STEM OPT to Green Card Without an H-1B: When Rest-of-World Priority Dates Make It Possible
Your employer can start a green card while you are on STEM OPT, but three clocks decide whether you reach an I-485 and a work permit before your EAD ends. Here is the math with the November 2026 queues.

Part of our guide to Form I-485.
As of November 1, 2026, going from STEM OPT to a green card without an H-1B is legally possible, but for someone born outside India and China it rarely fits the calendar. No step of an employer-sponsored green card requires H-1B status, and an I-485 can be filed from F-1 status once your priority date is current. The catch is timing: a priority date earned by a PERM started this month is not current under either November 2026 chart, and the queues in front of it add more than a year. For most readers, the H-1B lottery stays a parallel track.
Status line (as of 2026-11-01): the November 2026 Visa Bulletin is published (2026-10-22), and USCIS requires its Dates for Filing chart for November I-485s. The December bulletin is not published. FY2028 H-1B registration is not announced.
Can you go from STEM OPT to a green card without an H-1B?
Yes, if three things happen before your STEM OPT EAD expires: your priority date becomes current, your I-485 is filed, and your (c)(9) work permit arrives. In November 2026 the EB-2 ROW cutoffs are 2025-04-01 (Final Action) and 2026-03-15 (Filing), so a PERM started now rarely makes that window. EB-1 ROW is Current, which helps only those who qualify.
In our reading of the timeline below, it works mostly for people whose PERM was filed early, often during the first OPT year. A timely STEM OPT I-765 still gets the 180-day automatic extension (in effect; the 2026-10-14 EAD rule did not touch it).
The three clocks that have to line up
- Your STEM OPT clock. The EAD end date is fixed, and you may be unemployed for no more than 150 days in aggregate on STEM OPT (90 on post-completion OPT), as the SEVIS unemployment counter page explains. Both limits are in effect and unchanged.
- Your priority date clock. For a PERM case, USCIS's priority dates page sets the date when "DOL accepts the labor certification application for processing." It must then be earlier than the cutoff on the chart USCIS names for your filing month.
- Your work-permit clock. A pending I-485 does not let you work by itself; you need the (c)(9) EAD in hand. On 2026-11-01, USCIS showed 80% of (c)(9) cases completed within 12 months (NBC) or 12.5 months (SCOPS).
Set the third clock against the first and you get the number most guides leave out: to avoid a work gap without an H-1B, the I-485 and its I-765 would need to be filed at least about 12 months before your STEM OPT end date, and 12 months is only the 80% mark, so one case in five took longer. That is our arithmetic from the 2026-11-01 figure; check the live USCIS processing tool. USCIS's FY2026 Q3 data also shows more (c)(9) denials (35,720) than approvals (32,249); it does not say why, but the card is not automatic.
Where the green card queues stand in November 2026
Rest-of-world cutoffs, as of 2026-11 (November 2026 Visa Bulletin, released 2026-10-22).
| Category, ROW | Final Action Date | Dates for Filing | A priority date earned in late 2026 |
|---|---|---|---|
| EB-1 | Current | Current | I-140 and I-485 can be filed together now, if you qualify |
| EB-2 (PERM or NIW) | 2025-04-01 | 2026-03-15 | Not current under either chart |
| EB-3 professional and skilled | 2024-06-15 | 2024-08-01 | Further back than EB-2 |
| EB-3 Other Workers | 2022-06-01 | 2022-07-01 | Rarely relevant to STEM roles |
Mexico shares every ROW date; the Philippines matches ROW in EB-1 and EB-2 but has its own EB-3 dates. Your column follows your "country of chargeability (usually the country of birth)," in USCIS's words, not your passport.
The two charts do different jobs. Dates for Filing decides when you may submit an I-485, in a month when USCIS names it; Final Action decides when it can be approved, and consular cases always use Final Action Dates. For November, the USCIS filing-charts page says: "For all employment-based preference categories, you must use the Dates for Filing chart." USCIS chooses monthly (no December choice was posted as of 2026-11-01), and cutoffs move both ways, as the October 2026 ROW retrogression showed.
