Upstate New York H-1B jobs sit mostly in research universities and academic medical centers, plus M&T Bank in Buffalo and GlobalFoundries in Malta, across Buffalo, Rochester, the Albany-Malta-Troy corridor, Syracuse and Ithaca. In the USCIS H-1B Employer Data Hub extract behind our New York sponsor list, the biggest upstate filers from FY2024 through part of FY2026 include Cornell University (346 petitions decided), the University at Buffalo (342 and 250 under two name variants), the University of Rochester (321) and Rochester General Hospital (232). Universities file cap-exempt, so as of 2026-11-01 the cap route matters more than the city.

Upstate New York H-1B jobs: the short answer

Outside New York City, most H-1B sponsorship in New York comes from research universities and medical centers in Ithaca, Buffalo, Rochester and Syracuse, plus M&T Bank in Buffalo and GlobalFoundries in Malta. Universities are cap-exempt employers, so they skip the lottery but give you no cap-gap. Banks and chipmakers usually file new hires through the wage-weighted lottery.

The New York state page counts 391 employers and 48,771 petitions decided from FY2024 through FY2026 (FY2026 partial). The New York, NY metro page, which holds employers filed under New York and Brooklyn addresses plus Jersey City and Newark, counts 310 and 43,144; our New York City H-1B guide covers that market. The twelve upstate employers in the table below total 2,536 petitions decided (our arithmetic).

The student pool is shrinking too. New York had 139,915 active F-1 and M-1 records in the October 2026 SEVIS data, 8.0% fewer than in October 2025 (our sums of DHS tables). That counts students, not jobs.

Which upstate New York employers sponsor H-1B?

"Petitions decided" counts approvals and denials for both new and continuing employment, so a big number can be mostly extensions. The directory label shows the split: actively hiring means more than half of an employer's petitions were for new employment, mostly renewals means fewer than one in ten, and mixed is in between.

By metro, the table's employers sum to Buffalo 787, Rochester 747, Ithaca 346, Syracuse 240, the Capital Region 220 and Utica 196 (our arithmetic). Further down the state list are Unity Hospital, Indotronix International and Paychex (Rochester), Kaleida Health and Roswell Park (Buffalo), Albany Medical Center, Corning Incorporated and Bassett Hospital (Cooperstown).

Two cautions. Some employers file under several legal names (UB twice, GlobalFoundries three times), so search every variant in the live USCIS H-1B Employer Data Hub, which now says it covers through FY2026 quarter 4 (checked 2026-11-01). And our directory files each employer under one primary city, so a Cornell petition counted in Ithaca can be for a job elsewhere, including Cornell's New York City campuses (our reading).

Westchester's corporate filers, such as Mastercard in Purchase (380) and Regeneron in Tarrytown (320), and Long Island's, such as Northwell Health, are outside this guide.

Rochester and Buffalo H-1B jobs: universities, hospitals and one bank

Rochester's top filers are a research university, a hospital and an IT services firm; Buffalo's are a public research university and a regional bank. Medical centers hire for clinical research, biostatistics, health IT and lab science as well as software and data; DOL's disclosure files (step 3 below) show the titles each employer files for.

M&T Bank is labelled mostly renewals, so a first H-1B straight from OPT looks uncommon there, and it would go through the lottery. At IT services firms, ask where you would actually work; the abstract of the H-1B reform proposal under OIRA review lists "increasing oversight over third party placements".

Rochester students also face a CPT pause. Since its 2026-08-28 notice, the University of Rochester approves new CPT only for training the degree requires. The SEVP guidance behind such pauses (BCM 2608-01 and 2608-02) is in effect and challenged in AAU v. DHS; a hearing is set for 2026-11-06 at 3:00 p.m. (check the docket after that). Ask your DSO before planning an internship.

Which Rochester and Buffalo hospital jobs are cap-exempt?

Not every one. It depends on the legal entity that files and on 8 CFR 214.2(h)(8)(iii)(F), in effect since 2025-01-17. A university meeting the Higher Education Act definition is a cap-exempt employer, which generally covers the University of Rochester, the University at Buffalo and SUNY Upstate Medical University, a SUNY campus that also runs Upstate University Hospital.

