Penn State H-1B Sponsorship and State College Jobs: Faculty-Only Rules and Where Graduates Go Next
If you are on OPT at Penn State, a staff job in State College will not lead to a Penn State H-1B, and knowing that early changes where you should look.

Part of our guide to companies that sponsor H-1B visas.
Penn State H-1B sponsorship is narrower than most students expect. As of November 2026, Penn State Global's Who We Sponsor page says the university sponsors visas for full-time academic teaching or research positions that require a doctoral or terminal degree, and that it "does not sponsor staff positions or part-time faculty." Faculty H-1B at Penn State runs to a maximum of six years. Because Penn State is a university, its petitions are exempt from the H-1B cap: no lottery, but also no cap-gap. Penn State Health in Hershey hires as a separate health system. If you are on OPT and need an H-1B sponsor, the large nearby markets are Pittsburgh, Philadelphia and New York.
Status as of 2026-11-01. Penn State's faculty-only policy is in effect on its own pages. Around it: cap-gap does not cover cap-exempt petitions (in effect); the F-1 60-day grace period still applies because the duration-of-status rule has been blocked by a federal court since 2026-09-14 (summary judgment briefed; DHS's appeal pending); the OPT fee is only proposed (comments close 2026-11-09); the $100,000 H-1B payment is blocked and not being collected; FY2028 H-1B registration is not announced on the USCIS registration page.
Does Penn State sponsor H-1B?
Yes, but only for full-time academic faculty and researchers in positions that require a doctoral or terminal degree, tenure-line or not. Penn State does not sponsor H-1B for staff positions, part-time employment, or a period longer than the funded appointment, and it caps faculty H-1B at six years, with limited exceptions. Postdocs not already on F-1 OPT or J-1 academic training start in J-1.
The degree requirement attaches to the job, not the person. Penn State Global's H-1B Specialty Worker page says it "applies even if the faculty member holds a Ph.D.; the requirement is tied to the position itself." The sponsorable titles are Professor (all ranks), Lecturer, Instructor, Assistant and Associate Teaching Professor, Teaching Professor, and Assistant and Associate Research Professor; anything else needs an exception from the Assistant Vice Provost. On pay, the salary "must be the higher of either the U.S. Department of Labor's prevailing wage determination or the actual wage paid to similarly employed individuals within Penn State."
Who Penn State sponsors, by position type
As of November 2026, from Penn State Global's pages. The examples of staff roles are ours.
| Position | H-1B from Penn State? | What Penn State's pages say |
|---|---|---|
| Tenure-line faculty | Yes, usually H-1B to start | "Typically receive sponsorship" for H-1B at onboarding and for permanent residency for long-term employment |
| Full-time non-tenure-line teaching or research faculty | Generally yes | "Most commonly H-1B, TN, or E-3"; the position must require a Ph.D. or terminal degree |
| Postdoctoral scholar | Usually J-1; H-1B by exception | J-1 research scholar by default; one listed exception is "Received Ph.D. in U.S. in F-1 status and is currently on OPT" |
| Staff (for example lab technician, research staff, IT, analyst, administrator) | No | "The university does not sponsor staff positions or part-time faculty." |
| Part-time or adjunct faculty | No | Same sentence; the H-1B page also excludes "part-time employment" |
| A job that does not require a Ph.D., even if you hold one | No, unless an exception is approved | The requirement "is tied to the position itself"; exceptions go to the Assistant Vice Provost |
| Hospital and clinic jobs at Penn State Health | Not covered by this policy | Separate health system (see below) |
The postdoc row comes from Penn State's Special Visa Guidance for Postdoctoral Scholars (PDF, 2025): international postdocs "are sponsored in J-1 research scholar status if they are not coming to the post-doc position in F-1 OPT or J-1 Academic Training." If you are finishing a Penn State Ph.D., our guide to postdocs on OPT, STEM OPT, J-1 or H-1B explains what each path costs you later.
