OPT RFE on Your First I-765: The Usual Reasons, What to Send, and the Risk of Denial With No RFE at All
An RFE on your first OPT application names a specific gap. Here is the document that closes each one, what the delay does to your start date, and why a missing item can now mean denial with no RFE.

Part of our guide to the OPT I-765 application.
An RFE for OPT is a Request for Evidence: USCIS has your post-completion OPT application (Form I-765, category (c)(3)(B)) and wants specific items before it decides. On a first I-765, the request usually points to evidence the form instructions require: an I-20 without a signed, dated DSO recommendation, dates that do not match SEVIS, missing prior CPT or OPT history, photo or identity problems, or a wrong category code. Answer once, completely, by the date printed on the notice. Since August 5, 2026, a missing required item can also mean a denial with no RFE at all.
Status as of 2026-11-01:
- In effect, challenged: policy alert PA-2026-05 (since 2026-08-05) lets USCIS deny without an RFE or NOID when required initial evidence is missing, OPT I-765s included. AAUP v. Mullin (D. Mass. 1:26-cv-14527, filed 2026-10-05) challenges it; there is no ruling or injunction.
- Blocked: the F-1 duration-of-status rule, by a federal court since 2026-09-14; summary judgment is briefed and DHS's appeal is pending. USCIS's I-539 page says it "will proceed under the previous regulatory provisions," so today's OPT windows and the 60-day F-1 grace period apply.
- Proposed only: the OPT fee rule, which the school, not the student, would pay; comments close 2026-11-09 (check the Federal Register for the outcome after that date). It would not reach DSO recommendations dated before a final rule takes effect.
- Grace ends 2026-11-09: old I-765 mailing addresses work only if postmarked on or before that date (filing locations update). An RFE response goes wherever the notice says.
What is an RFE for OPT?
An RFE on OPT is a written notice from USCIS saying your Form I-765 for post-completion OPT is missing something, or shows something the officer cannot verify, and giving you a deadline to supply it. It is not a denial. The officer decides after reading your response, or after the deadline passes without one.
Do not confuse it with three other notices. A rejection returns the package at intake while your windows keep running (see the OPT rejection refile window). A denial is a decision (see what to do after an OPT denial). A NOID signals likely denial and allows at most 30 days to reply.
PA-2026-05 also spells out how USCIS reads your reply: any response, "even if the evidence only partially responds to the RFE or NOID," counts as "a request for a decision." Do not expect a second round.
Common reasons for an OPT RFE, and the document that answers each
We found no USCIS figure for how often initial OPT applications get RFEs, or why. The triggers below follow the evidence that the Form I-765 instructions (edition 08/21/25) and 8 CFR 214.2(f) require.
Initial OPT RFE triggers and the document that answers each (as of 2026-11)
| Trigger | What the officer cannot confirm | Document that answers it | Who fixes it |
|---|---|---|---|
| I-20 recommendation missing, unsigned or undated | That your DSO recommended post-completion OPT | Your current I-20 with the post-completion OPT recommendation, signed and dated by the DSO | DSO |
| Dates that do not line up | That the program end date, requested start date and filing date fit the rules | I-20 pages whose program end date and recommended OPT dates match SEVIS; a reissued I-20 if SEVIS is wrong | DSO |
| The 30-day DSO window | That USCIS received the I-765 within 30 days of the SEVIS recommendation | The I-20 showing the recommendation date. If the receipt date really is late, no document cures it | DSO, then an attorney |
| Photo or identity | Your identity and a usable photo | Whatever the notice lists: often a biometrics appointment; a passport bio page; new 2x2 photos, unmounted and unretouched, if asked | You |
| Prior OPT or CPT history | Whether you have OPT time left at this level, or 12+ months of full-time CPT | A Part 6 statement listing every prior SEVIS number; prior I-20s recording each CPT authorization; prior EADs, front and back | You and your DSO |
| Signature | That the form is validly signed | Usually not an RFE item. An unsigned form is rejected; a deficient signature found later can mean rejection or denial | You |
| Category code | That you asked for the right benefit | Part 2, Item 27 should read (c)(3)(B); the I-20 shows which OPT your DSO recommended | You, with your DSO |
The I-20 is the center of an initial OPT case
8 CFR 214.2(f)(11)(ii)(C) is plain: "The DSO must provide the student with a signed, dated Form I-20 or successor form indicating that OPT has been recommended" (1-1-25 edition, before the blocked D/S rule). A common slip is uploading the old I-20 instead of the one printed after the recommendation. Only your DSO can fix SEVIS or reissue it.
The 30-day window: the deadline no document can fix
The instructions say: "You must file your Form I-765 within 30 days [of] this DSO recommendation. If you fail to do so, we will deny your OPT request." The outer window is 90 days before to 60 days after your program end date, and filing before the recommendation also means "USCIS will deny the application," per the SEVIS Help Hub. Under PA-2026-15 (in effect since 2026-10-23), a day-counted paper deadline ending on a weekend or holiday rolls to the next business day; online filings never roll. Our reading is that this covers both windows on paper; confirm with your DSO.
