H-4 Extension RFE on Form I-539: The Common Reasons and How Spouses Should Respond
Most H-4 extension RFEs ask for a handful of documents, and because H-4 EAD renewals filed since October 30, 2025 get no automatic extension, how fast you answer can decide whether your work permit lapses.

Part of our guide to the H-4 EAD.
An H-4 extension RFE is a Request for Evidence on your Form I-539, sent as Form I-797E, asking you to prove something the officer could not confirm from your file. It usually wants your H-1B spouse's approval notice and I-94, your spouse's recent pay stubs, a certified translation of your marriage certificate, a late-filing explanation, or your current I-94 after travel. As of November 1, 2026, the response date cannot be extended, and because H-4 EAD renewals filed since October 30, 2025 get no automatic extension, a slow answer can become a gap in your work authorization.
Status as of November 1, 2026:
- In effect, challenged: the final rule ending automatic EAD extensions (91 FR 65306, since 2026-10-14) for renewals filed on or after 2025-10-30; court relief covers seven named plaintiffs only.
- In effect, challenged: PA-2026-05 (since 2026-08-05), which lets USCIS deny without an RFE when required initial evidence is missing; 12 weeks is the maximum response time.
- Proposed: removing deference to prior approvals on I-129 extensions (RIN 1615-AD26); comments close 2026-11-13.
- Agenda only: no proposed or final rule ends the H-4 EAD; DHS lists a long-term agenda item (RIN 1615-AD14) with no proposal date.
- Not available: premium processing for an H-4 I-539 or an H-4 EAD.
What is an H-4 extension RFE?
An H-4 extension RFE is a USCIS notice asking an H-4 spouse or child for more evidence before it decides a Form I-539 extension. It is not a denial. You get one chance to answer: USCIS treats a partial response as a request for a decision on the record, and officers cannot extend the deadline printed on the notice.
USCIS's Form I-797 types page describes the I-797E simply as "Issued to request evidence." What the officer wants usually maps to what the Form I-539 instructions (edition 08/28/24) require from H-4 dependents:
- A copy of the front and back of the I-94 for each person on the application.
- Evidence of your relationship to the H-1B worker, "such as a birth certificate or marriage certificate and proof of termination of any prior marriage(s)".
- At least one document on the principal: the I-129 filed for them, the I-797 receipt for a pending I-129, their most recent I-94, or "A copy of the Form I-797 Approval Notice showing the H temporary worker has already been granted status for the period requested on your application."
Your H-4 status lasts only as long as your spouse's H-1B, so most RFEs come down to two questions: is your spouse in H-1B status for the period you requested, and are you married to them? Under PA-2026-05 (in effect, challenged in AAUP v. Mullin), an officer may deny outright when required initial evidence is missing, so treat an RFE as a second chance and answer every item.
Why did my H-4 extension get an RFE? The common reasons
Most H-4 RFEs trace back to a document that was missing, out of date or not what the instructions ask for. Your notice lists the exact items and governs over this table.
H-4 I-539 RFE reasons and the documents that answer them (as of 2026-11)
| RFE reason | What the officer is checking | Documents that usually answer it |
|---|---|---|
| Principal's approval not in the file | Your spouse's H-1B status for the period you requested | Principal's I-797A approval (or I-797C receipt if pending) and latest I-94 |
| Principal's maintenance of status | That your spouse actually works in the H-1B job | Principal's recent pay stubs, W-2s, employer letter |
| Relationship evidence | That you are legally married to the principal | Marriage certificate, proof any prior marriage ended, certified English translation |
| Your own status history | That you held H-4 status when you filed | Your latest I-94, passport, H-4 visa, prior H-4 approvals |
| Late filing | Whether a filing after your I-94 expired can be excused | A documented explanation addressing the five conditions in the instructions |
| Travel while pending | Whether the request is still needed and what status you hold now | Your new I-94, CBP travel history, the visa you entered on |
| Child co-applicant | That each child qualifies and is included correctly | Birth certificate, a signed Form I-539A per co-applicant |
The employer's attorney usually supplies the principal's documents; everything else, and above all a late-filing or travel RFE, belongs with a licensed immigration attorney.
