Do You Require Sponsorship? How H-4 EAD Holders Should Answer Both 'Now' and 'in the Future'
Your H-4 EAD lets you start a job without sponsorship, but the future half of the question depends on your spouse's green card stage, and a late renewal can now pause your job.

Part of our guide to the H-4 EAD.
If you hold an H-4 EAD and an application asks "Do you require sponsorship?", the accurate answer to the now half is usually no: your card (category C26) lets you work for any US employer without that employer filing anything with USCIS. The future half asks whether an employer will ever need to sponsor you, and the truthful answer depends on your spouse's H-1B and green card stage, and on whether you plan to get an H-1B of your own. Answer the halves separately, and save your card's end date for the offer stage.
Status as of 2026-11-01: the H-4 EAD is available. No proposed or final rule ends it, although DHS lists a long-term agenda item (RIN 1615-AD14) with no proposal date. The final rule ending automatic EAD extensions has been in effect since 2026-10-14 (and is challenged) for renewals filed on or after 2025-10-30, so a renewal still pending on your card's end date now pauses your work, and employers will ask about that.
Do H-4 EAD holders need visa sponsorship?
No, not to be hired. An H-4 EAD is an unrestricted work permit issued to you, so a new employer files nothing with USCIS to employ you; it checks the card on Form I-9 like any other employment authorization document. Sponsorship enters the picture if you later want an employer-filed status of your own, such as an H-1B, or if the H-4 status your card rests on ends.
The permit is derivative, which makes the second half hard. USCIS's page on employment authorization for certain H-4 dependent spouses limits eligibility to H-4 spouses of H-1B workers who are the principal beneficiary of an approved Form I-140 or hold H-1B status under AC21 sections 106(a) and (b), and the USCIS Policy Manual (current as of 2026-10-27) caps a (c)(26) card at the end date of your H-4 status. Your right to work today is solid; next year's runs through your spouse's case.
Expect the question even when a posting is silent. According to a single-vendor analysis by Match.dev of 2,718 engineering roles at 136 US companies (postings read 2026-10-13), 88.1% of postings were silent on sponsorship, yet 90.7% of application forms asked about sponsorship or work authorization. For OPT, STEM OPT, H-1B transfer and cap-exempt scripts, see how to answer the sponsorship question in an interview; this page covers only the H-4 EAD answer.
How to answer "do you require sponsorship" on an H-4 EAD, now and in the future
"Now" asks whether the employer must file a petition before you can start. "In the future" asks whether it will ever have to file one, which turns on your family's green card stage and your own plans.
Which answer usually fits (as of 2026-11-01)
| Your situation | "Now" half | "Future" half that is usually accurate | Mention in the screen |
|---|---|---|---|
| Spouse's I-140 approved; you plan to stay on the H-4 EAD | No | Usually no | Your EAD category; it renews with your spouse's extensions |
| Spouse extended under AC21 106(a)/(b); I-140 not yet approved | No | Usually no, but more contingent | The same; the case's earlier stage only if asked |
| An I-485 that includes you is pending | No | Usually no | That a green card application is pending |
| You plan to get your own H-1B | No | Yes | That nothing is needed to start |
| Your spouse's H-1B is ending or in doubt | No, while your card is valid | Unclear | Talk to a licensed immigration attorney first |
Answer the question as the form words it. Most forms ask whether you will need the employer to sponsor an employment visa (the phrasing IER's FAQ uses); in our reading, that is not a request to forecast rule changes. If a form asks something else, such as when your authorization expires, answer that accurately. Never call the EAD guaranteed, and tell the employer if your plan changes.
Script 1: your spouse's I-140 is approved
"I'm authorized to work for any employer on an employment authorization document, so there's nothing you'd need to file to hire me. It comes through my spouse's H-1B, and their green card petition is already approved, so I'm not expecting to need sponsorship from an employer. I'm happy to give HR the card's end date."