The six-year limit and the appointment period
Penn State's H-1B page states: "H-1B is limited to a maximum of six (6) years, in up to three-year increments," and "extensions beyond the sixth (6) year are possible in limited circumstances." That matches the federal ceiling on USCIS's H-1B page, "a total period of admission of 6 years." The requested period "should match, but not exceed, the appointment period," so a one-year funded research appointment gets, at most, a one-year petition.
Read the green-card line carefully: the Who We Sponsor page describes permanent-residency sponsorship only for tenure-line hires, while non-tenure-line positions "generally qualify for non-immigrant visa sponsorship." On a renewable research appointment, ask IFA and an immigration attorney early how the six-year clock and any green-card plan fit together.
What the faculty-only rule means if you are on OPT at Penn State
Post-completion OPT needs no sponsor, so a Penn State staff job can be a valid OPT job if the work fits your major. It is just not an H-1B path at Penn State. The university will not file an H-1B for a staff role, and you cannot request one yourself: "Sponsorship requests must be initiated by the hiring unit and will be evaluated by International Faculty Advising (IFA)."
The OPT side runs through ISSA, Penn State Global's international student advisers. Penn State's post-completion OPT page says all OPT employment "must be closely related to your program of study," that students request an OPT I-20 in iStart, and that the I-765 is due "within 30 days of the date of OPT I-20 issuance or by the 60th day from the program end date, whichever comes first." A new job is reported in iStart "within 10 days of starting work to stop the unemployment counter." The limit is unchanged: 90 unemployment days on post-completion OPT, 150 in total with STEM OPT.
Worked example: a staff research job on OPT
Say you finished a master's in August 2026, your post-completion OPT card (EAD) runs 2026-10-01 to 2027-09-30, and you take a full-time research staff position in a Penn State lab.
Illustrative timeline, as of 2026-11. Your own EAD, I-20 and adviser's guidance govern.
| Date | What happens | Rule behind it |
|---|---|---|
| 2026-10-01 | OPT and the staff job start; report the employer in iStart within 10 days | Penn State OPT page; 90-day unemployment limit |
| 2026-11-09 | OPT fee comment period closes; the rule is still a proposal | Already-approved OPT is not covered |
| Spring 2027 (expected, not announced) | FY2028 H-1B registration; a cap-subject employer would have to register you | 30 days' notice required; wage-weighted selection in effect |
| In the 90 days before 2027-09-30 | If the degree is STEM-eligible, the STEM OPT I-765 window: it opens 90 days before the EAD expires and closes when it does (E-Verify employer, Form I-983, DSO recommendation) | USCIS STEM OPT page; 180-day extension for timely filers |
| 2027-09-30 | The EAD ends; without STEM OPT or another status, work stops | Cap-gap covers only a timely, cap-subject change-of-status petition |
| 2027-11-29 | The F-1 60-day grace period ends | 60 days apply while the duration-of-status rule stays blocked |
The realistic H-1B routes from this job are a cap-subject employer that registers you in the lottery, or a cap-exempt employer whose role qualifies, such as a later Penn State faculty or research appointment that meets its rules; a STEM extension buys more lottery attempts. The OPT fee proposal, if finalized, would reach only DSO recommendations dated 60 or more days after a final rule, with the school as the payer (it may pass the cost on). A later STEM OPT recommendation could be covered, and the proposal leaves open whether a student whose first OPT was fee-free would trigger the $70,000 or the $30,000 charge; ask your ISSA adviser how Penn State is planning for it.
Is Penn State cap-exempt?
Penn State is a university, and university H-1B petitions are exempt from the annual cap. USCIS says "H-1B workers who are petitioned for or employed at an institution of higher education or its affiliated or related nonprofit entities, a nonprofit research organization" (or a government research organization) "are not subject to this numerical cap." Penn State's own pages do not use the phrase "cap-exempt," so let IFA confirm how your case is filed.
