After You Answer an RFE: How Long USCIS Takes to Decide, With and Without Premium Processing
Once USCIS has your RFE response, a premium case gets a brand-new 15- or 30-business-day window, while a regular case has no fixed clock at all.

Short answer, as of November 1, 2026: how long USCIS takes after you answer an RFE depends on premium processing. In a premium case, USCIS starts a brand-new window the day it receives your response: 15 business days for most H-1B and other I-129 petitions, 30 business days for OPT and STEM OPT applications. A regular case has no fixed deadline after an RFE response, so the live USCIS processing-times tool is your only official guide. Your own RFE response time comes first: the due date printed on the notice, by which USCIS must receive your response. No extensions exist.
Status line, 2026-11-01. USCIS Policy Alert PA-2026-05 has been in effect since 2026-08-05 and is challenged in AAUP v. Mullin (D. Mass., filed 2026-10-05; no ruling). Under it, 12 weeks is the maximum RFE window and NOIDs allow 30 days. The premium processing timeframes USCIS lists are in effect. "Amending the Premium Processing Timeframe" (RIN 1615-AD25) has been under OIRA review since 2026-10-13 with no public text.
RFE response time: the two clocks that run on your case
RFE response time runs on two clocks. Yours is the due date on the notice: USCIS must receive one complete response by then, 12 weeks is the maximum (30 days for Form I-539), and extensions are not allowed. USCIS's clock depends on premium processing. A premium case gets a new full business-day window; a regular case gets no fixed deadline.
How long do you have to respond to an RFE?
Until the deadline printed on the notice, with no extension. The officer sets that date, a regulation caps it, and timeliness turns on when USCIS receives your response, not when you send it.
The cap comes from 8 CFR 103.2(b)(8)(iv): "in no case shall the maximum response period provided in a request for evidence exceed twelve weeks." Before PA-2026-05, officers generally gave the full 12 weeks. Now they "are not required to issue an RFE with a standard 12-week response period," and the USCIS Policy Manual, Volume 1, Part E, Chapter 6 lets them pick "a response time that is reflective of the evidence being requested," up to that cap.
The details that decide whether you are on time
- Mailed notices add 3 days. The Policy Manual calls this "a maximum of 87 days after USCIS mailed the RFE, for USCIS to receive a timely RFE response." A ceiling, not a promise.
- Form I-539 is shorter. The Policy Manual caps I-539 RFEs at 30 calendar days plus 3 mailing days, which covers H-4, L-2 and F-1 change-of-status applicants.
- No extra time from abroad. PA-2026-05 dropped the 14 extra days once added for notices mailed outside the United States.
- Weekends and holidays. If the deadline falls on a Saturday, Sunday or federal holiday, a mailed response arriving the next business day is timely. An online response counts on the day you submit it, weekend or not (Policy Manual; PA-2026-15, in effect since 2026-10-23).
A NOID runs on a tighter 30-day clock and signals a planned denial; see how a NOID differs from an RFE.
Can you ask for more time to answer an RFE?
No. The same regulation says: "Additional time to respond to a request for evidence or notice of intent to deny may not be granted." Under 8 CFR 103.2(b)(11) you can send a complete response, send a partial one and accept a decision on the record, or withdraw. All requested materials "must be submitted together at one time," and a partial package is treated as a request for a decision on the record; in the Policy Manual's words, "USCIS does not wait for a second response." Missing the deadline lets USCIS deny the case as abandoned, on the record, or both (8 CFR 103.2(b)(13)). Building that single package is covered in our H-1B RFE response playbook.
How long does USCIS take to decide after an RFE response?
With premium processing, USCIS must act within a new full window that starts when it receives your response. Without it, USCIS publishes no fixed post-response timeframe; the decision comes when an officer reaches the file.
The case-status line "Response To USCIS' Request For Evidence Was Received" is the marker between the two clocks. It confirms that USCIS has logged your response and the file is waiting for an officer; it is not an approval or a denial. Keep your own delivery or online-submission proof as well, because the premium window runs from the day USCIS received the package, not from the day the status line changed.
Does premium processing restart after an RFE response?
Yes, in full. USCIS's premium processing page says "the 15-, 30-, or 45-day premium processing time period will stop and reset," and a new period begins when USCIS receives the RFE or NOID response.
- A fresh window, not the remainder. If the RFE went out on business day 9, USCIS does not resume with 6 days left. It gets a full 15 again.
- Business days, not calendar days. Weekends and federal holidays stretch the calendar.
