Does UF Sponsor H-1B in 2026? Florida's University Pause, UF's Pulled Filing and Gainesville Options
UF still renews H-1Bs, but Florida's pause blocks new ones until at least January 5, 2027. Here is who sits outside it and what Gainesville graduates can do now.

Part of our guide to companies that sponsor H-1B visas.
The University of Florida is a cap-exempt H-1B employer, but as of November 1, 2026 it is not filing new H-1B petitions for new hires. Florida's Board of Governors paused new H-1B hiring at all 12 state universities on March 2, 2026, until at least January 5, 2027. Renewals for people already working at UF on H-1B continue. By October 28, UF had removed an H-1B job notice posted two days earlier, and President Stuart Bell said it went up without his approval. So University of Florida H-1B sponsorship is paused for new hires, not ended, and private employers are untouched.
Status as of 2026-11-01
- In effect (state policy): the Board of Governors pause on new H-1B hires at the 12 public universities, until at least 2027-01-05. No extension or early end has been announced.
- Not affected: renewals for current H-1B employees, private universities and private cap-subject employers.
- Unclear: whether the pause reaches UF Health Shands, a separately incorporated nonprofit.
- Unchanged federal rules (in effect): UF's cap exemption, the cap-gap rule (cap-subject petitions only) and the OPT unemployment limits of 90 days, or 150 in aggregate on STEM OPT.
- Under White House review (no public text): USCIS's "Reforming the H-1B Nonimmigrant Visa Classification Program" (RIN 1615-AD00), at OIRA since 2026-08-24; its agenda abstract mentions "revising eligibility for cap exemptions". Nothing has been published.
Does the University of Florida sponsor H-1B right now?
Not for new hires. As of November 1, 2026, the University of Florida, like Florida's other 11 public universities, is under a Board of Governors pause on new H-1B hiring that runs until at least January 5, 2027. UF still renews H-1Bs for current employees, and the pause does not touch private universities or private companies.
In ordinary times UF files year-round: its H-1B Visa page states that "University of Florida is exempt from H-1B Cap", so there is no lottery. The pause is a state decision layered on that federal status, which is why the cap-subject versus cap-exempt career tradeoff still applies beyond Florida's public campuses.
The same page says the hiring department starts the petition, which must be filed "with UF Immigration Compliance Services nine months prior to the employee's effective date," and lists the premium processing fee as "required for new UF H-1B petitions." That nine-month lead time matters when you plan around the pause's end date.
For scale, in the USCIS Employer Data Hub extract this site uses, the University of Florida recorded 640 H-1B petitions across FY2024 to FY2026 (FY2026 is partial), the most of any Florida university. Its FY2024 figures, the latest full year, were 145 initial-employment and 107 continuing-employment approvals. Initial approvals are broadly first-time H-1B employment with that employer and continuing ones cover people already in H-1B status, so neither column maps exactly onto the pause.
What does the Florida universities H-1B pause cover?
It covers new H-1B hires at the 12 universities in the State University System, from March 2, 2026 until at least January 5, 2027. According to Central Florida Public Media's report on the vote, the moratorium "does not impact workers who are currently employed or up for renewal on those visas."
Florida university H-1B pause: old rule, new rule, what to do (as of 2026-11)
| Situation | Before 2026-03-02 | As of 2026-11-01 | What to do differently |
|---|---|---|---|
| New H-1B hire at UF, FSU, USF or another of the 12 public universities | Cap-exempt petitions filed year-round | Paused until at least 2027-01-05 | Ask UF Immigration Compliance Services about timing and keep a parallel search |
| Extension for someone already on H-1B at UF | Filed through UF Immigration Compliance Services | Not affected by the pause | Give the office documents early |
| Moving to UF from another H-1B employer | Change-of-employer petition | Not addressed in the reporting; our reading is that it is a new hire for UF | Confirm with UF before you resign anywhere |
| Private university, such as the University of Miami | Cap-exempt filer | Outside the Board of Governors' authority | Normal cap-exempt timing, with no cap-gap |
| UF Health Shands (separate private nonprofit) | Separate employer from the university | Unclear | Ask the entity that would sign the petition |
| Cap-subject private employer, in Gainesville or remote | H-1B lottery | Not covered; FY2028 registration not announced | Ask whether the employer will register you |
| Texas public university | Cap-exempt filer | Separate Texas freeze, 2026-01-27 to 2027-05-31 unless the Texas Workforce Commission permits | Do not treat it as an easy fallback |
Governor Abbott's order "to freeze new H-1B visa petitions" at Texas state agencies and public universities was reported by the Texas Tribune; our overview of the Texas and Florida hiring freezes compares the two states from the start.