A separately run hospital is different. Rochester General is not part of the University of Rochester, and Buffalo's hospital systems file under their own names, not UB's. An affiliation agreement counts only if "a fundamental activity of the nonprofit entity is to directly contribute to the research or education mission" of the university. Shared control, university operation and nonprofit research status are separate routes; our guide to cap-exempt universities and research hospitals walks through each.

Common misconception: "Every hospital near a medical school is cap-exempt." Correction: Exemption follows the filing entity and the test. A worker for a non-qualifying employer can be exempt by spending at least half their work time on duties at a qualifying institution, and "USCIS will focus on the job duties to be performed, rather than where the duties are physically performed." Ask in writing: "Will this position be filed cap-exempt, and on what basis?"

The chip corridor: GlobalFoundries in Malta, RPI in Troy, Micron in Clay

The Capital Region's semiconductor base is GlobalFoundries' Malta campus, with RPI in Troy nearby. Micron's megafab is a separate, newer project in Clay, north of Syracuse. Only GlobalFoundries has an upstate filing record in our extract.

GlobalFoundries' H-1B record in Malta

GLOBALFOUNDRIES U S INC, filed under Malta, accounts for 119 petitions decided from FY2024 through part of FY2026, labelled mixed, and two smaller GlobalFoundries entities in Malta also file. As a for-profit manufacturer, its new hires generally go through the lottery. In a 2024-11-20 release, GF said up to $1.5 billion in CHIPS Act funding would support a Malta expansion, a new Malta fab tied to customer demand and a Vermont fab upgrade, and that the investments in both states combined should create close to 1,000 direct manufacturing jobs. Those are projections, not openings.

Will Micron hire international engineers in Clay?

Micron has not said. New York State's 2022-10-04 announcement set out "up to $100 billion over the next 20-plus years" in the Town of Clay. Micron's 2026-07-09 release says first concrete marks "the transition from site preparation to vertical construction", for up to four fabs "expected to generate 50,000 jobs in New York, including 9,000 direct Micron jobs." It gives no New York output date.

Common misconception: "Micron is hiring thousands of engineers in Clay right now." Correction: Micron's New York fact sheet (updated 2023-06-06, so its dates are stale) says "Micron will begin direct hiring for the megafab in line with the production ramp." Its New York careers page lists Clay roles and apprenticeships and says nothing about citizenship, work authorization or export control. Micron's filings sit under its Boise, Idaho base in our directory, with no Clay figure.

Export controls: the question fab roles add

Many chip-manufacturing roles touch technology controlled under the Export Administration Regulations. The Commerce Department's deemed exports page says "A deemed export refers to the sharing or release of controlled technology or source code to a foreign person", including within the US, and in Part 6 of Form I-129 the employer certifies whether a license is needed to release controlled technology to you. GF says its New York and Vermont fabs "are both Trusted Foundry accredited"; our reading is that government secure-chip work can carry citizenship or clearance requirements. See our explainers on the "are you a U.S. person?" question and semiconductor jobs and the CHIPS Act.

Concurrent H-1B employment, such as a cap-exempt RPI appointment alongside a private-sector job, avoids the cap only while the cap-exempt job continues; if it ends, you become cap-subject unless previously counted, and USCIS "may revoke" the concurrent petition. Take that plan to a licensed immigration attorney.

Syracuse, Ithaca and Utica: Cornell, SUNY Upstate, Syracuse University

Ithaca is a one-employer metro on our state list: Cornell, labelled actively hiring. Syracuse has SUNY Upstate Medical University (147) and Syracuse University (93), with Micron's Clay site just north. A university's exemption follows the employer, not the job title, so its research, IT and analytics roles can all be filed cap-exempt. Utica's Upstate Cerebral Palsy (Upstate Caring Partners) is not a university, so it is cap-subject unless it meets one of the tests above.

Is upstate New York cheaper than NYC on an H-1B salary?

Usually, on prices and local tax, but check your metro. BEA's Regional Price Parities compare price levels by metro area, and the state tax department lists New York City and Yonkers tax, resident income taxes that Buffalo, Rochester, Syracuse and Albany do not levy. A tax professional who handles nonresident returns can apply that to you.

The visa angle is the wage level. DOL prevailing wages are set by occupation and area, and under the wage-weighted selection rule in effect since 2026-02-27, a Level IV registration gets four entries and a Level I registration one. A salary that only reaches Level I in New York City can reach a higher level in a lower-wage area (our reading); check your occupation and county in the OFLC wage search or our prevailing wage lookup by state and metro. A DOL rule to raise the percentiles behind each level (RIN 1205-AC30) is still only proposed.