Prior CPT and OPT history
Under 8 CFR 214.2(f)(10)(i), "Students who have received one year or more of full time curricular practical training are ineligible for post-completion academic training." Full-time CPT at a previous school at the same program level counts (SEVIS Help Hub), and pre-completion OPT is deducted from post-completion time (USCIS OPT page). If you are near 12 months of full-time CPT, get your CPT record from your DSO and see an immigration attorney before you answer.
Photos and the biometrics appointment
The instructions still ask for two identical passport-style photos, and USCIS's OPT page warns that mounted or retouched photos "will delay the processing of your application and may prompt USCIS to require you to visit an Application Support Center." Under PA-2025-29 (2025-12-12), USCIS will not use self-submitted photos and reuses a biometrics photo only if it is 36 months old or less. NAFSA reads this to mean I-765 filers will generally get a biometrics appointment, and calls it prudent to keep sending the photos. Do not skip it: "If you do not attend your biometric services appointment, we may deny your application" (OPT biometrics guide).
How long do I have to respond to an OPT RFE?
You have until the deadline printed on the notice, and no longer. The regulation that PA-2026-05 quotes says "in no case shall the maximum response period provided in a[n RFE] exceed twelve weeks," and "Additional time to respond to a[n RFE] or [NOID] may not be granted." Twelve weeks is a ceiling, your notice may give less, and mailed notices add 3 days.
What PA-2026-05 changed for OPT filers (as of 2026-11)
| Topic | Before 2026-08-05 | Since 2026-08-05 | What to do differently |
|---|---|---|---|
| Missing initial evidence | Officers were instructed to issue an RFE or NOID | The officer may deny without either | Check every instruction item before filing |
| RFE response period | Generally the full 12 weeks | Up to 12 weeks, possibly less | Read the printed deadline the day the notice arrives |
| Notice mailed outside the US | 14 extra days added | 3 days for mail, wherever you are | Do not count on travel time abroad |
| Partial response | Less explicit (PA-2026-05 calls this a clarification) | Any response, even partial, is a request for a decision | Send everything in one package |
How to respond to an OPT RFE, step by step
- Read the RFE (in your USCIS online account or on paper) and list every item it requests, word for word.
- Email your DSO the notice the same day, with your SEVIS ID, program end date and recommendation date.
- Request a reissued Form I-20 if any item touches the recommendation, dates or SEVIS data.
- Collect the rest: your I-94 from the CBP I-94 website, passport and visa pages, prior EADs, and every prior I-20 that records CPT or OPT.
- Write a one-page cover letter that answers each item in order and names the exhibit that proves it.
- Assemble the package as the notice instructs, with the notice on top if asked.
- Submit by the method on the notice: upload through your USCIS account if you filed online, or mail to the address printed on the RFE, not the I-765 filing address.
- Keep the upload confirmation or tracked delivery receipt, and watch your case status for a biometrics notice or a decision.
Your DSO owns the I-20, SEVIS, your dates and your unemployment count. A licensed immigration attorney handles eligibility questions: possible unauthorized work, CPT near 12 months, a filing outside the windows, or an earlier status problem.
Can I work while my OPT RFE is pending?
No. USCIS's OPT page says: "You may not begin your pre- or post-completion OPT until after we approve your Form I-765 and you receive your Employment Authorization Document (EAD)." Study in the States agrees: "you cannot begin to work while the Form I-765 is pending with USCIS."
That is the big difference from a STEM OPT RFE: a timely STEM OPT extension carries a 180-day automatic extension of your existing EAD, while a first I-765 has no card to extend. The 2026-10-14 final rule ending automatic extensions for certain EAD renewals changes neither point.
Staying in the US is a separate question. For a student whose OPT is approved, 8 CFR 214.2(f)(10)(ii)(D) counts the time the application was "properly filed and pending approval" as duration of status; if OPT is denied, ask your DSO in writing how much time you have. And stay put: Cornell, Johns Hopkins and USC advise against international travel until the EAD arrives, and a missed biometrics appointment while abroad can delay or deny the case.
Does an OPT RFE delay my start date?
Often, yes. Under 8 CFR 214.2(f)(11)(iii)(A), post-completion OPT "begins on the requested date of commencement or the date the Form I-765 or successor form is approved, whichever is later." The end date does not move out to compensate: under 8 CFR 214.2(f)(10)(ii)(A)(3), "A student must complete all practical training within a 14-month period following the completion of study." So a late approval shortens your card.
The good news: the SEVIS Help Hub unemployment counter counts the 90 days from the actual OPT start date, for each day without employer information, so days spent waiting on an RFE are not unemployment days.
Worked example: one RFE, real dates
A hypothetical case, not a prediction of USCIS timing; your DSO and your card set your real dates.
| Date | Event | What it means |
|---|---|---|
| 2026-08-14 | Program end date on the I-20 | The 60-day filing window closes 2026-10-13 |
| 2026-08-18 | DSO enters the OPT recommendation in SEVIS | USCIS must receive the I-765 by about 2026-09-17 |
| 2026-09-02 | USCIS receives the I-765 online, requested start 2026-10-01 | Inside both windows |
| 2026-10-27 | RFE (USCIS could instead have denied): the uploaded I-20 lacks the signed recommendation page | Deadline printed on the notice, at most 12 weeks out (say 2026-12-22) |
| 2026-11-10 | Reissued I-20 uploaded in one complete response | USCIS treats it as a request for a decision |
| 2027-01-08 | Approval (hypothetical) | The EAD starts 2027-01-08, the later of the two dates |
| About 2027-10-14 | 14 months after the program end date | The latest this card can run |
The result: roughly nine months of OPT instead of twelve, with the 90-day count starting 2027-01-08, not 2026-10-01. If you have an offer, warn the employer early.