What the exemption gives you, and what it does not:
- No lottery and no calendar. A cap-exempt petition does not wait for registration or an October 1 start.
- No cap-gap. USCIS's cap-gap page (updated 2025-01-17) says the provision "applies only to beneficiaries of cap-subject H-1B petitions, not to beneficiaries of cap-exempt H-1B petitions." If your EAD ends before a Penn State H-1B is approved, you stop working. Our guide to why cap-gap does not apply to cap-exempt H-1Bs walks through the timing math.
- The exemption belongs to the employer. If you later leave for a cap-subject employer, you become cap-subject unless you were previously counted against the cap in your six-year period. Concurrent employment works differently: a cap-subject concurrent petition is not counted while the cap-exempt job continues. Our explainer on cap-exempt employers as an H-1B bridge covers that strategy and its trade-offs.
- The $100,000 payment is blocked. Proclamation 11069 is in effect on paper to 2027-09-21, but courts blocked the agency policies that collect it, and a change of status granted inside the US was never covered. It still shaped hiring from abroad: a CRS Insight (2026-10-14) reports that in the fee's first eight months, initial H-1B petitions for consular processing from cap-exempt employers fell 91% from the same period a year earlier.
One item to watch: a USCIS draft titled "Reforming the H-1B Nonimmigrant Visa Classification Program" (RIN 1615-AD00) has been under OIRA review at the White House since 2026-08-24. Its agenda abstract mentions "revising eligibility for cap exemptions." No text is public, so today's rules apply.
Penn State H-1B numbers: what the Data Hub shows
In the USCIS H-1B Employer Data Hub extract F1Jobs uses, The Pennsylvania State University (University Park) has 373 H-1B petitions across FY2024 to FY2026, with FY2026 partial. In FY2024, the latest full year, the Hub shows 63 initial approvals and 85 continuing approvals.
Zoom out and the State College problem is clear: the extract's Pennsylvania hub lists 170 employers with 25 or more petitions, 22,617 petitions in all, led by Deloitte Consulting at 5,203. Of those 170, 34 list Pittsburgh as their primary city and 28 list Philadelphia. Only one lists University Park: Penn State itself. The pipeline is shrinking too. Pennsylvania's active F-1 and M-1 SEVIS records in October 2026 were 8.2% below October 2025, against 7.1% nationally, by our sums of the DHS SEVIS data. These are active records, not new enrollments.
Jobs in State College, PA: what the local market can do for a visa holder
State College is a university town, and in the H-1B data the university is the whole local market. For OPT that matters less, because no sponsor is needed. For H-1B it means one employer with a faculty-only rule.
Which companies near State College hire OPT students?
Any employer can, because post-completion OPT does not require sponsorship, as long as the work is closely related to your major; STEM OPT also needs an E-Verify employer and a signed Form I-983 training plan. Besides Penn State's own labs and offices, State College's best-known private employers include AccuWeather and Minitab, both headquartered there. Neither appears among the extract's Pennsylvania employers with 25 or more petitions, which tells you they are not large H-1B filers, not whether they hire on OPT or ever sponsor; ask each one.
For H-1B, look beyond the town. Elsewhere in central and eastern Pennsylvania, the extract includes three Geisinger entities in Danville (the largest is Geisinger Clinic) and two more universities, Bucknell (Lewisburg) and Lehigh (Bethlehem). Appearing in the data means an employer filed petitions in FY2024 to FY2026, not that a given posting is open to you.
Where do Penn State graduates go next: Pittsburgh, Philadelphia or New York?
If you need sponsorship and want to stay in the region, these are the three large markets to weigh, and the choice turns on your field and your visa path more than the map.