What happened with UF's pulled H-1B notice in October 2026?
A UF H-1B job notice appeared online, drew criticism and was taken down within two days. The sequence, as reported by WCJB and The Independent Florida Alligator:
- 2026-10-26 (Monday): UF posted a notice for an "H-1B Financial Analyst" position, with a requested employment period of 2027-02-02 to 2030-02-01, according to the posting WCJB quoted.
- 2026-10-27: A writer shared the notice's details on X.
- 2026-10-28: President Bell said, as quoted by WCJB, "This job was posted without my approval or authorization, and it has been removed." He added that UF "will continue to remain in full compliance with Governor DeSantis' direction on H-1B hires."
The notice is not a sign that UF has resumed new H-1B hiring; as of November 1, 2026, the pause stands until at least 2027-01-05. The requested start, 2027-02-02, falls four weeks after the pause's earliest end date (our arithmetic). Nine months before it is May 2026, inside the pause, which shows how UF's lead time can collide with the pause even for a start date after it. Neither report says why the notice was posted.
When does the Florida H-1B pause end?
The pause runs until at least January 5, 2027. That is a floor, not an end date: the Board of Governors can extend it, and as of November 1, 2026 no extension and no early end had been announced. Central Florida Public Media described it at the vote as a 10-month freeze lasting "at least through January 5, 2027."
Until there is an announcement, treat any early-2027 start date as uncertain and ask UF Human Resources after January 5, 2027. UF's H-1B page did not mention the pause when we read it, so its silence is not evidence either way.
Can UF renew or extend an existing H-1B during the pause?
Yes. Renewals were left out of the pause from the start. If you already work at UF on H-1B, your extension still runs through UF Immigration Compliance Services, and UF's H-1B page notes that an extension request may be filed with USCIS up to six months before the current approval expires.
Two federal points matter for any extension filed this autumn. DHS has proposed ending deference to prior approvals on I-129 extensions (RIN 1615-AD26; comments close 2026-11-13). It is a proposal, so current deference policy still applies. And from 2026-11-09 (scheduled), USCIS accepts only the 09/09/26 edition of Form I-129, per the USCIS I-129 page, a detail for UF's office rather than for you.
Does the pause apply to UF Health or private Florida universities?
Private Florida universities are outside it, because the Board of Governors governs only the 12 public universities. UF Health is the hard case, and public reporting does not settle it.
Private universities
The University of Miami is private, so the state board has no authority over its hiring. In the same Data Hub extract it recorded 326 H-1B petitions across FY2024 to FY2026 (University of Miami employer page). Under federal rules a private nonprofit university is cap-exempt in the same way UF is. The catch is timing: cap-gap does not apply to cap-exempt H-1B petitions, so OPT work stops when your EAD ends unless the H-1B is approved and in effect by then.
UF Health
"UF Health" is an umbrella name. Faculty appointments in UF's health colleges are university jobs, which in our reading puts them inside the pause. The hospitals differ: under section 1004.41 of the Florida Statutes, Shands Teaching Hospital and Clinics, Inc. is "a private not-for-profit corporation" organized "for the primary purpose of supporting" the UF Board of Trustees' health affairs mission. Even so, Central Florida Public Media quoted a fellow at the Institute for Progress saying "the ban as written, also applies to UF Health," and reported that the board chair asked universities to tell him if the freeze affects access to life-saving medical care, since amendments could be made.
