What Is an RFE? A Request for Evidence Explained for OPT, H-1B and H-4 Cases

An RFE is not a denial, but since August 2026 USCIS can deny a filing that lacks initial evidence without one, and only the date printed on your notice counts.

What is an RFE? An RFE, or Request for Evidence, is a written notice from USCIS saying it cannot approve your application or petition yet, naming the evidence it wants, and giving a date by which USCIS must receive your answer. It is not a denial. It is a pause with a deadline. If you are on OPT, STEM OPT, H-1B or H-4, it can arrive on an I-765, an I-129 or an I-539, and the rules for answering are the same in outline.

Status as of 2026-11-01: USCIS Policy Alert PA-2026-05 has been in effect since 2026-08-05 and is challenged in AAUP v. Mullin (D. Mass., filed 2026-10-05, no ruling). It lets USCIS deny any benefit request, OPT I-765s included, without an RFE or NOID when required initial evidence is missing, and it makes 12 weeks the maximum RFE response time rather than the standard one. No published USCIS data yet covers decisions made under it.

This guide covers the mechanics every RFE shares. For case strategy, go to our H-1B RFE response playbook or the STEM OPT extension RFE guide.

What is an RFE in immigration?

A Request for Evidence is a USCIS notice, issued while your case is pending, that names the eligibility requirement your filing has not yet proven, explains why the evidence falls short, and asks for specific documents by a stated deadline. USCIS then decides the case on whatever it has once your response arrives or the deadline passes.

Under the USCIS Policy Manual, Volume 1, Part E, Chapter 6 (current as of 2026-10-27), an RFE should name the requirement not yet met and why the evidence falls short, list evidence a statute, regulation or form instruction requires, say whether it wants initial or additional evidence, give examples of other evidence, and state the deadline. Treat it as a map and answer each point in its order. It cannot rescue a filing that was ineligible on the day you filed: "RFEs are not issued to 'cure' an eligibility deficiency."

Who receives it depends on the filing. On an H-1B, the RFE goes to the petitioner, your employer, usually through its attorney, so you may see it only if you ask. On an OPT or STEM OPT I-765, you are the applicant. On an H-4 I-539 or H-4 EAD, it goes to the applicant named on the form.

RFE vs RFIE vs NOID vs rejection vs denial

Each notice tells you how much room you have left. You may see "RFIE" (request for initial evidence) used for an RFE that asks for missing initial evidence. The Policy Manual does not use that label; it simply requires every RFE to say whether it wants initial or additional evidence.

DenialA decision on the record, or for abandonment if you did not respondNot in this case; a motion, an appeal where one exists, or a new filingSet out in the denial notice

The Policy Manual says "It is not appropriate to issue a NOID if required initial evidence is not submitted," and that a denial for abandonment cannot be appealed, though you may file a motion to reopen on Form I-290B. Our NOID vs RFE comparison for H-1B and green-card petitions goes deeper on NOIDs.

How long do I have to respond to an RFE?

Until the date printed on your notice, and USCIS has to receive your response by then. The Policy Manual describes the mailed-RFE maximum as 87 days "for USCIS to receive a timely RFE response". The limits below are ceilings, and since PA-2026-05 officers need not give the full amount.

RFE and NOID response limits, as of 2026-11 (USCIS Policy Manual, current as of 2026-10-27)

Notice and formMaximum time to respondExtra time if mailedOn time when
RFE on most forms, including I-765 (OPT, STEM OPT, H-4 EAD), I-129 (H-1B) and I-14084 days (12 weeks)3 days, so up to 87USCIS receives it by the printed date
RFE on Form I-539 (H-4 extension or change, change to F-1)30 days3 days, so up to 33Same
NOID on any form30 days3 days, so up to 33Same
Any notice uploaded to your USCIS online accountAs printedNone; service is complete the day USCIS uploads itYou submit online by the date, weekends included

Three rules sit behind those numbers:

Worked example: three RFEs dated Monday, 2026-11-02

Suppose USCIS issues three RFEs dated Monday, 2026-11-02, and each officer gives the full maximum, which officers no longer have to. The Policy Manual counts the 87 days from when USCIS mailed the RFE, not from the day the envelope reaches you.

CaseHow the RFE was servedLatest day USCIS can receive the response
STEM OPT I-765 filed onlineUploaded to the USCIS online accountMonday, 2027-01-25 (84 days)
H-1B extension on a paper I-129MailedThursday, 2027-01-28 (84 + 3 days)
H-4 extension on a paper I-539MailedSaturday, 2026-12-05 (30 + 3 days); a mailed response received Monday, 2026-12-07 is still on time

These are maximums we calculated from the Policy Manual rules; your own notice controls. If an H-1B petition and the spouse's H-4 I-539 draw RFEs the same week, the H-4 answer may be due nearly two months earlier. And "USCIS always gives 87 days" is wrong: 87 is the ceiling for a mailed 12-week RFE, not a promise.

Can USCIS deny my case without sending an RFE?

Yes. Since 2026-08-05, PA-2026-05 lets an officer deny any benefit request, an OPT or STEM OPT I-765 included, without an RFE or NOID when required initial evidence is missing; the officer may still send an RFE instead. The policy is in effect and challenged in AAUP v. Mullin (D. Mass., filed 2026-10-05), with no ruling as of 2026-11-01.

The policy is about missing initial evidence, the documents the regulations or form instructions say must come with the filing. When all of it is there but does not prove eligibility, 8 CFR 103.2(b)(8)(iii) lets USCIS deny, send an RFE or send a NOID. The alert says the old policy "discouraged officers from exercising discretion to deny the benefit request, without first issuing an RFE or NOID."

Is an RFE a bad sign?