FY2024 to FY2026 petitions (FY2026 partial), from the USCIS Data Hub extract F1Jobs uses, as of 2026-11. Counts are petition decisions, not openings.
| Metro | Employers with 25+ petitions | Petitions | Largest names in the extract | Fits best if you... |
|---|---|---|---|---|
| Pittsburgh | 34 | 3,292 | University of Pittsburgh, BNY Mellon, Carnegie Mellon | want university, health-system or research roles, where cap-exempt employers are prominent |
| Philadelphia | 28 | 10,991 | Deloitte Consulting, Deloitte and Touche, Comcast, University of Pennsylvania | work in consulting, media or pharma, or want Penn's University City research cluster |
| New York | 310 | 43,144 | Citibank, Mphasis, Goldman Sachs, Bloomberg, Morgan Stanley | work in finance, data or software and can compete in the largest, most crowded pool |
For Pittsburgh's robotics, CMU and health-system employers, read our Pittsburgh H-1B jobs guide. For pharma and University City, see our Philadelphia H-1B guide. For banks and tech, start with our New York City H-1B jobs guide.
Big consultancies and outsourcers inflate a metro's totals, so a high count is not a high chance for you. Two visa questions matter more: are you aiming at a cap-subject employer (the lottery) or a cap-exempt one (no lottery, no cap-gap), and does your degree qualify for STEM OPT, which gives you more lottery years?
Does Penn State Health in Hershey sponsor separately?
Penn State Health is a separate employer from the university, and Penn State Global's faculty-only rule describes university positions, not health-system jobs. On its About page, Penn State Health describes itself as "an integrated academic health system serving patients and communities across 15 counties in central Pennsylvania," and says it began with Milton S. Hershey Medical Center, about 100 miles from University Park, in 1970. The same page says the Penn State College of Medicine "partners with Penn State Health to improve lives through research and education."
The jobs are split too. The College of Medicine's site sends "Academic Careers" to Penn State's HR site and "Health Systems Careers" to Penn State Health's careers site. Whether a Hershey job is a university appointment or a health-system job decides which employer petitions, which policy applies, and whether the employer can claim a cap exemption as a university-affiliated nonprofit, so ask that employer's HR, and take the cap question to an immigration attorney. Neither Penn State Health nor Hershey Medical Center appears among the extract's Pennsylvania employers with 25 or more petitions in FY2024 to FY2026. Our guide to cap-exempt healthcare and university hospitals covers how hospital sponsorship works more generally.
How to check a Penn State role's H-1B path, step by step
- Read the posting and offer letter for the classification (faculty, postdoc or staff) and whether the role is full-time.
- Ask the hiring unit in writing whether the title is on Penn State's sponsorable list and requires a doctoral or terminal degree.
- Confirm that the hiring unit will submit a sponsorship request to International Faculty Advising.
- Compare the appointment start date with the end date on your EAD (Form I-766); a cap-exempt petition gives you no cap-gap.
- Request your OPT I-20 in iStart, file Form I-765 with USCIS on time, and report your employer in iStart within 10 days.
- Check with ISSA, before your EAD expires, whether your degree and employer qualify for STEM OPT.
- Note Penn State's travel warning for a change of status to H-1B inside the US: employees "should NOT leave the U.S. while the petition is pending," because "USCIS considers leaving the U.S. while the petition is pending to be abandonment of the petition."
- Take status strategy (a staff-to-faculty move, a later switch to industry) to an immigration attorney, and F-1, OPT and SEVIS questions to your ISSA adviser.
Common mistakes
- Assuming a Penn State staff job leads to a Penn State H-1B. Penn State does not sponsor staff roles; only a later move into a qualifying faculty or research appointment could be.
- Thinking your Ph.D. qualifies you for any job. The position itself must require a doctoral or terminal degree.
- Expecting cap-gap on a university petition. Cap-gap covers only cap-subject petitions; your EAD end date is a hard stop.
- Treating Penn State Health as Penn State. It is a separate health system with its own hiring.
- Believing a cap-exempt H-1B carries into industry. A move to a cap-subject employer can mean the lottery unless you were already counted.
- Repeating "OPT now costs $70,000." It is a proposal, the school would be the payer, and it would reach only DSO recommendations dated 60 or more days after a final rule.
