Does Capital One Sponsor H-1B Visas? Tech Roles, the Data and the OPT-to-H-1B Path

Capital One sponsors H-1B visas for many technology roles, but not every posting, so here is how to tell which ones and how the OPT path works.

Yes, Capital One sponsors H-1B visas, and you can confirm its filings yourself in public USCIS and DOL data. Sponsorship is concentrated in specialty-occupation technology work such as software engineering, data, machine learning, cloud and cybersecurity. If you are asking "does Capital One sponsor H-1B for my role?", the honest answer is that it depends on the posting: some Capital One listings say plainly that the company will not sponsor a new applicant for that position.

So the useful questions are which Capital One roles sponsor, how to check the data, and how the F-1 to OPT to STEM OPT to H-1B path runs at a bank with a large engineering workforce.

Status line: what is true as of October 2026

Here is the policy backdrop any Capital One offer sits inside, as of October 14, 2026.

Does Capital One sponsor H-1B for every role? No, and here is the pattern

Capital One runs large engineering and data organizations, and H-1B status requires a specialty occupation: a role that normally needs at least a bachelor's degree in a specific field. That is why sponsorship clusters in technology. But it is decided position by position, so the table below is a general reading guide for large bank employers, not data about any individual Capital One posting.

Role familyGeneral pattern at large banksWhat to check
Software engineer, backend, full-stack, mobileClassic specialty occupation; commonly sponsoredWage level the role maps to; location
Data engineer, data scientist, ML engineerCommonly sponsoredWhether the posting requires a specific degree field
Cloud, DevOps, SRE, cybersecurityCommonly sponsoredAny clearance or citizenship line
Product manager (technical), business analystMixed; varies by team and programExplicit sponsorship language in the posting
Branch, call center, operations, salesRarely specialty occupationsUsually stated in the posting itself

The most important habit: read the bottom of every Capital One posting. Where the company will not support a visa for a role, the posting usually says so. Where that sentence is absent, ask the recruiter in your first conversation.

If you are comparing banks, the pattern is similar at other large institutions. Our guide to how JPMorgan Chase handles H-1B sponsorship shows the same tech-versus-business split, and the wider picture across Stripe, payment processors and neobanks is in our breakdown of fintech and payments companies that sponsor beyond the big banks.

How to check Capital One's H-1B data yourself

Do not rely on third-party "top sponsor" lists that do not show their source. Two government datasets let you see the filings directly.

  1. Open the USCIS H-1B Employer Data Hub. It covers FY2009 through FY2026 Q3 only, so treat any "FY2026 Q4" ranking as unreliable. Try name variants, because large companies often file under more than one legal entity.
  2. Note which metric you are reading. Initial-employment approvals (new H-1B workers) and continuing-employment approvals (extensions, transfers, amendments) are different numbers.
  3. Search DOL LCA disclosure data. OFLC publishes LCA records with job title, SOC code, worksite and wage level, which shows which Capital One teams and cities file, and at what level. Start from the DOL OFLC performance data page.
  4. Match titles to your target role. The wage levels attached to titles like yours are the closest public signal of where you would land in the weighted lottery.
  5. Check E-Verify if you need STEM OPT. Confirm through the E-Verify employer search rather than assuming.

For context, DOL's FY2026 numbers through Q3 show 426,659 LCAs, down 8.8% from FY2025, with software developers at 29.1% of certified positions (DOL OFLC FY2026 Q3 statistics). If you are targeting a software role at Capital One, you are competing inside the largest occupation group in the program.

The Capital One OPT-to-H-1B path, step by step

Most international new graduates start on F-1 work authorization and are sponsored later. Here is the usual sequence.