Not by itself. It means the officer needs more before deciding, and in the latest USCIS data most employer petitions that drew an RFE were still approved. What can turn an RFE into a denial is the response: late, partial, or not aimed at the requirement the notice names.

Source: the USCIS quarterly I-129 RFE workbook. Approval rate is approvals divided by approvals plus denials; a petition with several RFEs counts once. Every decision in it predates PA-2026-05, and FY2026 Q4 had not been posted as of 2026-11-01, so these figures say nothing about cases under the new policy, or about yours.

A pending proposal could add RFEs on I-129 extensions, H-1B included. DHS's deference NPRM (RIN 1615-AD26, proposed, published 2026-10-14, comments close 2026-11-13) estimates about 6,044 extra RFEs a year across 208,429 affected petitions. Until a final rule exists, the current deference rules apply.

What usually triggers an RFE for OPT, H-1B and H-4 cases?

Most RFEs come from a gap between what the regulations and form instructions require and what the file shows.

How do I send my RFE response, by mail or online?

Exactly the way the RFE tells you. If the case was filed online, the notice appears in your USCIS online account and you upload the response there; USCIS lists responding to RFEs among the benefits of an online account. A paper case is answered by mail, to the address printed on the RFE, as one package with the original notice on top.

USCIS's tips for filing forms by mail (updated 2026-07-10) say "Do not mail responses to a Request for Evidence (RFE) or similar notices to a USCIS Lockbox location," and not to share an envelope with unrelated filings. The 2026-10-07 filing-address change (old addresses accepted if postmarked on or before 2026-11-09) is for new filings; by our reading, an RFE response goes wherever the RFE says.

  1. Log the notice the day it arrives: receipt number, printed response date, return address or upload instructions, and whether it came by mail or through your USCIS online account.
  2. Confirm who files: the employer's attorney for an H-1B I-129; you for an OPT or STEM OPT I-765, with your DSO handling any I-20 or SEVIS fix; you or your attorney for an H-4 I-539 or I-765.
  3. List every item the RFE requests under its own headings, and mark what you already have.
  4. Request third-party documents on day one: a corrected I-20 from your DSO, an updated Form I-983 signed by your employer, letters from HR, transcripts or credential evaluations.
  5. Translate every foreign-language document in full, with the translator's certification of accuracy and competence, as 8 CFR 103.2(b)(3) requires.
  6. Assemble one package: the original RFE notice on top, a short index or cover letter, then exhibits in the order the RFE asks.
  7. Submit it through your USCIS online account for an online-filed case, or mail it to the address on the RFE with a trackable courier.
  8. Keep a complete copy and the tracking number or online confirmation, and watch your case status in the online account.

Step 6 is not optional. The Policy Manual says "benefit requestors must submit all requested materials together at one time, along with the original RFE or NOID," and USCIS "does not wait for a second response" after a partial one.

Can I work or travel while an RFE is pending?

An RFE does not, by itself, change whatever work permission you had while the case was pending, and it adds no time to it. Travel is where the risk sits, so treat any trip as a question for your DSO or attorney first.

USCIS's STEM OPT page says the automatic extension "ceases once USCIS adjudicates your STEM OPT extension application." The H-4 row reflects the final rule ending automatic EAD extensions (in effect since 2026-10-14 and challenged; a court order covers only seven plaintiffs), which left the STEM OPT extension alone. Frequently asked questions

What does RFE mean in immigration?

RFE stands for Request for Evidence. It is a USCIS notice saying your application or petition does not yet prove eligibility, listing the evidence the officer wants and the date by which USCIS must receive it. It is not a denial, and as of 2026-11-01 your window is whatever your notice states, up to 12 weeks for most forms.

Is an RFE a bad sign?

Not by itself. In USCIS data for October 2025 through June 2026, 8.5% of completed H-1B petitions had an RFE, and by our arithmetic about 82% of those were still approved. That data predates PA-2026-05 (in effect since 2026-08-05). An unanswered RFE can be denied as abandoned, and a partial answer is treated as a request for a decision on the record.

How long do I have to respond to an RFE?

Until the date printed on your notice. As of November 2026, the maximum is 12 weeks (84 days) for most forms, 30 days for Form I-539 and 30 days for a NOID, with 3 days added only when the notice is mailed. USCIS no longer adds 14 days for notices mailed abroad and cannot grant extensions.

Can USCIS deny my case without sending an RFE?

Yes. Under PA-2026-05, in effect since 2026-08-05 and challenged in AAUP v. Mullin (filed 2026-10-05, no ruling as of 2026-11-01), USCIS may deny any benefit request, including an OPT I-765, without an RFE or NOID when required initial evidence is missing. Use the form instructions as your checklist and file complete.

Can I work or travel while an RFE is pending?

An RFE does not change the work authorization you already had while the case was pending, such as the STEM OPT 180-day extension or cap-gap, and it adds no time to those limits. Travel is riskier, because leaving can affect a pending OPT or change-of-status request while the RFE clock keeps running. Ask your DSO (F-1 or OPT) or the immigration attorney (H-1B or H-4) before you book anything.

How we checked this: we read PA-2026-05, the Policy Manual evidence chapter (current as of 2026-10-27), 8 CFR 103.2 and 274a.12, USCIS's mail, online-filing and STEM OPT pages, the two Federal Register documents of 2026-10-14, and the FY2026 Q3 I-129 RFE workbook (whose counts we recomputed) on 2026-11-01.

This is general information, not legal or tax advice. Your own notice, I-20, I-94 and approval documents govern, and your DSO (for F-1, OPT and SEVIS questions) or a licensed immigration attorney (for H-1B, H-4 and status strategy) should review your situation.

An RFE is a hurdle, not a verdict, and your job search keeps moving behind it. If you are on OPT or STEM OPT and want that search pointed at employers that sponsor, F1Jobs can help you plan it.