The one open door is EB-1. If you could qualify for extraordinary ability (EB-1A, a self-petition) or as an outstanding researcher (EB-1B, employer-filed), the I-140 and I-485 can go in together now. The bar is high: in FY2026 Q3 (April to June 2026, before the PA-2026-05 evidence policy), USCIS approved 32.2% of decided EB-1A petitions and 93.0% of EB-1B, per its I-140 data. An EB-2 National Interest Waiver skips PERM, so its priority date is set when USCIS accepts the I-140, but the same EB-2 ROW cutoffs apply.
How long the steps before an I-485 take
Before a priority date exists, your employer needs a prevailing wage determination (Form ETA-9141) and recruitment under 20 CFR 656.17: a 30-day state workforce agency job order, two Sunday newspaper ads and three more steps, with the mandatory steps "conducted at least 30 days, but no more than 180 days, before the filing of the application." Then the PERM (Form ETA-9089) is filed. After certification, the I-140 must be filed within 180 days.
Queue snapshots, as of 2026-11. USCIS figures are the time within which 80% of cases were completed.
| Stage | Latest official snapshot | Live source |
|---|---|---|
| Prevailing wage (ETA-9141) | Working on June 2026 receipts (as of 2026-09-30) | DOL FLAG |
| PERM analyst review (ETA-9089) | January 2026 priority dates; average 303 days (as of 2026-10-21) | DOL FLAG |
| PERM audit review | December 2025 priority dates | DOL FLAG |
| I-140, EB-2 PERM | 3 months; premium 15 business days for $2,965 | USCIS |
| I-765 (c)(9) | 12 to 12.5 months | USCIS |
| I-131 advance parole | 26.5 months | USCIS |
| I-485, employment-based | 42.5 months (SCOPS) or 9.5 months (field offices) | USCIS |
DOL's FLAG page refreshes about monthly (next update expected around 2026-11-06), and quarterly PERM data sits on DOL's OFLC performance page. For the whole sequence, see the full road from F-1 to a green card.
A worked timeline: two rest-of-world workers, one STEM OPT end date
Ana and Ben are hypothetical. Both are charged to rest of world, both hold EB-2-level roles, and both have STEM OPT ending 2028-06-30. Ana's employer filed her PERM on 2026-01-20. Ben's employer agrees this month.
Illustration, as of 2026-11: our arithmetic from the DOL FLAG and USCIS snapshots above, assuming today's speeds hold and no audit. Real cases vary, and cutoffs can retrogress.
| Milestone | Ana (PERM filed early) | Ben (PERM started now) |
|---|---|---|
| Wage request (ETA-9141) filed | During her first OPT year | 2026-11-16 |
| PERM filed, setting the priority date | 2026-01-20 | About 2027-05-17, after a wage determination around March 2027 and recruitment |
| PERM certified at a 303-day average | About 2026-11-19 | About 2028-03-15 |
| I-140 approved with premium processing | About December 2026 | About April 2028 |
| Priority date vs November EB-2 ROW Filing date (2026-03-15) | Earlier, so fileable while USCIS uses that chart | About 14 months later |
| (c)(9) EAD at 12 months | About early 2028, if the I-485 goes in around January 2027 | After STEM OPT ends, even if the cutoff moved fast |
| What carries work past 2028-06-30 | The (c)(9) EAD, if it arrives in time | An H-1B or another status |
Ana is the case the title is about. Her priority date is earlier than November's EB-2 ROW Filing cutoff, so if USCIS still names that chart when she files, her I-485 can go in with or after the I-140, leaving about five months of margin at the 12-month (c)(9) mark. If USCIS names the Final Action chart instead, she waits until that cutoff (2025-04-01 now) passes 2026-01-20, which is also what approval waits for. Until the card is in her hand, an H-1B registration is her backup.
