." That rules out unpaid lab arrangements; on post-completion OPT, ask your DSO before counting any unpaid lab time.

Timing. The STEM OPT I-765 can be filed "up to 90 days before your current OPT employment authorization expires," and within 60 days of the date your DSO enters the recommendation in SEVIS. If the EAD expires while a timely application is pending, USCIS will "automatically extend your employment authorization for 180 days," ending when it decides. An application filed after the EAD expires gets no 180 days.

Unemployment. The SEVIS Help Hub allows 90 days on post-completion OPT and 150 days in total with STEM OPT. Lab start dates slip for funding and onboarding, and those days count.

Do research associate salaries meet H-1B wage rules?

They have to. DOL's H-1B program page sets the floor at the employer's actual wage for similar workers or "the prevailing wage for the occupation in the area of intended employment," whichever is greater. Which figure applies depends on the SOC code, the worksite county and the type of employer.

For universities, affiliated nonprofits and nonprofit or government research organizations, 20 CFR 655.731(a)(2)(vii) says "the prevailing wage level shall only take into account employees at such institutions and organizations in the area of intended employment." So the industry figure may not be the one a university uses.

DOL's wage data downloads show the current wage year as July 2026 to June 2027. DOL's prevailing-wage NPRM (RIN 1205-AC30, 2026-03-27) would move Level I from the 17th to the 34th percentile; it is proposed, with no final rule and nothing at OIRA. For the mechanics, see how the H-1B prevailing wage is determined.

How to check an RA offer's wage level

  1. Find the worksite county on your offer letter; the wage area is where you will work.
  2. Ask HR or the international office which SOC code the LCA will likely use, and whether the higher-education comparison applies.
  3. Open DOL's OFLC Wage Search and search by the SOC code (for example 19-1021) or the occupation title.
  4. Select the worksite state and county, and confirm the July 2026 to June 2027 wage year.
  5. Compare your base salary with the Level I to IV figures and note the highest level it equals or exceeds.
  6. Cross-check in DOL's OFLC disclosure files how that employer filed earlier "research associate" LCAs.
  7. Take any mismatch to the employer's immigration attorney, who sets the code and level from the duties.

Should I take a cap-exempt lab job to avoid the lottery?

It can make sense if you want H-1B certainty soon, plan a PhD or an academic research career, or expect industry offers at a low wage level. It makes less sense if you want industry within a couple of years, because moving to a for-profit employer later generally means the lottery anyway.

A worked timeline with real dates

You finished an MS in biotechnology (STEM-designated) in August 2026. Your OPT EAD runs 2026-10-01 to 2027-09-30, and you hold two offers that start in early November 2026, so about a month of your 90 unemployment days is used before day one.

2027-09-30OPT EAD ends. A selected change-of-status petition filed on time starts 2027-10-01 or, if still pending, gets cap-gap up to 2028-04-01; otherwise a timely STEM OPT I-765 continues work up to 180 days while pendingNo cap-gap: work stops unless the H-1B is approved and in effect, or a timely STEM OPT I-765 is pending

Cap-gap extends status and OPT work "until April 1 of the fiscal year for which such H-1B status is being requested," or the approved petition's start date if earlier, and USCIS's cap-gap page says it "applies only to beneficiaries of cap-subject H-1B petitions"; our explainer on whether cap-gap applies to cap-exempt H-1Bs covers the timing. A university can request premium processing, which as of 2026-11-01 is 15 business days for most I-129 petitions.

Decision checklist

Who to ask: your DSO for OPT, STEM OPT, I-983 and unemployment days; the employer's immigration attorney for cap-exempt status, the SOC code, the wage and filing dates; your own immigration attorney for status strategy; a tax professional who handles nonresident returns for withholding on lab pay.

Frequently asked questions

Do biotech companies sponsor H-1B for research associates?

Many do, but it varies by company and level. An industry RA H-1B is cap-subject, and since 2026-02-27 the lottery is weighted by wage level (Level IV four entries, Level I one). Check the USCIS H-1B Employer Data Hub and DOL's LCA disclosure files first.

Is a research associate role cap-exempt at a university?

Usually yes when the employer is the university, an affiliated nonprofit, a nonprofit research organization or a government research organization; the exemption follows the employer, not the title. As of 2026-11-01, Florida has paused new H-1B hires at 12 public universities until at least 2027-01-05, and Texas bars new petitions at public universities without state permission until 2027-05-31.

Can I work as a research associate on STEM OPT?

Yes, if your degree is STEM-designated, the role relates to it, and the employer uses E-Verify, signs a Form I-983 and offers comparable duties, hours and pay. Unpaid volunteer roles do not qualify. As of 2026-11-01, a timely STEM OPT application still extends work authorization up to 180 days while pending.

Do research associate salaries meet H-1B wage rules?

They must: the employer pays the higher of its actual wage or the DOL prevailing wage for the occupation and area. That depends on the SOC code, the county and, at universities and research organizations, a sector-only comparison. Check the OFLC Wage Search for the July 2026 to June 2027 wage year.

Should I take a cap-exempt lab job to avoid the lottery?

It can, if you want H-1B certainty soon, plan a PhD or academic research, or expect a low-level industry offer. There is no cap-gap, so the petition should be filed well before your OPT EAD ends, and a later move to industry generally means the lottery. Check your dates with your DSO and an immigration attorney.

Frequently asked questions

Do biotech companies sponsor H-1B for research associates?

Many do, but it varies by company and by job level, and an industry research associate H-1B is cap-subject, so your registration must first be selected in the lottery. Since 2026-02-27 selection is weighted by the wage level of the offer, with Level IV entered four times and Level I once. Check a company's record in the USCIS H-1B Employer Data Hub and in DOL's LCA disclosure files before you apply.

Is a research associate role cap-exempt at a university?

Usually yes when the employer is the university itself, a nonprofit related to or affiliated with it, a nonprofit research organization or a government research organization, because those employers are not subject to the H-1B cap. The exemption follows the employer, not the job title. As of 2026-11-01, Florida has paused new H-1B hires at 12 public universities until at least 2027-01-05, and Texas bars new petitions at public universities without state permission until 2027-05-31, so ask the international office before you accept.

Can I work as a research associate on STEM OPT?

Yes, if your degree is STEM-designated, the role relates to that degree, and the employer is enrolled in E-Verify, signs a Form I-983 training plan, and gives you duties, hours and pay comparable to similar US workers. Unpaid volunteer lab roles do not qualify. As of 2026-11-01, a STEM OPT application filed before your OPT EAD expires still extends your work authorization for up to 180 days while it is pending.

Do research associate salaries meet H-1B wage rules?

They have to, because the employer must pay the higher of its actual wage for similar workers or the DOL prevailing wage for the occupation and the worksite area. Whether a given RA salary clears that bar depends on the SOC code, the worksite county and, for universities and research organizations, a wage comparison limited to those employers. You can check the figures in DOL's OFLC Wage Search for the July 2026 to June 2027 wage year.

Should I take a cap-exempt lab job to avoid the lottery?

It can make sense if you want H-1B certainty soon, plan a PhD or an academic research career, or expect an industry offer at a low wage level. Cap-exempt petitions get no cap-gap, so the petition should be filed well before your OPT EAD ends, and a later move to a for-profit employer generally means entering the lottery unless you were counted against the cap before. Walk through your dates with your DSO and an immigration attorney before you decide.