Don't describe the green card as close if it isn't. In the November 2026 Visa Bulletin, EB-2 India's Final Action Date (the chart consular cases always use) stayed at 2013-11-01, so "approved petition, long wait" is the honest frame for many families.
Script 2: an I-485 is pending
"I'm authorized to work for any employer, and I don't expect to need sponsorship now or later. I'm included in a green card application that's already pending with USCIS."
You may also hold a work permit from your own pending application; see how the C09 green-card-pending EAD differs from your C26. C09 renewals filed on or after 2025-10-30 also get no automatic extension. For November 2026 I-485s, USCIS requires the Dates for Filing chart (EB-2 and EB-3 India both 2015-01-15).
Script 3: you plan to get your own H-1B
"I'm authorized to work now on an EAD, so you wouldn't need to file anything for me to start. Longer term I'd like my own H-1B so my status isn't tied to my spouse's, so the accurate answer to the future question is yes. I'd raise timing with HR well before any registration window."
Unless the employer is cap-exempt, a first H-1B generally goes through the annual registration. The FY2028 registration is not announced as of 2026-11-01; USCIS must announce it at least 30 calendar days ahead, so watch its registration page. If a recruiter raises the $100,000 payment, courts have blocked the agency policies behind it and it is not being collected, though the proclamation stands on paper and the USCIS I-129 page says "If this order is later lifted, DHS still plans to collect the payment." USCIS's H-1B page (updated 2026-09-21) says change-of-status requests it grants inside the US are not covered, while a denied one would be; whether the payment could reach your case is for the employer's immigration counsel.
What to type when the form has a text box
- "Authorized to work for any US employer on an EAD (category C26), valid through [date]. No sponsorship needed to start."
- Then the one true line: "Do not expect to need employer sponsorship." / "Green card application pending." / "May seek H-1B sponsorship in a future year."
Common misconception: "The future question is really about when my card expires, so I should answer yes."
Correction: The sponsorship question asks whether the employer will have to file a petition for you. An H-4 EAD renewal is your own Form I-765, often filed alongside your H-4 extension when your spouse's H-1B is extended; the hiring employer files nothing and only re-checks your new card on Form I-9. The end date is an offer-stage scheduling matter, not a sponsorship answer.

Is the H-4 EAD being taken away?
Not as of 2026-11-01. No proposed or final rule ends the H-4 EAD, and eligible spouses can still apply and renew. DHS's regulatory agenda lists a long-term item titled "Removing H-4 Dependent Spouses From the Classes of Noncitizens Eligible for Employment Authorization" (RIN 1615-AD14). Its next step is a proposed rule, dated "To Be Determined"; it is not under White House review and has no Federal Register document. The Congressional Research Service wrote on 2026-10-14 that DHS "is considering removing their eligibility for work authorization altogether" (CRS Insight IN12747).
In an interview that cuts both ways: you can't honestly call the card permanent, and you shouldn't volunteer that it is ending.
What changed for H-4 EAD renewals in October 2026?
The final rule published 2026-10-14 (91 FR 65306) adopted without change the interim rule that ended automatic EAD extensions for renewals filed on or after 2025-10-30. It did not end the H-4 EAD category. It does mean a renewal still pending on your card's end date stops your work, and no court has restored the extension beyond seven named plaintiffs.