- Action, not approval. The Form I-907 instructions define action as an approval, a denial, an RFE or a NOID, so the new window can end in a second RFE. If USCIS misses the window, the fee is refunded "but we will continue to process the case." USCIS may keep the fee and skip the deadline if it opens a fraud or misrepresentation investigation.
You can also upgrade after responding: the instructions allow a request "as long as USCIS has not made a final decision," but only the filer can ask (your employer for an I-129, you for your own OPT I-765). Whether the fee earns its keep is the subject of our H-1B premium processing guide.
What happens without premium processing?
You wait, with no deadline. The USCIS processing-times tool reports how long it took to complete 80% of cases of a form and category, measured across the whole case. It is not a countdown that restarts on your response. Our explainer on the 80% rule behind USCIS processing times shows how to read it, and if months pass with no movement, see what to do when an H-1B case status is stuck.

| I-129 for H-1B, L-1, O-1 or TN | 84 days (+3 if mailed) | New 15 business days | $2,965 | No fixed time |
| I-765 for OPT or STEM OPT, (c)(3)(A)-(C) | 84 days (+3 if mailed) | New 30 business days | $1,780 | No fixed time |
| I-539 change to F-1, J-1 or M-1 (or F-2, J-2, M-2) | 30 days (+3 if mailed) | New 30 business days, once all prerequisites are met | $2,075 | No fixed time |
| I-539 for H-4 or L-2 | 30 days (+3 if mailed) | Not available | n/a | No fixed time; reviewed after the principal's I-129 when filed together |
| I-765 H-4 EAD, (c)(26) | 84 days (+3 if mailed) | Not available | n/a | No fixed time |
| I-140, most categories / EB-1C and NIW | 84 days (+3 if mailed) | New 15 / 45 business days | $2,965 | No fixed time |
Every window in the second column is a ceiling. The date printed on your notice controls.
Worked example: one RFE, three possible clocks
Suppose USCIS mails an RFE on Thursday, September 10, 2026, on an H-1B extension your employer filed with premium processing, and the officer gives the full 12 weeks.
- Find the outer deadline. 84 days plus 3 mailing days lands on Sunday, December 6, 2026, so a mailed response arriving Monday, December 7 would still be timely; an online response must be submitted by December 6. If your printed date differs, it wins.
- Respond early. Say the attorney's response reaches USCIS on Monday, November 2, 2026.
- Count the new premium window. Counting business days from the day after receipt and skipping Veterans Day (November 11), the 15th business day is Tuesday, November 24, 2026. By then USCIS must approve, deny, or issue another RFE or a NOID.
- Compare an OPT case. A premium OPT I-765 whose response arrived the same day gets 30 business days. Skipping Veterans Day and Thanksgiving (November 26), that is Wednesday, December 16, 2026.
- Compare a regular case. Same response, no premium: there is no date to count to.
USCIS does not spell out a counting convention, so treat those dates as estimates within a day. The OPT date in step 4 falls after 2026-12-11, when current federal funding ends unless Congress passes funding by then. In the 76-day DHS-only funding lapse of February to April 2026, fee-funded USCIS kept processing.
OPT, cap-gap and H-4: what changes the stakes
If you are on OPT or STEM OPT
You file and answer your own I-765 RFE, so you can request premium processing yourself, including online. PA-2026-05 lets USCIS deny an OPT application with no RFE when required initial evidence is missing, so an RFE is at least a chance to complete the record. If it touches your I-20 or SEVIS record, involve your DSO first. Cornell, Johns Hopkins and USC advise against travelling abroad while an initial OPT application is pending, since a missed biometrics appointment can delay or deny the case; ask your DSO before booking. Our guide to common STEM OPT RFE reasons covers what officers usually ask for.
If your H-1B cap petition carries cap-gap
USCIS's cap-gap page extends F-1 status and OPT work for a timely cap-subject change-of-status petition until April 1 of the fiscal year requested (April 1, 2027 for FY2027 petitions), or the approved petition's validity start date if that comes first. It ends automatically if the petition is denied, withdrawn, revoked or rejected; cap-exempt petitions get none. An RFE is not one of those events, since the petition stays pending (our reading), but a regular-processing wait runs against that April 1 date. Whether to upgrade is your employer's call with its attorney; your DSO confirms your SEVIS record.