What decides your case is the legal entity named as petitioner on Form I-129. A nonprofit can qualify as cap-exempt through a written affiliation agreement in which "a fundamental activity" supports the university's mission (8 CFR 214.2(h)(8)(iii)(F)). Whether that entity is also bound by the state pause is a question for its own immigration office, and for an attorney if an offer depends on it.
University of Florida H-1B sponsorship next to other Florida universities
The four largest university filers in the extract show how the pause splits the state.
Florida university H-1B filers (the site's USCIS Employer Data Hub extract, FY2024 to FY2026)
| Employer | Type | Inside the pause? | H-1B petitions, FY2024 to FY2026 (FY2026 partial) |
|---|---|---|---|
| University of Florida | Public | Yes | 640 |
| University of Miami | Private | No | 326 |
| Florida State University | Public | Yes | 235 |
| University of South Florida | Public | Yes | 227 |
Across the whole Florida employer hub, the extract lists 142 employers and 14,640 petitions over the same years. Check the live USCIS H-1B Employer Data Hub for the current figures; USCIS says it now covers through FY2026, quarter 4.
The student pipeline has held up better in Florida than nationally. In October 2026, Florida's active SEVIS records were down 1.5% on October 2025, against a 7.1% national decline (our sums of the DHS October 2026 SEVIS data). Those are active records, not new enrollments.
Jobs in Gainesville, FL if you need visa sponsorship
In the site's data, Gainesville's H-1B activity is essentially UF. Of the 142 employers in the Florida hub, UF is the only one based in Gainesville; the largest clusters are in Tampa (30 employers), Miami (19), Jacksonville (19) and Orlando (9). The hub lists only employers with enough petitions to rank, so a small Gainesville company can sponsor and still be missing from it.
That leaves four routes for someone who wants to stay in or near Gainesville:
- UF itself, on OPT for now. Working on your own OPT EAD involves no H-1B petition (our reading), so ask the department whether it can hire you on OPT while the pause runs.
- UF Health Shands and other separate entities. Ask who the petitioner would be before assuming the pause applies.
- Cap-subject employers with Gainesville or remote roles. These go through the lottery; ask early whether the employer registers candidates.
- The rest of Florida. Start with the metro pages for Tampa (5,568 petitions across FY2024 to FY2026 in the extract), Miami and Jacksonville, then our Florida H-1B jobs guide to the state's tech and healthcare sponsors.
For smaller employers, the USCIS Data Hub can be queried by city, state and ZIP code.
What can a UF graduate on OPT do if their lab can't sponsor?
There are three main tracks, and they can run in parallel: a cap-exempt employer outside the pause, a cap-subject employer through the lottery, and STEM OPT if your degree qualifies. Your DSO at the UF International Center's student services office is the person for anything that touches your OPT, STEM OPT or SEVIS record.
- Cap-exempt, outside the pause: private universities, eligible affiliated nonprofits, nonprofit research organizations, and public universities in states with no freeze. There is no lottery, but there is also no cap-gap.
- Cap-subject, through the lottery: FY2028 registration is not announced (USCIS must give at least 30 days' notice; March 2027 is only an expectation), and wage-weighted selection is in effect; see our FY2028 H-1B lottery guide. A timely cap-subject change-of-status petition gets cap-gap protection, as the USCIS cap-gap page explains; a university petition does not.
- STEM OPT as runway: a STEM OPT application filed on time, before your OPT EAD expires, comes with the 180-day automatic extension described on the USCIS STEM OPT page. It is in effect, untouched by the 2026-10-14 final rule that ended automatic extensions for certain EAD renewals. A STEM application filed after the EAD expires gets no 180 days.
- J-1 research scholar: a separate program with its own limits, including a five-year cap on the professor and researcher category and, for some, the two-year home residency rule. The reporting on the pause covers H-1B only; see J-1 vs H-1B for researchers and postdocs.
A worked timeline: a December 2026 UF graduate
Here is how the clocks interact for a hypothetical master's graduate whose post-completion OPT EAD runs from 2027-01-15 to 2028-01-14, and whose lab wants to keep them. It illustrates timing, not a filing plan.
- Through at least 2027-01-05: the pause blocks UF from starting a new H-1B for you.