Your spouse's H-1B approval was not in the file
This is usually the easiest RFE to fix. If you filed separately, or before your spouse's I-129 was approved, the officer may not have the approval in front of them; send the principal's I-797A and attached I-94 covering your requested dates. If your spouse's case is a transfer or amendment, see what happens to H-4 family members when the H-1B is transferred or amended for why your dates must match the right petition.
Your spouse's pay stubs: the maintenance-of-status request
This one asks about someone else's job: the officer wants proof the H-1B worker is being paid in the role your status depends on. Get recent pay stubs and W-2s through the employer's HR team or attorney. Our guide to maintenance-of-status RFEs on H-1B extensions covers pay gaps, unpaid leave and bench time on the principal's side.
Marriage evidence that did not meet the instructions
An untranslated certificate, a translation without a proper certification, or a name spelled differently across documents can draw an RFE. The translator "must sign a certification that the English language translation is complete and accurate", with a signature, printed name, date and contact information. If a prior marriage ended, include the divorce decree or death certificate.
A late-filed I-539
If you filed after your I-94 expired, the instructions say the delay "may be excused" if you show, when you file, extraordinary circumstances beyond your control, a reasonable delay, no other status violation, that you are still a bona fide nonimmigrant, and that you are not in removal proceedings. The excuse is discretionary. Take this RFE to a licensed immigration attorney before you write anything, and send only accurate, documented facts.
What documents prove H-4 status in an RFE response?
Your records plus your spouse's. Yours: your latest I-94, passport bio page, H-4 visa if you entered on one, and prior H-4 approvals, which together show you held H-4 status on the day you filed. Your spouse's: the I-797 approval for your requested period and their latest I-94. Download your I-94 from the CBP I-94 website and compare it with every date on your application; a common trap is an I-94 cut short because your passport expired first (see an I-94 shorter than the approval notice). Send legible copies; if you send originals that were not requested, "USCIS may destroy them after we receive them."
Did traveling while my I-539 was pending cause the RFE?
Travel has no RFE category of its own, but it can change your case. According to AILA's summary of a 2016 USCIS message, USCIS treats a pending I-539 change of status to H-4 as abandoned if you leave the US before it is approved. For an extension, neither the USCIS Form I-539 page nor the instructions spell out a travel rule, and attorneys commonly advise that leaving can abandon the pending request or make it moot. If you came back on an H-4 visa, the I-94 CBP issued at entry is now your current record, and an officer may ask for it with your travel history.
Whether the I-539 still matters, and what happens to an EAD application bundled with it, depends on how that new I-94 compares with what you asked for; that is a question for an immigration attorney. Planning a trip? Talk to one before you book: under State's interview waiver update (effective 2025-10-01), H-4 visa applicants, renewals included, interview in person.
How to respond to an H-4 I-539 RFE, step by step
USCIS's Policy Manual chapter on evidence is blunt: "regulations prohibit officers from granting additional time to respond to an RFE."
- Read the I-797E and calendar its response date. Under PA-2026-05, 12 weeks is the maximum; the officer can set less.
- List every requested item in the notice's own wording.
- Contact the attorney who filed your I-539 the day the notice arrives (often your spouse's employer's attorney; confirm they represent you).
- Request your spouse's I-797A, I-94, recent pay stubs and W-2s from the employer.
- Order a full English translation with a signed certification for any foreign-language document.
- Download your I-94 and travel history from the CBP I-94 website.
- Assemble one complete package with the original RFE on top; you "must submit all requested materials together at one time, along with the original RFE or NOID."
- Send it the way the notice instructs, to the address printed on the RFE (not the I-539 filing address), with tracking, well before the date.
- Keep a full copy and track the case online.
Does an RFE on my I-539 delay my H-4 EAD?
Usually, yes. If you filed your H-4 EAD application (Form I-765, category (c)(26)) with your I-539, USCIS's H-4 EAD page says: "we will not make a decision on your Form I-765 until after we have adjudicated your Form I-539". An RFE on the I-539 holds the EAD too.