If you are an H-4 spouse
An H-4 I-539 RFE has the 30-day maximum, and neither the H-4 I-539 nor the (c)(26) H-4 EAD can be premium processed. For an H-4 I-539 filed with the principal's I-129, USCIS says an officer reviews it "as soon as possible after reviewing the principal's Form I-129," which is not a deadline. EAD renewals carry more risk: under the final rule ending automatic EAD extensions (in effect since 2026-10-14 and challenged), a (c)(26) renewal filed on or after 2025-10-30 no longer lets you keep working past the card's end date while it is pending, so an RFE delay can mean a gap. Timely renewals filed before that date keep up to 540 days. A court order in Jane Doe 1 v. DHS protects only seven named plaintiffs. Talk to an immigration attorney about any expected gap.
How often do H-1B petitions get RFEs?
Less often than O-1, L-1 or TN petitions. USCIS's I-129 RFE data for FY2026 Q1-Q3 (October 2025 to June 2026, initial and extension petitions combined) shows the share of completed petitions that had an RFE: 8.5% for H-1B, 13.0% for TN (USCIS-filed only), 24.2% for O, 25.9% for L-1A and 29.4% for L-1B. All of it predates PA-2026-05, so it says nothing about how the August policy changed RFE practice.
Is a premium processing rule pending?
One is under review, but nothing has changed as of 2026-11-01. A USCIS rule titled "Amending the Premium Processing Timeframe" (RIN 1615-AD25) has been at the White House Office of Information and Regulatory Affairs since 2026-10-13, listed at the proposed-rule stage. Its text is not public and its direction is unknown. The timeframes in the table apply unless and until a final rule takes effect.
What to do after you send your RFE response
- Keep the courier or USPS delivery confirmation, or the online submission confirmation; the premium window runs from USCIS's receipt.
- Check your USCIS online account or Case Status Online for "Response To USCIS' Request For Evidence Was Received." It confirms receipt, not a decision.
- Count the premium window in business days from receipt.
- Call 866-315-5718 with your receipt number if the window passes with no action (USCIS lists it for people who already filed Form I-907); OPT applicants who filed the I-907 online can send a secure message through their USCIS online account.
- Use the processing-times tool for a regular case, including the date it shows for when a case inquiry becomes possible.
- Ask your DSO about SEVIS, OPT or cap-gap, and an immigration attorney (your employer's, for an I-129) about an upgrade, a NOID, or a denial and Form I-290B.
Common misconception: "Premium means a decision 15 days after I respond." Correction, as of 2026-11-01: USCIS commits to action within a new 15-business-day window (30 for OPT), and that action can be another RFE or a NOID.
Common mistakes
- Planning around 87 days. That is the ceiling for a mailed 12-week RFE, not a default.
- Mailing on the due date. USCIS must receive a mailed response by the deadline; the postmark does not count.
- Sending the response in pieces. A partial first package gets a decision on the record.
- Counting calendar days. Premium timeframes are business days.
- Reading the processing-times figure as a post-RFE countdown. It measures whole cases from receipt.
- Assuming an H-4 rides the H-1B premium clock. It has no premium guarantee.
Frequently asked questions
How long does USCIS take after receiving an RFE response?
It depends on premium processing. A premium case gets a new full window from the day USCIS receives the response, which as of 2026-11-01 is 15 business days for most I-129 and I-140 petitions and 30 for OPT I-765s and F, J or M I-539s. A regular case has no fixed deadline, so check the live USCIS processing-times tool.
Does premium processing restart after an RFE response?
Yes, in full. USCIS says the premium period stops and resets when it issues an RFE or NOID, and a new period begins when it receives the response. As of 2026-11-01 that is 15 business days for most I-129 and I-140 petitions, 45 for EB-1C and NIW, and 30 for OPT. The window promises action, which can be another RFE, not an approval.
How long do I have to respond to an RFE?
Until the due date printed on your notice. 8 CFR 103.2(b)(8)(iv) caps an RFE at 12 weeks, and since PA-2026-05 (in effect since 2026-08-05, challenged in court) that is a maximum, not a standard period. The USCIS Policy Manual caps Form I-539 RFEs at 30 days, and a mailed notice adds 3 days. USCIS must receive your response by the deadline.
What does "Response To USCIS' Request For Evidence Was Received" mean?
It means USCIS has logged your RFE response and the case is back in line for an officer. It is not an approval or a denial. In a premium case the new business-day window runs from that receipt; in a regular case the next update can be an approval, a denial, another RFE or a NOID, with no fixed date as of 2026-11-01.
Can I ask for more time to answer an RFE?
No. 8 CFR 103.2(b)(8)(iv) says additional time to respond to an RFE or NOID may not be granted, and USCIS policy as of 2026-11-01 repeats that. You can send a complete response, send a partial one and accept a decision on the record, or withdraw. Take the notice to your immigration attorney, or your DSO for OPT, the day it arrives.