H-4 EAD renewals: old rule, new rule, what to do (as of 2026-11-01)
| Topic | Old rule | Rule now (status) | What to do differently |
|---|---|---|---|
| Automatic extension | Up to 540 days for a timely renewal filed before 2025-10-30, with an unexpired H-4 I-94 (not if it depended on a pending H-4 extension) | None for renewals filed on or after 2025-10-30 (in effect, challenged) | Treat a card that ends in your first months as an offer-stage topic |
| When work stops | Card end date plus any extension | The day after the card's end date | Know your exact last working day |
| The H-4 EAD category | Available | Available; removal is only a long-term agenda item (RIN 1615-AD14) | Don't tell an employer it is ending |
Other renewal facts, dated 2026-11-01
| Item | Where it stands |
|---|---|
| Premium processing for (c)(26) | None; the premium processing page lists only F-1 OPT categories of Form I-765, and the final rule says USCIS "will continue to explore" expanding it |
| How you file | Paper only for (c)(26); $520 under fee schedule G-1055, edition 10/26/26 |
| Processing time (80% of cases) | 17.5 months standalone; 6.5 months when filed with the H-4 I-539 (live tool) |
| Court relief | The Jane Doe 1 v. DHS preliminary injunction (C.D. Cal., 2026-09-10) covers seven named H-4 plaintiffs only |
The rule's preamble adds that "USCIS does not postdate the renewal EAD," so a renewal decided well before your card ends lowers the risk of a gap but, the preamble notes, may leave a shorter combined validity period. Background: what ended with the H-4 EAD automatic extension, current H-4 EAD processing times and where the H-4 EAD lawsuit stands.
When should you tell an employer about your renewal date?
At the offer stage, not the first screen; your card's end date is logistics for HR. Two exceptions: if an application asks when your authorization expires, give the date accurately, and if your card would lapse before the proposed start date, raise it as soon as dates come up, because you cannot start without valid authorization.
A worked timeline (hypothetical, real dates)
Meera's H-4 EAD and H-4 I-94 both end on 2027-03-15. With an approved I-140 in the family, she answered "no" to both halves.
| Date | What happens | Why it matters |
|---|---|---|
| 2026-11-20 | Verbal offer; start date 2026-12-07 | She gives HR the card's end date and how renewal works |
| 2026-12-01 | Her I-539 and I-765 go in with her spouse's H-1B extension | Her renewal clock starts |
| 2026-12-07 | First day; she shows her EAD for Form I-9 | No sponsorship involved |
| 2027-03-15 | Last day the current card covers | The employer reverifies by this date |
| 2027-03-16 | No work until the new card is approved | Unpaid leave or a pause, if the employer agrees |
| About 2027-06-15 | 6.5 months after filing (our arithmetic) | Most cases at the 2026-11-01 pace finish by then, not all |
In USCIS's 2026-11-01 snapshot, 80% of cases finished within 6.5 months, so one in five took longer, and the pace changes. When to file is a question for the attorney on her spouse's extension.
"Before we lock the start date, one logistics note. My work authorization card is valid through March 15, 2027, and it renews with my spouse's H-1B extension, filed December 1. Renewals no longer extend automatically, so if the new card hasn't arrived by March 15 I'd need to pause work until it does. Could we agree now how a short pause would be handled?"
What happens to your job if your H-4 EAD renewal is late?
If your renewal was filed on or after 2025-10-30, you must stop working from the day after your card's end date until USCIS approves the new card. Your employer must reverify you on Form I-9, and a receipt notice does not extend the card for these renewals. Earlier timely renewals may keep up to 540 days.
The rule does not require an employer to hold your job; unpaid leave or a delayed return is a negotiation, not a right. When the new card arrives, you choose what to show: IER says "Employers can't specify which documents they will accept from a worker" (IER FAQs; see also USCIS I-9 Central). Our guide to Form I-9 reverification when an EAD expires walks through Supplement B.
Can an employer refuse to hire you because your EAD depends on your spouse?
It depends on the reason. IER says "Generally, an employer may ask job applicants if they have the legal right to work in the United States and if they will need sponsorship for an employment visa," and an employer may decline to sponsor. Rejecting you over your card's expiration date is different.
IER's FAQ poses that case, whether an employer may reject an applicant "due to the uncertainty of continued employment authorization", and answers "No." It adds that weighing a future expiration date "may constitute an unfair immigration-related employment practice". The limit: IER lists citizens, nationals, recent permanent residents and people granted asylum or refugee status as protected from citizenship-status discrimination. H-4 EAD holders are not on that list, so whether a refusal is unlawful depends on facts that IER or an employment lawyer must assess.