Worked timeline: two upstate offers after a December 2026 graduation

Say you finish a STEM master's at RIT on 2026-12-18 and your post-completion OPT EAD runs from 2027-02-01 to 2028-01-31. Offer A is a research engineering role at the University of Rochester. Offer B is a process engineering role at GlobalFoundries in Malta.

Cap-exempt vs cap-subject timeline, as of 2026-11

DateOffer A (university, cap-exempt)Offer B (manufacturer, cap-subject)
2027-02-01Start work on OPTStart work on OPT; any export-control review happens before you access controlled technology
March 2027 (expected, not announced)No registration neededEmployer registers you for FY2028; your wage level sets your entries
Spring 2027Employer may file the I-129, no earlier than 6 months before the start dateIf selected, employer files the I-129 in the filing period USCIS sets
2027-10-01Still on OPT unless an approved H-1B started earlierH-1B starts if approved; if not selected, you stay on OPT
2028-01-31OPT EAD ends; with no cap-gap, work stops unless the H-1B is approved and has started, or a timely STEM OPT extension is pendingIf not selected, a timely STEM OPT extension (STEM degree, E-Verify employer) extends work authorization up to 180 days while pending

For Offer A, the risk is a late filing, not the lottery: a petition "may not be filed earlier than 6 months before the date of actual need," and our explainer on why cap-gap does not cover cap-exempt petitions shows how to work backward from your EAD end date. Premium processing for most I-129s takes 15 business days (Form I-907, $2,965 since 2026-03-01, per the USCIS premium processing page). For Offer B, the risk is the lottery, and a STEM degree buys more registration seasons.

How to research an upstate sponsor before you apply

  1. Open the New York sponsor list and shortlist employers by metro, field and directory label.
  2. Search the USCIS H-1B Employer Data Hub by every legal-name variant, comparing initial with continuing approvals.
  3. Check DOL's OFLC disclosure data (latest files through 2026-06-30) for the job titles and upstate worksites each employer files Labor Condition Applications for.
  4. Look up the prevailing wage for the occupation and county, so you know which wage level an offer reaches.
  5. Ask the recruiter whether the role is filed cap-exempt or cap-subject, whether they hire from OPT and, for fab roles, whether it needs export-control review.
  6. Confirm SEVIS reporting for a new employer or a gap between jobs with your DSO, and cap-exempt basis or concurrent-employment questions with a licensed immigration attorney.

Frequently asked questions

Which upstate New York employers sponsor H-1B?

In the USCIS H-1B Employer Data Hub extract behind our company pages (FY2024 to part of FY2026), the biggest upstate filers include Cornell University (346 petitions decided), the University at Buffalo (342 and 250 under two names), the University of Rochester (321), Rochester General Hospital (232), Upstate Cerebral Palsy in Utica (196) and M&T Bank (195). Counts include renewals and denials.

Does GlobalFoundries in Malta sponsor H-1B?

Yes. GLOBALFOUNDRIES U S INC accounts for 119 petitions decided in our FY2024 to FY2026 extract (FY2026 partial), labelled mixed, and other GlobalFoundries entities also file. Its new hires usually go through the wage-weighted lottery, and some fab roles need export-control review.

Will Micron's Clay fab hire international engineers?

Micron has not said. Its New York fact sheet (updated 2023-06-06) ties direct hiring to the production ramp, and its 2026-07-09 release, on the first concrete pour, expects 9,000 direct Micron jobs. Neither mentions visa sponsorship, and fab roles can involve export-controlled technology.

Are Rochester and Buffalo hospitals cap-exempt?

Not automatically. The University of Rochester, the University at Buffalo and SUNY Upstate Medical University are generally cap-exempt employers, but a separately run hospital such as Rochester General must meet a test in 8 CFR 214.2(h)(8)(iii)(F), in effect since 2025-01-17. Ask the employer in writing how your position will be filed.

Is upstate New York cheaper than NYC on an H-1B salary?

Usually, on prices and local tax. Compare metros in BEA's Regional Price Parities, and note that New York City and Yonkers tax residents' income. Prevailing wages are set by area, so the same salary can reach a higher wage level upstate, which matters in the wage-weighted lottery.