Ben's math does not close. Even if the cutoff advanced fast enough for an I-485 in April 2028, a 12-month (c)(9) card would leave him months without work authorization after 2028-06-30. His PERM still sets a priority date that a later I-485 or consular case could use, but his work path through 2028 runs through the H-1B registrations inside his STEM OPT, or another status.
What happens if STEM OPT ends before your priority date is current?
Your permission to work ends on the EAD end date unless cap-gap covers you: it applies to a timely, cap-subject H-1B change-of-status petition, runs to April 1 of the fiscal year requested (or the petition start date, if earlier), and is unavailable for cap-exempt petitions. A pending PERM or approved I-140 does not extend F-1 status, add work authorization or pause the unemployment counter; ask the employer's attorney what carries over to a later H-1B or consular case.
The F-1 grace period after STEM OPT is still 60 days, because the duration-of-status rule has been blocked by a federal court since 2026-09-14. Summary judgment is briefed (replies due 2026-11-02) and DHS's appeal is pending, with its First Circuit opening brief due 2026-11-09; a ruling can come any time, so check the case docket. USCIS's I-539 page says it "will proceed under the previous regulatory provisions." For how these dates interact, see how OPT, STEM OPT and the H-1B lottery fit together.
Does filing an I-140 violate F-1 status?
Not by itself. The USCIS Policy Manual says: "A student may be the beneficiary of an approved or pending permanent labor certification application or immigrant petition and still be able to demonstrate their intention to depart after a temporary period of stay." Our guide to PERM and the I-140 on OPT and the immigrant-intent question covers the consulate and border side.
The line is your own I-485. Under 8 CFR 245.2(a)(4)(ii), leaving the US while it is pending "shall be deemed an abandonment of the application" unless you were granted advance parole first and are inspected on return. The exceptions cover H-1, L-1, H-4, L-2, K-3, K-4 and V holders who meet their conditions; F-1 is not listed. With advance parole at 26.5 months in the 2026-11-01 snapshot, any trip after filing is a question for your attorney first. The $1,050 HR-1 parole fee is charged only on approval, and the Form G-1055 fee schedule (edition 10/26/26) lists an exception for a lawful adjustment applicant "returning to the United States after temporary travel abroad," so do not assume you owe it.
Discretion is the other factor. USCIS memo PM-602-0199 (2026-05-21; in effect, challenged in AAUP v. Mullin, filed 2026-10-05, no ruling) calls adjustment "a matter of discretion and administrative grace." It names no visa class, treats dual-intent categories as an acknowledged exception, and says even dual-intent status is "not sufficient, on its own." F-1 is not a dual-intent status, so in our reading it is worth having an attorney review your entries and visa statements before an I-485 goes in.
Do you still need to enter the H-1B lottery?
For most rest-of-world STEM OPT workers whose PERM starts now, yes, as a parallel track. As of 2026-11-01 USCIS has not announced FY2028 registration and must give at least 30 days' notice under 8 CFR 214.2(h)(8)(iii)(A)(3); a March 2027 window is an expectation only. Wage-weighted selection, in effect since 2026-02-27, gives a Level IV registration four entries and a Level I registration one; the FY2027 fee was $215. See the USCIS registration page and what is expected for FY2028 registration.
A 24-month STEM OPT period usually spans two spring registration windows. The tracks do not compete: H-1B allows dual intent, and an approved I-140 later supports H-1B extensions past six years under AC21.
What could change your timeline (as of 2026-11-01)
- PERM and wage rules. DOL's labor-market-test NPRM (RIN 1205-AC29) cleared OIRA on 2026-10-23 but is not published, so current 20 CFR 656.17 applies. The prevailing-wage rule is still proposed (2026-03-27).
- Your employer. DOL's PERM suspension of eight employers (Microsoft, Adobe, Cognizant, Infosys, TCS, Wipro, HCL, Capgemini) is in effect with no written notice or end date; Mayer Brown notes it suspends no one from H-1B. Cloudera is under a settled two-year PERM debarment (2026-10-16).