That now costs more. Under the final rule ending automatic EAD extensions, in effect since 2026-10-14, renewals filed on or after 2025-10-30 get no automatic extension, and (c)(26) authorization ends the day after your card's end date. Earlier timely renewals keep up to 540 days. Our breakdown of the October 14 final rule covers who falls on which side.
If the RFE names Form I-765 itself, check which eligibility basis it questions. The same page says an H-4 spouse qualifies when the H-1B spouse "Is the principal beneficiary of an approved Form I-140" or "Has been granted H-1B status under sections 106(a) and (b) of AC21". The answer is the I-140 approval notice or, for AC21, the principal's I-797s and I-94s and the PERM or I-140 filing behind the extension.
Common misconception: "My H-4 EAD renewal is pending, so I can keep working." Correction: for a renewal filed on or after 2025-10-30, a pending application does not extend your card. The USCIS H-4 EAD page (last updated 2024-08-02) still mentions automatic extension, but the final rule controls, and the 2026-09-10 Jane Doe 1 v. DHS order covers only seven named plaintiffs. Working past the end date is unauthorized employment, which can itself hurt your extension.
USCIS processing times read 2026-11-01 (80% of cases completed within)
| Form and category | Time |
|---|---|
| I-539, H-4 change or extension | 10.5 months |
| I-539, H-4 extension filed with an I-765 | 5 months |
| I-765 (c)(26), filed with an H-4 I-539 | 6.5 months |
| I-765 (c)(26), filed on its own | 17.5 months |
These move; check the live USCIS processing times tool, which shows no separate figure for cases waiting on an RFE response. Our post on how long H-4 EAD cases are taking right now tracks the numbers.
A worked timeline: why answering in week two beats week eleven
A hypothetical bundled filing, renewal filed after the 2025-10-30 cutoff:
| Date | Event | What it means |
|---|---|---|
| 2026-06-29 | Employer files your spouse's H-1B extension (I-129) | Your H-4 depends on this petition |
| 2026-07-06 | You file I-539 with an I-765 (c)(26) renewal on paper | No automatic extension for your current card |
| 2026-09-02 | Spouse's I-129 approved | The principal's side is settled |
| 2026-10-15 | I-539 RFE asks for spouse's pay stubs and a certified translation | Response date on the notice, in this example 2027-01-07 (12 weeks) |
| 2026-12-31 | Your current H-4 EAD and I-94 end | Last day you can work on this card |
| 2027-01-01 | No work authorization unless the new EAD is approved | The gap starts |
Answer on 2026-10-29 and USCIS has your evidence about two months before the card ends. Answer on 2027-01-05, still on time, and the gap from 2027-01-01 is certain, because the I-765 cannot move until the I-539 does. Nobody can promise when USCIS will decide; you control only how long the response sits with you.
Can I use premium processing after an H-4 RFE?
No. The USCIS fee schedule, G-1055 (edition 10/26/26), lists I-539 premium processing ($2,075) only for F, J and M applicants, and USCIS has announced no H-4 option for Form I-907; the final rule says only that USCIS "will continue to explore" expanding premium processing for Form I-765. The (c)(26) I-765 is also paper-only.
Your spouse's premium processing applies to the I-129; whether USCIS decides a concurrently filed I-539 alongside it is a question for the attorney who filed it. An expedite request is possible on grounds such as severe financial loss, an emergency or clear USCIS error, but "The decision to expedite is within the sole discretion of USCIS," and the financial-loss ground does not apply when the urgency comes from a failure "to timely respond to any requests for evidence".
What else applies to an H-4 RFE as of November 2026?
Rules that touch an H-4 I-539 RFE (as of 2026-11)
| Rule or policy | Status (2026-11-01) | What it means for you |
|---|---|---|
| Removing deference on I-129 extensions (RIN 1615-AD26) | Proposed; comments close 2026-11-13 | Current deference still applies to your spouse's extensions |
| I-539 filing addresses | Changed 2026-10-07; old ones accepted if postmarked on or before 2026-11-09 | Use the current address for any new filing |
| I-539 edition and fee | Only the 08/28/24 edition (not 09/15/26); $470 paper, $420 online | Check both before any refiling |
The deference proposal changes nothing unless a final rule is published. For general I-539 mechanics, see our I-539 extension and change-of-status walkthrough, but use the fees and editions above, current as of November 2026.