- 2027-01-05 at the earliest: if the board lets the pause lapse, UF's guidance is that departments file with Immigration Compliance Services nine months before the start date. A January 2027 submission points to a start around October 2027 (our arithmetic).
- From 2027-01-15, the EAD start date: OPT work can begin, in the lab too if the department will hire you on OPT; no OPT work is allowed before that date.
- USCIS processing: UF's page lists premium processing as required for new UF petitions; Form I-907 costs $2,965 for most I-129 classes under the G-1055 fee schedule (edition 10/26/26). Without premium, the USCIS processing-times tool showed 80% of H-1B change-of-status petitions completed within 10 months (read 2026-11-01); check the live tool.
- 2028-01-14, the EAD end date: cap-exempt petitions get no cap-gap (8 CFR 214.2(f)(5)(vii)), so OPT work stops that day unless the H-1B has taken effect or a timely STEM OPT application applies.
- The whole year: the 90-day unemployment limit on post-completion OPT (150 days in aggregate with STEM OPT) counts every day without employer information in SEVIS, as the SEVIS Help Hub unemployment page describes.
Together, the pause and UF's nine-month lead time can use up most of a 12-month EAD before an H-1B start date arrives, which is why a parallel search matters.
How to check whether a Gainesville or Florida offer can be sponsored
- Ask the hiring department which legal entity would sign Form I-129 as petitioner: the university, UF Health Shands, or another employer.
- Email UF Immigration Compliance Services ([email protected]) to ask whether that role can be sponsored now or after the pause, and what its internal deadline is.
- Search the USCIS H-1B Employer Data Hub by employer name, or by city and state, to see the entity's filing history.
- Check your EAD end date and unemployment days, keep your employer details current in the SEVP Portal, and ask your DSO at the UF International Center about STEM OPT timing.
- Ask any cap-subject employer whether it plans to register you once USCIS announces FY2028 registration.
- Consult a licensed immigration attorney before you leave another H-1B job, or accept a start date that depends on the pause ending.
Common mistakes
- Writing UF off entirely. Renewals continue, the pause has a floor date, and UF's federal cap exemption is unchanged.
- Reading the pulled October notice as a restart. UF removed it and said it lacked the president's approval.
- Assuming every "UF Health" job is on the same side of the line. University appointments and Shands hospital jobs have different employers. The petitioner decides.
- Repeating press headcounts. Published counts of UF's H-1B workers mix headcounts, approvals and fiscal years. Name the source and the metric, or use the Data Hub.
- Letting the unemployment clock run while you wait. The pause does not stop your 90 or 150 days.
Frequently asked questions
Is the Florida university H-1B pause still in effect?
Yes. As of November 1, 2026, the Board of Governors pause on new H-1B hires at the 12 public universities, approved March 2, 2026, is in effect and runs until at least January 5, 2027. No extension or early end had been announced, so check with UF Human Resources after that date.
Can UF renew or extend an existing H-1B during the pause?
Yes. The pause covers new H-1B hires, and renewals for people already working at UF on H-1B are not affected, according to reporting on the March 2, 2026 vote. UF Immigration Compliance Services handles extensions, so confirm your own case and its internal deadline with that office.
Does the pause apply to UF Health or private Florida universities?
Private universities such as the University of Miami are outside it, because the Board of Governors governs only the 12 public universities. UF Health is less clear. Its Shands hospitals are run by a separate private nonprofit, but a critic quoted by Central Florida Public Media in March 2026 said the ban as written also applies to UF Health, so ask the entity that would file your petition.
When does the Florida H-1B pause end?
It runs until at least January 5, 2027. That date is a floor, not a promise, because the board can extend the pause, and as of November 1, 2026 it had announced neither an extension nor an end. The UF notice removed on October 28, 2026 does not mean the pause has lifted.
What can a UF graduate on OPT do if their lab can't sponsor?
Most graduates in that spot look at employers outside the pause, such as private universities, eligible nonprofits and cap-subject companies that register for the H-1B lottery, and ask a DSO whether STEM OPT fits their degree. Cap-exempt petitions get no cap-gap, so OPT work stops when the EAD ends unless the university H-1B is approved and in effect by then.