- Forms. USCIS takes only the 09/18/26 Form I-485 edition; old filing addresses work only if postmarked on or before 2026-11-09.
- Travel ban. Proclamation 10998 (in effect since 2026-01-01, unchanged) restricts visas for nationals of 39 countries; partial-list nationals are barred from B, F, M, J and immigrant visas (Turkmenistan: immigrant visas only). The State Department notice has the lists. If yours is named, see an attorney before any travel or consular step.
Steps to take if your employer offers to start now
- Check the end date on your STEM OPT EAD and ask your DSO for your SEVIS unemployment-day count.
- Ask the employer's immigration attorney which category (EB-2 or EB-3) the role supports and when the Form ETA-9141 wage request goes to DOL.
- Confirm your country of chargeability, then read this month's chart on the USCIS filing-charts page and the State Department Visa Bulletin.
- Count back about 12 months from your STEM OPT end date using the USCIS tool's Form I-765 (c)(9) figure, to find the latest month an I-485 could still beat your EAD.
- Ask whether the employer will also register you once USCIS opens FY2028 H-1B registration online.
- Check that your employer is not among the eight PERM-suspended employers or on DOL's H-1B debarment list.
- Discuss travel with the attorney before any I-485 goes in, and keep meeting STEM OPT reporting duties through your DSO.
Common mistakes
- Reading "Dates for Filing" as approval. It only lets you submit; approval waits for the Final Action Date, and USCIS can switch charts any month.
- Dating the priority date from your offer letter. For PERM it is the day DOL accepts the ETA-9089, not the wage request.
- Assuming a pending I-485 lets you work. You need the (c)(9) card, and renewals filed on or after 2025-10-30 get no automatic extension (final rule in effect since 2026-10-14). See our (c)(9) EAD explainer.
- Travelling on your F-1 visa after filing the I-485. Without advance parole, that abandons the application.
- Sending an incomplete package. Under PA-2026-05 (in effect since 2026-08-05, challenged in AAUP v. Mullin), USCIS may deny without a request for evidence when required initial evidence is missing.
Frequently asked questions
Can I get a green card directly from OPT?
Yes, in principle. No step of an employer-sponsored green card requires H-1B status, and an I-485 can be filed from F-1 status once your priority date is current. In November 2026 that rarely works for a rest-of-world PERM started on OPT, because the EB-2 ROW cutoffs are 2025-04-01 (Final Action) and 2026-03-15 (Dates for Filing). EB-1, which is Current, is the main exception.
Can I file an I-485 while on STEM OPT?
Yes, if your priority date is earlier than the cutoff on the chart USCIS requires that month, your I-140 is filed with it or already approved, and you meet the other requirements an attorney should confirm. For November 2026 that is the Dates for Filing chart (EB-2 ROW 2026-03-15). Leaving the US without advance parole while the I-485 is pending abandons it, and F-1 is not an excepted status.
What happens if STEM OPT ends before my priority date is current?
Your permission to work ends on your EAD end date unless cap-gap from a timely, cap-subject H-1B petition or another status covers you. A pending PERM or approved I-140 does not extend F-1 status or create work authorization. As of 2026-11-01 the 60-day F-1 grace period still applies because the duration-of-status rule is blocked.
Is EB-2 current for rest of world in 2026?
No. The November 2026 Visa Bulletin, released 2026-10-22, sets the EB-2 rest-of-world Final Action Date at 2025-04-01 and the Dates for Filing at 2026-03-15. The December bulletin was not published as of 2026-11-01, so any December figure is a forecast.
Do I still need to enter the H-1B lottery?
For most rest-of-world STEM OPT workers whose PERM starts now, yes, as a parallel track, because the priority date and the (c)(9) work permit are unlikely to arrive before the EAD ends. As of 2026-11-01 USCIS had not announced FY2028 registration, must give at least 30 days of notice, and keeps wage-weighted selection in force.