  1. Internship, usually on CPT. If you are still in school, a summer internship normally runs on Curricular Practical Training authorized by your school. SEVP's August 2026 CPT broadcasts (BCM 2608-01 and 2608-02) are in effect as guidance and are being challenged in AAU v. DHS, with a hearing set for 2026-11-06. Confirm your CPT eligibility with your DSO before you accept, not after.
  2. Full-time start on post-completion OPT. You can be unemployed for no more than 90 days in aggregate on post-completion OPT. An offer with a start date months away still counts against that clock if your OPT has started, so coordinate your OPT start date with your DSO.
  3. STEM OPT extension (24 months). If your degree is on the STEM list, the employer must be enrolled in E-Verify and complete a Form I-983 training plan with you. The aggregate unemployment limit rises to 150 days across OPT and STEM OPT. The Study in the States STEM OPT hub is the official reference.
  4. H-1B registration. The employer, not you, registers you in the spring lottery. FY2028 dates are not announced. Selection is wage-weighted, so a Level III role in your metro gets three entries in the pool, a Level I role one. The combined OPT and STEM OPT window often gives you two or three registration seasons, depending on when you started.
  5. Petition and cap-gap. If you are selected and Capital One files a timely change-of-status petition for an October 1 start, cap-gap generally extends your OPT authorization to bridge the gap. Read your own I-797 and I-20, which govern over anything published here.
  6. Green card, later. Permanent residence typically runs through PERM labor certification, then Form I-140, then adjustment of status. You can see an employer's PERM history in the same DOL disclosure data.

The full timing logic is in our OPT to H-1B timeline guide.

Where Capital One hires, and why location changes your lottery odds

Capital One is headquartered in McLean, Virginia, with large technology operations in Virginia (McLean and Richmond), Plano in Texas, and offices in cities including New York. Location is not a detail here. Under the weighted lottery, your wage level is set by the role's SOC code, its requirements and the prevailing wage for the worksite's area. The same salary can map to a higher level in a lower-wage metro and a lower level in a high-cost one.

Northern Virginia and Richmond have a deep tech labor market, much of it built around government contractors that often require citizenship, and banks like Capital One are among the large Virginia employers that do sponsor. Our Virginia H-1B jobs guide maps which employers there sponsor and which roles are closed to visa holders. For how levels convert into entries, see the wage-weighted lottery explained.

Policy changes that touch a Capital One sponsorship

Old ruleNew rule (status, date)What to do differently
H-1B lottery was a random drawWage-weighted selection, in effect since 2026-02-27Know your role's level and worksite before registration season
No layoff factor in H-1B adjudicationEO 14431, in effect as a directive since 2026-09-18Watch for agency guidance; assume neither denial nor approval
No six-figure H-1B charge$100,000 restriction blocked; $103,265 fee proposedAsk how the employer is budgeting; nothing is collected today

The DOL PERM suspension announced 2026-10-08 (in effect) names eight employers: Microsoft, Adobe, Cognizant, Infosys, TCS, Wipro, HCL and Capgemini. Capital One is not among them, and that action covers PERM only; H-1B petitions are untouched by it. Capital One also acquired Discover in 2025, so you may see roles under more than one corporate name.

Common mistakes

Frequently asked questions

Does Capital One sponsor H-1B visas for new graduates?

Capital One files H-1B petitions, mostly for specialty-occupation technology roles, and you can check its filings in the USCIS H-1B Employer Data Hub. New graduates usually start on OPT or STEM OPT and are registered for the H-1B lottery later. Sponsorship is decided role by role, so read each posting and ask the recruiter directly.

Does Capital One hire international students on OPT or STEM OPT?

Whether a given role accepts OPT candidates is set in the posting or by the recruiter, not company-wide. STEM OPT also requires the employer to use E-Verify and sign a Form I-983 training plan. Some postings state that Capital One will not sponsor a new applicant for that position, so treat the posting language as the answer for that role.

Does the $100,000 H-1B fee affect a Capital One offer?

Proclamation 11069 extended the $100,000 entry restriction to September 21, 2027, but two federal courts have blocked the fee, so it is not being collected as of October 2026. A separate $103,265 fee for cap-subject petitions is only proposed. Ask the employer's immigration team how they are planning for both.

Does Capital One sponsor green cards?

Large US banks commonly sponsor green cards through PERM labor certification for eligible employees, and you can check Capital One's PERM history in DOL disclosure data. Capital One is not one of the eight employers named in DOL's October 8, 2026 PERM suspension. Timing and eligibility are set by the employer and its counsel, so raise it with your manager and the immigration team.

Could EO 14431 on layoffs affect Capital One sponsorship?

EO 14431, in effect as a directive since September 18, 2026, tells agencies to take into account whether a sponsor engaged in layoffs. It does not define layoffs, creates no automatic denial and had no implementing guidance as of this writing. Watch for agency guidance rather than assuming any outcome.