If an offer is rescinded over sponsorship
- Ask the recruiter or HR, by email, for the specific reason.
- Compare it with your application answers; if you answered "no" to the future question and later mentioned H-1B plans, correct the record in writing.
- Clarify in one line if the recruiter assumed an H-4 EAD means H-1B sponsorship: "My EAD lets me work for any employer; you'd file nothing to hire me."
- Call the IER worker hotline at 1-800-255-7688 if the reason was the card's end date or a demand for a green card instead of your EAD.
- Consult an employment lawyer about remedies, and a licensed immigration attorney if status questions arise.
Prepare your answer before you apply
- Read your EAD (Form I-766): note the category (C26) and the "Card Expires" date.
- Check your most recent I-94 on CBP's I-94 website; a C26 card cannot run past your H-4 status.
- Confirm with your spouse, or the attorney on your spouse's case, whether your EAD rests on an I-140 approval (Form I-797) or an AC21 extension, and whether an I-485 receipt (Form I-797C) exists.
- Decide whether you intend to pursue your own H-1B; if you're unsure what that involves, book a consultation with a licensed immigration attorney.
- Write your two-line form answer and 20-second screen script from the templates above.
A DSO is relevant only if you change to F-1 status to study; for H-4 and H-1B questions, the right adviser is a licensed immigration attorney.
Common mistakes
- Answering "yes" to the now question out of caution. It routes you into a sponsorship filter you don't belong in.
- Answering "no" to the future question while planning your own H-1B. The mismatch surfaces the moment you mention the plan.
- Telling your spouse's whole immigration story in the first screen. One sentence on your EAD's basis is enough; details go to HR.
- Hiding the renewal date until after you start. If the card ends in your first months, a surprise pause costs more trust than an early heads-up.
- Assuming a receipt notice keeps you working. For renewals filed on or after 2025-10-30 it does not.
- Calling the H-4 EAD guaranteed, or doomed. No proposed or final rule ends it; DHS lists a long-term agenda item with no proposal date.
Frequently asked questions
Do H-4 EAD holders need visa sponsorship to get hired?
Usually not. As of November 1, 2026, an H-4 EAD (category C26) lets you work for any US employer without that employer filing a petition, so the accurate answer to needing sponsorship now is usually no. Sponsorship comes up if you later want an employer-filed status of your own, such as an H-1B, or if the H-4 status your card rests on ends.
Should I answer yes or no to the "now or in the future" sponsorship question on H-4 EAD?
The now half is usually no. The future half depends on your facts on the day you answer. If your spouse's I-140 is approved or an I-485 that includes you is pending, and you plan to stay on the EAD, no is usually accurate; if you plan to seek your own H-1B, yes is accurate. Answer the question exactly as the form words it, and tell the employer if your plan changes.
Is the H-4 EAD being taken away?
As of November 1, 2026, no proposed or final rule ends the H-4 EAD, and eligible spouses can still apply and renew. DHS lists a long-term regulatory agenda item to remove it (RIN 1615-AD14) with no proposal date, so it is a possibility to watch, not a rule. The agenda names a proposed rule as the next step and gives it no date.
What happens to my job if my H-4 EAD renewal is late?
If your renewal was filed on or after October 30, 2025, you must stop working from the day after your card's end date until USCIS approves the new card, under the final rule in effect since October 14, 2026. Your employer must reverify you on Form I-9, and whether it holds the job during the pause is the employer's decision. Earlier timely renewals may keep up to 540 days.
Can an employer refuse to hire me because my EAD depends on my spouse?
An employer may ask whether you will need sponsorship and may decline to sponsor. The Justice Department's Immigrant and Employee Rights Section (IER) says an employer may not reject an applicant over the uncertainty of continued employment authorization, and that weighing a future expiration date may be an unfair immigration-related employment practice. H-4 EAD holders are not among the groups IER lists as protected from citizenship-status discrimination, so a specific refusal turns on its facts; call the IER worker hotline at 1-800-255-7688 or an employment lawyer.