Can USCIS deny OPT without sending an RFE?
Yes. PA-2026-05 says that "when a benefit requestor fails to submit all required initial evidence, USCIS in its discretion may deny the benefit request for lack of initial evidence or for ineligibility or issue an RFE for the missing initial evidence." It applies to requests pending or filed on or after 2026-08-05.
How often this happens is unknown. The latest USCIS I-765 data, FY2026 Q3 (April to June 2026, posted 2026-09-08), shows 56,901 post-completion OPT receipts and 70,225 pending. That quarter ended before the policy began, so no data shows it causing denials. When we read the USCIS processing times tool on 2026-11-01, 80% of F-1 student I-765s were completed within 5 months; check it live.
Pre-filing checklist to avoid a denial with no RFE
Use this before a first filing or a refile; our I-765 OPT walkthrough covers the form itself.
- Edition: Form I-765 edition 08/21/25 (see the I-765 page).
- Recommendation first: your DSO has entered it in SEVIS, and you hold the new I-20, signed and dated.
- Timing: USCIS receives the I-765 within 30 days of the recommendation and between 90 days before and 60 days after your program end date.
- Category and IDs: (c)(3)(B) in Part 2, Item 27, and your SEVIS number in Item 26.
- History: Part 6 lists every previous SEVIS number and every CPT or OPT authorization, with its academic level.
- Status and identity: your I-94 (or passport), plus prior EADs front and back, or a government photo ID if you never had an EAD.
- Photos: two identical 2x2 color photos, unmounted and unretouched.
- Fee: $520 on paper or $470 online under the G-1055 fee schedule (edition 10/26/26), paid by card (Form G-1450) or ACH (Form G-1650).
- Address and signature: the filing location in effect since 2026-10-07, and a handwritten signature on paper, never a typed name.
Will premium processing fix an OPT RFE or a late filing?
No. Premium processing for OPT costs $1,780 on Form I-907, and USCIS's premium processing page promises only "adjudicative action" within 30 business days, such as an approval, a denial, a NOID or an RFE. After an RFE, that page says the premium period "will stop and reset," with a new one starting when USCIS receives your response.
It cannot rescue a late filing either. The 30-day and 60-day limits are eligibility rules, and $1,780 buys speed, not eligibility. Our breakdown of premium processing for initial OPT covers when it does pay off.
Common mistakes
- Answering in pieces. Your first response is treated as a request for a decision.
- Mailing the response to the I-765 filing address instead of the address on the RFE.
- Starting work on your requested start date because an employer asked. Before approval and the EAD, that is unauthorized employment.
- Leaving the US while the case is pending, with a deadline and a possible biometrics notice ahead.
- Assuming the RFE pauses your filing windows. If the case is denied, a refile still has to fit the 30-day and 60-day rules.
- Trusting forum "RFE rates" or claims that PA-2026-05 caused a denial wave. No USCIS data supports either.
Frequently asked questions
What are common reasons for an OPT RFE?
On a first post-completion OPT I-765, RFEs usually point to evidence the form instructions require, such as a signed, dated DSO recommendation on the I-20, dates that match SEVIS, prior CPT or OPT history, photos or identity documents, and the (c)(3)(B) category code. Most are answered with a corrected I-20 from your DSO, prior I-20s and EADs, or identity documents.
How long do I have to respond to an OPT RFE?
Until the deadline printed on your notice. Under 8 CFR 103.2(b)(8)(iv) the response period can never exceed 12 weeks and USCIS cannot grant more time. Since PA-2026-05 (in effect 2026-08-05), mailed notices get 3 extra days and notices mailed abroad no longer get 14. Send everything in one response.
Can I work while my OPT RFE is pending?
No. USCIS says you may not begin post-completion OPT until it approves your Form I-765 and you receive your EAD, and Study in the States says you cannot begin to work while the I-765 is pending. Initial OPT has no automatic extension like the STEM OPT 180-day rule.
Does an OPT RFE delay my start date?
It can. Under 8 CFR 214.2(f)(11)(iii)(A), post-completion OPT begins on your requested start date or the approval date, whichever is later, and all training must end within 14 months after your program ends, so a late approval shortens your OPT. The 90-day unemployment count starts from the actual OPT start date.
Can USCIS deny OPT without sending an RFE?
Yes. Policy alert PA-2026-05, in effect since 2026-08-05, lets USCIS deny any benefit request, OPT I-765s included, without an RFE or NOID when required initial evidence is missing. It is challenged in AAUP v. Mullin with no ruling as of 2026-11-01, and no USCIS data yet covers decisions made under it.