Common mistakes
- Sending part of what was asked. USCIS treats "any partial submission" as a request for a final decision on the record.
- Answering the RFE you expected rather than the exact items on your notice.
- Mailing to the original filing address instead of the address on the RFE.
- Waiting until the last week when your EAD is close to its end date.
- Assuming your spouse's premium processing covers you. It applies to the I-129.
- Working past your EAD end date because a renewal is pending.
- Leaving the US while the I-539 is pending without an attorney's review.
- Missing a biometrics appointment if USCIS schedules one. The instructions say, "If you do not attend your biometric services appointment, we may deny your application."
Frequently asked questions
Why did my H-4 extension get an RFE?
Usually because the officer could not confirm your spouse's H-1B status (approval notice, I-94, recent pay stubs), your marriage (a certificate with a certified translation), a late filing, or your current I-94 after travel. The I-797E lists what is missing, and officers cannot extend its response date.
What documents prove H-4 status in an RFE response?
Your latest I-94, passport, H-4 visa and prior H-4 approvals, plus, under the I-539 instructions (edition 08/28/24), relationship evidence and at least one principal document, such as the I-797 approval for your requested period or the principal's latest I-94. Send copies unless originals are requested.
Did traveling while my I-539 was pending cause the RFE?
Not by itself, but it can change your case. USCIS said in 2016 that it treats a pending change of status to H-4 as abandoned if you leave before approval, and a pending extension may be treated the same way. Your new I-94 becomes your current record, and an officer may ask for it. Have an immigration attorney review your facts.
Does an RFE on my I-539 delay my H-4 EAD?
Usually yes, if the I-765 was filed with the I-539: USCIS will not decide the I-765 until after the I-539. Under the final rule in effect since 2026-10-14, a renewal filed on or after 2025-10-30 gets no automatic extension, so you cannot work after the card's end date until the new card is approved.
Can I use premium processing after an H-4 RFE?
No. As of 2026-11-01, G-1055 (edition 10/26/26) offers I-539 premium processing only for F, J and M applicants, and none exists for the H-4 EAD. An expedite request is possible under USCIS's criteria, at its sole discretion.

Frequently asked questions
Why did my H-4 extension get an RFE?
An H-4 I-539 RFE asks for something the officer could not confirm from your file, usually your spouse's H-1B approval notice and I-94, recent pay stubs showing your spouse works in H-1B status, a marriage certificate with a certified English translation, a late-filing explanation, or your current I-94 after travel. The Form I-797E lists exactly what is missing, and officers cannot extend its response date.
What documents prove H-4 status in an RFE response?
Your most recent I-94, passport, H-4 visa and prior H-4 approval notices show your status. The Form I-539 instructions (edition 08/28/24) also ask for proof of your relationship to the H-1B worker and at least one document on the principal, such as the I-797 approval for your requested period or the principal's latest I-94. Send copies unless the RFE asks for originals.
Did traveling while my I-539 was pending cause the RFE?
Travel is not an RFE category of its own, but it can change your case. USCIS said in 2016 that it treats a pending change of status to H-4 as abandoned if you leave before approval, and a pending extension may be treated the same way. The I-94 CBP gave you on return becomes your current record, and an officer may ask for it. Have an immigration attorney review your facts before you answer.
Does an RFE on my I-539 delay my H-4 EAD?
Usually yes, if you filed the I-765 with the I-539, because USCIS says it will not decide the I-765 until after it adjudicates the I-539. Under the final rule in effect since October 14, 2026, an H-4 EAD renewal filed on or after October 30, 2025 gets no automatic extension, so you cannot work after the card's end date until the new card is approved.
Can I use premium processing after an H-4 RFE?
No. As of November 1, 2026 the USCIS fee schedule (G-1055, edition 10/26/26) offers I-539 premium processing only for F, J and M applicants, and none exists for the H-4 EAD. You can ask USCIS for an expedite under its published criteria, but the decision is at its sole discretion.
